ROLL CALL AYES: Melo, Munk, Patel, Schwartz, Garcia, CP Schaer ABSENT: Love Item 41A was adopted out of order On a motion by Council Member Schwartz and seconded by Council Member Melo the following RESOLUTION WAS OFFERED FOR ADOPTION CITY OF PASSAIC RESOLUTION # 19-07-222 RESOLUTION HONORARILY DESIGNATING THE CORNER OF BROADWAY AND PROSPECT STREET AS “PERU PLAZA” WHEREAS, the Mayor and City Council for the City of Passaic wish to recognize and acknowledge the vibrant cultures and traditions of its residents; and WHEREAS, the neighborhood surrounding Broadway and Prospect Street in the City of Passaic illustrates the culture, tradition, and heritage of the City’s Peruvian-American residents and businesses; and WHEREAS, each year people of Peruvian descent celebrate their country’s Independence Day on July 28th; and WHEREAS, in observance of Peruvian Independence Day, the City of Passaic wishes to join the Peruvian-American community in celebrating and highlighting the invaluable contributions made by members of the Peruvian-American community within and beyond the City of Passaic. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Conduct a community assessment of its land use plans, regulations and physical characteristics to evaluate the extent to which the community meets the needs of older adults; and 2. Provide recommendations for strategies and actions the municipality could undertake to enhance its aging-friendly characteristics; and WHEREAS, the City of Passaic is committed to evaluating strategies that will enable older residents to remain active, healthy, engaged, ad capable of continuing to live in their community; THEREFORE, BE IT RESOLVED that the City of Passaic: 1. Requests the technical assistance team, assembled by New Jersey Future, work with the municipality to assess the needs of older populations and identify strategies to enhance aging-friendly characteristics; 2. Authorizes the municipal administrator to enter into the appropriate agreements with New Jersey Future to have the technical assistance team work with the municipality at no cost; 3. Agrees to appoint a municipal point of contact and aging-friendly steering committee to participate in and guide the aging-friendly community assessment; 4. Authorizes the municipal administrator to provide the technical assistance team with maps, data, municipal plans, regulations, and other information necessary to perform the community assessment; 5. Supports active outreach and community engagement to inform the aging-friendly assessment, planning, and decision-making; and, 6. Agrees to the Planning Principles set forth herein below to guide planning activities. 10 Passaic City Council July 23, 2019 Minutes ------------------------------------------------------------ CITY OF PASSAIC RESOLUTION NO. 19-07-226 RESOLUTION AUTHORIZING EXECUTION OF 2019 OPEN SPACE & FARMLAND PRESERVATION TRUST FUND AGREEMENT WITH THE COUNTY OF PASSAIC WHEREAS, the Board of Chosen Freeholders of the County of Passaic adopted Resolution R-19-05885(n-59) on June 25, 2019, authorizing the award of grant funding from the Open Space and Farmland Preservation Trust Fund to fund Pulaski Park park improvements in Passaic, New Jersey in the amount of $99,000.00; and WHEREAS, County of Passaic Resolution R-19-0588 (n-59) requires all municipalities receiving such funds must agree to place in their tax letter an insert indicating said funds were received from the Passaic County Open Space and Farmland Preservation Trust Fund Program; and WHEREAS, the City of Passaic is required to enter into an Open Space Agreement, a copy of which is attached hereto, with the County of Passaic in order to receive such funds. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to enter into the attached 2019 Open Space Agreement with the County of Passaic for grant funding from the Open Space and Farmland Preservation Trust Fund to fund Pulaski Park park improvements in Passaic, New Jersey in the amount of $99,000.00; and BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to execute any and all documents required to facilitate the Open Space Agreement and receipt of funds. ------------------------------------------------------------ CITY OF PASSAIC RESOLUTION NO. 19-07-227 RESOLUTION AUTHORIZING THE TAX COLLECTOR TO ISSUE AND EXECUTE A DUPLICATE FOR A LOST TAX SALE CERTIFICATE WHEREAS, US Bank Custodian for Actlien Holding has made a formal request for the issuance of a Duplicate of an Original Tax Sale Certificate number 16-00100 which was lost; 11 Passaic City Council July 23, 2019 Minutes WHEREAS, N.J.S.A. 54:5-52.1 provides that the Tax Collector of a municipality shall issue and execute a new Certificate of Sale in place of a certificate that have been destroyed or lost, and there shall appear on the new certificate a statement that it is a duplicate of the original which was lost or destroyed with a charge not to exceed $100.00 for the duplicate certificate; provided that the Tax Collector is authorized to do so by resolution of the governing body of the municipality; NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Passaic, Passaic County, New Jersey, in accordance with N.J.S.A. 54:5-52.1 that the Council hereby directs that the Tax Collector is hereby authorized to issue and execute a Duplicate for Tax Sale Certificate 16-00100 and to collect the $100.00 fee from the above lienholder. ------------------------------------------------------------ CITY OF PASSAIC RESOLUTION # 19-07-228 RESOLUTION AUTHORIZING 2019 RENEWAL OF THE AGREEMENT WITH WORK FIRST NEW JERSEY FOR THE COMMUNITY WORK EXPERIENCE PROGRAM WHEREAS, the City of Passaic seeks to renew its Agreement with WorkFirst New Jersey for the Community Work Experience Program (CWEP) for FY2019; and WHEREAS, the purpose of CWEP is to provide employment experience and training to individuals and to assist them in obtaining unsubsidized employment; and WHERAS, pursuant to the terms and conditions of the proposed Agreement attached hereto, WorkFirst New Jersey may provide up to five (5) general laborers and ten (10) clerical assistants to the City of New Jersey under the CWEP; and WHEREAS, participation in the CWEP is at no cost to the City of Passaic; and WHEREAS, the attached Agreement has been reviewed and approved by Personnel and by the City Attorney. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to accept the grant award from the Community Work Experience Program (CWEP) for FY2019 and to renew the Agreement with WorkFirst New Jersey, subject to the terms and conditions set forth therein; and 12 Passaic City Council July 23, 2019 Minutes BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and directed to execute documents necessary to effectuate the purpose of this Resolution. ------------------------------------------------------------ CITY OF PASSAIC RESOLUTION # 19-07-229 RESOLUTION AUTHORIZING THE PURCHASE OF EIGHT (8) TURNOUT GEAR COATS/BUNKER PANTS PASSAIC FIRE DEPARTMENT WHEREAS, the Passaic Fire Department wishes to purchase Turnout Gear coats/bunker pants offered under NJ State Contract #A80948 from Safe-T of Riverdale, NJ; and WHEREAS, N.J.S.A.40A:11-2 authorizes the purchase of any materials, supplies or equipment under State Contract entered on behalf of the State by the Division of Purchase and Property in the Department of the Treasury without the necessity for public bidding; and WHEREAS, the turnout gear is priced as follows: Turnout Gear Coats @$ 1,397.27/ea. Total $11,178.16 Turnout Gear Pants @ $ 1,212.81/ea. Total $ 9,702.48 Grand Total $20,880.64 NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that a contract be awarded to Safe-T of Riverdale, NJ in the amount of $ 20,880.64. BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute a contract for the above on a form approved by City Attorney. Section 6 If any portion of this Ordinance is declared to be invalid by a court of competent jurisdiction, it shall not affect the remaining portions of this Ordinance which shall remain in full force and effect.
