City Council President Schaer called for a moment of silence in observance to those who lost their loves in the mass shootings in Dayton, Ohio and El Paso Taxes City Council President Schaer expressed sympathy to the family of Chief Judge Diaz of the Municipality of Passaic on her passing. City Council President Schaer expressed sympathy to the family of Luis Sanchez, Fire Official on the passing of his brother. Council Member Munk took his seat at on the dais at 7:11 pm Council President went out of order and presented item No. 33 from the agenda. Mayor Hector C. Lora read on record the resolution. CITY OF PASSAIC RESOLUTION # 19-08-248 RESOLUTION HONORARILY DESIGNATING THE TRIANGLE CORNER OF MONTGOMERY STREET, MONROE STREET, AND GREGORY AVENUE AS “DOMINICAN SQUARE” WHEREAS, the Mayor Hector C. Lora, and City Council for the City of Passaic wish to recognize and acknowledge the vibrant cultures and traditions of its residents; and WHEREAS, the City of Passaic proudly boasts one of the nation’s largest populations of people of Dominican-descent, including our current Mayor and Councilwoman; and WHEREAS, Dominican-Americans have made lasting impacts on the City of Passaic community in the areas of government, law enforcement, business, education, the arts, and athletics; and WHEREAS, the neighborhood surrounding the triangle corner of Montgomery Street, Monroe Street, and Gregory Avenue in the City of Passaic illustrates the culture, tradition, and heritage of the City’s Dominican-American residents and businesses; and WHEREAS, the City of Passaic wishes to celebrate and highlight the invaluable contributions made by members of the Dominican-American community within and beyond the City of Passaic. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” 3 Passaic City Council August 6, 2019 Minutes Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. Will there be ongoing maintenance cost and is there any warranty that kicks in before maintenance, does warranty cover parts and labor? ROLL CALL AYES: Munk, Love, Melo, Patel, Schwartz, Garcia, CP Schaer ABSENT: 10 Passaic City Council August 6, 2019 Minutes RESOLUTIONS: THE FOLLOWING RESOLUTION WAS TAKEN OFF THE AGENDA RESOLUTION AUTHORIZING CLOSED EXECUTIVE SESSION OF THE CITY COUNCIL OF PASSAIC ON PASSAIC ON AUGUST 6, 2019 AT 5:30 PM OR ANYTIME THEREAFTER TO DISCUSS PENDING LITIGATION, CONTRACT NEGOTIATIONS AND PERSONNEL MATTERS THE FOLLOWING ITEMS WERE VOTED ON BY ONE MOTION On a motion by Council Member Melo and seconded by Council Member Patel the following RESOLUTIONS WERE OFFERED FOR ADOPTION CITY OF PASSAIC RESOLUTION # 19-08-240 RESOLUTION AUTHORIZING A LEASE AGREEMENT BY AND BETWEEN NEW JERSEY TRANSIT AND THE CITY OF PASSAIC FOR A BUS TERMINAL AT MAIN AVENUE, BETWEEN PASSAIC AVENUE AND PARK PLACE, (BLOCK 1134.01, LOT 1), CITY OF PASSAIC, NEW JERSEY WHEREAS, the City of Passaic owns a property located at Block 1134.01, Lot 1, on Main Avenue, between Passaic Avenue and Park Place in the City of Passaic, New Jersey (Property); and WHEREAS, the City of Passaic seeks to enter into a lease agreement with New Jersey Transit Corporation (NJ Transit), an instrumentality of the State of New Jersey, for NJ Transit to construct and operate a bus terminal on the Property; and WHEREAS, NJ Transit has secured federal funding from the Federal Transit Administration (FTA) to partially fund the construction of the new bus terminal on the subject Property; and WHEREAS, the proposed new bus terminal shall provide a significant benefit to the residents of the City of Passaic; and WHEREAS, the original term of the lease shall be for a period of forty (40) years, with an option to renew for a period of five (5) additional years and the City of Passaic shall receive an annual rent of One Dollar ($1.00) per year from NJ Transit for use of the subject Property; and 11 Passaic City Council August 6, 2019 Minutes WHEREAS, the City of Passaic and NJ Transit intend to execute the proposed Lease Agreement attached hereto, which has been reviewed and approved by the City Attorney. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to enter into the attached Lease Agreement by and between the City and the New Jersey Transit Corporation (NJ Transit) in order for NJ Transit to construct and use property located on Main Avenue, between Passaic Avenue and Park Place (Block 1134.01, Lot 1), as a bus terminal in the City of Passaic; and BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute the Lease Agreement attached hereto. ------------------------------------------------------------ CITY OF PASSAIC RESOLUTION NO. 19-08-241 RESOLUTION AUTHORIZING COP TECH FORUM GRANTS FOR POLICE AGENCIES APPLICATION WHEREAS, the City of Passaic has received notice from Cop Tech regarding its Forum Grants for Police Agencies grant program, which covers attendance and all travel (airfare, hotel, and meals) for a police department’s representative to attend the Cop Tech Forum on September 9-11, 2019 in Jacksonville Beach, Florida and, WHEREAS, said grant requires no matching contributions from the City of Passaic; and WHEREAS, the City of Passaic wishes to submit an application for this grant. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic is hereby authorized to submit a grant application to Cop Tech. BE IT FURTHER RESOLVED that the Passaic Police Department, Mayor, and City Clerk are hereby authorized to take all necessary actions to file this application and to accept grant funds from Cop Tech. ------------------------------------------------------------ 12 Passaic City Council August 6, 2019 Minutes CITY OF PASSAIC RESOLUTION NO.19-08-242 RESOLUTION AUTHORIZING LEARY FIREFIGHTER’S GRANT FOR FIRE DEPARTMENTS APPLICATION WHEREAS, the City of Passaic has received notice from the Leary Firefighter Foundation regarding its available grants training, equipment, and technology for fire departments in the US. WHEREAS, through the Jeremiah Lucey Grant Program, the Foundation supports paid departments in New York, Massachusetts, and Detroit, Michigan. The Foundation has recently expanded its scope of funding to include paid and volunteer departments in other parts of the country and, WHEREAS, said grant requires no matching contributions from the City of Passaic; and WHEREAS, the City of Passaic wishes to submit an application for this grant with awards ranging from $5,000 to $35,000 dollars. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic is hereby authorized to submit a grant application to Cop Tech.
