Lora updated the council and resident on the following:  Updated on the City's COVID numbers, which have recently declined due to duplicate result entry.  Recent positive cases are in the single digits.  He thanked the public for adhering to wearing masks and social distancing and urges everyone to continue to do so.  Passaic Valley Water Commission was working in the area, cause many residents to have brown water and low water pressure- ensured the public this would be resolved promptly. Council Member Love joined the meeting.  He asked the public to please complete their 2020 census applications; the city of Passaic is currently at 60%.  Food distribution to residents continues weekly on Wednesdays.  Mexican Flag Raising was a great success; we recognized Herminio Garcia, a prominent leader in the Mexican community who passed away recently.  Yom Kipper holiday is this Sunday, September 27, 2020  The Passaic Train Tracks are being removed, great for our city. HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. CITY OF PASSAIC ESOLUTION NO. 20-09-279 RESOLUTION AUTHORIZING AGREEMENT BETWEEN THE CITY OF PASSAIC AND PASSAIC COUNTY COMMUNITY COLLEGE FOR JOB TRAINING PROGRAM WHEREAS, the City of Passaic, having an office at 330 Passaic Street, Passaic, New Jersey, 07055 (“City”), wishes to enter into an Agreement for a medical job training program (“Agreement”), with Passaic County Community College, having a principal place of business at 1 College Boulevard, Paterson, New Jersey 07505 (“PCCC”); and WHEREAS, PCCC’s Department of Continuing Education and Workforce Development shall provide phlebotomy technician training through their program (hereinafter the “program”) to students referred from City; and WHEREAS, of the nine (9) slots to be allocated in the program, five (5) shall be reserved for students referred from City; and WHEREAS, the tuition for the program shall be two thousand and one hundred dollars ($2,100.00) per student to be covered in full by City through COVID-19 CDBG funding Page 15 of 21 Passaic City Council September 22, 2020 Minutes MEETING WAS CONDUCTED AS A ZOOM LIVE STREAM VIA FACEBOOK upon pre-qualification and is to be used solely for the student’s first attempt at completing the program; and WHEREAS, students who successfully complete the program will receive a non-credit certificate of completion from PCCC’s Department of Continuing Education and Workforce Development and earn the opportunity to take the certifying exam with National Healthcareer Association (NHA); and WHEREAS, City and each student shall separately execute an additional agreement as a prerequisite to the program setting forth the terms and conditions of student’s participation; and WHEREAS, City and PCCC have set forth their intentions within the Agreement attached herewith and mutually agree to be subject to the terms and conditions therein. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Passaic that the City of Passaic is hereby authorized to enter into the attached Agreement with Passaic County Community College to provide medical job training subject to the terms and conditions thereof; and BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute the Agreement attached hereto; and BE IT FURTHER RESOLVED that a copy of this Resolution and a copy of the executed Agreement shall be forwarded to Passaic County Community College. CITY OF PASSAIC ORDINANCE #2278-20 ORDINANCE ADOPTING A REDEVELOPMENT PLAN FOR 426 & 430 LAFAYETTE AVENUE, 102 AND 102B GRANT STREET AND 13-19 WICKHAM STREET (BLOCK 3219, LOTS 4, 5, 15, 32 AND 38) WHEREAS, the real property identified on the Official Tax Map of the City of Passaic as Block 4128, Lots 41 and 85 more commonly known as 426 & 430 Lafayette Avenue, 102 & 102B Grant Street and 13-19 Wickham Street (the “Property”) has been identified as a location in need of rehabilitation; and WHEREAS, the City Council for the City of Passaic adopted a Resolution directing the City of Passaic Planning Board to conduct a preliminary investigation into whether the Property met the statutory criteria for designation as an Area in Need of Rehabilitation under the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq.; and WHEREAS, the City of Passaic Planning Board held a public hearing on the investigation results and adopted a Resolution recommending that the City Council for the City of Passaic designate the Property an Area in Need of Rehabilitation under the New Jersey Local Redevelopment and Housing Law, N.J.S.A. 40A:12A-1, et seq.; and WHEREAS, the City Council for the City of Passaic adopted a Resolution accepting said recommendation of the City of Passaic Planning Board; and WHEREAS, the City of Passaic Planning Board reviewed the proposed Redevelopment Plan and adopted a Resolution finding said Redevelopment Plan to be substantially consistent with the City of Passaic’s Master Plan and referring same to the City Council for all appropriate action. Section 2 The City Council of the City of Passaic hereby approves and adopts the attached Redevelopment Plan for the Property as an Area in Need of Rehabilitation. Section 3 The zoning standards set forth in the Redevelopment Plan for 426 & 430 Lafayette Avenue, 102 & 102B Grant Street and 13-19 Wickham Street Area in Need of Rehabilitation shall supersede and replace all underlying zoning standards in accordance with N.J.S.A. 40A:12A-7c, rather than serving as overlay zoning for the said Area. Section 4 The City of Passaic Zoning Map is hereby amended to include the new Redevelopment Plan for 426 & 430 Lafayette Avenue, 102 & 102B Grant Street and 13-19 Wickham Street Area in Need of Rehabilitation, Block 3219 Lots 4, 5, 15, 32 and 38 in accordance with N.J.S.A. 40A:12A-7c. Section 5 All ordinances or portions thereof inconsistent with this Ordinance are repealed to the extent of such inconsistency. Section 6 If any portion of this Ordinance is declared to be invalid by a court of competent jurisdiction, it shall not affect the remaining portions of this Ordinance which shall remain in full force and effect. Section 7 This Ordinance shall take effect in the time and manner prescribed by law. CITY OF PASSAIC ORDINANCE NO. 2279-20 REFUNDING BOND ORDINANCE PROVIDING FOR THE REFUNDING OF OUTSTANDING GENERAL IMPROVEMENT BONDS BY THE CITY OF PASSAIC, APPROPRIATING $4,800,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $4,800,000 REFUNDING BONDS OF THE CITY TO FINANCE THE COST THEREOF BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASSAIC (not less than two-thirds of all members thereof affirmatively concurring) AS FOLLOWS: Section 1. The City of Passaic, a municipal corporation of the State of New Jersey (the “City”) is hereby authorized to refund its outstanding General Improvement Bonds, Series 2010A and Sewer Utility Bonds, Series 2010B dated August 5, 2010 and maturing on August 1, 2021 through August 1, 2026 in the aggregate principal amount of $4,574,000 (the “Refunded Bonds”). Section 2. For the refunding described in Section 1 of this refunding bond ordinance, there is hereby appropriated the sum of $4,800,000. In order to finance the cost of the refunding described in Section 1, negotiable refunding bonds are hereby authorized to be issued in the aggregate principal amount of not to exceed $4,800,000 pursuant to the Local Bond Law. Section 3. The purpose of the refunding described in Section 1 of this refunding bond ordinance is to realize an interest cost savings for the City. Section 4. An aggregate amount not exceeding $150,000 for items of expense listed in and permitted under N.J.S.A. 40A:2-51(b) is included in the estimated cost of the refunding described in Section 1 of this refunding bond ordinance, which estimated cost is equal to the appropriation stated in Section 2 of this refunding bond ordinance. Section 5. The Supplemental Debt Statement required by the Local Bond Law has been duly prepared and filed in the office of the Clerk, and submitted to the office of the Director of the Division of Local Government Services in the Department of Community Affairs of the State of New Jersey (the “Director”). Such Statement shows that the gross debt of the City is increased by $4,800,000 (the amount of the authorization of the obligations provided for in this refunding bond ordinance), and that $4,574,000 (the aggregate principal amount of the Refunded Bonds) is deductible from the gross debt of the City which results in a $226,000 increase in the net debt of the City. The obligations authorized herein will be within all debt limitations prescribed by the Local Bond Law. Section 6. A certified copy of this refunding bond ordinance as adopted on first reading shall be filed with the Director prior to final adoption. Section 7. This refunding bond ordinance shall take effect 20 days after the first publication thereof after final adoption, as provided by the Local Bond Law.
