MAYOR’S UPDATE
Mayor Hector C. Lora updated the council and residents on
the following:
Updated the City Council on the most recent COVID-
19 numbers
Hospitalizations due to COVID -19 are up
Vaccines will be available to the state of NJ, and
the City of Passaic has been selected to provide
vaccines to the public.
COVID 19 testing is available now seven days a week
in the city of Passaic
Encouraging all residents to continue to social
distance and wear mask
Many businesses are suffering- Local government
stands with them and will assisting them in finding
assistance
The city is distributing toys to families in need
This year celebration will be different; therefore,
The city will hold a virtual Hanukkah menorah
lighting and Parade of Lights
Thanks to Assemblyman Schear, who facilitated people
with cosmetology licenses for another county to be
able to legally work in this country as they acquire
their license in this country
HEARING OF CITIZENS
Council President Schaer opened the public portion of the
Meeting with the following statement for the record:
In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et
seq.). The Council opens every public meeting for comments of the
public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this
Act shall be construed to limit the discretion of a public body to
permit, prohibit or regulate the active participation at any meeting,”
Therefore, the City Council will not entertain any comments from
persons who communicate obscene material, make statements which are
considered bias intimidation in which any person attempts to
intimidate any individual or group because of race, color, religion,
handicap, sexual orientation or ethnicity or makes personally
offensive or abusive, defamatory or profane comments, comments
intending to harass or speak any offensive or abusive language. The
person who makes these statements will relinquish their allotted five
minutes for public discussion.

ORDINANCE AMENDING THE DESIGNATION OF RESTRICTED PARKING
FOR DISABLED PERSONS BY NJ LICENSE PLATE NUMBER
Council Member Schwartz moved a public hearing to be held
on Ordinance. Motion was seconded by Council Member Love,
So Ordered. The Council President then announced that all
interested parties would be given an opportunity to be
heard for or against the adoption of the Ordinance

judgments from a rendered decision entered on 11/20/2020
for Block: 1292.01 Lot 12, also known as 40-46 Elliot St.
Passaic, NJ, property owner: Weingarten, Neil & Chana. The
judgment entered reduced the assessed value on the
property by 101,000 for tax years 2019 & 2020.
WHEREAS, the above-mentioned property, based on same
judgments entered from the Tax Court of New Jersey, have
overpaid their taxes for tax year 2019 & 2020.
NOW THEREFORE BE IT RESOLVED, by the City Council of
the City of Passaic, that the Chief Financial Officer, be

RESOLUTION AUTHORIZING THE ACCEPTANCE OF
THE NEW JERSEY DEPARTMENT OF TRANSPORTATION
MUNICIPAL AID GRANT PROGRAM AWARD
WHEREAS, the City of Passaic has applied for grant
funding through the Municipal Aid Grant Program (“Program”)
being offered through the New Jersey Department of
Transportation (“NJDOT”); and
WHEREAS, the purpose of the Program is to provide
funding to municipalities for local transportation
improvement projects, including but not limited to, road
improvement projects, road resurfacing projects, road
rehabilitation projects, road reconstruction and
signalization, and bridge improvements; and

WHEREAS, the City of Passaic has been awarded grant
funding from the NJDOT in the total amount of
$754,435.00 to be used for various street improvements;
and
WHEREAS, the City of Passaic wishes to accept the
maximum grant award being allotted through this
Program.
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Passaic that the City of Passaic is hereby
authorized to accept the grant award from the application
identified as MA-2021-Various Streets-00364 from the New
Jersey Department of Transportation Municipal Aid Grant
Program in the total amount of $754,435.00, subject to the
terms and conditions set forth in the grant guidance
attached hereto; and
BE IT FURTHER RESOLVED that the Mayor, City Clerk and
City Engineer are hereby authorized and directed to
execute any documents and/or undertake any and all such
actions necessary to effectuate receipt of these funds.

RESOLUTION NO. 20-12-368
RESOLUTION AUTHORIZING THE ACCEPTANCE OF NEW JERSEY
DIVISION OF CRIMINAL JUSTICE STATE BODY ARMOR
REPLACEMENT FUND GRANT PROGRAM AWARD(S)
WHEREAS, the City of Passaic Police Department has
applied for grant funding through the State Body Armor
Replacement Fund Program (“Program”) being offered through
the New Jersey Division of Criminal Justice (“DCJ”); and
WHEREAS, the purpose of the Program is to support the
purchase of ballistic-resistant or stab-resistant body
armor to replace worn or expired body armor used by
municipal or county law enforcement agencies; and

WHEREAS, the City of Passaic has been awarded grant
funding in the amount of $31,546.06 for the 2019 fiscal
year; and
WHEREAS, the City of Passaic has been awarded grant
funding in the amount of $3,600.00 for the 2020 fiscal
year; and
WHEREAS, the City of Passaic wishes to accept the
maximum grant award(s) being allotted through this Program
for fiscal years 2019 and 2020 prior to the expiration
date(s).
NOW, THEREFORE, BE IT RESOLVED, by the City Council
of the City of Passaic that the City of Passaic Police
Department is hereby authorized to accept all eligible
grant awards from the New Jersey Division of Criminal
Justice State Body Armor Replacement Fund Program for the
fiscal years of 2019 and 2020, subject to the terms and
conditions set forth in the grant guidance attached hereto;
and
BE IT FURTHER RESOLVED that the Mayor, City Clerk and
Police Department are hereby authorized and directed to

ONE (1) 2020 FORD UTILITY INTERCEPTOR VEHICLE
HUMAN SERVICES
WHEREAS, the City of Passaic wishes to purchase One
(1) 2020 Ford Utility Interceptor Vehicle – Human
Services; and
WHEREAS, N.J.S.A.40A:11-2 authorizes the purchase
of any materials, supplies or equipment under a
Cooperative Pricing System/NJ State Contract without the
necessity for public bidding; and
WHEREAS, this vehicle is offered under the New Jersey
State Contract # 88728 as follows:
One (1) 2020 Ford Utility Interceptor Vehicle $ 30,344.00
Options: (Attached) 3,158.00
Total $ 33,502.00
NOW THEREFORE BE IT RESOLVED by the City Council of
the City of Passaic that a contract be awarded to Winner
Ford, Cherry Hill, NJ in the amount of $ 33,502.00.
BE IT FURTHER RESOLVED that the Mayor and City
Clerk are authorized to execute a contract for the above

RESOLUTION AWARDING CONTRACT FOR SNOW PLOWING/
REMOVAL SERVICES 2020-2021
CITY OF PASSAIC
WHEREAS, bids were received by the Director of
Purchasing on Tuesday, November 17, 2020 for Snow
Plowing/Removal Services 2020-2021; and
WHEREAS, bids were received as per the attached
summary:
WHEREAS, in addition to the attached specifications
were downloaded from the City of Passaic’s website by the
following vendors, none of whom submitted bids:
TTL Services Source Mngt. Bid Net Construction Journal
Paramus, NJ Seattle, WA Latham, NY Stuart, FL
WHEREAS, Doris Dudek, Director of Purchasing
recommends that a contract be awarded to Super LLC,
Haledon, NJ for the following truck classes on an as needed
basis; and
Truck Class Hourly Rate
Class A: 26,000 lbs. & over GVW $170.00/hr.
Class B: 20,000 lbs. to 25,999 GVW $150.00/hr.
Class C: 6,500 lbs. to 19,999 $120.00/hr.
Class D: Small 4 wheel drive vehicles $110.00/hr.
Class E: Front Loader minimum 3yd bucket $220.00/hr.
WHEREAS, the City of Passaic shall determine the need
to execute this contract on an as needed basis with a
minimum accumulation of four (4) inches or more of snow;
and
WHEREAS, the above rates shall not exceed a total of
$25,000.00 commencing December 1, 2020 to through April
15, 2021; and
NOW THEREFORE BE IT RESOLVED by the City Council of
the City of Passaic that the contract for Snow

Plowing/Removal Services be awarded to Super, LLC of
Haledon, NJ for the above mentioned rates on an as needed
basis (a minimum accumulation of four (4) inches or more
of snow shall dictate the calling out of Contractor) in
an amount not to exceed $25,000.00.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
are authorized to execute a contract on a form approved
by City Attorney.
CERTIFICATION OF FUNDS
Funds for the above are available in Public Works Acct.
#0-01-26-290-000-028 and funds for subsequent budget is
available providing that the budget is approved by the
governing body.

RESOLUTION #20-12-374
RESOLUTION AUTHORIZING AMENDMENT OF CONTRACT
FOR PYSICIAN SERVICES FOR SUBSTANCE
ABUSE TREATMENT PROGRAM
WHEREAS, on December 17, 2019 the City Council of
the City of Passaic adopted Resolution #19-12-365
(Attached), approving a contract with Dr. Nirmal Trivedi
for Physician Services for Substance Abuse Treatment
Program in an amount not to exceed $ 48,000.00; and
WHEREAS, it is necessary to increase the contract
amount by an additional $ 15,700.00 for additional
sessions for a revised total amount of $ 63,700.00.
NOW, THEREFORE, BE IT RESOLVED that the contract
with Dr. Nirmal Trivedi for Physician Services for
Substance Abuse Treatment Program shall be increased by an
additional $15,700.00 for a revised total amount of
$ 63,700.00.

TAX APPEAL APPRAISER

WHEREAS, proposals were received by the Director of
Purchasing on Friday, November 13, 2020 for Tax Appeal
Appraiser; and
WHEREAS, the proposals were solicited through a fair
and open process in accordance with N.J.S.A. 19:44A-20.4
et. seq; and
WHEREAS, proposals were received from the attached
vendors:
WHEREAS, in addition to the attached, proposals were
downloaded from the City of Passaic’s website by the
following vendors, none of whom submitted proposals:
Stirling Disanto & Assoc. Associated Appraisal Group
Somerville, NJ Cranford, NJ
WHEREAS, it is the recommendation of the Evaluation
Committee, that the contract for Tax Appeal Appraiser be
awarded to McNerney & Associates, of Glen Rock, NJ at an
hourly rate of $ 100.00 in an amount not to exceed

19 related revenue loss during the budget year 2020; and
WHEREAS, P.L. 2020, c. 74 provides for the funding
of these revenue losses through a COVID-19 Special
Emergency; and
WHEREAS, in order to qualify for a special emergency
under the provisions of N.J.S.A. 40A: 4-53, as amended by
P.L.2020, c. 74, the City must make an application to the
Director of the Division of Local Government Services to
obtain an approval of the certification of the special
emergency and the resulting deferred charge in advance of
the close of budget year 2020; and
WHEREAS, the City has received an extension to submit
the required Certification to the Director of the Division
of Local Government Services by December 9, 2020; and
WHEREAS, the Chief Financial Officer has determined
that there is an operational gap attributable to COVID -
19 affected revenue loss which needs to be addressed prior
to year-end.
NOW, THEREFORE BE IT RESOLVED, by the Governing Body

WHEREAS, the Governor of the State of New Jersey (the
“State”) has heretofore declared a public health emergency

announced by the World Health Organization on February 11,

municipality may, subject to the approval of the Director

Jersey Department of Community Affairs (the “Director”),
adopt an ordinance providing for a special emergency

WHEREAS, the City of Passaic has experienced
approximately $2,200,000 in COVID-19 related revenue
losses during the 2020 budget year; and

prescribed by the Director, a copy of which has been
presented at this meeting, certifying that the deficit
balances anticipated to be reported on the City’s annual

in the Sewer Utility Fund; and
WHEREAS, the City Council, by resolution adopted on
December 8, 2020, by a majority of the full governing body,
approved the certification and the submission of the
application to the Director in accordance with N.J.S.A.
40A:4-53(m); and
WHEREAS, the City Council now wishes to make a special
emergency appropriation in accordance with N.J.S.A. 40A:4-
53(m) and adopt an ordinance authorizing such special
emergency appropriation in the amount of $2,200,000,
consisting of $1,500,000 in the Current Fund and $700,000
in the Sewer Utility Fund to provide for the funding of
such deficit balances.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE
GOVERNING BODY OF THE CITY OF PASSAIC, IN THE COUNTY OF
PASSAIC, STATE OF NEW JERSEY, AS FOLLOWS:
SECTION I
Pursuant to N.J.S.A. 40A:4-53(m), the City has determined
and does hereby authorize a special emergency
appropriation in the amount of $2,200,000, consisting of

beginning in the year after the year in which the resulting
deferred charge appears in the City’s unaudited financial
statements, as provided by N.J.S.A 40A:4-55. Thus, the
deferred charge resulting from the special emergency in
2020 will not be budgeted in 2021, but rather one-fifth
(1/5) of the amount will be budgeted in the 2022 through
2026 annual budgets.
SECTION III
The Mayor and Chief Financial Officer are each hereby
authorized and directed to determine all matters in
connection with the special emergency appropriation not
determined by this or a subsequent ordinance, all in
consultation with the City Attorney or Bond Counsel, and
the manual or facsimile signature of the Mayor or Chief
Financial Officer upon any documents shall be conclusive
as to all such determinations.
SECTION IV
A certified copy of this ordinance shall be filed with the
Director of the Division of Local Government Services, New
Jersey Department of Community Affairs (“the Director”).
SECTION V
This ordinance is subject to the approval of the Director
and shall take effect upon final passage and publication,
as required by law; provided that the approval of the
Director has been obtained.
Council Member Schwartz moved the Ordinance be approved

Melo the public hearing be held on December 17, 2020.

In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens
every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-
12 “nothing in this Act shall be construed to limit the discretion of a public body to permit,
prohibit or regulate the active participation at any meeting,”
Therefore, the City Council will not entertain any comments from persons who
communicate obscene material, make statements which are considered bias intimidation
in which any person attempts to intimidate any individual or group because of race, color,
religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive,
defamatory or profane comments, comments intending to harass or speak any offensive or
abusive language. The person who makes these statements will relinquish their allotted
five minutes for public discussion.
