MAYOR’S UPDATE Mayor Hector C. Lora updated the council and residents on the following:  Storm Ida impacted Passaic, flood conditions in every ward, with some areas receiving over 10 feet of water  There was some loss of life: Luis Jalil-Solarzario perished, but his wife and son were rescued. Two young people drowned, Nidhi Rana and Ayush Rana, who were prom king and queen in June 2021. Passaic City Council September 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK  He thanked Passaic police department, fire department, and neighboring municipalities like Kearny police department for assisting citizens across the city  Mayor and FEMA toured Passaic to assess water damage.  Condolences to those who lost family  Governor Murphy and Passaic county representatives toured the city to assess storm damage, including loss of fields for youth city sports.  He met with President Biden and Governor Murphy along with four other NJ mayors to discuss the storm impact. Passaic county was declared area of disaster.  There is a boiled water advisory in Passaic. Water distribution implemented while water advisory is in effect. Information can be found on city website.  Two buildings faced roof collapse. 51 displaced, Red Cross was unable to assist.  COVID statistics from March 2020 to date:  8885 tested positive for Covid-19; of those there were 309 deaths but no deaths since June  80% of Passaic residents vaccinated  School started on September 9.  9/11 memorial will be held on September 10.  Robinson Cano of NY Mets will be present at the last Passaic family festival/carnival.  September 18 is the day for Prayer walk  Rosh Hashanah was celebrated this week. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. BE IT FURTHER RESOLVED that the Mayor of the City of Passaic, as Certifying Officer, is hereby authorized as follows: a) To execute contracts with HUD allowing for the expenditure of said funds pursuant to the terms of said contract The Secretary of Housing and Urban Development is hereby assured of full compliance by the City of Passaic. CITY OF PASSAIC RESOLUTION # 21-09-196 RESOLUTIONAUTHORIZING AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF PASSAIC AND THE PASSAIC ENTERPRISE ZONE DEVELOPMENT CORPORATION FOR NPP YEAR 2 GRANT MANAGEMENT SERVICES WHEREAS, the City of Passaic has received certain funding from the State of New Jersey, Department of Page 10 of 53 Passaic City Council September 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK Community Affairs, Neighborhood Preservation Program (“NPP”); and WHEREAS, there are certain deadlines imposed on the City regarding the timing of expending the grant funds; and WHEREAS, the Passaic Enterprise Zone Development Corporation (“PEZDC”) has pursued various projects to assist businesses within its UEZ zone in the City of Passaic, with goals of retaining and expanding business activity, increasing employment and expanding the local tax base; and WHEREAS, the City would benefit from the participation of the PEZDC to serve as a sub-grantee that shall provide grant management services for the NPP Year 2 Grant; and WHEREAS, the PEZDC has served as a sub-grantee for the NPP Year 1 Grant in an effective manner; and WHEREAS, the NPP has agreed that the PEZDC may serve as a sub-grantee for the NPP Year 2 Grant and that such would be in the best interest of the City and NPP; and WHEREAS, the Board of Trustees of the PEZDC shall adopt a Resolution for the PEZDC to serve as a sub-grantee for the NPP Year 2 Grant at its next quarterly meeting to be held on September 15, 2021; and WHEREAS, the parties have set forth their intentions within the attached Interlocal Agreement and mutually agree to the terms therein. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Passaic, that the City of Passaic is hereby authorized to enter this Interlocal Agreement with the Passaic Enterprise Zone Development Corporation for the purposes of managing the NPP Year 2 Grant; and Page 11 of 53 Passaic City Council September 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute the Interlocal Agreement attached hereto; and BE IT FURTHER RESOLVED that a copy of this Resolution and a copy of the executed Interlocal Agreement shall be forwarded to the PEZDC. CITY OF PASSAIC RESOLUTION #21-09-197 RESOLUTION DESIGNATING BLOCK 2151 LOTS 24 AND 27 WHICH IS LOCATED AT 31-33 AND 35-39 GROVE STREET AS AN AREA IN NEED OF REHABILITATION WHEREAS, it has been determined by the Planning Board of the City of Passaic that Block 2151, Lots 24 and 27 on the Tax Map of the City of Passaic is an area in need of rehabilitation; and WHEREAS, a preliminary investigation in this matter has been approved by the Planning Board of the City of Passaic; and WHEREAS, the Planning Board of the City of Passaic has recommended to the City Council to proceed with the determination of the need of rehabilitation in this matter; and WHEREAS, the Planning Board of the City of Passaic has authorized the rehabilitation plan and its adoption; and WHEREAS, the Planning Board of the City of Passaic has approved and memorialized these determinations and recommendations on August 4, 2021; and WHEREAS, it is the desire of the City Council to accept these determinations and recommendations of the Planning Board of the City of Passaic and commence with Page 12 of 53 Passaic City Council September 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK all rehabilitation efforts regarding Block 2151 Lots 24 and 27. NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Passaic that the City of Passaic is hereby authorized to accept the recommendation of the Planning Board regarding the rehabilitation efforts that concern Block 2151 Lots 24 and 27; and BE IT FURTHER RESOLVED, that the Mayor and City Clerk are hereby authorized and directed to execute any documents and/or undertake any and all such actions necessary to effectuate the purpose of this Resolution. CITY OF PASSAIC RESOLUTION NO._21-09-198 RESOLUTION AUTHORIZING TRAINING AGREEMENT BETWEEN THE CITY OF PASSAIC AND PASSAIC COUNTY COMMUNITY COLLEGE FOR EKG TECHNICIAN TRAINING WHEREAS, the City of Passaic, having an office at 330 Passaic Street, Passaic, New Jersey, 07055 (“City”), wishes to enter into a Training Agreement for EKG Technician Training (“Agreement”) with Passaic County Community College, One College Boulevard, Paterson, New Jersey 07505 (“PCCC”); and WHEREAS, City has received a grant from the Department of Housing and Urban Development (HUD) via the Community Development Block Grant known as the CDBG CARES Act, which was enacted in order to prevent, prepare for and respond to the current Coronavirus pandemic (COVID- 19); and WHEREAS, an approved program that these funds may be used for is a medical job training program for income qualified residents of City; and Page 13 of 53 Passaic City Council September 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK WHEREAS, City has requested that PCCC provide EKG Technician training to certain constituents of City; and WHEREAS, City and PCCC have set forth their intentions within the attached Agreement and mutually agree to the terms therein. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Passaic that the City of Passaic is hereby authorized to enter into the attached Training Agreement with Passaic County Community College for EKG Technician training subject to the terms and conditions thereof; and BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute the Training Agreement attached hereto; and BE IT FURTHER RESOLVED that a copy of this Resolution and a copy of the executed Training Agreement shall be forwarded to Passaic County Community College. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Passaic that the following sections of the City Code of the City of Passaic Chapter 295 “Vehicles and Traffic,” Part 10 “Residential Parking Permits,” Article XXI “Residential Parking Permit Requirements” are hereby amended as follows: ALL ADDITIONS ARE UNDERLINED ALL DELETIONS ARE NOTED BELOW SECTION I § 295-49 Application for permit; fee. There is no permit fee for the residential parking permits, except: A. A fee of $5 will be charged for the replacement of the first lost permit. B. A fee of $10 will be charged for the replacement of the second and every subsequent lost permit. C. A fee of $10 will be charged for the replacement of a misplaced or lost visitor parking permit. D. A fee of $10 will be charged for a change of address for the permit. E. Parking permits are limited to one residential parking permit for each valid driver's license and registered vehicle at the verified address as listed in this article. A yearly fee of $300 will be charged for permits in the Main Avenue Redevelopment Plan Area. § 295-52 Restricted zones. A. Pursuant to the provisions of this article and based upon the findings of the Chief of Police, or his designee, made in accordance therewith, no person who does not hold a residential parking permit issued in accordance with the terms of this article shall park any vehicle within the following described residential zones or portions thereof in the City of Passaic between 12:00 midnight and 6:00 a.m. except Saturdays, Sundays or announced holidays: (1) North Pulaski Park Residential Zone: East Monroe Street from Market Street to the Passaic River and Fourth Street from Virginia Street to East Monroe Street. (1) Eastside Residential Zone: First Street to the Passaic River heading eastbound and Virginia Street to the Passaic River heading southbound. (2) Wall Street Residential Zone: Eighth Street from Wall Street to Passaic Street, Ninth Street from Wall Street to Passaic Street, and the full length of Veterans Court. (3) (2) Main Avenue Redevelopment Plan Area: Boundary as delineated in the Main Avenue Redevelopment Plan. ROLL CALL (VIA ZOOM) AYES: Munk Melo Patel Schwartz Garcia CP Schaer ABSENT: Love Council President Schaer read said Ordinance by title: CITY OF PASSAIC ORDINANCE #2318-21 ORDINANCE AUTHORIZING THE CITY OF PASSAIC TO VACATE A PUBLIC RIGHT-OF-WAY KNOWN AS A PORTION OF MINERAL SPRINGS ROAD WHEREAS, N.J.S.A. 40:67-1, et seq. authorizes a municipal council to vacate, release and extinguish the public’s rights in any portion of public street, highway, Page 49 of 53 Passaic City Council September 9, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK lane or alley, and any portion of a property dedicated as a public street, where the public interest will be better served by releasing those lands or any part thereof from such dedication; and WHEREAS, Mineral Springs Road was dedicated as a public right-of-way by virtue of said street being historically reserved as a public road and as a conveyancing reference; and WHEREAS, a portion of the lands, formerly dedicated as a portion of Mineral Springs Road, ceases to be utilized by the public after the construction of Veterans Memorial Park; and WHEREAS, the portion to be vacated (hereinafter “subject property”) is further described on the survey annexed hereto, made a part hereof and marked as Exhibit A, dated July 19, 2021 and prepared by DMC Associates, Inc. Professional Land Surveyors; and WHEREAS, it is the intention to subsequently incorporate the vacated subject property as part of Veterans Memorial Park; and WHEREAS, the City Engineer has reviewed this vacation request and determined that there is no potential public need for the subject property; and WHEREAS, the subject property serves no purpose for the traveling public and is not required for street, road or public right-of-way purposes, and thus vacating such would promote the public interest and general welfare of the City of Passaic. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Passaic as follows: Section 1. That the foregoing recitals are hereby incorporated as if set forth in full herein. Section 2. Section 3. That the vacation of the subject property shall in no way affect any private rights which may exist at the time of passage and adoption of this Ordinance. Section 4. That all rights and privileges possessed by any public utility are hereby reserved and exempted from the effects of this Ordinance. Section 5. That the Mayor, City Clerk and Business Administrator are hereby authorized and directed to execute any documents and/or undertake any and all such actions necessary to vacate the subject property and effectuate the purpose of this Ordinance. Section 6. That this Ordinance and all requisite supporting instrumentalities, including certified copies of the proof of publication, shall be filed in the office of the Passaic County Clerk in order to record and perfect this vacation. Section 7. That if any section or provision of this Ordinance shall be invalid in any court, the same shall not affect the other sections or provisions of this Ordinance, except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.
