Lora updated the council and residents on the following: Passaic City Council September 23, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK  COVID statistics from March 2020 to date:  8927 tested positive for Covid-19; of those there were 309 deaths but no deaths since June 2021.  85% of residents 18 and over have been vaccinated.  72% of residents aged 12-17 have been vaccinated, the highest percentage in Passaic county.  Free vaccines and testing available every Wednesday at 333 Passaic Street.  Water and food distribution continues on Wednesdays, and FEMA representatives are also available.  Because of high winds and intense rain predicted, metal barricades have been erected in areas prone to flash flooding. PSE&G is onsite in event of power outages.  Mayor Lora, along with two California assembly members, was invited to a virtual roundtable hosted by President Biden. Mayor Lora spoke on infrastructure and Passaic needs including water absorption strategies that Passaic used, i.e., rain guards.  Mayor Lora received a personal letter from Biden reiterating his commitment to work with the state to mitigate issues from Storm Ida.  Passaic town halls are planned, to answer questions from residents.  Passaic residents are being assisted through storm damage by human services departments in City Hall.  Residents can apply for affordable home ownership for VFW building condos. The program is in partnership with Habitats for Humanity. Veterans are encouraged to apply.  Free SORA security license training and certification and job placement has begun for Passaic residents. Apply before October 5.  Free flu vaccines will be given at 333 Passaic Street, Department of Health on October 1, 15 and 29.  Boiled water advisory continues in Passaic. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the application of CENTRO DE RESIDENTES BOLIVIANOS EN NJ to hold a Bolivian Festival on October 23, 2021 from 12:00 p.m. to 6:00 p.m. at Plaza Garibaldi, Dayton Avenue at Monroe Street, Passaic, New Jersey, which will include the sale of alcohol in a public place, is hereby approved subject to strict compliance with the following conditions: 1. The sale of alcoholic beverages by the glass or other open receptacles at the above-captioned event shall be for immediate consumption in a confined area(s) of the Bolivian Festival between the hours of 12:00 p.m. and 6:00 p.m. All advertisements related to the Picnic festival, including tickets, must include the Special Permit No. issued by the State of New Jersey, Department of Law and Public Safety, Division of Alcoholic Beverage Control, and the Special permit shall be conspicuously displayed at the Bolivian Festival. 2. Self-service by attendees of the Bolivian Festival is strictly prohibited and all sale, service or delivery of alcoholic beverages to attendees of the Bolivian Festival must be made and supervised by the Applicant’s authorized staff. The Applicant shall maintain adequate staff at the Bolivian Festival to monitor each sale, service or delivery of an alcoholic beverage to prevent service to intoxicated or underage individuals. Such staff shall check identification of individuals prior to entry in the confined area(s) where alcoholic beverages are available to confirm that all persons therein are at least twenty-one (21) years of age. Sale, service or delivery shall be limited to two (2) alcoholic beverages per customer at a time. All persons admitted to the area(s) where alcoholic beverages are sold and/or consumed shall wear a bracelet indicating that such person has been approved for admittance. No other persons shall be allowed in such area(s) where alcoholic beverages are sold and/or consumed. 3. The Applicant may purchase alcoholic beverages for the Bolivian Festival only from licensed New Jersey wholesales or retailers who license privilege permits the sale of package goods for off-premises consumption except Applicant, if a club licensee, may use its own inventory for the Bolivian Festival. All alcoholic beverages purchased at wholesale and not consumed at the Bolivian Festival must be returned to the wholesaler. 4. The Applicant shall comply with all State, federal, and local laws, statutes, ordinances, rules and regulations applicable to this application, including, but not limited to, the sale and consumption of alcoholic beverages. 5. The Applicant’s failure to comply with any of the foregoing conditions, including but not limited to the requirement that it obtain a Special Social Affair Permit from the State of New Jersey, Department of Law and Public Safety, Division of Page 10 of 29 Passaic City Council September 23, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK Alcoholic Beverage Control, renders this approval null and void. CITY OF PASSAIC RESOLUTION NO. 21-09-229 RESOLUTION AUTHORIZING THE CITY OF PASSAIC TO APPLY FOR FUNDS FROM THE NEW JERSEY DEPARTMENT OF COMMUNITY AFFAIRS (DCA) 2022 RECREATIONAL OPPORTUNITIES FOR INDIVIDUALS WITH DISABILITIES GRANT PROGRAM WHEREAS, there is a need to provide recreation and leisure services for individuals with disabilities in the City of Passaic; and WHEREAS, the Recreational Opportunities for Individuals with Disabilities (ROID) Grant supports projects that will provide these services to people with disabilities in our community by offering the ROID Grant Program; and WHEREAS, the City of Passaic Department of Recreation wishes to provide individuals with disabilities in need these services being offered under this grant program; and WHEREAS, the City of Passaic desires to apply for and obtain a grant from the New Jersey Department of Community Affairs for approximately $20,000 with 20% matching funds for this grant opportunity to carry out a project to enhance inclusive social events and diversified programming within the City; and WHEREAS, the City of Passaic recognizes and accepts that the Department may offer a lesser or greater amount and therefore, upon receipt of the grant agreement from Page 11 of 29 Passaic City Council September 23, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK the New Jersey Department of Community Affairs, does further authorize the execution of any such grant agreement; and also, upon receipt of the fully execution of any such agreement; and also, upon receipt of the fully executed agreement from the Department, does further authorize the expenditure of funds pursuant to the terms of the agreement between. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Passaic City the City of Passaic is hereby authorized to apply for funds from the New Jersey Department of Community Affairs 2022 Recreational Opportunities for Individuals with Disabilities Grant; and be it FURTHER RESOLVED that the Mayor and City Clerk are hereby that authorized to and directed to execute the application and any other documents necessary in connection therewith. CITY OF PASSAIC RESOLUTION NO. 21-09-230 RESOLUTION AUTHORIZING THE CITY OF PASSAIC DIVISION OF HEALTH TO RENEW USDA GRANT FOR THE SPECIAL SUPPLEMENTAL NUTRITION PROGRAM FOR WOMEN, INFANTS AND CHILDREN (WIC) FOR FFY 2022 WHEREAS, the Special Supplemental Nutrition Program for Women, Infants and Children (WIC) Program’s mission is to safeguard the health of low-income women, infants and children who are at nutritional risk by providing vouchers for nutritious foods, nutrition education, breastfeeding education and support and community referrals; WHEREAS, the City of Passaic Division of Health has been the recipient of USDA funding through the NJ Department of Health for the Passaic WIC Program for over 30 years; Page 12 of 29 Passaic City Council September 23, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK WHEREAS, the grant provides necessary funding to provide WIC services for eligible clients residing in the City of Passaic and the surrounding communities; WHEREAS, the NJ Department of Health has offered to renew the City of Passaic Division of Health’s WIC grant for FFY 2022; WHEREAS, a total of $1,116,055 in grant funding is being offered by the NJ Department of Health to the City of Passaic Division of Health for FFY 2022; WHEREAS, the funding will permit full support of salaries and fringe benefits for twelve full-time employees and salaries for six part-time employees, and; WHEREAS, the funding will also support the Breastfeeding Peer Counselor Program, Saturday clinic hours for working parents and pre-school age children, maintenance costs for the building at 333 Passaic Street and programmatic expenses associated with providing WIC benefits by the Passaic WIC Program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Passaic that Kenneth Pincus, Health Officer, is hereby authorized and directed to make an application to the NJ Department of Health & Senior Services renewing the Special Supplemental Nutrition Program Women, Infants and Children grant for FFY 2022. Consulting Gem Mobile Health FD Stonewater East Brunswick, NJ Lakewood, NJ Arlington, VA Sam Medical Tualatin, OR WHEREAS, the evaluation Committee reviewed the proposals received and recommends that the contract for Emergency Medical Services/Basic Life Support Ambulance Services and Lease of EMS Facility be awarded to Prime Healthcare Services – Saint Clare’s, LLC, Dover, NJ as per the attached spreadsheet. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the contract for Emergency Medical Services/Basic Life Support Ambulance Services and Lease of EMS Facility be awarded to Prime Healthcare Services – Saint Clare’s, LLC, Dover, NJ as per the attached Spreadsheet. CITY OF PASSAIC RESOLUTION NO. 21-09-232 RESOLUTION AUTHORIZING THE CITY OF PASSAIC TO ENTER INTO A CONTRACT FOR SOFTWARE LICENSING FOR HEALTH DEPTARTMENT, CODE ENFORCEMENT, TAX ASSESSOR, FIRE PREVENTION, ENGINEERING AND DEPARTMENT OF PUBLIC WORK WHEREAS, the City of Passaic, wishes to enter into an agreement with SHI International of Somerset, NJ for Software Licensing for Health Department, Code Enforcement, Tax Assessor, Fire Prevention, Engineering and Department of Public Works under Bergen County Cooperative Contract Purchasing System #CK04 ; and WHEREAS, the software license is the primary database that performs functions and services for inspections and tracking; and WHEREAS, Local Public Contracts Law 40A:11-2 authorizes the purchase of any materials, supplies or equipment under a Cooperative Pricing System entered on behalf of the State by the Division of Purchase and Property in the Department of the Treasury without the necessity for public bidding; and WHEREAS, the cost for the software license is $ 55,000.000 for the period October 1, 2021 through September 30, 2022. WHEREAS, it is the recommendation of Chris Post, IT, that the agreement be entered into with SHI International for Software Licensing in the total amount of $ 55,000.00 for the period October 1, 2021 through September 30, 2022. (the “ Long Term Tax Exemption Law” ), governing payments made to the City in lieu of real estate taxes on the Project pursuant; and WHEREAS, 125 SOUTH ST URBAN RENEWAL, LLC filed an application with the City for approval of a Long-Term Tax Exemption for the Project, which is on file with the City Clerk (the “Application”), a copy of which is attached hereto; and WHEREAS, the provisions of the Long-Term Tax Exemption Law authorize the City to accept, in lieu of real property taxes, an annual service charge paid by 125 SOUTH ST URBAN RENEWAL, LLC to the City; and WHEREAS, 125 SOUTH ST URBAN RENEWAL, LLC has agreed to make payment of an Annual Service Charge as defined in the Long-Term Tax Exemption Law to the City as set forth in the attached Financial Agreement; and WHEREAS, the City Council has determined that the Project represents an undertaking permitted by the Long- Term Tax Exemption Law, and has further determined that the Project is an improvement made for the purposes of clearance, replanning, development, or redevelopment of an area in need of redevelopment within the City as authorized by the Long Term Tax Exemption Law; and WHEREAS, the City Council has determined that the Project would not have been constructed without a tax exemption. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Passaic that an exemption from taxation as set forth in the Financial Agreement is hereby granted to125 SOUTH ST URBAN RENEWAL, LLC, with respect to the Project on the Project Site for the term set forth in the Page 26 of 29 Passaic City Council September 23, 2021 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK Financial Agreement; provided that in no event shall the tax exemption exceed the earlier of (i) thirty (35) years from the date of execution of the Financial Agreement or (ii) to the extent permitted by N.J.S.A. 40A:20-13, thirty (30) years from the Entity’ s receipt of a Certificate of Occupancy for the Project or Phase thereof and only so long as the Entity remains subject to and complies with the Financial Agreement and the Long-Term Tax Exemption Law and any other agreement related to the Project or the Property; and BE IT FURTHER ORDAINED that the Mayor and Clerk are hereby authorized and directed to execute the attached Financial Agreement, a certified copy of which shall be kept on file in the Office of the City Clerk; and BE IT FURTHER ORDAINED that the Project shall conform with all Federal and State law and ordinances and regulations of the City relating to its construction and use; and BE IT FURTHER ORDAINED that 125 SOUTH ST URBAN RENEWAL, LLC shall, from the time the Annual Service Charge becomes effective, pay the Annual Service Charge as set forth in the Financial Agreement; and BE FURTHER ORDAINED that if any section of provision of this ordinance shall be invalid in any court the same shall not affect the other sections or provisions of this ordinance except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof; and BE IT FURTHER ORDAINED that all ordinances or parts of ordinances inconsistent herewith are hereby repealed as to such inconsistencies only; and BE IT FURTHER ORDAINED that this Ordinance shall take effect upon final adoption and publication in accordance with law.
