The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. CITY OF PASSAIC RESOLUTION NO. 22-05-116 RESOLUTION AUTHORIZING SETTLEMENT OF TAX APPEAL CAPTIONED SANCTUARY REALTY, LLC V. CITY OF PASSAIC WHEREAS, Sanctuary Realty, LLC has filed tax appeals in Tax Court challenging the assessment of real property designated as Block 3257, Lot 32, on the official Tax Map of the City of Passaic and located at 253 Main Ave, Passaic, New Jersey for the tax years 2019, 2020, and 2021; and Page 8 of 22 Passaic City Council May 12, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK WHEREAS, the total refund and estimated tax credit for the proposed settlement offer for tax years 2019, 2020 and 2021 is approximately $12,225.79; and WHEREAS, the total estimated tax credit for the proposed settlement offer for tax year 2022, calculated using the 2020 general tax rate, is approximately $7,862.16; and WHEREAS, it has been determined that the proposed settlement offer is in the best interest of the City of Passaic; and WHEREAS, the City of Passaic wishes to accept the proposed settlement offer of Counsel for the taxpayer. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Passaic that City of Passaic is hereby authorized to accept the proposed settlement offer for the matter of Sanctuary Realty, LLC v. City of Passaic. CERTIFICATION OF FUNDS Funds for the above are available in Police Traffic Acct. #1-01-25-240-003-014 and DOT Grant 2020 Various Roads G-02-40-346-020-9RD Page 12 of 22 Passaic City Council May 12, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK CITY OF PASSAIC RESOLUTION NO. 22-05-120 RESOLUTION AUTHORIZING EXTENSION OF CONTRACT FOR TELECOMMUNICATIONS SERVICES REGIONAL AND LONG DISTANCE WHEREAS, on December 6, 2018, the City Council adopted Resolution #18-12-395 approving a contract with Data Network Solutions of Little Silver, NJ for Telecommunications Services Regional and Long Distance with the City of Passaic for three (3) years with the option to renew for an additional two (2) one-year terms or one (1) two-year term; and WHEREAS, the City of Passaic wishes to exercise its option to extend the contract for an additional one (1) two-year terms with the same terms and conditions as the initial three (3) year contract; and WHEREAS, this contract shall expire on December 31, 2024. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the contract for Telecommunications Services Regional and Long Distance with Data Network Solutions of Little Silver, NJ shall be extended for an additional one (1) two-year terms with the same terms and conditions as the initial three (3) year contract expiring on December 31, 2024. BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute a contract for these services, on a form approved by Corporation Counsel. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic is hereby authorized to submit a grant application to the New Jersey Department of Health, Childhood Lead Exposure Prevention (CLEP) Grant Program. BE IT FURTHER RESOLVED that the City of Passaic, Mayor, and City Clerk are hereby authorized to take all necessary actions to file this application and to accept grant funds from the New Jersey Department of Health, Childhood Lead Exposure Prevention (CLEP) Grant Program. Page 15 of 22 Passaic City Council May 12, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK CITY OF PASSAIC RESOLUTION NO. 22-05-123 RESOLUTION AUTHORIZING The SUBMISSION OF AN APPLICATION FOR THE FY2023 NEW JERSEY DIVISION OF HIGHWAY TRAFFIC AND SAFETY PEDESTRIAN SAFETY GRANT PROGRAM WHEREAS, the City of Passaic has received notification from the State of New Jersey, Office of the Attorney General, Department of Law and Public Safety, Division of Highway Traffic Safety, regarding a grant for the FY2023 Pedestrian Safety Grant Program; and WHEREAS, under the Pedestrian Safety Grant Program $35,000.00 in funding may be utilized from October 1, 2022, to September 30, 2023, for law enforcement personnel costs; and WHEREAS, the City of Passaic Police Department wishes to submit an application for this grant. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic Police Department is hereby authorized to submit a FY2023 grant application to the State of New Jersey, Office of the Attorney General, Department of Law and Public Safety, Division of Highway Traffic Safety in the amount of $35,000.00 for law enforcement personnel costs under the Pedestrian Safety Grant Program. Page 16 of 22 Passaic City Council May 12, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK CITY OF PASSAIC RESOLUTION NO. 22-05-124 RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE NEW JERSEY DEPARTMENT OF TRANSPORTATION’S 2022 LOCAL FRIEGHT IMPACT FUND PROGRAM AWARD WHEREAS, the City of Passaic has applied for and has been awarded funding in the amount of $950,000.00 from the New Jersey Department of Transportation through the Local Freight Impact Fund Program for the 8th Street Improvement Project; and WHEREAS, the purpose of the program is to provide funds to governmental entities to encourage and support the advancement of freight projects which emphasize and enhance the safe movement of truck traffic, renewing aging structures that carry large truck traffic, promote economic development and above all supports new transportation opportunities throughout our State; and WHEREAS, the City of Passaic desires to accept a grant from the New Jersey Department of Transportation for the Local Freight Impact Fund Grant Program; and WHEREAS, such grant is in the amount of $950,000.00. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to accept the grant award from the application identified as LFIF-2022-8TH Street Improvement Project -00007 from the New Jersey Department of Transportation, Local Transportation Projects Fund Grant Program in the amount of $950,000.00; and BE IT FURTHER RESOLVED THAT the Mayor and Clerk are hereby authorized to execute any documents and/or take all other steps necessary to effectuate the receipt of the grant monies.
