MAYOR’S UPDATE  Memorial day parade will begin at 9am on May 31.  Because of elevated covid numbers reported by the state, Passaic schools are urged to wear masks.  Board meeting with NJ Judge Caposela and other county members, talked about gun controls. In conjunction with Judge Caposela, Passaic youth programs expanded. Passaic City Council May 25, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK  In conjunction with United Passaic Organization (UPO), a new community food bank has been established, giving alternative to areas with food swamps (non-nutritious food).  Food truck for homeless with hot free meals is available every Saturday at. Mt Pilgrim Missionary Baptist Church from 10 a.m. - 12 p.m.  Congratulates Janelle Hall as new Executive Director of UPO, and Diane McNair chairperson of the UPO.  Recommended Dr. Therese Hiller added to housing board as governor’s appointment recommended by mayor.  Jewish American heritage and Asian American pacific highlanders were celebrated during the month of May. Council Member Munk joined at 7:28 p.m. HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. He needs an inspector to come by and explain what needs to be repaired. Cindy Hernandez, 57 Pine St  On April 26 meeting, she brought up some issues, and Chief Guzman addressed some issues. Some issues not resolved are loitering on Pine Street; can a no loitering sign be placed outside her house?  At 208 Summer Street, bikers are racing motorcycles; can speed bumps be installed on the street to prevent racing? Aryeh Mack – 187 Howard Ave  When will construction of tennis courts in third ward park area begin?  There is not much police presence in the upper third ward area and response times has been slow. JAE FARMS INC CANNABIS BUSINESS LICENSURE WHEREAS, Pursuant to N.J.A.C. 17:30-7.1, N.J.A.C. 17:30-7.8, and N.J.A.C. 17:30-7.10 applicants for cannabis business licenses (“license-applicants”) shall submit proof of local support in the form municipal approval as part of their application; and WHEREAS, pursuant to N.J.A.C. 17:30-5.1, N.J.A.C. 17:30-6.3 and the Notice of Application Acceptance adopted by the New Jersey Cannabis Regulatory Commission (“Commission”) on November 9, 2021, municipalities may submit their preference for licensure to the Commission; and WHEREAS, pursuant to Passaic, New Jersey, Municipal Code art. IV, § 232-5 (2021), the City of Passaic authorizes a person to engage in cannabis business, including cultivation, manufacture, processing, laboratory testing, transporting, dispensing and distribution of cannabis or a cannabis product only if the person: (1) has a valid cannabis business permit or cannabis dispensary permit from the City of Passaic; and (2) is currently in compliance with all applicable laws and local laws and regulations pertaining to the cannabis business and the cannabis business activities, including the duty to obtain any required state licenses; and WHEREAS, pursuant to Passaic, New Jersey, Municipal Code art. CITY OF PASSAIC RESOLUTION NO. 22-05-130 RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR THE US DEPARTMENT OF JUSTICE (DOJ) BULLETPROOF VEST PARTERNSHIP (BVP) GRANT PROGRAM WHEREAS, the City of Passaic has learned of the availability of funding from the US Department of Justice Bulletproof Vest Partnership Program; and WHEREAS, through the Bulletproof Vest Partnership Program, the US Department of Justice provides funding to local law enforcement agencies for the procurement of new body armor and . applicants will be reimbursed up to 50% of the cost of body armor purchased; and WHEREAS, said grant requires 50% matching funds from the City of Passaic; and Page 11 of 18 Passaic City Council May 25, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK WHEREAS, the City of Passaic wishes to submit an application for this grant. ROLL CALL (VIA ZOOM) AYES: Munk Love Melo Schwartz Garcia CP Schaer ABSENT: Patel Page 14 of 18 Passaic City Council May 25, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK Council President Schaer read said Ordinance by title: CITY OF PASSAIC ORDINANCE NO. 2351-22 ORDINANCE AMENDING CHAPTER 149, “FOOD ESTABLISHMENTS”, ARTICLE XIII “FARMERS’ MARKETS”, SECTIONs 51 AND 52 OF THE CITY OF PASSAIC CODE TO EXTEND THE FARMERS’ MARKET OPERATING SEASON WHEREAS, pursuant to N.J.S.A.40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and WHEREAS, the City Code of the City of Passaic, Chapter 149, “Food Establishments,” Article XIII, “Farmers’ Markets”, Sections 51 “Operating season; location” and 52 “Farmers’ market vendor license required; dates of validity” set forth the rules and regulations governing the operating season of Farmers’ Markets in the City of Passaic; and WHEREAS, the City of Passaic wishes to amend the Farmers’ Market ordinance to extend the operating season in order to improve nutritionally at-risk residents’ access to locally grown healthy foods in accordance with the standards of this code; and NOW THEREFORE, IT IS ORDAINED by the City Council of the City of Passaic that the City Code of the City of Passaic, Chapter 149, “Food Establishments,” Article XIII, “Farmers’ Markets”, Sections 51 “Operating season; location” and 52 “Farmers’ market vendor license required; dates of validity” is hereby amended as follows: ALL ADDITIONS ARE UNDERLINED Page 15 of 18 Passaic City Council May 25, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK ALL DELETIONS ARE NOTED BELOW SECTION 1 § 149-51 Operating season; location. A. Operation shall be restricted to between June 1 May 15 and October 31 November 30 of the same calendar year. Hours of operation shall be no earlier than 8:00 a.m. and shall end no later than 6:00 p.m. B. The location of the farmers' market shall be subject to City Council approval. § 149-52 Farmers' market vendor license required; dates of validity. A. https://ecode360.com/16123426 - 16123426A farmers' market vendor license shall be required for each individual stand, kiosk, booth, table, or similar conveyance from which food is served or sold, whether with or without charge, at the farmers' market. B. Farmers' market vendor licenses shall be valid from June 1 May 15 to October 31 November 30 of the same calendar year in which they were issued. SECTION II If any section or provision of this ordinance shall be invalid in any court the same shall not affect the other sections or provisions of this ordinance except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof. SECTION III All ordinances or parts of ordinances to inconsistent herewith are hereby repealed to the extent of such inconsistency. SECTION IV This Ordinance shall be subject to review by the Council after passage of six months from its effective date.
