Council Member Love joined at 7:05 p.m. MAYOR’S UPDATE  St. Anthony Padua held their yearly family festival.  On Sunday, Pastor Frank Seminerio of Trinity Assembly of God Church held a cookout for Passaic firefighters.  Passaic County primary elections were held on Tuesday. Passaic City Council June 9, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK  A motor vehicle service held at Passaic City Hall.  A CPR class for restaurant owners was given.  Ken Pincus from the health office reported that the city’s COVID numbers remain steady. 2022 BUDGET TRANSMITTAL  Finance director and CFO Omar Garcia presented the budget for January-December 2022  Total proposed appropriations for 2022 is $103.425,124.  Employee salaries increased $1,129,755 (2.41% increase from 2021)  Garbage contract (recycling) increased this year by $664,000 from last bidding cycle  Pension contributions increased $316,532 (7.02% for PERS and 2.16% for PFRS)  Capital improvements include an additional $1,000,000 for the purchase of a new fire engine and street sweeper  Debt service increased $347,960 due to a bond issue relating to a 2018 bond ordinance  Increase in construction code permit revenue of $500,000  Municipal court revenue decreased by $138,000  Estimated impact of proposed tax rate increase is 5%; Average home assessed at $275,000 HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Passaic that the City of Passaic is hereby authorized to submit a grant application to the New Jersey Department of Environmental Protection’s Radon Awareness Program. BE IT FURTHER RESOLVED, that the City of Passaic, Mayor, and City Clerk are hereby authorized to take all necessary actions to file this application and to accept grant funds from the Radon Action Partnership Program. CITY OF PASSAIC RESOLUTION NO. 22-06-133 RESOLUTION AUTHORIZING SHARED SERVICE AGREEMENT BY AND BETWEEN CITY OF PASSAIC AND PASSAIC VALLEY WATER COMMISSION FOR FIRE HYDRANT TESTING AND INSPECTION SERVICES OF THE WATER DISTRIBUTION SYSTEM WHEREAS, the City of Passaic and the Passaic Valley Water Commission desire to enter into the attached Shared Service Agreement pursuant to N.J.S.A. 40A:65-l et seq. for fire hydrant testing and inspection services of the City's water distribution system; and WHEREAS, the City will perform all testing and inspection services as set forth in Article II, Scope of Page 11 of 23 Passaic City Council June 9, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK Services, of the attached Shared Service Agreement in exchange for payment from the Passaic Valley Water Commission in the amount of $69,500.00 per year as set forth in Article IV, Responsibilities of the City and Compensation, of the attached Shared Service Agreement, for a period of five (5) years from the effective date thereof; and WHEREAS, N.J.S.A. 40A:ll-5(2) provides an exception under the Local Public Contracts Law for contracts entered into with a municipality and/or any board, body, office, Agency or authority thereof. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized enter into the attached Shared Services Agreement with the Passaic Valley Water Commission for fire hydrant testing and inspection services of the City's water distribution system subject to the terms and conditions therein; and BE IT FURTHER RESOLVED that the Mayor and City Clerk shall execute the Shared Services Agreement attached hereto and that copies of this Resolution shall be forwarded to the Passaic Valley Water Commission to commence the Shared Services Agreement; and BE IT FURTHER RESOLVED that a copy of this Resolution and a copy of the executed Shared Services Agreement shall be forwarded to the Division of Local Government Services pursuant to N.J.S.A. 40A:65-4 by the City Clerk. CITY OF PASSAIC RESOLUTION NO. 22-06-134 RESOLUTION ADOPTING THE CITY OF PASSAIC’S PROCEDURE FOR ADMINISTRATION AND INSPECTION OF FEDERAL AID HIGHWAY PROJECTS WHEREAS, the Federal Highway Administration (“FHWA”) provides opportunities for Local Public Agencies (“LPA”), Page 12 of 23 Passaic City Council June 9, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK such as the City of Passaic, to receive Federal Aid Highway Program (“FAHP” or “federal aid”) funds through the New Jersey Department of Transportation; and WHEREAS, the City of Passaic is presently the recipient of federal aid funds through a project awarded under the Transportation Alternatives Program (“TAP”); and WHEREAS, the City of Passaic, as an LPA, is responsible for administering federal aid funded projects in compliance with all federal aid requirements established by the FHWA; and WHEREAS, the New Jersey Department of Transportation, through its Stewardship Agreement with FHWA, is responsible for ensuring that the City of Passaic is adequately staffed and suitably equipped to undertake federal aid projects and ensure that federal requirements are met; and WHEREAS, the City of Passaic, as required by the New Jersey Department of Transportation, has developed a Policy outlining the required procedures for the Administration of Federally Funded Transportation Projects administered through the New Jersey Department of Transportation. CITY OF PASSAIC RESOLUTION NO. 22-06-139 RESOLUTION AUTHORIZING THE ISSUANCE OF ESTIMATED TAX BILLS WHEREAS, the City of Passaic has determined that the Municipal Tax Collector will be unable to complete the mailing and/or delivery of 2022 tax bills by June 15, 2022 as required by law, since the City’s tax rate has not yet been certified by the County; and WHEREAS, N.J.S.A. 54:4-66.2 provides that in the above circumstance the governing body may authorize and direct the Tax Collector to prepare and issue estimated tax bills for the third quarter 2022, as provided by statute, and such bills must be mailed to tax payers by June 30, 2022; and WHEREAS, N.J.S.A. 54:4-66.2 also provides that in the event that Estimated Tax Bills are issued, that Reconciled Page 18 of 23 Passaic City Council June 9, 2022 Minutes PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WAS CONDUCTED AS A LIVE STREAM VIA FACEBOOK Tax Bills must also be issued for the same tax year by September 30, 2022; WHEREAS, it is in the best interests of the City of Passaic that said authorization be granted; WHEREAS, the Chief Financial Officer and the Tax Collector have computed an estimated tax levy in accordance with N.J.S.A. 54:4-66.3 and has attached a certification showing the tax levies for the previous year, the tax rates and the range of permitted estimated tax levies. City council members thanked the Business Administrator and CFO Omar Garcia for a clear and concise budget presentation.
