Burns, Esq., City Attorney Invocation was rendered by Council Member Melo followed by the Pledge of Allegiance. Passaic City Council Minutes: May 23, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC MAYOR’S UPDATE  Mayor Lora congratulated councilwoman elect Maritza Colon-Montanez and re-elected Council Members and Council President.  Mayor Lora acknowledged May 16 promotions in the fire department.  May 15-19 was National Bike To Work Week.  On May 21 was the annual Bike ride  Stand Down day postponed from May 13 to June 24.  Veterans and Armed Forces Day postponed from May 20 to a date to be announced.  May 24-25 will be certification training for NJ state police and security.  Memorial day parade will take place on May 29.  June 2 annual golf outing event will be held at Crystal Springs Resort from 8-3.  Free fishing father’s day event will be held on June 3 from 9-12, location to be determined.  Christopher Columbus parking has been completed.  ADA-compliant ramp at City Hall building has been completed ice skating rink tables and chairs at Third Ward Memorial Park has been added.  Spray pads will be ready by the holiday weekend.  City received a $360,000 transportation award to fix Myrtle Avenue.  Mayor Lora thanked everyone for their condolences on the passing of his brother. Council Member Love took his seat on the dais at 7:42 p.m. MAYORS PRESENTATION 2023 Preliminary Budget was presented by finance manager Omar Garcia. Upon motion made by Council Member Love and seconded by Council Member Melo the aforementioned meeting minutes were approved. The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Yosef Wolf, 71 Spring St  School budget resulted in an increase; many other cities are knowledgeable of increase of students. Joe Conoscenti, 170 Broadway  Was a study made on dirt bikes and electric bikes?  The intersection at Paulison and Howe Avenues needs to have yellow stripes painted.  He would like an update on illegal vendor citations.  In Third Ward park near the medal of honor and Jewish monuments, a rotting tree needs to be replaced. CITY OF PASSAIC RESOLUTION NO.23-04-151 RESOLUTION AUTHORIZING A SHARED SERVICE AGREEMENT WITH PASSAIC BOARD OF EDUCATION FOR USE OF SCHOOL AND CITY FACILITIES 2023-2024 WHEREAS, City of Passaic and Passaic Board of Education wish to enter into the attached Shared Services Agreement for the shared use of Board of Education facilities and City of Passaic fields and facilities pursuant to N.J.S.A. 40A:65-1, et seq.; and WHEREAS, under such Shared Service Agreement, the City of Passaic and Board of Education shall provide each other with a list, semi-annually, of the facilities and fields to be used and dates and times requested and agree that their use of each other’s facilities shall not interfere or conflict with that other party’s use of its own facilities; and WHEREAS, under such Shared Service Agreement, the City of Passaic and Board of Education agree to waive any fees and forms for the use of each other’s fields and facilities; and WHEREAS, under such Shared Service Agreement, the City of Passaic and Board of Education shall mutually indemnify and hold harmless each other and shall also obtain the appropriate liability coverage naming each other as an additional insured for the use of each other’s fields and facilities; and WHEREAS, the term of the Shared Service Agreement shall commence on July 1, 2023 and expire on June 30, 2024. CITY OF PASSAIC RESOLUTION NO.23-04-152 RESOLUTION AUTHORIZING SHARED SERVICES AGREEMENTS BETWEEN THE CITY OF PASSAIC, AND THE PASSAIC BOARD OF EDUCATION FOR USE OF SALT WHEREAS, the City has agreed to share salt with the Passaic Board of Education; and WHEREAS, the Passaic Board of Education will pass a resolution to authorize this shared services agreement; and Page 12 of 30 Passaic City Council Minutes: May 23, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, parties agree to share this salt subject to the terms and conditions of the agreement, at the current contract price plus an administrative fee of 5%, for the term July 1, 2023 through June 30, 2025.
