The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Joe Conoscenti, 170 Broadway  Where is the Griffin Latona plaque that used to be at 103 Steps on 481 Harrison?  What happened to the aerators in Third Ward park?  Near the old tennis courts on Van Houten avenue, the property nearby needs work, has broken lighting etc.  Are tickets being issued for people parking on yellow lines?  Hodges pond would be nice with a third fountain. On a motion by Council Member Melo and seconded by Council Member Munk the following communications and petitions were received placed on file and approval granted Passaic Board of Education, submitting the following:  Notice of their June 13, 2023, meeting ROLL CALL Munk Love Melo Schwartz Garcia CP Schaer X ABSTAIN X X X X MAYOR’S UPDATE  Mayor Lora thanked the Aquino family for allowing Passaic to honor their father.  On May 29, Passaic held its Memorial Day parade ceremony.  Mayor Lora thanked all who participated in the annual golf outing at Crystal Springs Resort.  On Friday the city green mobile starts up from 10-2 where people can buy fresh fruits and vegetables.  On June 3 the Father’s Day fishing outing was held at Hughes Lake Memorial park.  At a future date a citywide campout will be organized with tents, barbecues, campfires, etc.  RBI baseball and softball leagues have started.  A scavenger hunt was held in Third Ward Memorial Park.  On June 15 there will be a Passaic youth concert in honor of Passaic’s 150th anniversary.  On June 17, Passaic in collaboration with NAACP held its fourth annual Juneteenth event in Third Ward Memorial Park.  Work on Passaic tennis courts continues. Page 11 of 50 Passaic City Council Minutes: June 13, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC BUDGET INTRODUCTION CY 2023 Council President Schaer read said Ordinance by title: CITY OF PASSAIC, PASSAIC COUNTY, NEW JERSEY CALENDAR YEAR 2023 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) ORDINANCE NO._2401-23 WHEREAS, the Local Government Cap Law, N.J.S. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget up to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the Governing Body of the City of Passaic, in the County of Passaic finds it advisable and necessary to increase its CY 2023 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the Governing Body hereby determines that a 1.0 % increase in the budget for said year, amounting to $963,603 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS, the Governing Body hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. NOW THEREFORE BE IT ORDAINED, by the Governing Body of the City of Passaic, in the County of Passaic, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2023 budget year, the final appropriations of the City of Passaic shall, in Page 12 of 50 Passaic City Council Minutes: June 13, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5 %, amounting to $3,372,610, and that the CY 2023 municipal budget for the City of Passaic be approved and adopted in accordance with this ordinance; and, BE IT FURTHER ORDAINED, that any that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption. CITY OF PASSAIC RESOLUTION NO.23-06-168 RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION AND ACCEPTANCE FROM THE NJ DEPARTMENT OF COMMUNITY AFFAIRS FY 23 LEAD GRANT ASSISTANCE PROGRAM (LGAP) WHEREAS, effective July 22, 2022, the Legislature enacted P.L. 2021, c. 182, “An Act concerning certain lead-based paint hazard, and residential rental Page 17 of 50 Passaic City Council Minutes: June 13, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC property, and establishing lead-based paint hazard programs, supplementing P.L. 2003, c. 311 (C. 52:27D- 437.1 et al.) amending various parts of the statutory law, and making an appropriation;” and WHEREAS, pursuant to N.J.S.A. 52:27D-437.16(b)(1), a municipality that maintains a permanent local agency for the purpose of conducting inspections and enforcing laws, ordinances, and regulations concerning buildings and structures, is required to inspect for lead-based paint hazards in certain specified single-family, two- family, and multiple rental dwellings, at the time periods set forth in the statute; and WHEREAS, pursuant to N.J.S.A. 52:27D-437.16(b)(2) a municipality that does not maintain such a permanent local agency must hire a lead evaluation contractor, certified to provide lead paint inspection services by DCA, or enter a shared services agreement as permitted by law, for the purpose of conducting the inspections for lead-based paint hazards; and WHEREAS, Pursuant to Section 9 of P.L. 2021, c. 182, the State of New Jersey has allocated the sum of $3,900,000 to effectuate the purposes of P.L. 2021, c. 182 (C. 52:27D-437.16). Further, pursuant to the FY 2023 Appropriations Act (P.L. 2022, Chapter 49), DCA received a grant-in-aid amount of $3,900,000 for P.L. 2021, c. 182, for a total of $7,800,000 in appropriations to effectuate the purpose of the Act. WHEREAS, DCA has allocated $7,000,000 of this appropriation to the development of the Lead Grant Assistance Program (“LGAP”) for the issuance of grant funds to municipalities for the purpose of assisting in municipal compliance with P.L. 2021, c. 182. NOW, THEREFORE, BE IT RESOLVED, the Governing Body of the City of Passaic does hereby authorize Ken Pincus, Health Officer to sign the attached grant agreement, and thus bind City of Passaic to the grant agreement’s terms in order to receive an estimated $111,400.00 grant award from the DLGS. CITY OF PASSAIC RESOLUTION NO.23-06-169 RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR THE U.S. DEPARTMENT OF JUSTICE (DOJ) RURAL AND SMALL DEPARTMENT VIOLENT CRIME REDUCTION PROGRAM WHEREAS, the City of Passaic has learned of the availability of funding from the United States Department of Justice Rural and Small Department Violent Crime Reduction Program; and WHEREAS, Through the Rural and Small Department Violent Crime Reduction Program, the US DOJ supports small and rural agencies in their efforts to combat violent crime; and WHEREAS, said grant requires no matching contributions from the City of Passaic; and WHEREAS, the City of Passaic wishes to submit an application for this grant. CITY OF PASSAIC RESOLUTION NO.23-06-188 RESOLUTION HONORARILY DESIGNATING THE CORNER OF HOPE AVENUE AND JACKSON STREET AS ALEJANDRO “PAPO” AQUINO CORNER WHEREAS, the City of Passaic is committed to recognizing individuals who have made significant contributions to their community; and WHEREAS, Alejandro “Papo” Aquino, who was born in Las Marias, Puerto Rico, in 1938, was a beloved member of our community for nearly four decades, creating a vibrant neighborhood institution, Las Marias Grocery, and serving the community with passion and commitment; and WHEREAS, after immigrating to the Mainland New York in his early 20s and working as a factory worker, Papo realized his dream of owning a business and opened Las Marias Grocery in October 1977 along with his brother Heriberto; and WHEREAS, Las Marias Grocery, named after Papo’s hometown, quickly became a staple in our community, providing quality products and excellent customer service. His teachings have contributed significantly to the community, as seen through the accomplishments of his children, grandchildren, and other family members, who serve the city in various capacities including roles within the Passaic Board of Education, Passaic Fire Department, and Passaic Police Department; and WHEREAS, Papo was a pillar of support not only for his family but also for his community, often extending credit to his customers until they received their paychecks, demonstrating a faith in the Honor System that is a testament to his character; and WHEREAS, on August 8, 2022, the city mourned the loss of Papo, whose love for his community and family were widely known and whose contributions to the City of Passaic will forever be remembered; and WHEREAS, upon the request of the Mayor of the City of Passaic, and in recognition of the remarkable contributions of Alejandro “Papo” Aquino, this honorary naming of the corner of Hope Avenue and Jackson Street as Alejandro “Papo” Aquino Corner has been proposed to pay tribute to Papo's lasting impact on our community.
