Lora followed by the Pledge of Allegiance. Passaic City Council Minutes: June 27, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC MAYOR’S UPDATE • Mayor Lora asked for a moment of silence for Reverend Bernard Durham of Grace Bible Class Church on Pine Street. • The Passaic/NAACP Juneteenth event was celebrated on Saturday, June 17. • On June 20 Passaic county dietician came to meet with seniors and other vulnerable populations. • On June 21, Ellen Ochoa, the first Hispanic astronaut, visited Passaic. • On June 22nd, 157 children graduated from Passaic high school. • The veterans stand down program was held at Albert Lawson Memorial VFW on Saturday, June 24. • Passaic summer youth employment programs for ages 17-25 has begun. • On August 14-18, the Passaic 2nd fire academy will take place. • The first family festival will take place from June 30-July 4; fireworks will be at Pulaski Park. • Soccer, track & field and foundational tennis summer programs will begin. • The Brook Avenue parking initiative will be completed next week. HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments Page 2 of 19 Passaic City Council Minutes: June 27, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC intending to harass or speak any offensive or abusive language. Aryeh Mack – 187 Howard Ave • He welcomed the newly elected councilwoman. • At Pennington Avenue and Howard, it’s still hard to cross because of a tree blocking the light. • Parking is difficult on Howard avenue, why are there new yellow lines? Joe Conoscenti, 170 Broadway • Near the old tennis courts on Van Houten avenue, the wall and sidewalk and surrounding section needs cleanup, lighting. • What can be done about the loud music coming from backyards, yards? • What can be done about the gang related activity on Oak street? • Will the frequency be changed on the new police scanners? John Wallis – Homeless (formerly at 380 Highland Ave) • There have been many shootings in Passaic, seems like there is no information given to the community as to how to help. CITY OF PASSAIC RESOLUTION NO. 23-06-197 RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICATION FOR THE U.S. DEPARTMENT OF AGRICULTURE (USDA)- NJ NRCS COMMUNITY GARDENS/FARM AGREEMENTS FY23 GRANT PROGRAM WHEREAS, the City of Passaic has learned of the availability of funding from the U.S. Department of Agriculture NJ NRCS Community Gardens/Farm Agreements Grants Program to establish community and pollinator gardens; and WHEREAS, Through the New Jersey NRCS Community Gardens/Farm Agreements Grants, the USDA supports local governments, non-profit organizations, institutions of higher education, and other community partners to encourage collaboration with partners to establish community and pollinator gardens across New Jersey; and WHEREAS, said grant requires no matching funds from the City of Passaic; and WHEREAS, the City of Passaic wishes to submit an application for this grant in the amount of $20,000.00. CITY OF PASSAIC RESOLUTION NO. 23-06-198 RESOLUTION AUTHORIZING THE CITY OF PASSAIC TO ACCEPT GRANT FUNDING FROM THE NEW JERSEY DEPARTMENT OF HEALTH OFFICE OF LOCAL PUBLIC HEALTH CHILDHOOD LEAD PROGRAM WHEREAS, the City of Passaic desires to accept a grant from the New Jersey Department of Health Office of Local Public Health Childhood Lead Program. WHEREAS, such grant is in the amount of $794,349.00 effective for the grant period of August 1st 2023 through June 30th, 2024; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Passaic that the City of Passaic is hereby authorized to accept a grant from the New Jersey Department of Health Office of Local Public Health Childhood Lead Program in the amount of $794,349.00; and BE IT FURTHER RESOLVED THAT the Mayor and Clerk are hereby authorized to execute the required Contract Agreement and/or take all other steps necessary to effectuate the receipt of the grant monies. CERTIFICATION OF FUNDS Funds for the above are available in Acct. #T-03- 56-293-000-808 CITY OF PASSAIC RESOLUTION NO. 23-06-204 RESOLUTION HONORARILY DESIGNATING THE CORNER OF TULIP STREET AND SHERMAN STREET AS “SILVER STAR SQUARE” WHEREAS, the Silver Star Lodge No. 45, chartered on December 26, 1922, represents a significant facet of the rich tapestry of Passaic's history and community; and WHEREAS, the founding members of Silver Star Lodge No. 45, including John Wilson, Alphonse Sutherland, Page 14 of 19 Passaic City Council Minutes: June 27, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC Pinkney McClinton, Thaddeus Perkins, Elmer Harris, William Harris, and Rosser Harrison, demonstrated an unwavering dedication to the establishment of the lodge; and WHEREAS, the lodge has held its meetings in the City of Passaic for nearly a century, moving to its current location at 84 Tulip Street in 1946 under Worshipful Master Carnie P. Bragg Sr., where it continues to operate to this day; and WHEREAS, since its establishment, Silver Star Lodge No. 45 has made significant contributions to the City of Passaic through a multitude of service projects, including school supply giveaways, holiday celebrations, anti-violence workshops, voter registration drives, and more; and WHEREAS, the Peter L. McKinney Scholarship Fund, established by the lodge, has awarded $7,000 to nine promising young individuals in Passaic and vicinity, easing the financial burden of further education for local families; and WHEREAS, in this centennial year of its existence, Silver Star Lodge No. 45 continues its dedication to the City of Passaic, making lasting impacts and fostering a community spirit; and WHEREAS, the Mayor of the City of Passaic has formally requested the designation of the intersection of Tulip Street and Sherman Street as "Silver Star Square" in honor of the significant and ongoing contributions of Silver Star Lodge No. 45 to the city. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of Passaic, New Jersey, that the corner of Tulip Street and Sherman Street in Passaic, New Jersey shall be designated and known as "Silver Star Square” in honor of the legacy of Silver Star Lodge No. 45. CITY OF PASSAIC RESOLUTION NO. 23-06-205 RESOLUTION AWARDING CONTRACT FOR FURNISHING AND DELIVERY OF TWO (2) LEAD PAINT ANALYZERS CITY OF PASSAIC WHEREAS, proposals were received by the Director of Purchasing on Wednesday, May 31, 2023, for the Furnishing & Delivery of Two (2) Lead Paint Analyzers; and WHEREAS, the proposals were solicited through a fair and open process in accordance with N.J.S.A. 19:44A-20.4 et.seq; and WHEREAS, a proposal was received from SciAps, Inc., Woburn, MA in the amount of $27,000.00/ea. for each Lead Paint analyzer for a total amount of $54,000.00; and WHEREAS, a list of proposals that were downloaded from the City of Passaic’s website can be found in the Purchasing Department’s office; and WHEREAS, the evaluation Committee reviewed the proposals received and recommends that the contract for Furnishing & Delivery of Two (2) Lead Paint Analyzers be awarded to SciAps, Woburn, MA in the amount of $54,000.00; and NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the contract for Furnishing & Delivery of Two (2) Lead Paint Analyzers be awarded to Page 16 of 19 Passaic City Council Minutes: June 27, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC SciAps Inc., Woburn, MA in the amount of $ 54,000.00; and BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute a contract on a form approved by City Attorney. CERTIFICATION OF FUNDS Funds for the above are available in the Childhood Lead Grant Account #G-02-40-022-CHL-037 ROLL CALL Munk Love Melo Schwartz Garcia CP Schaer X X X X X X On a motion by Council Member Love and seconded by Council Member Melo the following RESOLUTIONS WERE OFFERED FOR ADOPTION CITY OF PASSAIC RESOLUTION NO. 23-06-206 RESOLUTION APPOINTING WEATHERLY FRIAS AS THE MUNICIPAL CLERK FOR THE CITY OF PASSAIC WHEREAS, Pursuant to N.J.S.A. 40A:9-133, et seq., there shall be a municipal clerk appointed for a three- year term by the governing body of the municipality; and WHEREAS, Ms. Weatherly Frias holds a Registered Municipal Clerk Certificate as required by N.J.S.A. 40A:9-133, et seq. WHEREAS, the Council has reviewed the credentials of Ms. Frias and believes that she has the qualifications necessary to serve as Municipal Clerk, pursuant to N.J.S.A. 40A:9 133, et seq. Page 17 of 19 Passaic City Council Minutes: June 27, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC NOW, THEREFORE, BE IT RESOLVED that Weatherly Frias shall serve as the Municipal Clerk for the City of Passaic, for a term of three years commencing June 27, 2023 and ending June 27, 2026, and shall receive salary as set forth by Ordinance. This salary shall include any and all hours required and Ms. Frias shall not be entitled to overtime or compensation; and BE IT FURTHER RESOLVED, that Ms. Frias shall be appointed to the position of Municipal Clerk effective June 27, 2023; and BE IT FURTHER RESOLVED, that Ms. Frias shall receive other benefits as per City policy; and BE IT FURTHER RESOLVED, that Ms. Frias shall receive all employee holidays with the exception of Election Day, which shall be a work day for Ms. Frias; and BE IT FURTHER RESOLVED, that Ms. Frias shall receive expenses with paid time off for professional development and recertification as required by N.J.S.A. 40A:9-133. et seq.
