The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Supreme Allah  There is no place to put concession stands.  The mayor talked about history of Passaic, but omitted African American community’s contribution. Kenneth Johnson  There should be job opportunities for all ethnicities not just Spanish speaking. Sean Allen, Passaic NAACP President  The Bragg family is on board with changes uptown. Shantia Staff  She went to the mayor with a proposal to create community gardens. The Bragg concession stand will take away green space. She feels that the mayor divides ethnic groups. John Willis  If the park near VFW was put up for sale, how much would the city sell it for? How much was the VFW awarded to fix? Jamae Gibson Williams  Statements were made that Passaic city is set up for certain groups. When there is a need, i.e., bookbag drive, we do what is needed and the mayor donates and supports our efforts. Sharon Bachelor  Churches were not warned about the parade that happened on Sunday. Carl Singer  In 1985 his family moved to Passaic at Howe and Spring Avenues for 28 years which was a quiet area until feeds to route 21 was added, things changed. Additional signs are needed to indicate 25 mph speed limit on Howard. Renee Griggs  She has been coming to city council meetings since Fred Curran was interim mayor. People have to do their own due diligence by following city procedures to get things done. Pedro Ruiz  There is an issue with residents getting parking tickets because of nonresidents taking up the parking spaces. Donald McMann  When Bragg Park was first constructed, there was a sense of pride in the 2nd ward community. He salutes the mayor for wanting to make improvements to the park. Evelyn T. Robinson  Citizens need to do their homework before making criticisms about what the city is doing. CITY OF PASSAIC RESOLUTION NO. 23-08-233 RESOLUTION RE: GOVERNING BODY CERTIFICATION OF THE ANNUAL AUDIT WHEREAS, NJ.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and WHEREAS, the Annual Report of Audit for the year December 31, 2021 has been filed by a Registered Municipal Accountant with the Municipal Clerk pursuant to N.J.S.A. 40A:5-6, and a copy has been received by each member of the governing body; and, Page 13 of 45 Passaic City Council Minutes: August 1, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, R.S.52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and, WHEREAS, the Local Finance Board has promulgated NJ.A.C. 5:30-6.5, a regulation requiring that the governing body of each municipality shall by resolution certify to the Local Finance Board of the State of New Jersey that all members the governing body have reviewed, as a minimum, the sections of the annual audit entitled "Comments and Recommendations, and. WHEREAS, the members of the governing body have personally reviewed, as a minimum, the Annual Report of Audit, and specifically the sections of the Annual Audit entitled "Comments and Recommendations", as evidenced by the group affidavit form of the governing body attached hereto; and, WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C'. 5:30-6.5; and, WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S.52:27BB-52, to wit: R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand Page 14 of 45 Passaic City Council Minutes: August 1, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office. NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Passaic, hereby states that it has complied with N.J.A.C. 5:30-6.5 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance. CITY OF PASSAIC RESOLUTION NO. 23-08-234 RESOLUTION AUTHORIZING EXTENSION OF CONTRACT FOR BURGLAR ALARM MONITORING EQUIPMENT MAINTENANCE/SERVICE AND CCTV CAMERA SYSTEM MAINTENANCE, CITY OF PASSAIC NEW JERSEY WHEREAS, on August 2, 2022, the City Council adopted Resolution #22-08-195 (attached) approving a contract with CSI of Sparta, NJ for Burglar Alarm Monitoring, Equipment Maintenance, And CCTV Camera System Maintenance with the City of Passaic for one (1) year with the option to extend the contract for two (2) one year contracts or one (1) two year contract; and WHEREAS, the City of Passaic wishes to exercise their option to extend the contract for an additional one (1) two year term with the same terms and conditions as the first year of the contract; and WHEREAS, the contract year shall commence on September 1, 2023, through August 31, 2025. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the contract for Burglar Alarm Monitoring, Equipment Maintenance Service And CCTV Camera System Maintenance Service shall be extended for Page 15 of 45 Passaic City Council Minutes: August 1, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC an additional one (1) two year term commencing on September 1, 2023 through August 31, 2025. BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute a contract for these services, on a form approved by City Attorney. CERTIFICATION OF FUNDS Funds for the current Calendar Year are available in Buildings and Grounds Contractual Account #3-01-26-310- 000-029. Funds for the subsequent budget will be available, providing the budget is approved by the governing body. CITY OF PASSAIC RESOLUTION NO. 23-08-235 RESOLUTION AUTHORIZING THE PURCHASE AND INSTALLATION OF OUTDOOR SECURITY CAMERAS WIC – 333 PASSAIC STREET WHEREAS, the WIC Clinic wishes to contract for the Installation and purchase of outdoor Security Cameras under the Hunterdon County Educational Services Commission Cooperative Purchasing Program contract#HCESC-CAT-09 from Technotime, of West Caldwell, NJ; and WHEREAS, N.J.A.C. 5:34 Rules and Regulations authorizes the purchase of any materials, supplies, or equipment under County Cooperative Contract Purchasing Systems without the necessity for public bidding; and WHEREAS, the equipment will cost a total of $28,242.12. WHEREAS, it is the recommendation of Ken Pincus, Health Office, that the contract be awarded to Technotime, of Caldwell, NJ in the amount of $28,242.12. VALKOV WHEREAS, Stoian A. Valkov, an individual residing in the City of Passaic (the “Artist”), has expressed a desire to exhibit two large-scale sculptures (the “Sculptures”) at 333 Passaic Street and Christopher Columbus Park in the City of Passaic, and has agreed to pay for all transportation and installation costs for same; and WHEREAS, the Sculptures are identified by photographs attached to the Artist’s submission to the City dated October 31, 2022, and the City of Passaic will derive significant benefit from the exhibit of the Sculptures; and WHEREAS, the Mayor has requested that the City Council authorize an agreement with the Artist regarding the exhibit of the Sculptures and holding the City harmless (the “Agreement”). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Passaic, that the City of Passaic is hereby authorized to enter into the Agreement with the Artist; and BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized to execute the Agreement and any documents required to further the purpose of this Resolution. Page 34 of 45 Passaic City Council Minutes: August 1, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC CITY OF PASSAIC RESOLUTION NO. 23-08-252 RESOLUTION AUTHORIZING EXTENSION OF CONTRACT FOR FIRE ALARM MONITORING SERVICES, EQUIPMENT ANNUAL INSPECTION SERVICE, AND MAINTENANCE WHEREAS, on August 2, 2022, the City Council adopted Resolution #22-08-196 (attached) approving a contract with United Federated Systems, Inc of Totowa, NJ for Fire Alarm Monitoring Services, Equipment Annual Inspection Service, and Maintenance with the City of Passaic for one (1) year with the option to extend the contract for two (2) one year contracts or one (1) two year contract; and WHEREAS, the City of Passaic wishes to exercise their option to extend the contract for an additional one (1) two year term with the same terms and conditions as the first year of the contract; and WHEREAS, the contract year shall commence on September 1, 2023, through August 31, 2025. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Passaic that the contract for Fire Alarm Monitoring Services, Equipment Annual Inspection Service and Maintenance shall be extended for an additional one (1) two year term commencing on September 1, 2023, through August 31, 2025. BE IT FURTHER RESOLVED that the Mayor and City Clerk are authorized to execute a contract for these services, on a form approved by City Attorney. Page 35 of 45 Passaic City Council Minutes: August 1, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC CITY OF PASSAIC RESOLUTION NO. 23-08-253 RESOLUTION DESIGNATING THE VAN HOUTEN AND PASSAIC AVENUE TRAIN STATION AREA AS “TOM SABA SQUARE” WHEREAS, the Mayor and City Council of the City of Passaic recognize the importance of honoring and preserving the memory of significant individuals who have made substantial contributions to the City and its community; and WHEREAS, Thomas Saba, a beloved fixture of Passaic for more than 35 years, sold ice cream and hot dogs to countless residents and visitors in the area around the Van Houten and Passaic Avenue Train Station, at Third Ward Park; and WHEREAS, Mr. Saba was a familiar face to those who would walk to the ballpark, with his classic 1940's Ford panel truck stationed faithfully above the field, dispensing not only delicious treats but a unique charm and warmth that enriched the city's character; and WHEREAS, Mr. Saba was known for his engaging personality, his joyful rendition of the soda flavors, and his enduring connection with the community, becoming one of the most well-known figures in the City of Passaic; and WHEREAS, Mr. Saba was a decorated veteran of the U.S Army who served his country with honor in 1920-1921, and an active member of St. Anne's R.C. (the “Long Term Tax Exemption Law”), governing payments made to the City in lieu of real estate taxes on the Project pursuant; and WHEREAS, 101 SEVENTH STREET URBAN RENEWAL ,LLC filed an application with the City for approval of a Long Term Tax Exemption for the Project, which is on file with the City Clerk (the “Application”), a copy of which is attached hereto; and WHEREAS, the provisions of the Long Term Tax Exemption Law authorize the City to accept, in lieu of real property taxes, an annual service charge paid by 101 SEVENTH STREET URBAN RENEWAL ,LLC to the City; and WHEREAS, 101 SEVENTH STREET URBAN RENEWAL ,LLC has agreed to make payment of an Annual Service Charge as defined in the Long Term Tax Exemption Law to the City; and WHEREAS, the City Council has determined that the Project represents an undertaking permitted by the Long Term Tax Exemption Law, and has further determined that the Project is an improvement made for the purposes of clearance, replanning, development, or redevelopment of an area in need of redevelopment within the City as authorized by the Long Term Tax Exemption Law; and Page 42 of 45 Passaic City Council Minutes: August 1, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC WHEREAS, the City Council has determined that the Project would not have been constructed without a tax emption; and WHEREAS, the City of Passaic has been designated a Garden State Growth Zone pursuant to the Economic Opportunity Act of 2013 (“EOA”) and possesses all relevant powers and authority pursuant to same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PASSAIC that an exemption from taxation as shall be set forth in the Financial Agreement is hereby granted to 101 SEVENTH STREET URBAN RENEWAL ,LLC, with respect to the Project on the Project Site for the term set forth in the Financial Agreement; provided that in no event shall the tax exemption exceed the earlier of (i) thirty-five (35) years from the date of execution of the Financial Agreement or (ii) to the extent permitted by N.J.S.A. 40A:20-13, thirty (30) years from the Entity’s receipt of a Certificate of Occupancy for the Project or Phase thereof and only so long as the Entity remains subject to and complies with the Financial Agreement and the Long Term Tax Exemption Law and any other agreement related to the Project or the Property; and provided, further that in no event shall the resulting property tax obligation in each year the property tax exemption is in effect, when combined with the Annual Service Charge as defined in the Financial Agreement, be less than the amount of the property tax obligation that would have been due and owing on the Property, after redevelopment, if no property tax exemption were to have been granted; and be it FURTHER ORDAINED that the Mayor and Clerk are hereby authorized and directed to execute the Financial Agreement with 101 SEVENTH STREET URBAN RENEWAL ,LLC, a certified copy of which shall be kept on file in the Office of the City Clerk; and be it FURTHER ORDAINED that the Project shall conform with all Federal and State law and ordinances and regulations of the City relating to its construction and use; and be it Page 43 of 45 Passaic City Council Minutes: August 1, 2023 Approved: PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC FURTHER ORDAINED that 101 SEVENTH STREET URBAN RENEWAL ,LLC shall, from the time the Annual Service Charge becomes effective, pay the Annual Service Charge as set forth in the Financial Agreement; and be it FURTHER ORDAINED that if any section of provision of this ordinance shall be invalid in any court the same shall not affect the other sections or provisions of this ordinance except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof; and be it FURTHER ORDAINED that all ordinances or parts of ordinances inconsistent herewith are hereby repealed as to such inconsistencies only; and be it FURTHER ORDAINED that this Ordinance shall take effect upon final adoption and publication in accordance with law.
