ROLL CALL Colon- Munk Love Melo Schwartz Garcia CP Schaer Montanez X X X X X X X MAYOR’S UPDATE The Mayor delivered a brief update, beginning by commending the City Clerk's office for its efficient management of the recent election process. He highlighted a successful initiative involving over 40 high school students working the election, which contributed to a smooth operation. The Mayor reported record voter turnout, with close to 10,000 individuals voting on Election Day alone, in addition to nine days of early voting, mail-in ballots, and provisional votes. This marked the highest voter turnout in the city's history and demonstrated strong civic participation among residents. He extended congratulations to re-elected and newly elected officials, including President-elect Donald Trump, Vice President-elect JD Vance, Senator-elect Andy Kim, Congresswoman-elect Nellie Pou, Sheriff-elect Thomas Adamo, re-elected Commissioners John Bartlett and Sandi Lazzara, and newly elected Commissioner Rodney De Vore. The Mayor also acknowledged the contributions of Director John Bartlett and Deputy Director Sandi Lazzara. Furthermore, he expressed gratitude to all candidates, emphasizing the value of their participation in the democratic process, regardless of the election outcome. Finally, the Mayor thanked the Business Administrator, David Charles, and the administrative staff for their work on the revised master plan. He noted that the updated plan, which includes contributions from the planning board, will help guide the city’s future development and direction. MASTER PLAN UPDATE BY BUSINESS ADMINISTRATOR The Business Administrator provided an update on the Page 2 of 47 Passaic City Council Minutes: November 7, 2024 Approved: January 21, 2025 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC reexamination of the city’s master plan, a process required every 10 years. The last update occurred in 2013, and this revision took an extensive approach, incorporating significant changes the city has experienced, including the impacts of the COVID-19 pandemic. HEARING OF CITIZENS Council President Schaer opened the public portion of the Meeting with the following statement for the record: In Accordance with the Open Public Meetings Act (N.J.S.A. 10:4-1 et seq.). The Council opens every public meeting for comments of the public. However, in accordance with N.J.S.A. 10:4-12 “nothing in this Act shall be construed to limit the discretion of a public body to permit, prohibit or regulate the active participation at any meeting,” Therefore, the City Council will not entertain any comments from persons who communicate obscene material, make statements which are considered bias intimidation in which any person attempts to intimidate any individual or group because of race, color, religion, handicap, sexual orientation, or ethnicity or makes personally offensive or abusive, defamatory or profane comments, comments intending to harass or speak any offensive or abusive language. The person who makes these statements will relinquish their allotted five minutes for public discussion. Renee Griggs • Renee Griggs expressed concerns over the treatment of homeless individuals in Passaic. • Shared a personal story of helping a homeless woman whose coat was later thrown away. • Proposed installing lockers for the homeless with a registration system for secure storage. • Highlighted broader challenges of homelessness, including mental health and substance abuse. • Urged the council to adopt compassionate, practical solutions to protect the belongings of homeless residents. • Emphasized the need for dignity and respect for all citizens, especially the vulnerabl. The city achieved 44 out of 46.5 possible points, well above the 35-point threshold to maintain state funding. The high score reflects the effective management of city operations, supported by clean audits across all agencies. Minor deductions were attributed to timing delays in budget implementation and financial reporting, which are common for municipalities of similar size. Council members praised the administration’s consistent performance, noting improvements compared to previous years and acknowledging occasional delays due to logistical challenges or state demands. This performance highlights the city's commitment to efficient governance and operational excellence. The limousine or livery service owner shall furnish the City Clerk with evidence of compliance Page 42 of 47 Passaic City Council Minutes: November 7, 2024 Approved: January 21, 2025 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC with this section and that the premium for the full period of the licensing period has been paid. §278-3 ( C), is amended to read as follows: C. In the event that the aforementioned insurance is canceled, the license shall terminate on the date of the cancellation, unless the insurance has been reinstated and a withdrawal of the cancellation or a new policy of insurance has been submitted to the City Clerk within two business days of any change. As a condition of obtaining a license, the license holder agrees to provide the City Clerk with the authority to communicate directly with the limousine license holder's or livery service provider’s insurance companies. SECTION 2 §278-4(C) is amended to read as follows: C. Each limousine licensed by the City of Passaic for use in limousine or livery service shall be required to pay an annual administrative fee of $125 to cover administrative costs, including, but not limited to, City vehicle inspections and limousine law enforcement. §278-14(A) is amended to read as follows: A. No person shall operate a limousine or livery service for hire upon the streets of the City of Passaic and no person who owns or controls a limousine shall permit it to be so driven and no limousine licensed by the City of Passaic shall be so driven at any time for hire unless the driver of said limousine shall have first obtained and shall have then in force the limousine operator's license under the provisions of this chapter. §278-21(B) is amended to read as follows: B. All accidents arising from or in connection with the operation of a limousine registered under this chapter which result in death or injury to any person or in damage to any vehicle or to any property in an amount exceeding $2500.00 shall be reported in writing to the City Clerk within 48 hours from the time of the occurrence. Failure to report said accidents shall be grounds for suspension and/or revocation of the limousine license. §278-27 is amended to read as follows: Every driver of a limousine or livery service vehicle, immediately after the termination of any hiring or employment, must carefully search such vehicle for any property lost or left therein, and any such property, unless sooner claimed or delivered to the owners, must be reported, in writing, by the driver or holder to the City Clerk, with brief particulars and a description of the property, within 24 hours after the finding thereof. SECTION 3 The following sections are amended to remove references to taxicabs and are amended and restated in their entirety as follows: §278-5(A). A limousine shall be the color black or white, and all vehicles used as a limousine shall be of a four- door model. Upon written request, City of Passaic may permit a vehicle smaller than a four-door model or more than four years old to be licensed. Such a request shall only be granted where the vehicle is a classic, antique, vintage or otherwise unusual and rare automobile. Furthermore, such requests shall only be granted where the vehicle in question is capable of safely performing the tasks for which it is licensed. Any limousine which had been licensed and in service prior to that date in excess of four years shall be replaced as follows: [TABLE REMAINS UNCHANGED] §278-21(B). Whenever a limousine licensed under this chapter is out of service for five or more days, the limousine license holder shall report the same in writing to the City Clerk with the reason therefor, the date of decommission, and the expected date of return. Prior to returning the limousine to service, the limousine license holder shall provide the City Clerk with a written letter from a mechanic, on the mechanic's official letterhead, Page 44 of 47 Passaic City Council Minutes: November 7, 2024 Approved: January 21, 2025 PUBLIC MEETING OF THE CITY COUNCIL OF THE CITY OF PASSAIC stating the vehicle is safe for operation as a limousine, and the date the vehicle may return to operation. §278-24(C). Any person found to be guilty of violating any provisions of this section shall be subject to a fine of not less than $1,000 and/or 180 days' imprisonment to be determined by the Municipal Court, and notice of the offense shall be sent to the owner of the limousine license for the first offense; and not less than $1,500 and/or 180 days' imprisonment to be determined by the Municipal Court and notice of the offense shall be sent to the owner of the limousine license for the second offense; and not more than $2,000 and/or one year's imprisonment to be determined by the Municipal Court, and notice of the offense shall be sent to the owner of the limousine license for the third or subsequent offense(s). §278-30. Any person found guilty of violating any of the provisions of this chapter for which no penalties have been specified may, in addition to the suspension or revocation of the license as heretofore provided, be subject to a fine of not less than $1,000 and/or 180 days' imprisonment to be determined by the Municipal Court, and notice of the offense shall be sent to the owner of the limousine license for the first offense; and not less than $1,500 and/or 180 days' imprisonment to be determined by the Municipal Court, and notice of the offense shall be sent to the owner of the limousine license for the second offense; and not more than $2,000 and/or one year's imprisonment to be determined by the Municipal Court, and notice of the offense shall be sent to the owner of the limousine license for the third or subsequent offense(s). SECTION 4 If any section or provision of this ordinance shall be invalid in any court the same shall not affect the other sections or provisions of this ordinance except so far as the section or provision so declared invalid shall be inseparable from the remainder or any portion thereof.
