Parking Authority Minutes: September 16, 2020 THE REGULAR MEETING OF THE PARKING AUTHORITY OF THE CITY OF PASSAIC WAS HELD VIA ZOOM ON SEPTEMBER 16, 2020 AT 7:00 P.M. IN THE COUNCIL CHAMBERS. Amada D. Curling, Secretary read the following notice into record: IN ACCORDANCE WITH THE STATE OF NEW JERSEY, BY GOVERNOR PHILIP MURPHY, REGARDING COVID-19 (“CORONAVIRUS”), CITY HALL COUNCIL CHAMBERS IS CLOSED TO THE PUBLIC; THE RE-ORGANIZATION PARKING AUTHORITY MEETING WILL BE LIVE STREAMED BEGINNING AT 7:00 P.M. On a motion made by Commissioner Ritz and seconded by Commissioner Shpilsky, the following RESOLUTION was adopted. All members voting “AYE” as the roll was called. CITY OF PASSAIC PARKING AUTHORITY RESOLUTION NO. PA 20-09-001 RESOLUTION DESIGNATING COMMISSIONER ADAM BUCKSTEIN, AS CHAIRMAN OF THE CITY OF PASSAIC PARKING AUTHORITY FOR A TERM TO EXPIRE ON JUNE 30, 2021 BE IT RESOLVED, by the Parking Authority of the City of Passaic that the Commissioners designate 1 Parking Authority Minutes: September 16, 2020 Commissioner Buckstein, as the Chairman for a term, said term to commence on July 1, 2020 and to terminate on June 30, 2021. ROLL CALL PRESENT: COMMISSIONER(S) ALLEN, RITZ, SHPILSKY, BUCKSTEIN ABSENT: BALBI, PEREZ --------------------------- NOMINATIONS AND SEATING OF VICE-CHAIRPERSON Commissioner Shpilsky nominated Commissioner Tiffany Allen for Vice- chairperson, no other name on the floor. On a motion made by Commissioner Shpilsky and seconded by Commissioner Ritz, the following RESOLUTION was adopted. All members voting “AYE” as the roll was called. Resolution No. PA20-09-002 RESOLUTION DESIGNATING COMMISSIONER TIFFANY ALLEN, AS VICE- CHAIRMAN OF THE CITY OF PASSAIC PARKING AUTHORITY FOR A TERM TO EXPIRE ON JUNE 30, 2020 BE IT RESOLVED, by the Parking Authority of the City of Passaic that the Commissioners designate Commissioner Tiffany Allen as the Vice-Chairman for a term, said term to commence on July 1, 2020 and to terminate on June 30, 2021. ROLL CALL PRESENT: COMMISSIONER(S) ALLEN, RITZ, SHPILSKY, BUCKSTEIN ABSENT: BALBI, PEREZ At this point Parking Authority Attorney administered the Oath of office to Chairperson Shpilsky and Vice-Chair person Allen ANNUAL RESOLUTIONS: RESOLUTION VOTED BY ONE MOTION: On a motion by Commissioner Ritz and seconded by Commissioner Shpilsky the following Resolutions was adopted. All members voting “AYE” as the roll was called: 2 Parking Authority Minutes: September 16, 2020 Resolution No. PA 20-09-003 RESOLUTION RE-APPOINTING EXECUTIVE DIRECTOR FOR THE PARKING AUTHORITY. WHEREAS, the Parking Authority needs an Executive Director to carry out the policies set by the Commissioners and manage the daily functions of the Parking Authority, and WHEREAS, Ricardo Fernandez, Business Administrator of the City of Passaic and is qualified to perform this function. NOW THEREFORE, BE IT RESOLVED, by the Commissioners of the Parking Authority of the City of Passaic that Ricardo Fernandez is hereby reappointed Executive Director of the Parking Authority with an annual compensation of $15,800. -------------------------------------------- Resolution No. PA 20-09-004 RESOLUTION RE-APPOINTING SECRETARY FOR THE PARKING AUTHORITY WHEREAS, the Parking Authority is required to have a secretary, and WHEREAS, Amada D. Curling, Passaic City Clerk and Registered Municipal Clerk, is qualified to perform this function. NOW THEREFORE, BE IT RESOLVED, the Commissioners of the Parking Authority of the City of Passaic hereby Re-appoints Amada D. Curling Secretary with an annual compensation of $6,700. ------------------------- Resolution No. PA 20-09-005 RESOLUTION RE-APPOINTING CERTIFIED FINANCE OFFICER FOR THE PARKING AUTHORITY WHEREAS, the Parking Authority is required to appoint a Certified Municipal Finance Officer, and WHEREAS, Omar Garcia, Finance Director of the City of Passaic and Certified Municipal Finance Officer, is qualified to perform this function. NOW THEREFORE, BE IT RESOLVED, that the Commissioners of the Parking Authority of the City of Passaic hereby re-appoints Omar Garcia as Certified Municipal Finance Officer of the Parking Authority with an annual compensation of $8,300. -------------------------- Resolution No. PA 20-09-006 RESOLUTION RE-APPOINTING PURCHASING AGENT TO THE CITY OF PASSAIC PARKING AUTHORITY WHEREAS, the Passaic Parking Authority is desirous of re-appointing a Purchasing Agent for the Authority; and, 3 Parking Authority Minutes: September 16, 2020 WHEREAS, the City Council of the City of Passaic, County of Passaic, State of New Jersey has approved Doris Dudek for the position of Purchasing Agent for the City of Passaic; and, WHEREAS, the Board Secretary shall furnish the City of Passaic Finance Department with the appropriate documentation so that they may process a yearly compensation in the amount of Five Thousand Dollars ($5,000.00) for Doris Dudek in her role as Purchasing Agent of the Parking Authority of the City of Passaic; NOW THEREFORE, BE IT RESOLVED, the Commissioners of the Parking Authority of the City of Passaic hereby Re-appoints Doris Dudek, as the Purchasing Agent, with an annual compensation of $5,000. --------------------- Resolution No. PA 20-09-007 RESOLUTION AUTHORIZING OFFICIAL NEWSPAPERS FOR THE FOR THE TERM JULY 1, 2020 TO JUNE 30, 2021 BE IT RESOLVED, by the Parking Authority of the City of Passaic that the Parking Authority hereby designates the North Jersey Herald & New, The Record and Poder Latino USA as Official Newspapers for the Parking Authority, which newspapers are authorized to publish legal advertisements. The Board Secretary shall retain the right to select which newspapers shall receive said advertisements in accordance with the law. ROLL CALL PRESENT: COMMISSIONER(S) ALLEN, RITZ, SHPILSKY, BUCKSTEIN ABSENT: BALBI, PEREZ At this point Parking Authority Attorney administered the Oath of office to the Executive Director, Board Secretary, Chief Finance Officer and Purchasing Agent RESOLUTIONS: THE FOLLOWING RESOLUTION WAS TAKEN OFF THE AGENDA: RESOLUTION AUTHORIZING CLOSED EXECUTIVE SESSION OF THE PASSAIC PARKING AUTHORITY ON SEPTEMBER 16, 2020 AT 7:00 P.M. OR ANYTIME THEREAFTER TO DISCUSS PENDING LITIGATION; CONTRACT NEGOTIATIONS AND PERSONNEL MATTER. ------------------------- On a motion by Commissioner Shpilsky and seconded by Commissioner Buckstein the following Resolutions were adopted. All members voting “AYE” as the roll was called: PASSAIC PARKING AUTHORITY CERTIFICATION OF THE ANNUAL AUDIT 4 Parking Authority Minutes: September 16, 2020 RESOLUTION No._PA20-09-008 WHEREAS, N.J.S.A. 40A:5-4 requires the governing body of every local unit to have made an annual audit of its books, accounts and financial transactions, and 1. WHEREAS, the Annual Report of Audit FOR THE YEAR THRU DECEMBER 31, 2019 AND 2018 (AFFIDAVIT OF AUDIT) has been filed by a Registered Municipal Accountant with the Secretary of the Passaic Parking Authority pursuant to N.J.S.A. 40A:5A-15, and a copy has been received by each member of the governing body; and, WHEREAS, R.S. 52:27BB-34 authorizes the Local Finance Board of the State of New Jersey to prescribe reports pertaining to the local fiscal affairs; and, WHEREAS, the Local Finance Board has promulgated N.J.A.C. 5:31-7.6, a regulation requiring that the governing body shall by resolution certify to the Local Finance Board of the State of New Jersey that all members of the governing body have reviewed, as a minimum, the sections of the annual audit entitled “Comments and Recommendations”, and, WHEREAS, the members of the governing body have personally reviewed as a minimum the Annual Report of Audit, and specifically the sections of the Annual Audit entitled “General Comments and Recommendations”, as evidenced by the group affidavit form of the governing body attached hereto; and, WHEREAS, such resolution of certification shall be adopted by the Governing Body no later than forty-five days after the receipt of the annual audit, pursuant to N.J.A.C. 5:31-7.6; and, WHEREAS, all members of the governing body have received and have familiarized themselves with, at least, the minimum requirements of the Local Finance Board of the State of New Jersey, as stated aforesaid and have subscribed to the affidavit, as provided by the Local Finance Board, and WHEREAS, failure to comply with the regulations of the Local Finance Board of the State of New Jersey may subject the members of the local governing body to the penalty provisions of R.S. 52:27BB-52, to wit: R.S. 52:27BB-52: A local officer or member of a local governing body who, after a date fixed for compliance, fails or refuses to obey an order of the director (Director of Local Government Services), under the provisions of this Article, shall be guilty of a misdemeanor and, upon conviction, may be fined not more than one thousand dollars ($1,000.00) or imprisoned for not more than one year, or both, in addition shall forfeit his office. NOW, THEREFORE BE IT RESOLVED, That the governing body of the Passaic Parking Authority, hereby states that it has complied with N.J.A.C. 5:31-7.6 and does hereby submit a certified copy of this resolution and the required affidavit to said Board to show evidence of said compliance. All members voting “AYE” as the roll was called: 5 Parking Authority Minutes: September 16, 2020 CITY OF PASSAIC PARKING AUTHORITY RESOLUTION# 20-09-009 RESOLUTION AUTHORIZING AMENDMENT OF CONTRACT FOR GENERAL LEGAL COUNSEL PARKING AUTHORITY WHEREAS, on December 19, 2018 the City of Passaic Parking Authority adopted Resolution #18-12-023 (attached) approving a contract with Eric M. Bernstein & Associates, Warren, NJ for General Legal Counsel-Parking Authority (Calendar Year January l,2019-December 31, 2019) in an amount not to exceed$ 5,400.00; and WHEREAS, it is necessary to increase the contract amount by an additional$ 537.50 for a revised total amount of$ 5,937.50 due to additional work concerning MPS implementation. NOW, THEREFORE, BE IT RESOLVED by the members of the Board for Passaic Parking Authority that the contract with Eric M. Bernstein & Associates, Warren NJ for General Legal Counsel - Parking Authority shall be amended to increase the contract amount to$ 5,937.50. BE IT FURTHER RESOLVED that the Chairman of the Parking Authority and Board Secretary are authorized to amend the contract to increase the total amount of this contract per resolution. CERTIFICATION OF FUNDS Funds are available in the Parking Authority Account, #P-19- 55-629-Yl9-021. ROLL CALL PRESENT: COMMISSIONER(S) ALLEN, RITZ, SHPILSKY, BUCKSTEIN ABSENT: BALBI, PEREZ Minutes On a motion by Commissioners Ritz, AND seconded by Vice Chair Allen, the minutes of June 17, 2020 were accepted and approved. All voting “AYE” as the roll was called. ROLL CALL PRESENT: COMMISSIONER(S) ALLEN, RITZ, SHPILSKY, BUCKSTEIN ABSENT: BALBI, PEREZ HEARING OF CITIZENS The public portion was opened: After ample time given and no one responding on a motion by Commissioner Ritz and Chairman Buckstein the Public Portion was closed. 6 Parking Authority Minutes: September 16, 2020 ROLL CALL PRESENT: COMMISSIONER(S) ALLEN, RITZ, SHPILSKY, BUCKSTEIN ABSENT: BALBI, PEREZ DISCUSSIONS: Director Fernandez, conducted a power-point presentation regarding the East Side Redevelopment, “a state of the art open space area in partnership with the County it will be the first Passaic County Park in our city” The Presentation included an overview of all the Redevelopment Projects completed: 2017-2020 COMPLETED PROJECTS 585 Main Avenue 26 Jefferson Street 73-79 Van Winkle Ave 20-22 Broadway 89 South Street 663 Main Avenue 201 Randolph Street 72 Hamilton Avenue 186 Gregory Avenue 90 Dayton Ave (Phase 1) 794 Main Avenue 299 Gregory Avenue 57-65 Ascension Street 13-43 East Monroe Street 228-230 Hope Avenue 308 Sherman Street BILL LIST: On a motion by Commissioner Ritz and seconded by Commissioner Shpilsky, the bills were accepted and approved.
