WHEREAS, the Mayor and Council of the City of Peachtree Corners are charged with the protection of the public health, safety, and welfare of the citizens of Peachtree Corners; and WHEREAS, Chapter 6 (“Alcoholic Beverages”) of The Code of the City of Peachtree Corners, Georgia, currently does not accommodate individuals who want to bring their own unopened bottle of wine or malt beverage into a dining establishment; and WHEREAS, Chapter 6 of The Code of the City of Peachtree Corners, Georgia, currently prevents retail establishments that don’t serve food from allowing the consumption of wine or malt beverages on their premises; and WHEREAS, the Mayor and Council desire to allow individuals to bring their own unopened bottle of wine or malt beverage into dining establishments that have a policy permitting this; and WHEREAS, the Mayor and Council further desire to allow the consumption of wine and malt beverages on the premises of certain types of businesses that are not dining establishments; NOW THEREFORE, the Council of the City of Peachtree Corners hereby ordains, as follows: Section 42: Chapter 6 (“Alcoholic Beverages”) of The Code of the City of Peachtree Corners, Georgia, is hereby amended by adding the following: It is prohibited for any person to bring his own alcoholic beverage into any business establishment without regard to whether such establishment is licensed to serve alcoholic beverages except as follows: (1) Any person dining at a business establishment licensed to sell wine and/or malt beverage for consumption on the premises may bring an unopened bottle of wine and/or malt beverage into said establishment for consumption if the establishment has a policy permitting same. Page 1 of 3 CITY OF PEACHTREE CORNERS COUNTY OF GWINNETT, STATE OF GEORGIA ORDINANCE 2013-12-23 (2) Any person who is a patron of a theater, art gallery, book store, hair salon, nail salon, spa, florist, live music or comedy venue may bring an unopened bottle of wine and/or malt beverage into the establishment for consumption on the premises, provided: (a) the owners or their agents have a policy permitting a patron to bring an unopened bottle of wine and/or malt beverage into the business establishment for consumption on the premises, (b) the establishment is licensed as required hereinafter and; (c) the business establishment does not meet the requirements for an alcoholic beverage license as described in Article II of this chapter. (3) Any wine or malt beverage not consumed at a business establishment, as described in subsections (1) and (2) of this section, shall be disposed of at the premises and not carried out in an open container, except that the business establishment may able to reseal and repackage the opened bottle of wine as required by O.C.G.A. § 3-6-4. (4) A business establishment, as described in subsection (2), shall be required to be licensed by the city and meet all application requirements and be governed by the ordinance provisions as set forth in section 9 of this chapter. Further, no business establishment so licensed shall have any employee under the age of 18 working in the establishment, and the business establishment shall have an established closing time no later than 10:00 p.m. The fee for a business establishment to permit wine and/or malt beverage to be brought into the establishment, as described in subsection (2), shall be in an amount as set by resolution of the city council, which amount shall remain in effect until modified or amended by subsequent resolution adopted by the city council. (5) All applicable state laws and city ordinances which address the use and serving of alcoholic beverages shall apply to this section. (6) For purposes of this section, the term business establishment shall not include a private hotel room or other similar guestroom or a private club. Section 2: Repeal of Conflicting Provisions. All ordinances, parts of ordinances, or regulations in conflict herewith are repealed. Section 3: Severability. Should any court of competent jurisdiction declare any section of this Ordinance invalid or unconstitutional, such declaration shall not affect the validity of the Ordinance as a whole or any part thereof, which is not specifically declared to be invalid or unconstitutional. Section 4: The provisions of this Ordinance shall become and be made a part of The Code of the City of Peachtree Corners, Georgia, and the sections of this Ordinance may be renumbered to accomplish such intention. The grant reimburses landscape projects up to $50,000 and grant funding can only be used for plant material. It cannot be used for signage, lighting, monument features or other similar components of a traditional entryway into a community. There are additional limitations to the grant, as well, such as the prohibition against using grant funding to landscape medians. All together, the grant is fairly limited in scope and funding; however, for the right project, it can provide sufficient enhancement to make a significant impact. Staff believes that Peachtree Corners has such a project, the type of project that the GATEway grant was designed to serve. In assessing possible sites for the use of the grant, Staff started with the 2033 Comprehensive Plan. The Character Areas map identifies six gateways into the City and describes their purpose (see attached). Staff investigated the site conditions at each location to determine where the grant funding, if awarded, would have the greatest impact. Based on the analysis of each site, it was determined that the most beneficial application of landscaping would be around the existing Peachtree Corners monument sign at the convergence of Peachtree Parkway and Peachtree Industrial Boulevard on the southern end of the City. This existing monument sign is well made and in good condition; however, its low profile makes the sign less noticeable than a traditional entryway feature. In this case, the addition of landscaping with vibrant colors would draw attention to the low profile sign. Staff is proposing that Okame Cherry trees, Fringe Trees, and Merlot Redbuds be planted behind the sign to add pink, white, and magenta colors in the Spring. Knockout Roses on the sides of the sign would add a profusion of bright red color at the same height as the sign during the Summer and into the Fall. In addition, new sod would be added in front of the sign and a maintenance plan (required by the grant application) is proposed to ensure the long-term health of all the new landscaping. GATEway Grant Program – Location Map NTS SR 141 Peachtree Industrial Boulevard at Peachtree Parkway FEBRUARY 2014  GATEway Grant Program – Existing Conditions EXISTING PEACHTREE CORNERS MONUMENT SIGN: Pine trees, contours, flumes and storm system to remain. Proposed planting to replace grass area next to sign. The maximum speed limit is 45 MPH. There are no plans to change this intersection. SR 141 Peachtree Industrial Boulevard at Peachtree Parkway FEBRUARY 2014 Site Analysis The site is located in the island just west (to the left) of the north bound fork of Peachtree Parkway (141) and Peachtree Industrial Boulevard (figure 1). At this location, both thoroughfares are limited access and both are nearing their intersections with Holcomb Bridge Road. A 62’ x 6’6” sign structure announcing “Peachtree Corners” is centered on the site (figure 2). The sign is set back approximately 50’ from the north bound and 50’ from the south bound roadway. The sign is oriented towards, and visible only, to north bound traffic. A thicket of mature pine trees is located to the rear of the sign and serves to block it from the view of south bound traffic (figure 3). Adequate area exists behind the sign to plant flowering trees without disturbing any pine trees. Concrete drainage ditches parallel each roadway but do not encroach into the proposed improvement area. Drainage around the existing sign appears to be excellent. However, not all of the City’s services were fully in place throughout the entire year. Code Enforcement, for example, was not fully staffed until August and the City’s new Trash Collection Service had not been fully implemented by year end. Nevertheless, there is now twelve months of data that has been collected and can be used as a base line for today and analyzed over time. Below and on the following two pages is a list of metrics that were used to track the core services that the City provides. Although the list is intended to be comprehensive, it is certainly not exhaustive and additional metrics could be added should additional information be sought.
