Order to approve and authorize the police officers identified on the proposed part-time work schedule for July 2025, which is attached hereto and made a part hereof, the use of the official Pearl Police Department uniform and official Pearl Police Department duty weapon and finding that the proposed employment is not likely to bring disrepute to the City of Pearl, or the Pearl Police Department, the officers at issue, or law enforcement generally, and that the use of the official uniform and weapon in the discharge of the officer’s private security endeavor promotes the public interest of the City of Pearl. approve. 9. Order to approve and authorize the purchase of (1) 2025 Nissan Altima from Gray-Daniels in the amount of $23,849.00 under state contract number 8200077384 and to be paid from Drug Seizure funds. Order to set public hearing on July 15, 2025, at 6:00 p.m. to determine whether or not that certain parcel of real property owned by, Johnnye Seavey Estate and located at 308 Lionel Road, Pearl, Rankin County, Mississippi 39208., is in such a condition or state as to be unsightly and un-kept or otherwise a menace to the public health and safety of the community, and therefore prohibited, pursuant to Chapter 24 of the Code of Ordinances of the City of Pearl, Mississippi and Section 21-19-11 of the Mississippi Code of 1972, as Amended. approve. 13. Order to set public hearing for July 15, 2025 at 6:00 p.m., to determine whether or not a conditional use request should be granted to allow R. Craig Smith to build and operate an enclosed recreational vehicle and boat storage facility at the property located on Parcel#G08M-27 on Highway 80 E. approve. 14. Order to approve and authorize the purchase of a 2021 Dodge Ram 1500 Classic from Enterprise Fleet Management. This is a buyout of a wrecked vehicle. (PW) approve. 15. Order to approve and authorize payment to Clear River Construction Co., Inc., in the amount of $6,894.86 for the Parks & Recreation Construction Project Phase II: City Park Improvements. Order to approve and authorize the replacing and reframing of 42 windows and seal and finish with stucco at the gymnasium at the Pearl City Hall Complex by Denis Henriquez in the amount of $30,000.00. (quotes obtained) approve. 17. Order to adopt a Resolution Appointing Mississippi Municipal League 2025 Voting Delegates for the City of Pearl, MS. Said delegates to be: Voting Delegate: Jake Windham, First Alternate: David Stovall. approve. 18. Order to approve and authorize the exemption from Ad Valorem Taxes for the 2025 tax year for Nissan North America, Inc.,as authorized by Section 27-31-51, et seq., of the Miss. Code of 1972, as Amended. approve. PUBLIC HEARINGS 1. Consider amendment to the language of the Zoning Ordinance. Page 3 of 9 Mayor and Board of Aldermen Meeting Minutes June 17, 2025 Charles Strickland for Spartan Homes appeared with his attorney Nick Giallourakis on behalf of the proposed amendment. Mr. Strickland and Spartan Homes propose to ultimately place a manufactured homes sales lot on property zoned C-2 and spoke to the benefits of said use. City Attorney, Brendan Sartin stated that the requested amendment to the zoning ordinance language is to include “Manufactured home and recreational vehicle sales and service” as a conditional use in the General Commercial District (C-2) under Section 1702. The stated purpose of C-2 the district is “…this district is to promote the development of well-planned shopping centers and independent commercial uses conducted in an enclosed permanent building within selected areas of the City of Pearl. The commercial activities permitted in this district include general neighborhood convenience retail and personal and professional services.” The current zoning ordinance and the previous zoning ordinance (2009) includes the same stated purpose and further states “(u)ses first permitted in C-3 Major Highway Commercial districts shall not be permitted in the C-2 district.” The requested amendment is contrary to the stated purpose of the C-2 district and the proposed amendment use is first permitted in the C-3 district. The City has been in discussions with its Principal Planner with the Central Mississippi Planning and Development District (CMPDD) for several months regarding the updating of the City’s Comprehensive Plan and the City has received the proposal with the intention of updating the Comprehensive Plan this year. The City's Principal Planner with the CMPDD also reiterated “based on the City’s adopted Ordinance, it is interpreted that ‘Manufactured Homes and Recreational Vehicle Sales and Service’ are not allowed by right or by conditional use in a C-2 General Commercial District.” Darren Givens, Pastor at Eastflow Church, spoke in favor of the proposed amendment for it was represented that that Spartan Homes would donate land to Eastflow Church. Shane Brown, a member of Eastflow Church, also spoke in favor of the proposed amendment. Motion was made by Alderman Foy to approved the amendment. There was no second and the motion failed. Motion was made by Alderman Foster and seconded by Alderman Knight to deny the amendment to the language of the zoning ordinance. This Motion carried six to one (Foy) to deny the amendment to the language of the zoning ordinance. Aye: Alderman Stovall, Alderman Williams, Alderman Dennis, Alderman Knight, and Alderman Foster Nay: Alderman Foy 2. Consider the request to rezone 2895 Highway 80 E. from C-2 to C-3. This request was withdrawn. 3. Consider request by Terence Lott for a conditional use permit to allow him to continue the operation of the trampoline park at 422 Riverwind Drive. Terrence and Jennifer Lott appeared on behalf of their request. Community Development Director, recommended approval. Motion was made by Alderman Foy and seconded by Alderman Knight to accept Community Development Director, Brad Robertson's recommendation and approve the request by Terence Lott for a conditional use permit to allow him to continue the operation Page 4 of 9 Mayor and Board of Aldermen Meeting Minutes June 17, 2025 of the trampoline park at 422 Riverwind Drive. The following members of the Board of Alderman voted in favor of the Motion which became the Order of the Board: Aye: Alderman Stovall, Alderman Williams, Alderman Dennis, Alderman Knight, Alderman Foy, and Alderman Foster 4. Consider request by Terry Craft for a variance to build a metal commercial building at 107 Legacy Park Drive. Terry Craft appeared on behalf of his request. Community Development Director, Brad Robertson recommended approval. Motion was made by Alderman Foy and seconded by Alderman Stovall to accept the recommendation of Community Development Director, Brad Robertson and approve the request by Terry Craft for a variance to build a metal commercial building at 107 Legacy Park Drive. The following members of the Board of Alderman voted in favor of the Motion which became the Order of the Board: Aye: Alderman Stovall, Alderman Williams, Alderman Dennis, Alderman Knight, Alderman Foy, and Alderman Foster PUBLIC HEARINGS 21-19-11 Determine whether or not the owners and those certain parcels of real property which are listed herein, are in such a condition or state as to be unsightly and un-kept or otherwise a menace to the public health and safety of the community, and therefore, prohibited, pursuant to Chapter 24 of the Code of Ordinances of the City of Pearl, Mississippi and Section 21-19-11 of the Mississippi Code of 1972, as Amended: 5. Johnie Jenkins Estate and located at 120 Jenkins Quarters, Pearl, Rankin County, Mississippi 39208. Johnie Jenkins Estate was served with notice of the public hearing as required by law. Community Development Director, Brad Robertson informed the Mayor and Board that the property owner had failed to keep the property in a manner to keep it from being an eye sore, unsightly and unkept or otherwise a menace to the public health and safety of the community. No one appeared at the hearing on behalf of the property. WHEREAS, said hearing was held at the time and place mentioned aforesaid, therefore: BE IT ORDERED AND RESOLVED BY THE MAYOR AND BOARD OF ALDERMEN OF THE CITY OF PEARL, MISSISSIPPI THAT: 1) The required notice which was mailed and posted in relation to this hearing is hereby received and recorded and the City Clerk is directed to record said copy in the minutes of these proceedings. 2) The parcel of real property owned by Johnie Jenkins Estate and located at 120 Jenkins Quarters, Pearl, Rankin County, Mississippi 39208, is hereby adjudicated, in its present condition, to be a menace to the public health and safety of the community for the reason that said property is in an unsafe, unsecure, and unclean condition with grass, weeds and other unsightly vegetation growing thereon and with debris present thereon, and said owner(s) has failed to remedy these hazardous, unsafe, unsecure, and unsightly conditions thereon. 3) That the Department of Community Development is hereby directed to post a copy of this Order on the property, and if said owner fails to bring said property into compliance by obtaining the necessary permits and by performing significant progress Page 5 of 9 Mayor and Board of Aldermen Meeting Minutes June 17, 2025 within ten (10) days of the date of this Order, then the Department of Public Works with the aid of the various departments of the City, including the Department of Community Development, to perform one or more or all of the following acts on and to said property to clean said lot and remedy the hazardous, unsafe and unsightly conditions thereon: Cutting grass, weeds, unsightly vegetation, cutting dead trees in danger of falling, filling cisterns, removing rubbish, dilapidated fences, outside toilets, demolishing and removing any dilapidated or unsafe or unsanitary buildings, including the dwelling, and other debris, and draining cesspools and standing water therefrom. 4)That the Director of Community Development is hereby directed to keep a careful and correct accounting of the cost of cleaning and remedying said lot and to report this accounting to the next regular meeting of the Mayor and Board of Aldermen after said property is cleaned and remedied in compliance with this Order. 5)That there should be and hereby is imposed and assessed against the subject property a penalty of One Thousand Five Hundred Dollars ($1,500.00) or fifty percent (50%) of the actual cost, whichever is more, which the City Clerk shall cause to be included in the assessments for municipal ad valorem taxes. 6) This adjudication that the property or parcel of land is in need of cleaning will also authorize the municipality to reenter the property or parcel of land up to six (6) times in any twelve-month period with respect to removing dilapidated buildings, dilapidated fences and outside toilets, and up to twelve (12) times in any twenty-four-month period with respect to cutting grass and weeds and removing rubbish, personal property and other debris on the subject property, without any further hearing if notice is posted on the property or parcel of land and at city hall or another place in the municipality where such notices are generally posted at least seven (7) days before the property or parcel of land is reentered for cleaning. (7) This property shall be brought into compliance within 45 days from this date. Community Development Director, Brad Robertson informed the Mayor and Board that the property owner had failed to keep the property in a manner to keep it from being an eye sore, unsightly and unkept or otherwise a menace to the public health and safety of the community. Community Development Director, Brad Robertson informed the Mayor and Board that the property owner had failed to keep the property in a manner to keep it from being an eye sore, unsightly and unkept or otherwise a menace to the public health and safety of the community. Leon Dye, property manager and Attorney, Marc Brand appeared at the hearing on behalf of the property.
