BOARD OF TRUSTEES February 13, 2023 PRESENT: Mayor Monachino Lapey Trustee Senerchia Trustee Bennett Trustee Owen-Michaane Trustee Cataldi DeLillo Attorney Cornachio Manager Luft PLEDGE OF ALLEGIANCE AND FIRE SAFETY ANNOUNCEMENT Mayor Monachino Lapey led those assembled in the Pledge of Allegiance and notified those in attendance where the fire safety exits were located. ------------ OPENING REMARKS Mayor Monachino Lapey opened the meeting and welcomed everyone. The Mayor said that that this was the first meeting with Lindsey Luft as Village Manager and she and the Board are delighted. She said that all residents should have received our newsletter which is one way we communicate. She said that we’ve gone back to the format that was previously used which is a hard copy format. She said she also does a weekly radio show so that all residents feel included. Trustee Owen-Michaane attended a New York Conference of Mayors conference last weekend. Municipal officials from across the state met in Albany to get a behind the scenes look at Albany. He attended forums and he said it was good to see other elected officials and understand what might happen especially regarding unfunded mandates. The Mayor said that Deputy Mayor DeLillo, Trustee Bennett, the Village Manager and she went to a Westchester Municipal Officials meeting on Emergency Services in Crisis. The Mayor said that this is a very important issue. She said that the Village houses the Fly Car and said that we are committed to First Responders. She said that there are challenges regarding ambulance and EMS. Trustee Cataldi DeLillo said that it is very important to understand that the fly car (which is provided through the Town and housed here in the Village of Pelham Manor) is the primary response and the Town’s ambulance contract provides secondary response when needed. Trustee Bennett said that this is a County-wide issue and people are coming together to deal with the issues. ----------- MINUTES FROM THE REGULAR MEETING ON JANUARY 23, 2023 The Mayor asked if there were any questions, comments or corrections to the minutes. There were no edits to the minutes. Trustee Cataldi DeLillo said that she would abstain from voting because she was not at this meeting. After discussion and upon motion duly made and seconded, it was RESOLVED, that the minutes from the Regular Meeting on January 23, 2023 be and hereby are approved. ----------- 1 REPORTS Fire Commissioner Senerchia discussed the monthly report with Chief Greco. He said it was another busy month. The Chief spoke about car fires. One was for New York City. He said that the Village extinguished the fire for them and they assisted. He said that it was a pretty routine month. There was a compactor fire at Michael’s that extended to the building. It was a prolonged event. Eastchester Fire Department manned the Village’s headquarters. The Fire Commissioner said that there were multiple calls in both Villages. He asked how mutual aid was working. Chief Greco said the Village received three back to back to back calls today and the Village was able to dispatch to all events with no diminution of services. He said that we were able to mitigate all with the resources we had. The Chief said that the new fire apparatus came from Wisconsin and is now in Patterson, New York. It will be delivered on Wednesday at ten o’clock in the morning. Mayor Monachino Lapey said that large scale purchases are planned for without borrowing. They are done in a financially responsible manner. The Mayor and Board thanked Chief Greco for his report. The Village Treasurer reported that the opening cash balance for the month was eleven million two hundred thirty- three thousand two hundred thirty- seven dollars and seventy- two cents and the balance at the close of the month was ten million one hundred ten thousand one hundred fifty-five dollars and fifty-six cents. Revenue receipts for the month totaled one hundred seventy- eight thousand four hundred thirteen dollars and forty- three cents. Non- property tax payments included the rental of real property for twenty-four thousand dollars, and building permits for twenty thousand seventeen dollars and ninety- two cents. The DPW Superintendent said that seventy-six percent of all material collected was recycled. Eight street lights were fixed and five were raised for brightness. Twelve street signs were replaced, potholes were patched and one hundred five trip hazards were attended to. DPW Commissioner Cataldi DeLillo said that she, Lindsey Luft and John Pierpont met with the engineers regarding the storm and sewer program. She said that it is a several pronged approach. Improvements, and sometimes repairs, where opportunities exist, are done first. She said that we will meet again in two weeks. The report will be ready on time for the end of the quarter. The Village Clerk said that it was a pretty steady month. There were thirty- one building permits, eleven notices of violation, sixteen vital statistics forms processed and two Board of Appeals Applications. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Fire, Police and Village Treasurer, DPW and Village Clerk reports be and hereby are adopted. ------------ LOCAL LAW NUMBER 2 OF 2023 Mayor Monachino Lapey said that this proposed Local Law is a new tax exemption for Senior Citizens who qualify. It is new to the Village of Pelham Manor. It is for people who are at least sixty -five years old who meet certain income limitations. This would currently affects ten properties and the impact would be minimal. This legislation has been widely adopted in the County. This is in addition to the Star program. 2 The Mayor said that she thought it was worthy of consideration and a Public Hearing should be set for the next Board meeting on February 27, 2023. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that a Public Hearing on Local Law Number 2 of 2023 be and hereby is Scheduled for Monday, February 27, 2023 at eight-fifteen in the evening. ------------ RESOLUTION TO APPROOVE SIGNAGE FOR OPTIMUM STORE IN PELHAM MANOR SHOPPING PLAZA In Two Thousand Ten, the Tenant Sign Design Criteria was put in place for the Pelham Manor Shopping Plaza and the Post Road Plaza Shopping Center. Signage in these areas must conform to the plan. The company has addressed concerns regarding the correct placement of the sign and illumination. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the signage for the Optimum store be and hereby is approved. ---------- RESOLUTION ON IMA WITH WESTCHESTER COUNTY FOR VOTING MACHINES AND PRIVACY BOOTHS The Mayor said the Village borrows the voting machines from Westchester County for its election in March. She said that the County has resources and we can avail ourselves of them. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Village Manager be and hereby is authorized to sign the Intermunicipal Agreement with Westchester County for the use of voting machines and privacy booths for the March 21, 2023 Village Election. ------------ RESOLUTION AUTHORIZING THE VILLAGE MANAGER TO SIGN OFFER SHEET FOR THE SALE OF A 2004 SEAGRAVE 1500/1000 PUMPER IN THE AMOUNT OF SIXTY-FIVE THOUSAND DOLLARS A municipality from New Hampshire is coming to pick up this piece of equipment. The sale price is sixty-five thousand dollars. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Village Manager be and hereby is authorized to sign the offer sheet for the sale of a 2004 Seagrave Pumper. ------------ SURPLUS EQUIPMENT BID RESULTS Mayor Monachino Lapey said that the surplus items have been put out to bid. Proper procedures have been complied with. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the surplus equipment be and hereby is awarded to the highest bidders. ------------ 3 RESOLUTION AUTHORIZING THE MAYOR TO SIGN ABSTRACT OF VOUCHERS NUMBERS 30861-30931 After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Mayor be and hereby is authorized to sign Vouchers Numbers 30861-30931. ------------- PUBLIC COMMENT The Mayor asked if there was any public comment. There was no public comment. The Mayor wished everyone a Happy Valentine’s Day. ----------- EXECUTIVE SESSION The Mayor said that there were issues regarding an employment matter and a legal matter. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Board be and hereby is authorized to conduct an Executive Session to discuss the following: Personnel Matter – Collective Bargaining Pending Litigation - Save The Sound No action was taken in Executive Session. -------------- RESUMPTION OF REGULAR MEETING MEMORANDUM OF AGREEMEENT After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Memorandum of Agreement between the Village of Pelham Manor and the Uniformed Fire Fighters Association of Pelham Manor be and hereby is approved. ------------ ADJOURNMENT There being no further business to come before the Board, the meeting was adjourned. -------------- Clerk 4
