BOARD OF TRUSTEES March 10, 2025 PRESENT: Mayor Monachino Lapey Trustee Bennett Trustee Owen-Michaane Trustee Case Trustee McLaughlin Attorney Cornachio Manager Luft PLEDGE OF ALLEGIANCE AND FIRE SAFETY ANNOUNCEMENT Mayor Monachino Lapey led those assembled in the Pledge of Allegiance and notified those in attendance where the fire safety exits were located. ----------- OPENING REMARKS Mayor Monachino Lapey opened the meeting and welcomed everyone. Trustee McLaughlin said that the Village is working collaboratively with New York Metropolitan Transportation Council (NYMTC). He spoke about the traffic survey by NYMTC which involves the property in Pelham Manor by Glover Field. He said that it is on the Village’s website and Facebook page. Manager Luft said the survey wants as much information as you can collect. The demographic questions are for a planning effort. The information can be used for grants and could be used for additional points in a grants process. Trustee Case said that last week he attended the annual volunteer firefighters’ dinner. He said that they are going to have a few events this spring and said that they do a great job. Trustee Bennett commented on the lovely weather and said that there will be a bicycle registration event soon. She said that you can also bring your bicycle to the Police Station to get it registered. She said that you do not need an appointment. Mayor Monachino Lapey said that accessibility is key for us. Trustee Owen-Michaane spoke about the DPW report and said that the Village Manager will do a lengthy report later in the meeting. ---------- MEETING MINUTES The Mayor asked if there were any comments or questions. There were no comments or questions on the minutes. After discussion and upon motion duly made and seconded, it was RESOLVED, that the minutes from the Regular meeting on February 24, 2025 be and hereby are approved. ---------- REPORTS Fire Commissioner Case discussed the monthly report with Chief Greco. He said that the month was uncharacteristically quiet. 1 Chief Greco said that one call stands out. Eleven people were stuck in an elevator at Dave& Busters. The Fire Department got them out in three minutes. In addition, there were seventeen safety inspections conducted during the month. Chief Greco said that the volunteers will be holding a flapjack breakfast. The Mayor and Board thanked the Chief for his report. The DPW Superintendent discussed the monthly report. She said that the street sweeper will be here on March 13th and March 14th. She said that they come in the very early hours of the morning so they shouldn’t encounter problems with vehicles parked on the street. She said that beginning this Saturday, March 15th, leaves can be placed loose at the curb. She reported that there were three weather events in February. One event included using the snow plows. The DPW Superintendent reported on the MS4 Permit. She said that some catch basins were rehabbed using the Village’s on call process for using a contractor. It was noted that DPW jet cleaned some stormwater drains. An update was provided for each stormwater watershed. Trustee Owen-Michaane asked who owned Glover Field and was told the School District owns the property. Trustee Owen-Michaane asked if there were multiple lines in Glover Field, not just those belonging to Pelham Manor, and was told yes. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Fire, and DPW reports be and hereby are approved. ---------- CONSIDERATOIN OF A RESOLUTION TO ADOPT LOAL LAW 1 OF 2025 The Mayor said that after the discussion at the Public Hearing she felt comfortable voting on the local law. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that Local Law 1 of 2025 be and hereby is adopted. - - - - - - -- - - - RESOLUTION AUTHORIZING ROUTE 1 RIGHT TURN LANE ONTO PELHAM PARKWAY Manager Luft said that a right turn lane with an arrow from Boston Post Road onto Pelham Parkway has been in the works for some time. She said that the DOT encouraged the Village to move forward with this as a local project. The Village has received half of the cost from Senator Fernandez and Assemblywoman Amy Paulin. She said that the Village will outlay the money and then be reimbursed. The Mayor said that this was a team effort. She said that this is one of the key areas in the Village. She said that school buses cannot make a right turn on red without a turn lane. She said that this will create a better flow of traffic. The Mayor said that that this reflects years of advocacy. RESOLUTION AUTHORIZING Route 1 Right Turn Lane onto Pelham Parkway Authorizing the implementation, and funding in the first instance of the State Multi-Modal Program-aid eligible costs, of a capital project, and appropriating funds therefor. WHEREAS a Project for the Route 1 Right Turn Lane onto Pelham Parkway, P.I.N. 8MA178.30A (the “Project") is eligible for funding under New York State’s Multi-Modal Program administered by the NYS Department of Transportation (NYSDOT); and WHEREAS the Village of Pelham Manor desires to advance the Project by making a commitment of 100% of the costs of work for the Project or portions thereof; and 2  NOW, THEREFORE, the Village of Pelham Manor Board of Trustees, duly convened does hereby RESOLVE, that the Board of Trustees hereby approves the above-subject project; and it is hereby further RESOLVED, that the Board of Trustees hereby authorizes the Village of Pelham Manor to pay in the first instance 100% of the cost of the Project or portions thereof; and it is further RESOLVED, that the sum of $300,000 is hereby appropriated from the General Fund and made available to cover the cost of participation in the above phase(s) of the Project; and it is further RESOLVED, that in the event the costs of the phase(s) exceeds the amount appropriated above, the Board of Trustees of the Village of Pelham Manor shall convene as soon as possible to appropriate said excess amount immediately upon the notification by the Village Manager thereof, and it is further RESOLVED, that the Village Manager of the Village of Pelham Manor be and is hereby authorized to execute all necessary Agreements, certifications or reimbursement requests for Multi- Modal Program Funding on behalf of the Village of Pelham Manor with NYSDOT in connection with the advancement or approval of the Project and providing for the administration of the Project and the municipality's first instance funding of project costs and all Project costs that are not so eligible, and it is further RESOLVED, that a certified copy of this resolution be filed with the New York State Commissioner of Transportation by attaching it to any necessary Agreement in connection with the Project, and it is further RESOLVED, that this Resolution shall take effect immediately. ---------- REQUEST TO USE SHORE PARK Nikki Calamari, 980 Plymouth Street, requested the use of Shore Park on Wednesday, June 4, 2025 from ten o’clock in the morning until one o’clock in the afternoon for the Montessori School of Pelham’s End of Year Picnic. A rain date of Thursday, June 5, 2025, with the same hours, was also requested. After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that Nikki Calamari on behalf of the Montessori School of Pelham, be and hereby is granted permission to use Shore Park on June 4th with a rain date of June 5th for their End of Year Picnic. ---------- RESOLUTION AUTHORIZING THE MAYOR TO SIGN ABSTRACT OF VOUCHER NUMBERS 33342-33374 After discussion and upon motion duly made and seconded, it was RESOLVED, that Vouchers-33342-33374 be and hereby are approved. ---------- PUBLIC COMMENT The Mayor asked if there were any comments or questions from the public. Melissa Eustace, 476 Esplanade, spoke about comments made about natural gas at the February Tenth Board meeting. She spoke about geothermal heating and said that the system installed at Huguenot Memorial Church years ago has not caused any problems. ------------- EXECUTIVE SESSION 3 After discussion and upon motion duly made and seconded, it was RESOLVED, that the Board be and hereby is authorized to conduct an Executive Session to discuss the employment of a particular person (s). No action was taken in Executive Session. ---------- ADJOURNMENT OF MEETING There being no further business to come before the Board, the meeting was adjourned. ---------- Clerk 4  BOARD OF TRUSTEES PUBLIC HEARING March 10, 2025 PRESENT: Mayor Monachino Lapey Trustee Bennett Trustee Owen-Michaane Trustee Case Trustee McLaughlin Attorney Cornachio Manager Luft PUBLIC HEARING ON LOCAL LAW 1 OF 2025 – RETAIL DISTRICT ZONING AMENDMENTS Mayor Monachino Lapey opened the Public Hearing. She said that we’ve been working on this for years. It is a desire to make stores more attractive post-Covid. She asked Manager Luft to give an overview of this proposed law. Manager Luft said that this proposed legislation builds upon uses and clarifies what would be a permitted use in the Retail District. She said that this is a Type II action under SEQR. Trustee Owen-Michaane said that the proposed uses would add to sales tax receipts. He said that this non property tax revenue would be a good thing. --------- PUBLIC COMMENT The Mayor asked if there were any comments or questions on Local Law 1 of 2025. Kate Pringle, 26 Suburban Avenue, commented on the proposed law and mentioned a florist, boutique and toy shop. Trustee McLaughlin spoke about specific prohibitions in the Zoning Code such as Tom Thumb or miniature golf courses. He said that the Code is on the Village’s website. He proceeded to read the current section of permitted uses in the Retail District. The Mayor said that the Village had outside counsel in preparing this law. Manager Luft said that there is a certain level of discretion for personal services. Village Attorney Cornachio said that this in an inclusive list rather than an exclusive list. He thought that it was well thought out on uses. Trustee Case said that this local law is to expand the current uses not to restrict or limit them. Mayor Monachino Lapey said that we are augmenting uses based on interest from the business community. She said that based on further discussion she is ready to take a vote. She said that it is important to expand new opportunities and said that the Board is happy to adjust the law if necessary. ----------- CLOSE THE PUBLIC HEARING After discussion and upon motion duly made and seconded, it was unanimously RESOLVED, that the Public Hearing on proposed Local Law 1 of 2025 be and hereby is closed. ----------- Clerk 5
