BOARD OF APPEALS March 23, 2022 PRESENT: Chairman Gregory Varone Member Kathryn Soderberg Member Michael Tesoro Member Carla Romita Eccleston Manager John T. Pierpont Chairman Varone opened the meeting and introduced the members of the Board. ---------- Manager Pierpont presented the application of Ms. Theresa Balducci, 682 Timpson Street, 163.83-1-4, for a variance to allow an unenclosed off-street parking space nearer than 25 feet to the street line. Chairman Varone recused himself from voting on this matter. John Woodruff, RA appeared before the Board to review the proposed variance. He presented photos of the property showing the previous unlawful parking space that is the subject of this application. A rock located on the site was discussed. The home’s proximity to the Hutchinson River Parkway was discussed. Mr. Woodruff reviewed the variance approval process. The potential for alternative location were discussed. Ms. Balducci rose to thank the Board for considering the proposal. Distinguishing characteristics included Hutchinson River Parkway across the street and ledge rock precludes excavation. No comments The Board reserved decision. ---------- Manager Pierpont presented the application Mr. Brian Mazza & Ms. Chloe Melos, 1251 Pelhamdale Avenue, 167.38-1-36, for a variance to allow the extension of a house with an existing lot area of 8,947.7 square feet where 10,000 square feet are required and for a special permit to allow the addition of a house in excess of 500 square feet. Gaby Tchilinguirian AIA, NCARB, RA appeared to review the proposed addition. The A/C and exterior lighting was reviewed. No comments The Board reserved decision. ---------- Manager Pierpont presented the application of Mr. Kalkin Narvalis & Ms. Nikki Grimm, 449 Wolfs Lane, 163.75-1-26, for a variance to allow the extension of a house with a street setback of 14.22 feet where 20 feet are required, and an existing rear yard of 2.0 feet where 10 feet are required. Danielle DeVito, RA rose to explain the proposed addition. Scope lighting on the exterior was reviewed. No additional A/C is proposed. No comments The Board reserved decision. ---------- The Board considered the application of Ms. Theresa Balducci, 682 Timpson Street, 163.83-1-4, for a variance to allow an unenclosed off-street parking space nearer than 25 feet to the street line. After discussion, and upon motion duly made and seconded, it was unanimously resolved that WHEREAS, there are special circumstances and conditions applying to this building and land which do not apply generally to the land and buildings in the neighborhood and have not resulted from any act of the applicant subsequent to the adoption of the regulations appealed; and WHEREAS, the circumstances and conditions are such that the particular applications of the conditions of the zoning ordinance would deprive the applicant of the reasonable use of the land and building; and WHEREAS, the granting of the variance sought will be in harmony with the general purpose and intent of the zoning ordinance and will not be injurious to the neighborhood or otherwise detrimental to the public welfare, and NOW THEREFORE BE IT RESOLVED, That the application of Ms. Theresa Balducci, 682 Timpson Street, 163.83-1-4, for a variance to allow an unenclosed off-street parking space nearer than 25 feet to the street line, be and hereby is granted - - - - - - - - - - -- The Board considered the application of Mr. Brian Mazza & Ms. Chloe Melos, 1251 Pelhamdale Avenue, 167.38-1-36, for a variance to allow the extension of a house with an existing lot area of 8,947.7 square feet where 10,000 square feet are required and for a special permit to allow the addition of a house in excess of 500 square feet.
