Adjournment to Executive Session Approved Next Regularly Scheduled BOT Meetings: Tuesday, April 19, 2016 (Note: Continuation of Public Hearings and FY 2016-17 Budget Adoption) Tuesday, May 3, 2016 All meetings start at 8:00 p.m. unless otherwise noted. *The Agenda is subject to change.* Board of Trustees Regular Meeting Monday, April 4, 2016 Item # 1 – Meeting called to order: The meeting of the Board of Trustees was called to order by Mayor Volpe at 8:40 p.m. following the Annual Organizational Meeting which started at 8:15 p.m. Item # 2 – Pledge of Allegiance: The Pledge of Allegiance was led by Mayor Volpe. Item # 3 - Roll Call Present were Trustees Cassidy, Ferrara, Kagan, Mutti, Reim and Reinke. Also present were Village Administrator Yamuder and Assistant to the Village Administrator Scelza. Mayor’s Report: Mayor Volpe stated the Junior League of Pelham celebrated its 75 th Anniversary this past week. The Junior League has assisted the Village by funding various projects throughout the community and he thanked them for all they do for the Pelham community. Mayor Volpe commented on a recent motor vehicle accident that occurred at the intersection of Colonial and Corlies Avenues involving a child being struck by a vehicle and sustaining a broken leg. The investigation into the accident is on-going and being headed by the Pelham Police Department, due to Colonial Avenue being in the jurisdiction of the Village of Pelham. Mayor Volpe mentioned a meeting has been scheduled with representatives from the School District, Village of Pelham and Village of Pelham Manor to discuss possible traffic calming measures. Trustees’ Report: Trustee Cassidy had nothing to report. ******** Trustee Ferrara thanked the Junior League of Pelham for their generosity and support and also mentioned they were willing to pay for an additional piece of play equipment at Woodland Park. She will report back to the Board at the next meeting. ******** Page 2 Board of Trustees Regular Meeting Monday, April 4, 2016 Trustee Kagan reported that the Village signed a settlement agreement with Cablevision regarding their merger with Altice. As part of the settlement agreement the Village received a check for $35,000 which includes a grant for the purchase of media equipment in Village Hall and past due DVR fees owed to the Village. He also mentioned the Village is one of nineteen communities in Westchester that worked with a group called Sustainable Westchester to bid the supply part of residents electric bills which would produce savings. Effective May 1st unless you opt out, the Village has chosen the Green Power Supply. A letter from Sustainable Westchester has been mailed to all residents explaining the Community Choice Aggregation Energy Program. ******** Trustee Mutti thanked the Department of Public Works for doing a great job preparing the parks for the upcoming season. She also mentioned the NYW&B Property after five years has finally been listed on the New York State Register for Historic Places. The Village is now in a position to look for grant opportunities to improve the space. ******** Trustee Reim congratulated the Junior League of Pelham on their 75th Anniversary and thanked all the voters who voted in the recent Village Elections. ******** Trustee Reinke had nothing to report. Page 3 Board of Trustees Regular Meeting Monday, April 4, 2016 Non-Recurring Items Item # 7 – Annual Organizational Meeting Resolutions and Mayor’s Committee Appointments A motion was made by Trustee Cassidy and seconded by Trustee Ferrara to open the organizational meeting at 8:15 p.m. The vote was approved by a vote of seven in favor, none opposed. Swearing in of Elected Officials by Judge DeChiaro Judge DeChiaro administered the oath of office to Adam Kagan who was elected Village Trustee on March 15, 2016; Judge DeChiaro administered the oath of office to Christopher Reim who was elected Village Trustee on March 15, 2016; and Judge DeChiaro administered the oath of office to Andrea Reinke who was elected Village Trustee on March 15, 2016. Note: Appointments by the Mayor of Village officials and staff, and appointments by the Mayor to Land Use Boards, require Board approval. ANNUAL ORGANIZATIONAL MEETING RESOLUTIONS 2016-17 RESOLUTIONS OF APPOINTMENT OF THE FOLLOWING OFFICIALS 1. Be it resolved, that Trustee Susan Mutti is appointed by the Mayor as Deputy Mayor and while so acting is vested with all of the powers and shall perform all of the duties of Mayor pursuant to Village Law § 4-400; in the event Mayor Volpe and Deputy Mayor Mutti are unavailable due to absence or disability pursuant to Village Law § 4-400 (2), Trustee Adam Kagan shall serve as Mayor and while so acting shall be vested with all of the powers and shall perform all of the duties of Mayor. Yamuder, of Hawthorne, NY, is hereby re-appointed as Village Administrator, Second Deputy Village Clerk, and re-appointed as Second Deputy Registrar of Vital Statistics. Yamuder, of Hawthorne, NY, is hereby re-appointed as Village Treasurer pursuant to Village Law § 3-301 (3). Be it resolved, that John Nesi, Receiver of Taxes for the Town of Pelham, is hereby re-appointed as Receiver of Taxes for the Village of Pelham. Be it resolved, that the First (1st) and Third (3rd) Tuesdays of every month are hereby designated as the Regularly Scheduled meeting nights of the Village of Pelham Board of Trustees (meetings will begin at 8:00 p.m.), except as the schedule may be otherwise amended from time to time. Motion by: Trustee Reim Seconded by: Trustee Ferrara Vote: 7-0 DESIGNATION OF OFFICIAL DEPOSITORY OF FUNDS Be it resolved, that pursuant to Village Law § 4-412 (3)(2) that JP Morgan Chase Bank, N.A., HSBC Bank USA, N.A. and Sterling National Bank are hereby designated as depositories for the Village of Pelham respecting various accounts the Village of Pelham maintains in the ordinary course of its business. Motion by: Trustee Mutti Seconded by: Trustee Kagan Vote: 7-0 DESIGNATION OF OFFICIAL VILLAGE NEWSPAPER Be it resolved, that the Journal News is hereby designated as the official newspaper of the Village of Pelham for the ensuing official year. Motion by: Trustee Mutti Seconded by: Trustee Ferrara Vote: 7-0 LAND USE BOARD APPOINTMENTS Mayor Volpe stated this item is tabled and will be taken up in the coming months. For those members whose terms have expired, they will continue to serve until further notice. Page 6 Board of Trustees Regular Meeting Monday, April 4, 2016 VILLAGE TRUSTEE LIAISON APPOINTMENTS Note: Trustee Liaison and Committee Appointments by the Mayor do not require Board action for advice and consent by the Board, but are included here to be entered into the minutes. Mayor Michael Volpe shall preside as required by New York State Law over collective bargaining negotiations and shall be assigned responsibility, in addition to all legal responsibilities assigned to Mayor, serve as Liaison for Downtown Development and Zoning Issues. Deputy Mayor Susan Mutti is appointed by the Mayor to serve as: → Public Works Department Liaison; → Community Liaison for Parks and Open Spaces; → Liaison for MTA/Metro North; → Chairperson of Village Tree Committee. Trustee Timothy Cassidy is appointed by the Mayor to serve as: → Liaison for Budgeting and Financial Planning. Trustee Xaira Ferrara is appointed by the Mayor to serve as: → Police Department Liaison; → Liaison for Village Communications; → Liaison to the Chamber of Commerce; → Liaison to the Office Staff and Employee Relations. Trustee Adam Kagan is appointed by the Mayor to serve as: → Liaison to Suez (formerly United Water); → Liaison for Public Contracting, Telecommunications and Code Changes; → Community Liaison for Sanitation Services; → Liaison for Collective Bargaining. Trustee Christopher Reim is appointed by the Mayor to serve as: → Fire Department Liaison; → Liaison for Shared Services; → Capital Projects Planning. Trustee Andrea Reinke is appointed by the Mayor to serve as: → Community Liaison for Parking Issues; → Community Liaison for Environmental Issues and Liaison to EcoPel; → Community Liaison for Flooding Issues; → Liaison to the Building Department and Land Use Boards. A motion was then made by Trustee Cassidy and seconded by Trustee Reim to close the organizational meeting at 8:40 p.m. The vote was approved by a vote of seven in favor, none opposed. Page 7 Board of Trustees Regular Meeting Monday, April 4, 2016 Item # 8 – Public Hearing on Proposed Local Law No. 1 of 2016 to Exceed Tax Cap, if Necessary A motion was made by Trustee Cassidy and seconded by Trustee Reinke to open the Public Hearing on a proposed local law to override the tax cap, if necessary. The vote was approved by a vote of seven in favor, none opposed. Mayor Volpe explained that this is just a precaution, and if the Board needed to override the tax cap a Local Law is required to do so and this gives the Village that safety net. The Board has every intention of making cuts necessary to come in at or under the tax-cap. As there were no comments the Board kept the Public Hearing open until April 19th. Page 8 Board of Trustees Regular Meeting Monday, April 4, 2016 Item # 9 – Public Hearing on the Proposed Preliminary Budget for Fiscal Year 2016-17 A motion was made by Trustee Kagan and seconded by Trustee Cassidy to open the Public Hearing on the Preliminary Budget for Fiscal Year 2016-17. The vote was approved by a vote of seven in favor, none opposed. The Mayor and Board discussed at length numerous additional cost saving ideas, however no actions were taken. As there were no comments the Board kept the Public Hearing open until April 19th. Page 9 Board of Trustees Regular Meeting Monday, April 4, 2016 Item # 10 – Authorizing the Promotion of a Police Officer to the Position of Police Sergeant in the Village of Pelham Police Department ( 1 of 2) A motion was made by Trustee Kagan and seconded by Trustee Ferrara to approve the resolution. The vote was approved by a vote of seven in favor, none opposed. Resolution Authorizing the Promotion of a Police Officer to the Position of Police Sergeant in the Village of Pelham Police Department Be it resolved, that the Board of Trustees of the Village of Pelham hereby authorizes the promotion and appointment by the Mayor of Danny Green of Pelham, NY to the position of Police Sergeant, from Civil Service Eligible List # 72-847, effective Monday, April 18, 2016 at an annual salary of $114,110.00 subject to the requirements of Westchester County Civil Service, for a probationary period of one (1) year; and Be it further resolved, that the Mayor, Village Administrator and Chief of Police are authorized to take the necessary and appropriate actions to effect this appointment. Page 10 Board of Trustees Regular Meeting Monday, April 4, 2016 Item # 11 – Authorizing the Promotion of a Police Officer to the Position of Police Sergeant in the Village of Pelham Police Department (2 of 2) A motion was made by Trustee Mutti and seconded by Trustee Ferrara to approve the resolution. The vote was approved by a vote of seven in favor, none opposed. Resolution Authorizing the Promotion of a Police Officer to the Position of Police Sergeant in the Village of Pelham Police Department Be it resolved, that the Board of Trustees of the Village of Pelham hereby authorizes the promotion and appointment by the Mayor of Ryan Carden of Pelham, NY to the position of Police Sergeant, from Civil Service Eligible List # 72-847, effective Monday, April 18, 2016 at an annual salary of $114,110.00 subject to the requirements of Westchester County Civil Service, for a probationary period of one (1) year; and Be it further resolved, that the Mayor, Village Administrator and Chief of Police are authorized to take the necessary and appropriate actions to effect this appointment. Page 11 Board of Trustees Regular Meeting Monday, April 4, 2016 Item # 12 – Presentation by Representatives from Zip Car This item was not discussed as representatives from Zipcar were not in attendance. Page 12 Board of Trustees Regular Meeting Monday, April 4, 2016 Item # 13 – Other Business – Worker’s Compensation Coverage R.J. Impastato of FOA and Son Corporation discussed with the Board the proposed increase to the Village’s Worker’s Compensation Premium for the July renewal. For the past three years, the Village has been working with PERMA who are estimating a 50% increase in premium due to PERMA paying out more in claims then premiums paid by the Village. The Board and R.J. had a lengthy discussion. Page 13 Board of Trustees Regular Meeting Monday, April 4, 2016 Recurring Items Item # 14 - Authorizing the Accounts Payable Trustee Cassidy audited the Accounts Payable. After a brief discussion, a motion was then made by Trustee Mutti and seconded by Trustee Ferrara to approve the resolution. The vote was approved by a vote of seven in favor, none opposed. Resolution Authorizing the Accounts Payable Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village. Now, therefore, be it resolved, that the Board of Trustees after audit of the following claims, authorizes payment for services rendered and materials received, for the following items that have been submitted to the Treasurer's Office for payment and authorized by the Village Administrator: Fund Name: Amount General Fund $312,795.01 Water Fund $0.00 Capital Projects Fund $0.00 Trust and Agency Fund $2,483.00 TE Expand Trust Fund $0.00 Grand Total $315,278.01 Be it further resolved, that this Board hereby approves payment of the above mentioned claims and authorizes payment thereof. Item # 16 – Adjournment to Executive Session A motion was made by Trustee Cassidy and seconded by Trustee Ferrara to adjourn the public portion of the Board meeting at 9:45 pm and go into Executive Session to discuss one pending litigation against the Village after which time the Board would adjourn for the evening.
