Item # 3 – Roll Call: Present were Trustees Kagan, Ferrara, Reinke, and Spira-Cohen. Trustee Mullen was present via Skype. Trustee Reim was absent. Also present were Village Administrator Yamuder and Assistant to the Village Administrator Scelza. Mayor’s Report: Mayor Volpe urged the residents present in the meeting to go vote on the Board of Education elections taking place that evening. Mayor Volpe encouraged residents to attend the Wolfs Lane Park opening on Friday, May 19th at 4pm across from Rockwells; he thanked Senator Klein, Klein’s staff, and Former Deputy Mayor/ Former Trustee Susan Mutti for their contributions to the Wolfs Lane Park project. Mayor Volpe reported that the issues at 30 Linden will be addressed this week, so please contact him or the Village Administrator with any further questions regarding this property. Mayor Volpe has been in contact with Mayor Thomas of Mount Vernon concerning the noise emanating from recent concerts at Memorial Field, and at this point the Village does not need to worry, but the Village will continue to monitor the situation to determine its potential impact on the community. Mayor Volpe is supportive of Mount Vernon improving itself and applauds the efforts of Mayor Thomas to revitalize his community. Mayor Volpe attended the opening of Inspo Boutique and encourages people to patronize the store. Mayor Volpe invited everyone in the community to attend the Memorial Day Parade, and the kick off will begin at 11:30 am. Page 2 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Lastly, the Mayor would like to thank Rob Yamuder for his excellent service all these years, he wishes him well at Mamaroneck and assures the Village that Mr. Yamuder will available during the transition period. Trustees’ Report: Trustee Ferrara thanked the Pelham Preservation Society for their flower basket donation. She wanted to notify the residents of the Con-Edison project to replace the poles and wiring between Lincoln Avenue and Harmon Avenue; Michael Shriman amended the Con Edison project, so the wires are positioned under the highline to minimize the danger. Trustee Ferrara along with Trustees Mullen and Spira-Cohen met as members of the Parks committee and outlined their goals, which is now available on the website. ******** Trustee Kagan reported that he and Mayor Volpe met with concerned Pelhamdale residents to discuss their concerns about dangerous traffic conditions occurring in the morning northbound near the train station. They will monitor the situation and consider possible solutions, but enforcement will be issuing tickets. Trustee Kagan and Mayor Volpe met with the Chief of Police and Lieutenant to understand what goes into building a schedule for shifts. He said Suez will be conducting a hydrant flush starting on Monday, May 22nd for a three week period, so water will still be drinkable but if the water turns brown just run it until it turns clear. ******** Trustee Mullen would like to congratulate the Inspo Boutique on their grand opening this past weekend, and encourages people to visit the store. He reviewed the Village’s communication tools with the Assistant to the Village Administrator Chris Scelza, and they both agreed that the notification system needs to be updated. Trustee Mullen thanked the Fire Chief, James DiNapoli for a great informational session and the tour of the fire house. He would like to wish Rob Yamuder well in his future endeavors. ******** Trustee Reinke reported that the Nurses Network of America will be hosting a color run event on Sunday, May 21st at 10am. ******** Trustee Spira-Cohen has been gathering information on the LED lighting conversion process for the street lights, and passed along the information to the Board for review. She urges residents to get involved with the Committees and to check the website for additional information. Page 3 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Village Administrator’s Report: Village Administrator Yamuder said it was a pleasure to serve the Village of Pelham and to work with dedicated staff during his tenure. Item # 7 – Public Comments Dominique Shuminova,21 Fifth Avenue, expressed concerns about the status of the Wolfs Lane Park project. She read a statement regarding the redesign of Wolfs Lane Park and the lack of transparency during the process. Shuminova presented Mayor Volpe and the Board with a petition of 123 signatures imploring the Village to adopt a resolution on immigration. Marilyn Zelinski, 60 1st Street, she commended the Mayor and the Board’s ability to produce and disseminate immigration related information to the community. Ms. Zelinski said it is the responsibility of each resident to inform his or herself on developments in the community. Mayor Volpe in response to Ms. Shuminova’s comments on the lack of transparency in the park design process, said that the Board was aggressive in their outreach efforts, and former Trustee/ former Deputy Mayor Mutti met with many community organizations. Again, Mayor Volpe would like to thank Senator Klein for the Wolfs Lane Park redevelopment. Page 4 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Non-Recurring Items Item # 8 – Authorizing the Appointment of a Fire Chief Resolution Authorizing the Appointment of a Fire Chief Be it resolved, that the Board of Trustees of the Village of Pelham hereby confirms the appointment by the Mayor of James A. DiNapoli formally of Yonkers, NY to the position of Fire Chief from Civil Service Eligible List # 76-816, effective Tuesday, May 16, 2017 at an annual salary of $137,500.00 subject to the requirements of Westchester County Civil Service and for a probationary period of six (6) months; and Be it further resolved, that the Mayor and Village Administrator are authorized to take the necessary and appropriate actions to effect this appointment. Motion by: Trustee Mullen Seconded by: Trustee Ferrara Vote: 6-0 Page 5 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 9 – Public Hearing on a Local Law to Repeal Local Law No. 1 of 2017 and to Repeal the Override of the Tax Levy Limit Established in General Municipal Law §3-c A motion was made by Trustee Reinke and seconded by Trustee Ferrara to open the Public Hearing on a proposed local law to override the tax cap, if necessary. The vote was approved by a vote of six in favor, none opposed. Mayor Volpe explained that this is just a precaution, and if the Board needed to override the tax cap a Local Law is required to do so and this gives the Village that option. The Board has every intention of making cuts necessary to come in at or under the tax-cap. As there were no public comments the Board closed the Public Hearing with a motion made by Trustee Kagan and seconded by Trustee Ferrara. Page 6 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 10 – Adopting Local Law No. 4 of 2017 to Repeal Local Law No. 1 of 2017 and to Repeal the Override of the Tax Levy Limit Established in General Municipal Law §3-c Resolution Adopting Local Law No. 4 of 2017 to Repeal Local Law No. 1 of 2017 and to Repeal the Override of the Real Property Tax Levy Limit Established in General Municipal Law §3-c Whereas, the Board of Trustees of the Village of Pelham has proposed a local law to repeal Local Law No. 1 of 2017 and to repeal the override of the real property tax levy limit established in General Municipal Law §3-c for the fiscal year commencing June 1, 2017 – May 31, 2018; and Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the local law is a Type II Action and are therefore not subject to the requirements of the State Environmental Quality Review Act (“SEQRA”) and; Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper of the Village of Pelham; and Whereas, said public hearing was held on May 16, 2017 at or about 8:00 p.m. at Village Hall, 195 Sparks Avenue, Pelham, NY and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said to proposed local law or any part thereof. Now, therefore, be it resolved, as follows: 1. The Board of Trustees hereby adopts Local Law No. 4 of 2017 to repeal Local Law No. 1 of 2017 and to repeal the override of the real property tax levy limit established in General Municipal Law §3-c for the fiscal year commencing June 1, 2017 – May 31, 2018; 2. The Board of Trustees directs the Village Clerk and Village Administrator to prepare said Law for filing with the Secretary of State. Motion by: Trustee Reinke Seconded by: Trustee Spira-Cohen Vote: 6-0 Page 7 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 11 - Authorizing the Award of Insurance Coverage through FOA and Son Insurance Corp. for Property and Casualty Insurance Coverage (Property including Crime, General and Law Enforcement Liability, Public Officials and Employment Practices Liability, Automobile Liability and Physical Damage, and Excess Liability for the Period of June 1, 2017 through May 31, 2018 R.J. Impastato reviewed the 2017-18 Property/Casualty Insurance Renewal Report with the Board. Mr. Impastato recommended that the Village move forward with Traveler’s Insurance at a 4% increase over the incumbent, but this does not include a cyber liability policy, so Mayor Volpe asked Mr. Impastato for quotes. Resolution Authorizing the Award of Insurance Coverage through FOA and Son Insurance Corp. for Property and Casualty Insurance Coverage (Property including Crime, General and Law Enforcement Liability, Public Officials and Employment Practices Liability, Automobile Liability and Physical Damage, and Excess Liability) Whereas, the Village of Pelham is renewing Property and Casualty Insurance to provide coverage for the Village of Pelham. Property and Casualty Insurance covers: Property Including Crime; General and Law Enforcement Liability; Public Officials and Employment Practices Liability; Automobile Liability and Physical Damage; and Excess Liability; and Whereas, the Village Administrator recommends renewing the Property and Casualty insurance package to Travelers Insurance Company. Now, therefore, be it resolved, that the Village authorizes retention of Insurance through FOA and Son Insurance Corp., with Property and Casualty through Travelers Insurance Company and ACE Insurance Company and American Alternative Insurance Company, to provide umbrella liability coverage, at a total cost of One Hundred Ninety-Four Thousand Four Hundred Twenty-Six dollars ($194,426.00), not including applicable taxes, as detailed in the proposal received May 12, 2017; and Be it further resolved, that the Mayor and Village Administrator are authorized to take the necessary and appropriate actions to retain coverage for the Property and Casualty Insurance to be effective June 1, 2017 through May 31, 2018. Motion by: Trustee Ferrara Seconded by: Trustee Mullen Vote: 6-0 Page 8 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 12 - Authorizing the Award of Workers’ Compensation Insurance Coverage for the Period of June 1, 2017 through May 31, 2018 Mr. Impastato expects continued savings on Workers’ Compensation Insurance Coverage because the 2013 year will soon be eliminated from the record, which will give the Village an improved claims history. Resolution Authorizing the Award of Workers’ Compensation Insurance Coverage for the Period of June 1, 2017 through May 31, 2018 Whereas, the Village of Pelham (“Village”) has been seeking Worker’s Compensation Insurance proposals to provide coverage to the Village for the period of June 1, 2017 through May 31, 2018; and Whereas, the Village sought to obtain Worker’s Compensation Insurance proposals through FOA and Son Insurance Corp. from PERMA, New York State Insurance Fund and New York State Workers’ Compensation Alliance submitted as follows: Insurance Carrier Quote New York State Workers’ Compensation Alliance $447,774.00 New York State Insurance Fund $492,898.00 PERMA $525,000.00 Whereas, based on our review of the proposals and other pertinent factors, the Village recommends awarding the Worker’s Compensation Insurance package to New York State Workers’ Compensation Alliance. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby awards Worker’s Compensation Insurance Coverage for the period of June 1, 2017 through May 31, 2018 to New York State Workers’ Compensation Alliance at a total cost of $447,774.00; and Be it further resolved, that the Mayor and Village Administrator are authorized to take the necessary and appropriate actions to effectuate the intent of this resolution. Motion by: Trustee Kagan Seconded by: Trustee Ferrara Vote: 6-0 Page 9 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 13 – Discussion on Immigration Related Issues Mayor Volpe received a letter from a resident who is an attorney at Kasowitz, Benson, and Torres LLP that advised the Board not to pass the resolution on Immigration because it would restrict the Mayor’s statutory power to manage the police, but Mayor Volpe will research this matter further. John Cassone, 312 7th Avenue, stated that our police department is here to protect us, and we should follow in the steps of other municipalities. Elizabeth Massie, 44 8th Avenue, spoke in support of the Board adopting this resolution and that Pelham should follow the example of other villages. Paula Wood, 62 Clifford Avenue, spoke in support of the Board adopting this resolution because the Village of Pelham is a welcoming place, so diversity is a selling point. We should not expand the role of the police and takes cues from our New York City neighbors. Heather Glickman-Eliezer, 261 Highbrook Avenue, spoke in support of the Board adopting this resolution because people should be able to approach the police without fear. Josh Wallach, 62 Clifford Avenue, spoke in support of the Board adopting this resolution because the police should not take on the responsibilities of the federal government. Roger Sadler, 55 Willow Avenue, had a couple of remarks about the video from the May 2nd Board of Trustees meeting, specifically the individuals who claimed to be “unaware” of the immigration issue because a statement regarding this issue was introduced in February. He wanted to echo a sentiment from earlier this evening, that with rights comes responsibilities, so residents have an obligation to stay informed on issues in their community. Mr. Sadler was disappointed to hear that some individuals are threatening legal action instead of engaging in a public discussion. He was further displeased at the disruptive behavior of some individuals during the May 2 nd meeting, and he strongly urges the passage of the resolution. Jessica Jaffe, 129 3rd Avenue, spoke in support of the Board adopting this resolution because the police should not enforce racially based policy. Mike Klieman, 54 Young Avenue, supports the passage of resolution because it is not the responsibility of the police to enforce federal laws. Charles Meyer, 171 Harmon Avenue, voiced his opposition to the resolution because it is not warranted in the community. Amy Rios, 105 5th Avenue, supports the passage of the resolution. Page 10 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Eldar Shuminova, 21 5th Avenue, supports the passage of the resolution because it is a matter of public safety. Charlie Stern, 3rd Avenue, spoke in support of the Board adopting this resolution, and urges the Board to expeditiously move onto other business in the Village. Greg Shunick, 60 1st Street, spoke in support of the Board adopting this resolution because it does not negatively impact the Village, and it will depict the Village as an inclusive and diverse community. Mayor Volpe said that he and Deputy Mayor Kagan met with the Police Chief, Lieutenant, and Sergeants to get their input on this matter. Mayor Volpe assured the community that police resources have not been misused, and the Pelham police have never inquired about an individual’s immigration status. Mayor Volpe said the Board needs further information to move forward, so Board will not vote on the resolution tonight. Mayor Volpe said the Police do not feel that the resolution is necessary, but the Board has asked them to review the resolution and the Attorney General’s guidelines. Trustee Spira-Cohen said this issue was discussed during the Board of Trustees election cycle, and she ran on this issue with public support. Trustee Mullen wanted to clarify that this is not a critique of current policing practices, but rather the recognition that the political climate has changed; as a result it is reasonable to assume that the executive order released will increase activity regarding immigration. This resolution seeks to hold the police accountable to the people they serve, and to strike a balance between the police and citizen concerns. Trustee Ferrara said it is great to see people engaged and passionate about the resolution. Trustee Kagan has reviewed police procedures, researched information on permissive and mandatory referendums, and has met with individuals all in service of this resolution. He agrees with Trustee Mullen that the Board does set policy, but it is not their role to direct police policy or procedure. He wants to encourage people to come back and discuss this issue further, and that this resolution is an opportunity for the Village to lead. Trustee Reinke said that the political climate is changing, so it is necessary for the police to know what is expected of them in this new environment. Page 11 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 14 - Authorizing Warrant Processing on May 31, 2017 Resolution Authorizing Warrant Processing on May 31, 2017 Be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes warrant processing on May 31, 2017 to facilitate the timely payment of bills due to the month of May 2017 having five Tuesdays and only two regularly scheduled Board of Trustees Meetings; and Be it further resolved, that a Board member will be scheduled to audit the invoices and copies of the voucher detail report will be distributed to all Board members prior to payment; and Be it further resolved, that the Mayor and the Board of Trustees of the Village of Pelham hereby approves payment of the above mentioned claims. Motion by: Trustee Reinke Seconded by: Trustee Ferrara Vote: 6-0 Page 12 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 15 - Authorizing Payroll Processing Agreement with Paylocity Corporation Resolution Authorizing Payroll Processing Agreement with Paylocity Corporation Whereas, ADP, LLC, has been providing payroll services to the Village of Pelham (“Village”); and Whereas, Paylocity Corporation has provided the Village a quote in the amount of $9,832.00 annually based on 84 employees; and Whereas, said quote provides additional services above and beyond what the Village is currently receiving from ADP, LLC; and Whereas, the Village Administrator and Village Staff have recommended that the Village contract with Paylocity Corporation to perform the Villages payroll services, pursuant to a proposed Quote for Service (attached hereto and made a part hereof). Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Village Administrator to execute the attached Quote for Service and Payroll Processing Agreement with Paylocity Corporation for an initial two year period for payroll services; and Be it further resolved, that the Mayor, Village Administrator and appropriate Village Staff are authorized to take the necessary and appropriate actions to effectuate the intent of this resolution. Motion by: Trustee Ferrara Seconded by: Trustee Reinke Vote: 6-0 Page 13 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 16 - Authorizing the Acceptance of a Donation from the Pelham Preservation and Garden Society for the Purchase of Flower Baskets and Flowers for the Downtown Resolution Authorizing the Acceptance of a Donation from the Pelham Preservation and Garden Society for the Purchase of Flower Baskets and Flowers for the Downtown Be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the acceptance of a donation from the Pelham Preservation and Garden Society for the hanging baskets and flowers along Wolfs Lane and Fifth Avenue valued at $5,829.70 with thanks to the donors for their contribution to the Village of Pelham community. Motion by: Trustee Ferrara Seconded by: Trustee Reinke Vote: 6-0 Page 14 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 17 - Authorizing Change Order for Contract # 2016-02 Wolfs Lane Park Site Improvements Village Administrator Yamuder reported that additional top soil will be needed to finish the project. Mayor Volpe expressed his concerns about the cost of the top soil, but Village Administrator Yamuder assured him that it will come under budget with approximately $12,000-$15,000 left over from the grant in contingency money. Resolution Authorizing Change Order for Contract # 2016-02 Wolfs Lane Park Site Improvements Whereas, the Village Board of Trustees at their meeting on October 18, 2016 adopted a resolution awarding Contract # 2016-02 “Wolfs Lane Park Site Improvements” to Perennial Gardens, Inc., 414 Old Post Road, Bedford, NY 10506, at a total cost of $452,770; and Whereas, there is a need to install approximately 260 cubic yards of topsoil (2” thickness) and grade over all disturbed areas from construction activities in preparation for grass seed and hay installation; and Whereas, the amount of the subject change order will be charged to resources available in the existing grant funded contingency line. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Village Administrator to execute the attached Change Order totaling $20,280.00 for topsoil installation which will bring the total cost of Contract # 2016-02 to $518,875.00; and Be it further resolved, that the Mayor and Village Administrator are authorized to take the necessary and appropriate actions to effect this resolution. Motion by: Trustee Kagan Seconded by: Trustee Ferrara Vote: 6-0 Page 15 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 18 - Authorizing Stipulation of Settlement with the Pelham Police Benevolent Association, Inc. Mayor Volpe, Trustee Ferrara, and Trustee Kagan decided to settle the grievance that was filed by the Pelham Police Department, which concerns how their double time payment is calculated under the collective bargaining agreement. Mayor Volpe and Trustee Kagan thought it would be prudent to settle this matter. Resolution Authorizing Stipulation of Settlement with the Pelham Police Benevolent Association, Inc. Whereas, the Village of Pelham (“Village”) and the Pelham Police Benevolent Association, Inc. (“PBA”) are parties to a Collective Bargaining Agreement (“CBA”) covering the period of June 1, 2012 to May 31, 2016, which in Article 6 – Premium Pay contains provisions governing the payment of overtime; and Whereas, a dispute has arisen concerning the double time (2X) payment in Article 6 – Premium Pay; and Whereas, the PBA has filed for arbitration pursuant to Article 14 – Grievance Procedure and Arbitration of the CBA; and Whereas, the PBA and the Village have reached an agreement in full settlement of the grievance. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham approves the Stipulation of Settlement (attached hereto and made a part hereof) and authorizes the Mayor to execute the stipulation, settling the aforementioned grievance; and Be it further resolved, that the Mayor, Village Administrator and Police Chief are authorized to take the necessary and appropriate actions to effectuate the intent of this resolution. Motion by: Trustee Kagan Seconded by: Trustee Mullen Vote: 6-0 Page 16 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 19 - Authorizing the Renewal of an Inter-Municipal Agreement between the County of Westchester and the Village of Pelham for Police Academy Instructor Services Resolution Authorizing the Renewal of an Inter-Municipal Agreement between the County of Westchester and the Village of Pelham for Police Academy Instructor Services Whereas, Westchester County (“County”) operates a Police Academy located in Valhalla, New York; and Whereas, for many years, the Pelham Police Department has assigned qualified in-service Pelham Police Officers to serve as instructors at the Police Academy to provide required training for new police recruits and in-service personnel from all county wide municipal police agencies; and Whereas, in order to further this cooperative effort, the County Board of Legislators recently approved an Inter-Municipal Agreement (“IMA”) providing for Pelham Police Officer instructor training services at the Police Academy for the period of March 21, 2017 through March 20, 2022, with a termination clause of 30 days written notice by either party; and Whereas, the primary purpose of the IMA is to identify and clarify the extent and parameters of the police instruction services specifically the indemnification, liability, employment and legal responsibilities of the Village of Pelham and County. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby authorizes the Village Administrator to execute a renewal of an Inter-Municipal Agreement (attached hereto and made a part hereof) between the Village of Pelham and Westchester County to provide for the assignment of Village of Pelham Police Officers to perform instructional training on behalf of Westchester County at their Police Academy in Valhalla, NY; and Be it further resolved, that the Mayor, Village Administrator and Police Chief are authorized to take the necessary and appropriate actions to effectuate the intent of this resolution. Motion by: Trustee Kagan Seconded by: Trustee Ferrara Vote: 6-0 Page 17 Board of Trustees Regular Meeting Tuesday, May 16, 2017 Item # 20 – Other Business Resolution Authorizing the Acceptance of a Donation from Kazz Handyman for Painting the Firehouse Apparatus Floor Be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the acceptance of a donation from Kazz Handyman for the painting of the Firehouse Apparatus floor valued at $6,750.00 with thanks to the donor for their contribution to the Village of Pelham. Resolution Authorizing the Accounts Payable Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village.
