Item # 3 – Roll Call: Present were Trustees Kagan, Ferrara, Mullen, Reinke, and Spira-Cohen. Newly appointed Trustee Potocki was absent. Assistant to the Village Administrator Scelza was present. Mayor’s Report: Mayor Volpe reported that Trustee Potocki has been sworn in, but could not make the meeting due to a work commitment. Mayor Volpe reported that he will attending a shared services meeting on Thursday, June 15 th. Mayor Volpe reported that the traffic problem on Lincoln Avenue persists, so suggestions on how to mitigate traffic are being reviewed. Mayor Volpe wanted to thank everyone who attended the Memorial Day parade, it was a wonderful opportunity to show off the park, so he wanted to give a special thanks to Senator Klein, Klein’s staff, and Susan Mutti for their assistance in the Wolfs Lane Park project. Mayor Volpe acknowledged the sidewalks problem, he said that the Village takes numerous steps to notify homeowners of their responsibility to fix the sidewalk, so the Village will be more aggressive on this issue. Mayor Volpe congratulated the Pelham Varsity Rugby team on their win, and said that the Board will have to consider the cost of the parade before they move forward with the request. Mayor Volpe would like to commend the Pelham Football team for working alongside Habitat for Humanity on community clean-up efforts. Page 2 Board of Trustees Regular Meeting Tuesday, June 6, 2017 Mayor Volpe said the Village will be moving forward with the audit process after July 4 th, so the Board will receive a letter from the Mayor asking them to make a statement about the audit process. Mayor Volpe wanted to inform everyone that the Board of Trustees July meeting will be taking place on Tuesday, July 18th instead of Tuesday, July 11th. Trustees’ Report: Trustee Ferrara wanted to assure residents that their complaints about the condition of the Village sidewalks have been heard, and she has scheduled a meeting with the Head of Public Works, Michael Shriman for the Monday, June 19th to address this problem. Trustee Ferrara stated that the Wolfs Walk event has to be done in collaboration with the Chamber of Commerce, and participation is welcomed, so please reach out to her for further information. ******** Trustee Kagan reported that he has been working with Mayor Volpe and Maryanne Joyce on drafting the immigration enforcement resolution, so the next step is to meet with the Police department to discuss the draft. After the meeting with Police leadership, Trustee Kagan will circulate the draft to the Board, hopefully by the next Board of Trustees meeting on Tuesday, June 20 th. Trustee Kagan would like to thank Ms. Joyce and the Mayor for the donating their time to this project. ******** Trustee Mullen wanted to thank the Fire Chief James DiNapoli for inviting him and Trustee Kagan to participate in the fire department training, and they are looking forward to it. ******** Trustee Potocki was absent. ******** Trustee Reinke had nothing to report. ******** Trustee Spira-Cohen has enrolled the Village in the LED street lights consortium, which is an information and resource sharing program. Trustee Spira-Cohen hopes that our participation in the program will outline the best strategies to accelerate our LED conversion timeline. Trustee Spira- Cohen said that some residents along with Eco Pel have expressed interest in becoming a solarized community. Trustee Spira-Cohen would like to invite representatives from Solarize Westchester to present before the Board. Page 3 Board of Trustees Regular Meeting Tuesday, June 6, 2017 Village Administrator’s Report: There was no report. Item # 7 – Public Comments Frank Begley, 1040 Esplanade, spoke in opposition to the sanctuary city issue because he believes it will decrease property values, and it will put the Village at risk. Susan Mutti, 4th Avenue, reported that the Pelham Preservation Society donated a pergola to the Wolfs Lane Park project, but they struggled with the retaining wall, so Aldo Devitto covered the wall by creating a blue stone cap that will also serve as a bench. Ms. Mutti would like to thank Mr. Devitto for his innovative thinking, which added to the functionality of the project, so Perennial Gardens will get back to work on the courtyard. The Pelham Preservation Society will be hosting its annual fundraising event, located at 530 Monterey Avenue on Saturday, June 10th at 7:00pm. Marilyn Zelinski, 60 1st Street, is in favor of adopting the resolution concerning immigration, but after reading Mr. Meyer’s petition on change.org, she was surprised to find out she agrees with most of the points. She agrees that the Village of Pelham should not become a sanctuary city, tie the hands of law enforcement, violate federal law, or jeopardize property values. Ms. Zelinski stated that there is some disagreement on how to keep the Village safe, but reasonable people should resist the temptation to turn this issue into something incendiary. Matthew Scampoli, 462 2nd Avenue, requested a parade, similar to the one arranged for the Ice Skating state champions earlier this year, to celebrate the Pelham Varsity Rugby team for capturing the Division 1, Tier 2 New York State Championship for the 2nd time since 2015. He also requested a banner to be placed on the train trestle. David Biskup, 1061 Clay Avenue, also wanted to congratulate the Pelham Varsity Rugby team on their win, and endorses Mr. Scampoli’s banner request. Charles Meyer, 171 Harmon Avenue, inquired as to when the Board planned to respond to the letter from Kasowitz, Benson, and Torres LLP concerning the immigration resolution. Mayor Volpe addressed Mr. Meyer’s concerns that the letter did not warrant a response, but the Mayor will write a response. Page 4 Board of Trustees Regular Meeting Tuesday, June 6, 2017 Non-Recurring Items Item # 8 – Authorizing the Completion of Probation for Fire Lieutenant Timothy Frusciante Resolution Authorizing the Completion of Probation for Fire Lieutenant Timothy Frusciante Be it resolved, that the Board of Trustees of the Village of Pelham hereby authorize the acknowledgement of the successful completion of probation for Timothy Frusciante as a Fire Lieutenant, which is approved based on the positive evaluation and recommendation of the Fire Chief. Motion by: Trustee Mullen Seconded by: Trustee Ferrara Vote: 6-0 Page 5 Board of Trustees Regular Meeting Tuesday, June 6, 2017 Item # 9 – Authorizing the Renewal of an Inter-Municipal Agreement between the City of New Rochelle and the Village of Pelham for the Disposal of Organic Waste including Yard Waste and Fall Leaves Mayor Volpe reported that this resolution allows the Village to extend the Inter-Municipal Agreement with the City of New Rochelle, and it informs us of the new fee schedule; Mayor Volpe reported that the cost is set by the ton, and it has increased from $21.68 to $22.15. Resolution Authorizing the Renewal of an Inter-Municipal Agreement between the City of New Rochelle and the Village of Pelham for the Disposal of Organic Waste including Yard Waste and Fall Leaves Be it resolved, that the Board of Trustees of the Village of Pelham herein authorizes the Mayor to execute the renewal of an Inter-Municipal Agreement between the City of New Rochelle and the Village of Pelham for the Disposal of Organic Waste, including Yard Waste, Leaves, Brush, Logs and other similar acceptable organic waste, at the City of New Rochelle Waste Transfer Station, per the agreement provided for by the City of New Rochelle (attached hereto and made a part hereof), effective January 1, 2017 through December 31, 2017. Motion by: Trustee Ferrara Seconded by: Trustee Reinke Vote: 6-0 Page 6 Board of Trustees Regular Meeting Tuesday, June 6, 2017 Item # 10 – Other Business Swearing in of New Chairmen Mayor Volpe thanked Barbara Bartlett and Nigel Scott-Williams for their years of dedicated service. Richard Veith was sworn in by Mayor Volpe as the Chair of the Zoning Board of Appeals. Joseph Marty was sworn in by Mayor Volpe as the Chair of the Planning Board. Mayor Volpe would like to thank Mr. Veith and Mr. Marty for answering the call to service. Street Repaving Mayor Volpe would like to use the CHIPS money to repave the roads on Fifth and Sixth avenue heading north from Lincoln Avenue, and the path on Ninth Avenue off Lincoln Avenue going into New Rochelle. Mayor Volpe said the cost of the project will be $147,000 about $ 2 more per ton, and the Village will be responsible for $25,000 of the cost. Page 7 Board of Trustees Regular Meeting Tuesday, June 6, 2017 Recurring Items Item # 11 - Authorizing the Accounts Payable Trustee Reinke audited the Accounts Payable. Resolution Authorizing the Accounts Payable Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village. Now, therefore, be it resolved, that the Board of Trustees after audit of the following vouchers, authorizes payment for services rendered and materials received, for the following items that have been submitted to the Treasurer's Office for payment and authorized by the Village Administrator: Fund Name: Amount General Fund $433,652.11 Capital Projects Fund $0.00 Trust and Agency Fund $0.00 TE Expandable Trust Fund $0.00 Grand Total $433,652.11 Be it further resolved, that this Board hereby approves payment of the above mentioned claims and authorizes payment thereof.
