Item # 2 – Pledge of Allegiance: The Pledge of Allegiance was led by Deputy Mayor Kagan. Item # 3 – Roll Call: Present were Trustees Ferrara, Kagan (via Skype), Mullen, Potocki, Reinke, and Spira-Cohen. Mayor Volpe was absent. Village Administrator Gallagher was present. Assistant to the Village Administrator Scelza was absent. Deputy Mayor’s Report: Deputy Mayor Kagan reported on October 24th, 2017 the Board declared themselves the lead agency for SEQRA for 8 Boulevard West and 185 Lincoln development projects. Trustee Kagan directed the Village staff to make these declarations available on the Village of Pelham website. On Tuesday, November 28th, the Board of Trustees will hold a public hearing on 185 Lincoln and 8 Boulevard West. Trustees’ Report: Trustee Ferrara reported a group of residents in collaboration with the Pelham Chamber of Commerce have been working on a “Wolfs Walk” community food truck event where residents are invited to savor the flavors of several local restaurants and learn more about our local businesses. The Chamber of Commerce will be sending a letter soon to request support for the event, and they are looking for volunteers, so if you are interested in volunteering please email her. Trustee Ferrara reported she has been working with Trustee Spira-Cohen for composting options that can be implemented in the Village of Pelham. They looked at the Village of Pelham Manor and the City of New Rochelle for potential drop off sites, but the Village of Pelham Manor has staffing and budget constraints, so it is not a viable site. A partnership with the City of New Rochelle is more likely, but the Board will see if a composting service can be incorporated with the garbage pick-up service. Page 2 Board of Trustees Regular Meeting Tuesday, November 14, 2017 ******** Trustee Mullen reported the Fire Department hosted a safety training for the au pairs from Cultural Care Au Pair, where the au pairs learned about fire prevention, poison control prevention, and how to detect and respond to carbon monoxide poisoning. The au pairs also learned how to use an epi-pen and fire extinguishers. Trustee Mullen thanked Lieutenant Benkwitt and Firefighter Bellantoni for hosting the training, and all the au pairs that attended the training. Trustee Mullen also thanked Karolina Ellison at the Cultural Care for reaching out, and it seems like this will be an annual training event. Trustee Mullen reported the Village has found a software solution for communications called “My Civic App”, so the Village can track issues raised by residents and allow residents to communicate with their local government. The mobile application will have all the important Village contact information, and residents will be able to report an issue where it will get routed to the appropriate department along with sending photos and GPS data of the issue. It will also enable the Village to manage issues more efficiently and survey the constituency for feedback, so we can prioritize our agenda. The Village will debut the mobile application within the next couple of months. ******** Trustee Potocki reported there will be a meeting with Police Chief Joseph Benefico to discuss the potential bus stop relocation on Lincoln Avenue. Trustee Potocki believes the Village will lose parking spots near the Mobil gas station and by Lincoln Avenue, and as a result it will cause more traffic. Trustee Potocki believes the bus stop should not be moved. Trustee Potocki reported they received a report from Anthony Olivieri (Dolph Rotfeld) concerning the storm water drain plans for 3rd Street and 4th Street, and the potential siphon at 5th Avenue and 6th Street, and unfortunately the siphon will be a difficult and costly task at approximately $600,000, so the Village may have to leave the pipe there. Trustee Potocki explained the Village had two different plans done by two different firms (Leonard Jackson) for the 3rd Street and (Dolph Rotfeld) for the 4th Street storm water drain plans, but the two engineering firms cannot come to an agreement concerning the pipe size and course of action, so the Village will employ Dolph Rotfeld to redo the plans for 3rd Street. Trustee Potocki stated the 3rd Street grant has a longer lifecycle, so hopefully the Village can get the pipe done because it is the most important part of the run that needs to be corrected. ******** Trustee Reinke had nothing to report. ******** Page 3 Board of Trustees Regular Meeting Tuesday, November 14, 2017 Trustee Spira-Cohen reported the Solarize team submitted the RFP on Thursday, November 9th, and if the Village of Pelham is awarded the campaign then it will be for Spring of 2018. Trustee Spira-Cohen reported Pelham Plus has published two letters concerning electromagnetic fields, one from Alison Main, and one from Richard Ellenbogen. Mr. Ellenbogen’s letter was a response to Ms. Main’s letter, which was revealed to be factually inaccurate by Mr. Ellenbogen, who has close to 40 years of expertise in this area. Mr. Ellenbogen’s letter states electromagnetic fields do not pose a public health hazard, and misinformation like Ms. Main’s letter is a public disservice. Trustee Spira-Cohen asked anyone with further concerns on this issue to please feel free to reach out to her. Trustee Spira-Cohen reported the deadline for joining the LED street lights consortium’s Community Managed RFP is on Wednesday, November 22nd, so please email her with any lighting concerns. Village Administrator’s Report: Village Administrator Gallagher reported the Annual Holiday Party will be held at Sergio’s Ristorante, on Tuesday, December 19th at 6pm. Item # 7 – Public Comments John Cassone, 312 7th Avenue, is excited about the mobile application, but he would like to remind the Board that there are seniors to take into consideration who are not technologically savvy. Trustee Mullen responded to Mr. Cassone’s concerns, and stated they are looking for a way to communicate with people who do not install the application. Mr. Cassone was impressed with the auditor’s report, and commended the Village on the budget. Page 4 Board of Trustees Regular Meeting Tuesday, November 14, 2017 Non-Recurring Items Item # 8 – Public Hearing on Local Law No. 6 of 2017 Creating Chapter 6 of the Village Code Entitled Best Value Procurement The public hearing was opened after a motion by Trustee Potocki and seconded by Trustee Ferrara, passed unanimously. Deputy Mayor Kagan stated the purpose of adopting Local Law No. 6 is to allow the Village to use another standard in our procurement policy, which will allows us to participate in the LED street light consortium. The Village’s current procurement policy is the lowest responsible bidder, and the Board believes it will be useful to have this alternative procurement policy in the future. Deputy Mayor Kagan stated this will not become the current default procurement policy, and it has to be approved each time it is used. The public hearing was closed after a motion by Trustee Mullen and seconded by Trustee Potocki passed 6-0. Page 5 Board of Trustees Regular Meeting Tuesday, November 14, 2017 Item # 9 – Adopting Local Law No. 6 of 2017 Creating Chapter 6 of the Village Code Entitled Best Value Procurement Deputy Mayor Kagan reiterated this procurement policy will not become the default procurement policy, which is and remains, lowest responsible bidder. Resolution Adopting Local Law No. 6 of 2017 Creating Chapter 6 of the Village Code Entitled Best Value Procurement Whereas, the Board of Trustees of the Village of Pelham has proposed a local law to create Chapter 6 of the Village Code which will authorize the use of Best Value Methodology in awarding contracts pursuant to New York State General Municipal Law §103(1); and Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the local law is a Type II Action and are therefore not subject to the requirements of the State Environmental Quality Review Act (“SEQRA”) and; Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper of the Village of Pelham; and Whereas, said public hearing was held on November 14, 2017 at or about 7:30 p.m. at Village Hall, 195 Sparks Avenue, Pelham, NY and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said to proposed local law or any part thereof. Now, therefore, be it resolved, as follows: 1. The Board of Trustees hereby adopts Local Law No. 6 of 2017 creating Chapter 6 of the Village Code entitled Best Value Procurement which will authorize the use of Best Value Methodology in awarding contracts pursuant to New York State General Municipal Law §103(1); and 2. Deputy Mayor Kagan stated no change to the route can be made without the approval of the Pelham Police Department. Resolution Approving a Request from the Friends of the Pelham Civic Association for a Half Marathon Whereas, the Friends of the Pelham Civic Association has requested permission to hold its 6th Annual Pelham Half Marathon in the Village on Saturday, November 25, 2017 by letter dated November 8, 2017 (attached hereto and made a part hereof); and Whereas, the temporary marking of the event route is necessary the day prior to the race as stated in the aforementioned request letter; and Whereas, the Friends of the Pelham Civic Association shall reimburse the Village for all costs incurred by the Village as a result of the event, including but not limited to Police Department and Department of Public Works overtime, and provide a certificate of liability insurance naming the Village as an additional insured in a form and amount satisfactory to the Village. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby authorizes the Pelham Half Marathon on Saturday, November 27, 2017 beginning at 8:00 a.m. and; Be it further resolved, that the Board of Trustees authorize the appropriate Village officials and staff to take the necessary and appropriate actions to effectuate the intent of this resolution. Deputy Mayor Kagan also stated that our participation in the Mid-Hudson Street light consortium will expedite the LED street light conversion process in providing the Village with a list of qualified responsible bidders to do the project more efficiently than we could accomplish with internal staff resources. Trustee Spira-Cohen stated the community of Red hook is asking for the Village’s enrollment in the municipal cooperation agreement, and about 15-20 communities have already signed the municipal cooperation agreement. Trustee Spira-Cohen reported the Village’s participation in the Mid-Hudson Street Light Consortium (MHSLC) does not obligate the Village in anyway, but rather it allows the MHSLC to present an RFP, seek bids, and set bid specifications. Trustee Potocki suggested the Department of Public Works coordinate with the future vendor for best possible locations of the LED installations. Resolution Authorizing Participation in the Mid-Hudson Street Light Consortium Whereas, Article 5-G of the New York State General Municipal Law authorizes municipal corporations to enter into cooperative agreements for the performance or exercise of services, functions, powers or activities on a cooperative or contract basis among themselves or one for the other; and Whereas, Section 119-n of the General Municipal Law defines the term “municipal corporation” for the purposes of Article 5-G as a county outside the city of New York, a city, a town, a village, a board of cooperative educational services, a fire district or a school district; and Whereas, the Village of Pelham is a “municipal corporation” as defined above; and Whereas, this Board wishes for this municipal corporation to become or remain a Participant pursuant to the Municipal Cooperation Agreement For the Mid-Hudson Street Light Consortium (the “Agreement”), among municipal corporations collectively identified as the Mid-Hudson Street Light Consortium (“Consortium”) upon the terms of the Agreement and further wishes to authorize participation as a prospective purchaser of services related to the energy efficiency and follow-on maintenance of municipal street lighting systems, as specified below; and Whereas, it has been determined by this Board that contracts for the conversion of municipal street lighting fixtures to LED technology and for ongoing maintenance and warranty service of municipal street lighting systems require the exercise of specialized and/or technical skills, expertise and Page 8 Board of Trustees Regular Meeting Tuesday, November 14, 2017 knowledge and, therefore, are not subject to the sealed, competitive bidding requirements under General Municipal Law § 103 and may instead be awarded using the Request for Proposals (RFP) process permitted by General Municipal Law § 104-b. Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby determines that, as it is in the interests of the Village of Pelham (hereinafter “Participant”) to participate in the Consortium: 1. The Village of Pelham authorizes and directs the Mayor or, in his absence, the Deputy Mayor, to sign the Agreement on Participant’s behalf and further authorizes its officers and employees to execute such other documents and take such other actions as may be necessary or appropriate to carry out the intent of this resolution; and 2. The Participant agrees to participate in the municipal cooperative solicitation of offers/proposals for services related to the energy efficiency conversion and follow-on maintenance and warranty service of municipal street lighting systems pursuant to the Agreement and subject to subsequent approval by this Board. 3. The Participant authorizes the Administrative Participant (as defined in the Agreement) to prepare, advertise, and disseminate an RFP containing appropriate details and bid specifications as the Administrative Participant deems appropriate to solicit proposals from a pool of qualified contractors (hereinafter referred to as “Offerors”) to assist Participants with the energy efficiency conversion of municipal street lighting systems and to provide follow-on warranty and maintenance services, and to open proposals and to select one or more Offerors on behalf of the Participant in accordance with such bid specification, subject to subsequent approval by this Board, on the basis of best value as is determined by the Administrative Participant, or to reject any or all such proposals; and 4. The officers and employees of Participant are authorized to execute such other documents and take such other actions as may be necessary or appropriate to carry out the intent of this resolution. The Village went out to bid on Monday, November 6th with several alternatives in service for curb side and rear yard pickup, and received two completed bid packets from R&S Waste Services, LLC and AAA Carting, Inc, and one incomplete bid from CRP Sanitation, Inc. Deputy Mayor Kagan reported the current cost of the Village contract is $612,173, but Trustee Mullen believes the Village should consider getting rid of the rear-yard pick-up as a cost savings measure. Trustee Mullen would like to get feedback from the community concerning the levels of service. Trustee Potocki revealed rear yard pickup is unique to the character of our community, and switching to curb side will produce more trash in the streets. Deputy Mayor Kagan explained a segment of the Village population will not be able to drag the bins to the curb, and eliminating rear yard would pose a safety issue because it will attract potential criminals. Trustee Mullen proposed developing a survey to distribute to the community because this is a contentious issue. Trustee Spira-Cohen suggested the Village require covered bins for its trash and recyclables to combat the issue of loose trash on the street. Village Administrator Gallagher reported he contract needs to be awarded by Tuesday, December 12th. Trustee Ferrara would like to see if the bidders could offer a composting pick up service once a week. Maggie Klein, Pelham Plus, stated garbage in the downtown business district is a problem because some of the private carters leave trash in the street. Ms. Klein also reported there are issues with trucks in the downtown district due to a lack of coordination. John Cassone, 312 7th Avenue, stated this is a reoccurring issue in the Village, and he believes eliminating the service to save money is the wrong approach. Mr. Cassone said recycling has been an issue since Mayor Cassidy’s time in office, but the Village has been trying to increase the amount of recycling. Mr. Cassone suggested the Village may want to increase garbage collection services during the spring/summer when more garbage is produced, but he implores the Village to continue to offer rear-yard pick-up. Page 13 Board of Trustees Regular Meeting Tuesday, November 14, 2017 Recurring Items Item # 15 - Authorizing the Accounts Payable Trustee Ferrara audited the Accounts Payable. A brief discussion took place on vouchers #9521, #9583, and #9512 Resolution Authorizing the Accounts Payable Whereas, pursuant to § 5-524 of the New York State Village Law, the Board of Trustees shall audit all claims against the Village. Now, therefore, be it resolved, that the Board of Trustees after audit of the following vouchers, authorizes payment for services rendered and materials received, for the following items that have been submitted to the Treasurer's Office for payment and authorized by the Village Administrator/Treasurer: Fund Name: Amount General Fund $228,897.27 Capital Projects Fund $9,620.00 Trust and Agency Fund $6,262.47 TE Private Purpose Trust Fund $2,193.00 Grand Total $246,972.74 Be it further resolved, that this Board hereby approves payment of the above mentioned claims and authorizes payment thereof.
