Item # 2 – Pledge of Allegiance: The Pledge of Allegiance was led by Mayor Volpe. Item # 3 – Roll Call: Present were Trustees Ferrara, Kagan, Mullen, Reinke, Spira-Cohen, and Potocki. Village Administrator Gallagher, Assistant Village Administrator Scelza, and Administrative Intern Yari Fernandez, and Village Attorney Ed Smith were present. Mayor’s Report: Mayor Volpe congratulated the Danny Fund for another successful fundraising event this past weekend, and a special thanks to Trustee Potocki and his lovely wife who was honored at the event. Mayor Volpe also thanked Detective John Hynes who did a wonderful job at running the event. Mayor Volpe announced the Pelham Picture House will be hosting an Oscar pre-party Hollywood style on Friday, March 2 from 7:00 p.m. to midnight at the Glen Island Harbour Club in New Rochelle for Marquee Night. Marquee Night will honor John Calvelli for his community based work, so Mayor Volpe encouraged residents to attend the event. Mayor Volpe announced that he will be giving on an update on the PBA interest arbitration during executive session. Mayor Volpe hopes to reach a decision soon. Mayor Volpe announced that former General Foreman of DPW, Michael Shriman officially retired on February 8th, so they will honor his many of years of service in the future. Mayor Volpe thanked Senator Klein for his continued support, and the opportunity to discuss the infrastructure needs of the firehouse during the tour. Mayor Volpe attended a Board of Education meeting, and he supports the construction of the new Hutchinson School. Mayor Volpe thinks it is important for the Village of Pelham to have a new building since the current building is inadequate and more than a 100 years old. Mayor Volpe has considered the tax issues associated with the new Hutchinson School, and he believes incremental costs to the tax payer on an annual basis will be greatly outweighed by the benefits to the community. Mayor Volpe believes the location of the new Hutchinson School will divert traffic off Lincoln Avenue Page 2 Board of Trustees Regular Meeting Monday, February 12, 2018 and redirect it behind the school. Mayor Volpe encouraged individuals to educate themselves on these issues and to meet with the Board of Education. Trustees’ Report: Trustee Ferrara reported she and Assistant Village Administrator Scelza met with the Pelham Preservation Garden Society to discuss the condition the pillars on Pelhamwood Avenue, so the Pelham Preservation Garden Society will restore the pillars in collaboration with the Department of Public Works. ******** Trustee Kagan reported the Hutchinson River Parkway closure date for the Third Street bridge repair has been pushed back to sometime in March. Trustee Kagan advised residents to report potholes and street conditions to the Village Administrator, so he can address these issues. ******** Trustee Mullen reported State Senator Jeff Klein walked through the firehouse on Wednesday, February 8th with himself, Fire Chief James DiNapoli, and Village Administrator John Gallagher. Trustee Mullen believes Senator Klein walked away with a better understanding of the challenges facing the firehouse, and Senator Klein intends to be a partner in the work ahead. Trustee Mullen thanked Senator Klein for his continued support. Trustee Mullen provided an update on the MyVop App, which will be a 311 style mobile application that residents will be able to download to their apple or android devices; Trustee Mullen hopes the mobile application will make information about Village services readily available while creating pathways for open communication between Village officials, staff, and residents. Trustee Mullen would like to beta test the mobile application, so residents are encouraged to email Trustee Mullen at chance.mullen@pelhamgov.com if they want to be a part of the beta testing process. Trustee Mullen reported the storm water drainage system on 3rd Street and First Avenue is outdated, so it needs to modernized for large scale events. Trustee Mullen and Trustee Potocki will like to update the storm water drainage system and take advantage of the grant money that is available, but will expire on March 31st. Trustee Mullen reported a number of complications: there is no cost effective way to address the blockage issues on 5th Avenue and 6th street and the 3rd street designs from Leonard Jackson are inadequate. The 4th Avenue section will be a difficult project because the sewer line running down 4th Avenue is in the wrong place, so the Village of Pelham would have to run connections to the sewers through the drainage system or move the sewer lines. Trustee Mullen and Trustee Potocki consulted an engineer about solutions for the 4th Avenue section, and the engineer suggested it would be best to reduce the amount of water coming into the top to begin with, which originates from New Rochelle. It would be best to reroute the water back up to New Rochelle’s drainage pipe, but Trustee Mullen revealed the New Rochelle engineers did not seem receptive to this suggestion, so they are at an impasse. Page 3 Board of Trustees Regular Meeting Monday, February 12, 2018 ******** Trustee Potocki reported the Village of Pelham needs to devise a plan by March 31st to take advantage of the FEMA grant to see if we can get reimbursed for plans that Village of Pelham can use in the future. Trustee Potocki stated that the New Rochelle engineers misinterpreted their request, and thought the Village of Pelham was requesting them to lower the lake, but in fact they were asking for the overflow of the water to be addressed. Trustee Potocki would like to get clarification from Dolph Rotfeld about the appropriate size for a storm pipe that would not disturb the sewer lines. Trustee Potocki asked Village Administrator Gallagher about the bus routes changes on Lincoln Avenue and the traffic light changes, and Village Administrator answered both of these changes have been delayed. Village Administrator Gallagher stated these concerns have been relayed to the liaison, and they will meet soon to discuss these issues. Village Administrator Gallagher stated they are waiting to hear back from Mount Vernon in regards to the traffic light, and the equipment is ready, so now it just a matter of getting it installed. ******** Trustee Reinke had nothing to report. ******** Trustee Spira-Cohen reported the Mid-Hudson LED street light consortium has received three bids, and communities (like our community) that signed up for the Community Managed RFP have to review the bids, fill out the score sheet, and evaluate the bidders. Trustee Spira-Cohen revealed there is a second type of RFP being released in the spring called a “turnkey” RFP where a design/build contractor will offer a turnkey solution, including project design, implementation, maintenance, measurement, and verification. The Village of Pelham will be able to participate in the turnkey RFP, and Trustee Spira-Cohen will provide another update as the consortium goes through the evaluation process. Mayor Volpe asked Trustee Spira-Cohen to get a draft of the procurement contract for the Board to review. Trustee Spira-Cohen reported there is going to be a “Solarize Pelham” campaign that will run from Wednesday, March 7th through Monday, June 4th. The launch event is an opportunity to hear about the program and it will be held at the Daronco Townhouse on Wednesday, March 7th at 7:30pm. A press release will be released with more information along with a website and a Facebook page launch. Village Administrator’s Report: Village Administrator Gallagher had nothing to report. Page 4 Board of Trustees Regular Meeting Monday, February 12, 2018 Non-Recurring Items Item # 8 – Public Hearing on Local Law No. 2 of 2018 to Amend Chapter 73 of the Village Code, Real Estate Tax Exemptions, Article IV Cold War Veteran’s Exemption The public hearing was opened after a motion by Trustee Reinke and seconded by Trustee Ferrara, vote 7-0. Mayor Volpe stated the purpose of the public hearing is to amend the law, so it can extend to cold war veterans. The public hearing was closed after a motion by Trustee Mullen and seconded by Trustee Ferrara, vote 7-0. Page 5 Board of Trustees Regular Meeting Monday, February 12, 2018 Item # 9 – Adopting Local Law No. 2 of 2018 Amending Chapter 73 of the Village Code, Real Estate Tax Exemptions, Article IV Cold War Veteran’s Exemption Trustee Kagan stated a substantive change to the law is the dollar amount of the exemption, which shall not exceed $54,000 as specified in paragraph 2(a) of Section 1. Mayor Volpe stated if a cold war veteran receives the New York State Real Property Tax Law under Section four hundred fifty-eight or four hundred fifty-eight-a then they would not be eligible to receive an exemption under this law. Resolution Adopting Local Law No. 2 of 2018 Amending Chapter 73 of the Village Code, Real Estate Tax Exemptions, Article IV Cold War Veteran’s Exemption Whereas, the Board of Trustees of the Village of Pelham has proposed a Local Law to amend Local Law No. 3 of 2008 which would extend the Real Property Tax Exemption to the Cold War Veteran’s to qualifying owners of qualifying real property for as long as they remain qualifying owners, without regard to the previous ten year limitation as authorized by § 458-b of the Real Property Tax Law and as amended recently by Chapter 290 of the Laws of 2017; and Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the local law is a Type II Action and are therefore not subject to the requirements of the State Environmental Quality Review Act (“SEQRA”) and; Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper of the Village of Pelham; and Whereas, said public hearing was held on February 12, 2018 at or about 7:30 p.m. at Village Hall, 195 Sparks Avenue, Pelham, NY and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said to proposed local law or any part thereof. Now, therefore, be it resolved, as follows: 1. The Board of Trustees hereby adopts Local Law No. 2 of 2018 of the Village of Pelham which amends Local Law No. 3 of 2008 which would extend the Real Property Tax Exemption to the Cold War Veteran’s to qualifying owners of qualifying real property for as long as they remain qualifying owners, without regard to the previous ten year limitation as authorized by § 458-b of the Real Property Tax Law and as amended recently by Chapter 290 of the Laws of 2017 ; 2. Mayor Volpe thanked Village Clerk, Terri Rouke, and the Pelham Police Department for their work in rerouting the cars from Parking Lot 1. The timeline for the wall replacement will take approximately two to three weeks, and have installation occur during warmer weather to avoid incurring the additional costs of heating. Mayor Volpe stated the Board will conditionally approve this resolution and not spend the extra money on heating the concrete. Trustee Kagan noted it looks like the plan is to pitch the floor of the parking lot back away from the wall, so the water will fall into a drain. Mayor Volpe asked Assistant Village Administrator Scelza to get a sidewalk constructed at this location next to the rocks for the same price. Trustee Kagan indicated that the scope of work excludes the finish work at the exterior faces of the newly built CMU wall, and Mayor Volpe stated the Department of Public Works will address this issue. Assistant Village Administrator Scelza revealed that the $126,500 cost will include replacing the fence and the guard rail. Resolution Authorizing Parking Lot 1 Retaining Wall Replacement on an Emergency Basis Whereas, a retaining wall supports Parking Lot 1 and incorporates natural elements of the landscape; and Whereas, certain elements of the retaining wall supporting Parking Lot 1 have failed and concerns have been raised regarding the potential for further failure; and Whereas, Grigg and Davis Engineers, P.C. prepared engineering plans and masonry details to address the aforementioned concerns; and Whereas, in order to expedite the work, the Village must utilize the emergency procurement process specified in §103(4) of the New York State General Municipal Law which allows for the waiving of competitive bids under circumstances where the public health and general welfare of the municipalities residents is threatened and immediate action is required which cannot wait competitive bidding. Trustee Spira-Cohen produced a draft mission statement for the Sustainability Advisory Board, and distributed the draft to Eco-Pel, Pelham Preservation Garden Society, the Solarize team, and the Town board. Trustee Spira-Cohen the language was amended to consider other issues, such as social and economic issues, and community resilience to natural disasters related to climate change. Trustee Kagan stated the police should be included in disaster resilience because they attend trainings on this subject matter. Mayor Volpe suggested to change the language of the draft to include climate change, and community and disaster resilience. Mayor Volpe suggested that there be a minimum of four meetings a year inclusive of the annual meeting. Mayor Volpe stated the Board liaison should not be granted the power to vote on issues, and that there be minimum of 5 members, which may be increased at the discretion of the Village Board with perhaps a maximum of 9 members. Mayor Volpe was in favor of staggered terms with 2 year term limits, and Trustee Mullen suggested the first four people appointed should begin staggered terms. Trustee Potocki suggested a residency requirement for the majority of the board members. Mayor Volpe advised Trustee Spira-Cohen to work on the draft now that she has input from the Board. Page 12 Board of Trustees Regular Meeting Monday, February 12, 2018 Item # 14 – Discussion on a Request for Proposals for the Redevelopment of Municipal Facilities Mayor Volpe stated they drafted an RFP to call for public-private partnership to redevelop several Village owned properties. Mayor Volpe stated this is an opportunity to address infrastructure needs with the cooperation of developers for a mutually beneficial outcome. Mayor Volpe thanked the Board members for their comments on the RFP, and the Mayor stressed this is just a call for proposals, so the Board will review all proposals submitted. Trustee Mullen thinks this is a great idea because the foundation of the Village of Pelham is old, so the Board has inherited a lot of their infrastructure problems due to age. Mayor Volpe stated the valuations of the properties included in the RFP will be revealed in the process, so he would like to get this RFP finalized and on the website. Mayor Volpe revealed that the Board may need to hire a project management team to oversee some of these redevelopments, but we can include that in the cost of the proposal. Page 13 Board of Trustees Regular Meeting Monday, February 12, 2018 Item # 15 – Discussion on Proposed Street Resurfacing Locations Assistant Village Administrator Scelza produced a map with the 2018 proposed capital paving locations and their cost, so the Village will be addressing five major streets in Pelham. Trustee Kagan instructed Village Hall to coordinate with Con Edison on the street resurfacing locations and dates, so Con Edison does not disrupt newly paved streets when they conduct their service upgrades and so that the Village does not pave roads that Con-Ed would be paving at their own cost (due to planned disruptions) anyway. Pelhamwood Avenue and First Avenue should be addressed first because they are high traffic areas. Mayor Volpe stated there is currently $120,000 available from CHIPS to resurface these five roads, so the rest of the funding will come from the BAN. Mayor Volpe stated this is a significant investment in our community. Page 14 Board of Trustees Regular Meeting Monday, February 12, 2018 Item # 16 – Other Business Discretionary Spending Freeze Mayor Volpe stated there will be a freeze on discretionary spending, and Mayor Volpe will have to approve funding requests, the Mayor will reach out to the liaisons for input on their department head’s request. Restructuring DPW Mayor Volpe would like to appoint Joseph Senerchia, the Building Inspector as the Provisional DPW General Foreman. This appointment will address combining the departments for the sake of efficiency. Mayor Volpe would like to explore a change for the department heads, like a director or a commissioner for the building department and the department of public works, so the Village Code would have to be amended for the title changes. Gerald Tew has stepped up in the department of public works in a lead capacity, so the Board will have to explore other titles for Mr. Tew; Mayor Volpe stated the Collective Bargaining Agreement for DPW is outdated, and the union representative is receptive to such a title change for Mr. Tew. Hutchinson School Trustee Potocki would like to have a discussion in March or April about the impact that the new Hutchinson School would have on Village services (police, fire, and sanitation). NYCOM Article Trustee Potocki would like the Board to plea to our state elected officials on the potential elimination of the State and Local Tax (SALT) deduction. Mayor Volpe revealed he had a discussion with Assemblywoman Paulin about this topic concerning this topic, and Assemblywoman Paulin is spearheading an effort to get legislation drafted in Albany about SALT. Page 15 Board of Trustees Regular Meeting Monday, February 12, 2018 Resolution Appointing Provisional General Foreman Of the Department of Public Works Be It Resolved, that the Board of Trustees of the Village of Pelham hereby confirms the Mayor’s appointment of Joseph C.
