Item # 5 - Village Administrator’s Report: -Reviewed the Social Media Sanitation schedule for October -Reminded all regarding the 2022 Fall Leaf Collection Item # 6 - Mayor’s Report - New municipal center groundbreaking will be at 10/19/22 at 2:00 PM. - Provided an update on the Westchester Municipal Officials Association Executive Committee Member Meeting and their efforts being made for affordable housing. - Parking transition plan is underway; recap of parking plan process and plan provided. Village Board of Trustees Regular Meeting Tuesday, October 11, 2022 Item # 7 - Public Comments 8:23 PM – Ashok Seecharran from Pelham Troop 1, Eagle Scout presented a Service Project of building platform steps at the Highbrook Highline. Reviewed projected plan and cost for the build of the platform steps. Public member attending the meeting recommended a handrail, which will be researched by Ashok. Funding will be raised by a “Go Fund Me” and donations from Home Depot. Joe Senerchia, Superintendent of DPW will be looped into the conversation for further discussion. The Village Board voice voted in favor of the project. 8:33 PM – Nick Tedrow, 125 Main Street, Ossining. Representing Sustainable Westchester. Presented options regarding Westchester Power and Community Energy and electricity supply program. 8:45PM – Tushar Udeshi – 305 6th Ave – One point of note is that the walk from Lot 7 & 9 are a much further walk then they are used to and not feasible for their people. Looking at the logistics, creating the street parking is taking away from patrons of the restaurants, and he feels it is not an effective parking plan. His proposal is to create some spots on 6th Avenue, as it is a wider street than most, as he feels it is the most feasible way to accommodate the population at 305 6th Ave and feels there is value to that consideration. The Mayor responded that what often happens with overnight permit holders, during the day the capacity of lots drops to 25% during the day which allows for the double use of permit and meter parking. Efforts were made to avoid using spots where a problem was anticipated. Gilda Bhiro, 305 6th Ave – Expressed concern over property value. She feels if she goes to sell and there is no parking lot, knowing the Village does not take residents into consideration when decisions are made and parking can be revoked or moved at any time, and no parking is allowed on the street. She feels the residents are being inconvenienced for new residents when the existing needs of the residents are not being met or taken care of. The Mayor responded that the fire house is about to fall down, a parking deck that is about to fall down, a police station that was not ever meant to be a police station, and a Village Hall that is not ADA compliant. The Mayor spoke of the funds required to repair or rebuild the current situation which would result in an uptick in taxpayer cost. The project allowed the Village to take on those renovations at no cost to the residents, with the benefit of parking on their private property. After the construction is completed, there is going to be a new public parking deck with 60 spaces, and maintain current parking plan as well. The goal of the parking schedule is to give priority to those who are closest to the different lots. A follow up question was posed asking if the Town made a deal with the builders of the new fire house at the expense of those in Lot 3, while homeowners are not being affected. And if a 12% tax raise would be spread out across the whole town and inconvenience everyone instead of just those at 305 6th Ave. She indicated that she will continue to fight for the value of her home, and will gather people who are against the firehouse moving to the new location. The mayor indicated it is to the benefit of the resident’s long term. Unknown Speaker – Why was the area behind Rockwell’s not considered for the new Municipal/Fire/PD station? The Mayor responded that when the first RFP was done in 2018, there were issues with access for the vehicles on Sparks and Wolfs Lane and the area was not conducive for the need and the Capital One building site was the geographic center of the Village. Village Board of Trustees Regular Meeting Tuesday, October 11, 2022 Unknown Speaker - The homeowners on 6th Ave have been fighting the change for a year. There are a lot of children walking and a dangerous situation could occur with the fire trucks. Why was the area behind Village Hall not considered, something could have been widened for the fire trucks. She expressed her feelings that she feels like it would have been a much better option and location to have the new municipal center located behind Village Hall. Feels that the people who it is effecting were not asked their opinion. She feels the residents’ opinions have not been heard. The Mayor responded that there have been a lot of public hearings over 4 ½ years to discuss, the public had their opportunity to share their feelings. The Mayor shared that the folks on 6th Avenue were heard, they felt most concerned about the fact that they did not want people parking in front of their homes. Deputy Mayor Carpenter indicated that the Fire Department will be operating out to 5th Ave. Terry Pizzuti, 305 6th Ave – a concern raised over seniors and disabled persons, children getting to school, her with arthritis and bad knees, bad weather, snow, rain, cold. When she gets home late at night, she is worried about crime, going to the store and carrying bags 5 blocks from where she parks her car. She feels from Lincoln to 6th Ave should have allocated spaces for the residents of 305 6th Ave. There is no thought of the people who own the co-ops and is causing large amounts of stress and is an anticipated hardship. She has been a resident of Pelham a long time and has never had to face anything like this. She does not want to walk up the hill and feels it changes her lifestyle because she does not feel safe. Will have challenges cleaning her car in the snow. Asks the Board to please take this all into consideration. Mayor Mullen responded that allocating more spaces on 6th Ave requires state approval which can be challenging. Unknown Speaker – uses the parking lot since 1996 for two cars and he understands this has been a discussion for a long time but feels the result of the discussion was not appropriate for those assembled and is upsetting for all those at 305 6th Ave. He spoke to numerous people and feels the decision really hurts all of them. He feels the Board needs to reconsider the project because it doesn’t work for many people. He asks the Board to leave the people alone and stop the project. He feels moving the parking to the new location is not appropriate and too far from their location. He feels they are getting kicked out of their location and it is very harsh. Mayor Mullen responded that the project is moving forward. Sylvia Moya, 305 6th Ave – Requested an explanation regarding the logistics of getting approval to park on the streets. A follow up statement was posed that it was a lot of work, and it is still shorter than the plan to park. Why is the Legislature so against people parking on the streets. Mayor Mullen responded with the process of planning, doing a full parking assessment, passing a resolution that goes to the State Representatives who sponsor it and the Assembly has a Committee who then goes through their checklist as to whether or not they will allow it. A full parking assessment was leading up to this, it passes through the committee to the Legislature and the Assembly and the Senate have to approve it and the Governor has to sign it. This process took about a year and a half. Deputy Mayor explained that Amy Paulin put in a lot of work to assist with getting this passed. The Mayor noted that getting the expansion was challenging. The Mayor tried to make sure to keep residents happy, ensuring there was a discount and a space for everyone. Michael Daniele 305 6th Ave – There has always been an issue with parking, his concern is plans for snow removal for the street parking, the plan for not getting snowed in and retrieving cars in a Village Board of Trustees Regular Meeting Tuesday, October 11, 2022 reasonable amount of time during a snow storm. Concern about un-shoveled sidewalks and walking to get to his car. Mayor Mullen responded that we already have some on street parking and are practiced in snow removal of street lots. The sidewalk issue is one he is glad was raised and will discussed with the DPW. May consider waiving certain parking restrictions in anticipation of a storm. Mila Vishinsky, 305 6th Ave – Sees that Pelham is a community, and feels that if one has to sacrifice, all should have to sacrifice. Feels her last benefit is being taken with the parking changes. Does not understand why she cannot park on 6th Ave overnight, when she is allowed to park during the day. Notes that in 3 years, we are going to be getting back a lot, can they compromise for 3 years with those neighbors that live on 6th Ave. Shared concerns of safety at night when traveling back and forth to new parking locations, and challenges of parents bringing their children home at night. Can police escorts be arranged for those walking late at night from the parking location to the building? Expressed that she feels like a second-grade citizen. Delilah Hanna, 305 6th Ave – Concerned about the most vulnerable residents which are the senior residents and those with children. How are those populations being prioritized and assisted? And how stable are the parking locations as her mother’s car was towed and she was out of town and there was a street fair event. Follow up statement made that there is no protection for the most vulnerable residents. Feels there is a big difference between a structure and street parking with a hill. Feels every factor needs to be considered when these changes are being made. Mayor Mullen responded that he does not feel there would be any events being held in Lot 9. We are reaching out directly to those with Handicap permits which is the way we have to differentiate. Mayor Mullen responded that we are selling permits as close to people’s residences as we can as there is only so much land to work with. Wayne Simmons, 305 6th Ave – With all this movement and activity, a portal has been created for people to leave Pelham, whether they want to or not. Patricia Dinapoli, 305 6th Ave – Remembers when construction was going on in Lot 2, residents were given special permits to park on the street. Why can Lot 3 permit holders not get a special permit to park on the street during construction? Feels that this situation is an emergency as well. The town street is not private and should be accessible to all residents. Mayor Mullen responded that it was an emergency situation as an engineer gave a report that the parking deck needed to be cleared by the following morning. That situation had its own challenges as well. He emphasized that this project is moving forward as planned, he is going to walk 6th Ave and note if there are 5-10 available spaces and go back to the state for approval but to note that the spots will in front of homes and no amount of parking on the street to satisfy all permit holders in the lots. Sharon Daniele, 305 6th Ave – Failing to understand why parking during the day in front of the neighbors’ houses, why parking can’t occur there overnight. If she comes home late at night, has to call husband to go with her to Lot 9, as she is nervous walking home alone. Feels that crime is happening everywhere. Says 5-10 years ago, there was a couple that lived in Manhattan that had moved to Pelham and the woman was raped. She feels vulnerable and worries about being in the wrong place at the wrong time. She is paying taxes as a homeowner and feels not equal to the others in Pelham. Feels they should have the right to park on 6th Ave, as she feels her building is doing the most sacrificing and the homeowners should have to sacrifice as well. Village Board of Trustees Regular Meeting Tuesday, October 11, 2022 Mayor Mullen responded that there are other permit holders that are also moving to further locations, it does not only affect 305 6th Ave. He is going to look for spots along 6th Ave, keeping in mind the other residents who have come to previous meeting to share their feelings. Right now, the Lot 3 holders are the only ones who can purchase in Lot 9 and he recommends making the change. Village Trustee Hill-Reis asked if there is a way to appeal to the State Representatives if the residents are to write letters appealing for the spots which may help the process along faster. Deputy Mayor says this has been discussed since 2017 and is not a surprise as it has been covered in press, emails and the meetings. Deanna Zammiti, 322 6th Ave, Board member of the Pelham Chamber of Commerce. Has spoken with a number of businesses in Pelham, who feel the aggressive jump in fines is disincentivizing for those shopping in Pelham. Expressed that being hit with a $50 fine can be quite a shock. Two counter strategies were suggested, and the Mayor confirmed those were the counter strategies proposed this evening. The Pelham Chamber of commerce is for the reduction of the fees. Personally, Deanna feels that the moment of impact is when you receive the ticket and the emotional impact can deter patrons in the future. Follow up was stated that she did speak to a business owner that stated he has had customers say not to park downtown and not to go to the stores because they get tickets and forget, and the cost continues to rise and the parents end up with a high fine. Village Trustee Hill-Ries indicated there is a cap to the parking fines. They are not fees, they are fines. A reminder to keep quarters and download the app, there are ways to avoid these fines. Glad were able to work with the Chamber to get the fees down to numbers people are comfortable with. 2. Cristina Chianese, President of the Chamber of Commerce, 535 Stellar Ave, Pelham Manor. Appreciates the thoughtfulness of the Board in taking their letter of suggestion seriously and pivoting quickly to accommodate their concerns. The $35 sounds better, and dropping the fee as they have done is a very fair compromise and will serve all well by going back to the businesses and showing their concerns were heard. 3. Francile Albright Mullen, 322 1st Ave, Deputy Executive Director of The Picture House, the fees have been in effect for a little while, and no negative feedback has been received, nor has there been a drop down in business based on the fines. Noted that landscaping crews for his neighbors have started before the allotted times outlined in the code. Encourages the Board to look at this further to move towards a cleaner, greener future. Deputy Mayor Carpenter agrees that the ideal change would be no more gas-powered leaf blowers, like Larchmont. And the community may not be fully behind it at this time, however this is a good first step, with perhaps the next big leap going forward. Deanna Zammit, 322 6th Ave – Why just Sunday? Why not Saturday and Sunday? Deputy Mayor Carpenter responded that they took a look at the municipalities around us and noted they were along the same lines. Felt if an initial step were to be taken, that Sundays may be the best initial buy in. The reason for the exception for Sundays, if you do your own yard work, there is a day available to do outdoor chores. Follow up question posed as to why Pelham Manor does Sunday and Monday? Village Trustee Hill-Ries and Deputy Mayor Carpenter responded they are not fully aware as to why. Francine Albright Mullen, 322 1st Ave, Is not a fan of leaf blowers, understands why it makes sense to start small and then expand. Hopes this idea is not tabled, and some language would be included on how it will be enforced. Would love to see Sundays and Mondays without gas leaf blowers.
