Village Trustee McGreal – Thanks to Bobby and the DPW for meeting with the Arts Council, Artist and Art Center about the new installation going up in April; and for removing the yellow sculpture and transporting it to the Art Center for display there. We’re very excited about the new installation going in! We are gearing up for Juneteenth - please contact a council member if you would like to serve as a volunteer on the committee or for the day of the event. We are also gearing up for another summer concert series, we have some new ideas for this summer. Stay tuned, and pray, dance, and sing for better weather luck this summer! Village Trustee Mohan – An activity report from the Fire Department shows that there was a total of 54 calls made in February, 4 of which pertained to structural fires. A reminder from Fire Chief Benkwitt to change the batteries in your smoke and carbon monoxide detectors, and to make sure addresses are visible from the street. A reminder to business and multiple family dwellings as well that they must have a Knox Box on the premises and if they do not, they are urged to call the Fire Department. Fire Chief Benkwitt attended a virtual meeting of the Westchester County Stake Holders sponsored by Westchester County Office of Emergency Management in February where they continued to make sure we are prepared for any and all emergencies. Village Trustee Otondi – nothing to report. Village Trustee Solomon – Residents that live near St. Catharine’s Church, from First to Fourth Avenue, are being asked to curb their dogs and be respectful of neighbors. Deputy Mayor Carpenter – A reminder that there is no election in the Village of Pelham in the month of March. Item # 5 - Village Administrator’s Report: Village Board of Trustees Regular Meeting Tuesday, March 12, 2024 A few updates in terms of grants, there were three grants that the Village was not approved for. Two with the Department of Environmental Conservation and one for sanitary sewer main replacement. The Village of Pelham also saw a grant through the Westchester CUNY Foundation regarding the decarbonization of the DPW building, however we were not chosen for it. The current grants we have in progress are the Westchester County Flood Mitigation Grant Program through Westchester County Planning Department. Phase one of the grant is engineering and soft cost while phase two is construction. Another grant given to the Village comes from the US Congress Community Project Funding which will be geared towards storm water as well. The Fire Department is looking into a possible grant for their staff and fire prevention training. In other news, the Department of Public Works starts Spring Leaf Collection on Friday, March 15 th through Tuesday, April 30th. Loose leaves can be placed curbside while all other organics must be bagged. Regular organic collection begins on Wednesday, May 1st and ends on Wednesday, October 9th. Item # 6 - Mayor’s Report In terms of flood mitigation, Mayor Mullen made a request for a voluntary easement from the School District. The District identified representatives from their Board to reach out to the Mayor and Board of Trustees and come up with a mutual arrangement. After Mayor Mullen was contacted by the representatives, he spoke with Village Administrator Scelza as well as the Village Attorney and came to the decision of a meeting with them as well as Deputy Mayor Carpenter and Village Trustee Mohan. Item # 7 - Public Comments No public comment. Village Board of Trustees Regular Meeting Tuesday, March 12, 2024 Non-Recurring Items Item # 8 – Heart and Soul Hospitality Group, Inc., - Outdoor Dining Special Permit (65 First Street, SBL 163.44-1-2.7) Resolution Pursuant to the New York State Environmental Quality Review Act (SEQRA) Regarding the Application of Heart and Soul Hospitality Group, Inc. (d/b/a The Rail House 10803) 65 First Street Outdoor Dining Special Permit Be it resolved by the Board of Trustees of the Village of Pelham, as follows: A. The proposed action is the approval of a Special Permit for outdoor dining pursuant to Chapter 98-106.5 of the Village Code. The proposal is to adapt a 600 square foot portion of the existing paved parking area for outdoor dining. The outdoor dining area would have approximately sixteen (16) tables and would be under an outdoor tent structure. The dining area would be screened from views of adjacent properties and roadways with natural landscaping. Since the dining area would be located in the property’s existing parking area, the restaurant would provide a valet parking service, pursuant to Sections 98-113(H) and 98-106.5[F]. B. The Village Board of Trustees has reviewed the application for Outdoor Dining, dated March 5, 2024, and considered the Short Environmental Assessment Form submitted by the applicant. C. The Village Board of Trustees has determined that: i. the proposed action is subject to the requirements of SEQRA; ii. the proposed action is an Unlisted Action; iii. the action is not located in an agricultural district; and Be it further resolved, that the Board of Trustees has determined that the Code of the Village of Pelham requires that the proposed action be referred to the Village of Pelham Architectural Review Board and directs the Deputy Village Clerk to make that referral; and Be it further resolved, that the Board of Trustees has determined that because there are no other involved agencies, it will serve as lead agency for purposes of the SEQRA review, in accordance with 6 NYCRR § 617.6(b). Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby adopts and approves the Standstill Agreement; and Be it further, that the Village’s counsel is authorized to execute the Standstill Agreement; and Be it further, that the Village Administrator, Village staff and counsel for the Village are hereby authorized to take any and all actions necessary to implement the Standstill Agreement. Deputy Mayor Carpenter does not think it is a good use of our public spaces. He discussed a proposed amendment to the Village Code limiting the Village’s ability to give permits for political campaign posters only to elections that either Village voters are affected by or promoting. In order to put up posters you come to Village Hall and pay $250 and are good to post 3 weeks prior to a primary special or general election. Deputy Mayor Carpenter believes it should be limited to elections that affect Pelham. Village Trustee Mohan states that would be a constitutional issue, specifically the first amendment and it should be discussed further. Mayor Mullen wants the Village Attorney to weigh in in terms of time, place and manner. Discussion on Chapter 98 re: Zoning Definition Change Deputy Mayor Carpenter reported back to the Village Board of Trustees regarding a question that was raised at the February 27th Work Session respecting the proposed definition of Indoor Recreation Facility. The proposed edit is talking about “within an enclosed building”. Deputy Mayor Carpenter interpreted that as the use being only what is inside the walls and what happens outside is separate, but it’s not the case. The use would only be for inside an enclosed premise. Meaning if there was an indoor recreational facility that had a backyard patio, the use could not extend outside the walls to the backyard (because of how it is defined). Deputy Mayor Carpenter wants the Village Board of Trustees to take it into consideration. The concern is that it is a new use and bringing it outside is a material change. It was supposed to be for internal use and it would be limited to the property. Mayor Mullen suggests adding the word primarily?
