Village Trustee Eldahry – nothing to report.
Village Trustee McGreal – absent.
Village Trustee Mohan – The planning for our annual 9/11 Memorial is scheduled for Wednesday,
September 11, at 8:30 AM. Congratulations to Hometown Hero Katie Douglas for representing us
well!
Village Trustee Otondi – Trustee Otondi and Department of Public Works Foreman Robert Giustino
are trying to figure out how to get utilize funds for road paving. It has been a challenge due to the
many roads that need to be maintained in Pelham.
Village Trustee Solomon – Thank you again for listening to the additional things in the work session,
and Trustee Solomon is excited to continue the conversation.
Deputy Mayor Carpenter – nothing to report.
Item # 5 - Village Administrator’s Report:
Field work on Fiscal Year 23-24 has been completed. The final financial statements will be available
sometime this fall. There is going to be a finalization of what roads will be paved in the Village. The
Village is also accepting resumes and letters of interest for the position of Village Clerk throughout
the end of August, please visit pelhamny.gov for more information.

Item # 6 - Mayor’s Report
The Village is planning to double the budget for road paving this year. We have received about
$250,000 in CHIPS funds, so we are putting close to half a million dollars towards paving. Second,
this Saturday we have an upcoming concert in the park from 6:30 to 8:00 PM, be sure to check it
out. Finally, congratulations to Kate Douglas for doing so well in the Olympics!
A welcome to Reeve Murrell, who is helping us put together a spreadsheet of permitted uses and
special permit uses in the Village’s downtown area as well as all the other downtown areas in
Westchester.

Pelham Village Code Entitled “Ethics, Code of”
Whereas, the Board of Trustees of the Village of Pelham has proposed an amendment to Chapter 5
of the Pelham Village Code Entitled “Ethics, Code of”; and
Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the
local law is a Type II Action and are therefore not subject to the requirements of the New York State
Environmental Quality Review Act (SEQRA); and
Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper
of the Village of Pelham; and
Whereas, said public hearing was held on August 6, 2024, at or about 8:00 p.m. online via Zoom
and in Village Hall and all parties in attendance were permitted an opportunity to speak on behalf of
or in opposition to said to proposed local law or any part thereof.
Now, therefore, be it resolved, as follows:
1. The Board of Trustees hereby adopts Local Law No. 6 of 2024 of the Village of Pelham to amend
Chapter 5 of the Pelham Village Code entitled “Ethics, Code of”;
2. The Board of Trustees directs the Deputy Village Clerk to prepare said Law for filing with the
Secretary of State.

Item # 12 - Resolution Adopting Local Law No. 7 of 2024 to Amend Chapter 90 of the
Pelham Village Code Entitled “Vehicles and Traffic” re: 25 MPH Village-Wide Speed Limit
Whereas, the New York State Legislature has adopted legislation authorizing municipalities to
reduce their legal maximum speed limit from 30 MPH to 25 MPH; and
Whereas, the legislation recognizes that the reduction in speed reduces the risk of injury or death
from automobile accidents between motorists and pedestrians. The “Justification” section of the
legislative history for this legislation states: “According to the AAA Foundation for Traffic Safety, a
pedestrian struck by a vehicle going 25 MPH has a 25 percent risk of sustaining a serious or fatal
injury, a 50 percent risk at 33 MPH and a 75 percent risk at 41 MPH.”; and
Whereas, the Board of Trustees of the Village of Pelham has proposed a Local Law to reduce the
maximum speed at which vehicles may proceed in the Village of Pelham from 30 MPH to 25 MPH;
and
Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the

Signal Modifications and ADA Ramps at the Intersection of Wolfs Lane and Sparks
Avenue (bid deadline and opening 7/17/24, 10:00 a.m.)
Whereas, the Village of Pelham (“Village”) issued a notice to bidders in request for bids under
Contract # 2024-01 for Pedestrian Signal Modifications and ADA Ramps at the Intersection of Wolfs
Lane and Sparks Avenue; and
Whereas, a public notice was duly published in the Journal news, an official newspaper of the
Village and on the Village’s website pursuant to New York State General Municipal Law § 103 (2); and
Whereas, at 10:00 a.m. E.S.T., on Wednesday, July 17, 2024, the Village Administrator publicly
opened and read aloud two proposals in Village Hall; and
Whereas, on reviewing the proposal, the bids were as follows:
Total Base Bid
1. Verde Electric Maintenance Corp. $275,535.00
2. Coppola Paving and Landscape Corp. $282,000.00
Whereas, the Village’s consulting Engineer and Village Administrator have determined that the
lowest responsible bid that meets the requirements is Verde Electric Maintenance Corp.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby awards
Contract # 2024-01 for Pedestrian Signal Modifications and ADA Ramps at the Intersection of Wolfs
Lane and Sparks Avenue at the total base bid cost of two-hundred seventy-five thousand five-
hundred thirty-five dollars ($275,535.00) to Verde Electric Maintenance Corp.; and
Be it further resolved, that the Village Administrator is hereby authorized to execute Contract #
2024-01 with said Verde Electric Maintenance Corp. and to undertake administrative acts as may be
required under said Agreement; and
Be it further resolved, the respective capital project and project budget is established, as follows:

Be it resolved, the Tri-Municipal Resurfacing of Various Roads Contract, be awarded to Laura Li
Industries, 136 Park Lane West Harrison, NY 10604, at the unit bid prices itemized as follows: Bid
Item 1 Bituminous Top Course - $133.00 per ton; Bid Item 2 Asphalt Removal (milling) – $5.85 per
square yard; Bid Item 3 Mill and Fill -$145.00 per ton; Bid Item 4 Adjustment of Manhole Castings –
$700.00 each; Bid Item 5 ADA Ramps - $2,650.00 each; based on estimated work quantities not to
exceed budgeted appropriations; and
Be it further resolved, that the Village Administrator is hereby authorized to execute Contract with
said Laura Li Industries, 136 Park Lane West Harrison, NY 10604, and to undertake administrative
acts as may be required under said Agreement.

Be it resolved, that the Board of Trustees of the Village of Pelham hereby confirms the Mayor’s
appointment of Oliver Cespedes, of Cortlandt Manor, New York, to the position of Police Officer (4th
Grade) Job Class Code 0134-01, effective Monday, August 19, 2024, at an annual salary of
$84,190.00, subject to the requirements of Westchester County Civil Service, the current Village of
Pelham Police Benevolent Association Collective Bargaining Agreement, Village of Pelham Employee
Handbook, the Unconsolidated Laws of New York State and any other applicable regulations in place
and for a probationary period of one (1) year; and
Be it further resolved, that the Village Administrator is authorized to take the necessary actions to
effect this appointment.

Class Code 0134-01, effective Monday, August 19, 2024, at an annual salary of $84,190.00, subject
to the requirements of Westchester County Civil Service, the current Village of Pelham Police
Benevolent Association Collective Bargaining Agreement, Village of Pelham Employee Handbook, the
Unconsolidated Laws of New York State and any other applicable regulations in place and for a
probationary period of one (1) year; and

Regarding an Amendment to Chapter 98-73 (A) of the Code of the Village of Pelham to
Add Outdoor Recreation Facility as a Use Requiring a Special Permit in the Village’s
Business-1 District and Add a Definition of Outdoor Recreation Facility to Chapter 98-6
Whereas, the Board of Trustees of the Village of Pelham has proposed a local law to amend Chapter
98-73 (A) of the Code of the Village of Pelham to Add Outdoor Recreation Facility as a Use Requiring
a Special Permit in the Village’s Business-1 District and Add a Definition of Outdoor Recreation Facility
to Chapter 98-6
Whereas, pursuant to the New York State Environmental Quality Review Act (SEQRA), on June 25,
2024, the Village Board of Trustees prepared a Short Environmental Assessment Form (EAF),
declared itself to be lead agency and identified the proposed action as an Unlisted Action; and
Whereas, notice was duly provided to the County of Westchester as required by General Municipal
Law § 239-m, 239-n and 239-nn and Westchester County Administrative Code § 277.61 and 277.71;
and
Whereas, the Board of Trustees of the Village of Pelham determined the Code of the Village of
Pelham § 98-141 requires the proposed action be referred to the Planning Board and such referral
was made on 6-25-2024.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby calls
for a Public Hearing on Tuesday, September 10, 2024, at 8:00 p.m. or soon thereafter on a proposed
local law to amend Chapter 98 of the Pelham Village Code entitled “Zoning”. This meeting will be held
at Village Hall, 195 Sparks Avenue, Pelham, New York; and
Be it further resolved, that those members of the public who want to attend/participate in the

Item # 19 – Other Business
Pro Housing Community Resolution: Mayor Mullen wants to make sure we comply with pro housing
communities, which is the State’s program to try and encourage more housing. You can become
certified as a pro housing community by either building a certain number of units, which the Village
has done, or by passing this resolution. The conversations with the State Housing Authority are going
to be picking up again.
When Village Trustee Solomon was at Nycom, this was a big conversation. By having this resolution,
it fast tracks the Village for other opportunities and grants.
Affordable Housing Ordinance: Mayor Mullen and Deputy Mayor Carpenter had a conversation
regarding the Affordable Housing Ordinance, it is something we need but also something that has to
be done correctly. The County Planning Board is obligated to encourage all municipalities to adopt
some uniform standard on how they approach this. The basic explanation of it is that you must have
something in the code that requires incoming developers to set aside some percentage of their units
(5% to 10%) that are pegged as AMI. Many different municipalities comply with it, and there are
different ways to build it in.

Whereas, the Board of Trustees of the Village of Pelham has proposed an amendment to Chapter 5
of the Pelham Village Code Entitled “Ethics, Code of”; and
Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the
local law is a Type II Action and are therefore not subject to the requirements of the New York State
Environmental Quality Review Act (SEQRA); and
Whereas, a notice of public hearing was duly advertised in the Journal News, the official newspaper
of the Village of Pelham; and
Whereas, said public hearing was held on August 6, 2024, at or about 8:00 p.m. online via Zoom
and in Village Hall and all parties in attendance were permitted an opportunity to speak on behalf of
or in opposition to said to proposed local law or any part thereof.
Now, therefore, be it resolved, as follows:
1. The Board of Trustees hereby adopts Local Law No. 6 of 2024 of the Village of Pelham to amend
Chapter 5 of the Pelham Village Code entitled “Ethics, Code of”;
2. The Board of Trustees directs the Deputy Village Clerk to prepare said Law for filing with the

Item # 12 - Resolution Adopting Local Law No. 7 of 2024 to Amend Chapter 90 of the
Pelham Village Code Entitled “Vehicles and Traffic” re: 25 MPH Village-Wide Speed Limit
Whereas, the New York State Legislature has adopted legislation authorizing municipalities to
reduce their legal maximum speed limit from 30 MPH to 25 MPH; and
Whereas, the legislation recognizes that the reduction in speed reduces the risk of injury or death
from automobile accidents between motorists and pedestrians. The “Justification” section of the
legislative history for this legislation states: “According to the AAA Foundation for Traffic Safety, a
pedestrian struck by a vehicle going 25 MPH has a 25 percent risk of sustaining a serious or fatal
injury, a 50 percent risk at 33 MPH and a 75 percent risk at 41 MPH.”; and
Whereas, the Board of Trustees of the Village of Pelham has proposed a Local Law to reduce the
maximum speed at which vehicles may proceed in the Village of Pelham from 30 MPH to 25 MPH;
and
Whereas, the Board of Trustees of the Village of Pelham has determined that the adoption of the
local law is a Type II Action and are therefore not subject to the requirements of the New York State
Environmental Quality Review Act (SEQRA).

Signal Modifications and ADA Ramps at the Intersection of Wolfs Lane and Sparks
Avenue (bid deadline and opening 7/17/24, 10:00 a.m.)
Whereas, the Village of Pelham (“Village”) issued a notice to bidders in request for bids under
Contract # 2024-01 for Pedestrian Signal Modifications and ADA Ramps at the Intersection of Wolfs
Lane and Sparks Avenue; and
Whereas, a public notice was duly published in the Journal news, an official newspaper of the
Village and on the Village’s website pursuant to New York State General Municipal Law § 103 (2); and
Whereas, at 10:00 a.m. E.S.T., on Wednesday, July 17, 2024, the Village Administrator publicly
opened and read aloud two proposals in Village Hall; and
Whereas, on reviewing the proposal, the bids were as follows:
Total Base Bid
1. Verde Electric Maintenance Corp. $275,535.00
2. Coppola Paving and Landscape Corp. $282,000.00
Whereas, the Village’s consulting Engineer and Village Administrator have determined that the
lowest responsible bid that meets the requirements is Verde Electric Maintenance Corp.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby awards
Contract # 2024-01 for Pedestrian Signal Modifications and ADA Ramps at the Intersection of Wolfs
Lane and Sparks Avenue at the total base bid cost of two-hundred seventy-five thousand five-
hundred thirty-five dollars ($275,535.00) to Verde Electric Maintenance Corp.; and
Be it further resolved, that the Village Administrator is hereby authorized to execute Contract #
2024-01 with said Verde Electric Maintenance Corp. and to undertake administrative acts as may be
required under said Agreement; and
Be it further resolved, the respective capital project and project budget is established, as follows:

Be it resolved, the Tri-Municipal Resurfacing of Various Roads Contract, be awarded to Laura Li
Industries, 136 Park Lane West Harrison, NY 10604, at the unit bid prices itemized as follows: Bid
Item 1 Bituminous Top Course - $133.00 per ton; Bid Item 2 Asphalt Removal (milling) – $5.85 per
square yard; Bid Item 3 Mill and Fill -$145.00 per ton; Bid Item 4 Adjustment of Manhole Castings –
$700.00 each; Bid Item 5 ADA Ramps - $2,650.00 each; based on estimated work quantities not to
exceed budgeted appropriations; and
Be it further resolved, that the Village Administrator is hereby authorized to execute Contract with
said Laura Li Industries, 136 Park Lane West Harrison, NY 10604, and to undertake administrative
acts as may be required under said Agreement.

Be it resolved, that the Board of Trustees of the Village of Pelham hereby confirms the Mayor’s
appointment of Oliver Cespedes, of Cortlandt Manor, New York, to the position of Police Officer (4th
Grade) Job Class Code 0134-01, effective Monday, August 19, 2024, at an annual salary of
$84,190.00, subject to the requirements of Westchester County Civil Service, the current Village of
Pelham Police Benevolent Association Collective Bargaining Agreement, Village of Pelham Employee
Handbook, the Unconsolidated Laws of New York State and any other applicable regulations in place
and for a probationary period of one (1) year; and
Be it further resolved, that the Village Administrator is authorized to take the necessary actions to
effect this appointment.

Regarding an Amendment to Chapter 98-73 (A) of the Code of the Village of Pelham to
Add Outdoor Recreation Facility as a Use Requiring a Special Permit in the Village’s
Business-1 District and Add a Definition of Outdoor Recreation Facility to Chapter 98-6
Whereas, the Board of Trustees of the Village of Pelham has proposed a local law to amend Chapter
98-73 (A) of the Code of the Village of Pelham to Add Outdoor Recreation Facility as a Use Requiring
a Special Permit in the Village’s Business-1 District and Add a Definition of Outdoor Recreation Facility
to Chapter 98-6
Whereas, pursuant to the New York State Environmental Quality Review Act (SEQRA), on June 25,
2024, the Village Board of Trustees prepared a Short Environmental Assessment Form (EAF),
declared itself to be lead agency and identified the proposed action as an Unlisted Action; and
Whereas, notice was duly provided to the County of Westchester as required by General Municipal
Law § 239-m, 239-n and 239-nn and Westchester County Administrative Code § 277.61 and 277.71;
and
Whereas, the Board of Trustees of the Village of Pelham determined the Code of the Village of
Pelham § 98-141 requires the proposed action be referred to the Planning Board and such referral
was made on 6-25-2024.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham hereby calls
for a Public Hearing on Tuesday, September 10, 2024, at 8:00 p.m. or soon thereafter on a proposed
local law to amend Chapter 98 of the Pelham Village Code entitled “Zoning”. This meeting will be held
at Village Hall, 195 Sparks Avenue, Pelham, New York; and
Be it further resolved, that those members of the public who want to attend/participate in the
