Item # 5 - Village Administrator’s Report:
The Village has received 150 new parking meters through funding from the Westchester County
Downtown Improvement Grant. The Department of Public Works has begun the installation and it is
anticipated to be completed in the upcoming weeks.
On Tuesday, November 4th, there will be no garbage or recycling collection due to the holiday. All
information has been posted to our website.

Item # 6 - Mayor’s Report
Mayor Mullen thanked Administrator Scelza for his efforts in coordinating with the MTA on the Penn
Station Access Project, which recently began tree clearing between Corona and Monterey. His work
ensured that the MTA will install site screening and fencing to reduce visual impact and noise, as well
as commit to replanting trees, ideally a row of evergreens, once construction is complete. The MTA
also agreed to remove several dead trees in the area. The track work is expected to be completed by
early December, or at the latest by the end of the year, with replanting scheduled for spring.
Mayor Mullen reminded residents that Election Day is on Tuesday and encouraged everyone to vote,
as participation remains essential.

Ciro Greco, 37 Third Ave: Ciro is representing the Planning Board. He has brought in plans from
Jessie Development Co., LLC at 46 Second Avenue as well as a proposed lot line adjustment and site
plan approval at 64 Lincoln Avenue and 216 Third Avenue to the Mayor and Board for approval.

Item # 8 – Resolution Approving Site Plan Application for Jessie Development Co., LLC.
at 46 Second Avenue
Whereas, the proposed action is a request to grant Site Plan approval to construct a single-family
residence at 46 Second Avenue. The 5,018 square foot property is located in the Residential B-2
Zoning District; and
Whereas, the Village Board of Trustees has reviewed and considered the Site Plan Application and
Declaration of Intent to Develop, received on September 3, 2025; and
Whereas, pursuant to Village Code § 34-23, the Applicant has submitted the requisite documents
and fees; and
Whereas, Village Code § 79-5 authorizes the Village Board of Trustees to grant Site Plan approval
for proposed developments that comply with Village Code; and
Whereas, Jessie Development Co., LLC., (“46 Second Avenue” or the “Applicant”) has applied to
develop the property known as 46 Second Avenue in accordance with those requirements and
standards; and
Whereas, Jessie Development Co., LLC., has represented to the Village Board of Trustees that it is
the lawful owner or contract vendee of the 46 Second Avenue Property; and
Whereas, in furtherance of its application, Jessie Development Co., LLC., has submitted to the
Building Inspector a Site Plan Application and Declaration of Intent to Develop accompanied by the
requisite documents, information and fees; and
Whereas, Jessie Development Co., LLC., has further submitted a formal and complete proposed Site
Plan prepared by Mastrogiacomo Engineering, P.C., dated 9-10-2025, satisfying the requirements of
Village Code Chapter 79, showing a proposed development and use of the 46 Second Avenue; and
Whereas, Jessie Development Co., LLC., proposes to create a single-family residential dwelling with
two (2) off-street parking spaces; and
Whereas, Jessie Development Co., LLC., consists of one tax parcel, Parcel 163.35-1-52-1, which is
located in the Residence B-2 Zoning District; and
Whereas, the proposed application was referred to the Planning Board and the Architectural Review
Board; and
Whereas, at the September 17, 2025, meeting of the Architectural Review Board (“ARB”), the ARB
reviewed the plans dated September 10, 2025, that responded to previous ARB comments; and
Whereas, at the September 17, 2025, meeting the ARB recommended to the Village Board of
Trustees that the Site Plan be approved; and
Whereas, at the October 21, 2025, meeting of the Planning Board, the Planning Board
recommended the site plan be approved; and
Whereas, the Village Board of Trustees affirms that:
(a) the proposed action is subject to the requirements of SEQRA;
(b) the proposed action is an Unlisted Action;

(c) the action is not located in an agricultural district;
(d) the Westchester County Board of Health is an involved agency, and
Whereas, Jessie Development Co, LLC., provided notice of its application to all property owners
contiguous to the applicant’s property as required; and
Whereas, notice was duly provided to the County of Westchester; and
Whereas, pursuant to the New York State Environmental Quality Review Act (SEQRA), on the Village
Board of Trustees received a Short Environmental Assessment Form (EAF), declared itself to be lead
agency and identified the proposed action as an Unlisted Action; and
Whereas, the Village Board of Trustees (1) considered the action as defined in 6 NYCRR §§617.2(b)
and 617.3(g); (2) reviewed the EAF, the criteria for determining significance set forth in 6 NYCRR
§617.7(c) and any other supporting information to identify the relevant areas of environmental
concern; (3) thoroughly analyzed the identified relevant areas of environmental concern to determine
if the action may have a significant adverse impact on the environment; and (4) set forth its
determination of significance in this Resolution; and
Whereas, the Village Board of Trustees considered the standards for Site Plan review established by
Village Code § 79-5.
Now, therefore, be it resolved, that after considering the documents submitted by the Applicant,
as recited above, the recommendation from the Architectural Review Board and the Planning Board,
the Board of Trustees of the Village of Pelham finds and determines as follows:
A. The proposed action will not have a significant effect on the environment and a Draft
Environmental Impact Statement will not be required; and
B. The property satisfies the requirements for consideration under Village Code § 79-5; and
C. The final Site Plan Approval is based on the following drawings prepared by Mastrogiacomo
Engineering P.C., dated 9-10-2025 that have been submitted by the Applicant (collectively, the
“Drawings”):

D. Site Plan approval is granted subject to the following conditions:
1. The Applicant shall, as a condition of Site Plan approval and prior to the issuance of a Building
Permit submit to the Building Inspector a complete and final set of plans and documents,
consistent with the conditions articulated above and as required by Chapter 34 of the Village

Code. Substantive deviations from the plans approved by the Board of Trustees will require a
resubmission to the Village Board of Trustees for a modification to an approved Site Plan.
This Site Plan approval is binding upon the applicant, the property owner and any subsequent owner of
the property and may not be changed without the approval of the Board of Trustees of the Village of
Pelham. If any term of this site plan approval is violated, the Building Inspector may stop work, revoke a
building permit or deny a certificate of occupancy.
Be it further resolved, that in accordance with Village Code § 79-7, this site plan approval shall be
null and void if the applicant fails to obtain a building permit within 120 days of this resolution unless
the Board of Trustees extends, by resolution, the time within which to do so; and
Be it further resolved, that this site plan approval will be null and void if the applicant does not
commence construction within six months of the date of the issuance of a building permit, unless the
Village Board of Trustees extends, by resolution, the time within which to do so.

Item # 9 – Resolution Approving Proposed Lot Line Adjustment and Site Plan Approval

Whereas, the Village Board of Trustees has found and determined that encouraging property
owners to use property more efficiently to reinvigorate the Village's downtown area will be more
cost-effective because it will use infrastructure that already exists and thereby avoid the need to
create additional costly infrastructure; owner investment in existing properties that creates additional
capacity for off-street parking is beneficial to adjacent property owners; and that developing within
the Village's downtown core will preserve, complement and be compatible with the character,
massing, and scale of adjacent residential land uses; and
Whereas, Pelham Funeral Home c/o Clive J. Anderson Realty LLC (the “Applicant”) has applied to
develop the property known as 64 Lincoln Avenue and 216 Third Avenue in accordance with those
requirements and standards; and
Whereas, the Applicant has represented to the Village Board of Trustees that it is the lawful owner
or contract vendee of 64 Lincoln Avenue and 216 Third Avenue; and
Whereas, the application comprises two tax parcels, Parcel 163.28. Lots 5 & 6 which are located in
the Business-1 and Residence A-3 Zoning District, respectively; and
Whereas, the Applicant has petitioned for a Zoning Map and Zoning Text Change, a Lot Line
Adjustment, and Site Plan Approval for a new parking lot and two new garages; and
Whereas, Village Code § 98 authorizes the Village Board of Trustees to modify, a Zoning Map,
Zoning Ordinance, and adjust a lot line in the manner provided by Article 7 of the New York State
Village Law; and
Whereas, in furtherance of its application, the Applicant has submitted to the Building Inspector a
Declaration of Intent to Develop accompanied by the requisite documents, information and fees; and
Whereas, the Applicant has further submitted a proposed site plan prepared by Mastrogiacomo
Engineering, P.C., dated 10-01-2023 and last revised 01-20-2025 satisfying the requirements of
Village Code Chapter 79, showing a proposed development and use of the 64 Lincoln Avenue and
216 Third Avenue property; and
Whereas, the Applicant petitioned the Village Board of Trustees to amend the Zoning Map to extend
the Business-1 (Bus-1) Commercial Zoning District 25’ to the south; and
Whereas, the Applicant petitioned the Village Board of Trustees to amend Section 98-8 of the Village
of Pelham Zoning Ordinance and adopt:
“Section 98-8 D. The Business-1 District as shown on the Zoning Map of the Village of Pelham, dated
June 2, 1987 is hereby extended to include 25’ of the property to the south (formerly zoned as
Residence A-3) and as further identified as Section 163.28-1-5 & 6 on the Town of Pelham Tax
Map.“; and

Whereas, Mastrogiacomo Engineering, P.C. submitted the following documents and plans in support
of the application:
• Site Plan Application and Intent to Develop Form, undated;
• Short Environmental Assessment Form dated 12-11-2023 and last revised 01-24- 2025;
• T100 – Title Sheet, Vicinity Map and WEB Soil Survey prepared by Mastrogiacomo Engineering
for Clive J Anderson LLC – dated 10-01-2023;
• Proposed site plan and zoning analysis table, prepared by Mastrogiacomo Engineering for Clive
J. Anderson LLC – undated;
• C100 – Proposed Site Plan, prepared by Mastrogiacomo Engineering for Clive J. Anderson LLC
– 10-01-2023;
Whereas, Clive J. Anderson Realty LLC provided notice of its application to all property owners
contiguous to the applicant’s property as required; and
Whereas, a notice was duly provided to the County of Westchester as required by General Municipal
Law §§239-m, 239-n and 239-nn and Westchester County Administrative Code §§ 277.61 and
277.71; and
Whereas, the Westchester County Planning Board responded to the referral on 02-03-2025 stating
that any disturbance to Lincoln Avenue, a County Road (CR 84), may require a permit from
Westchester County Department of Public Works and Transportation, and recommended the
applicant explore at-grade stormwater management solutions, such as using pervious paving for
parking areas; and
Whereas, the Village Board of Trustees determined the proposed actions be referred to the Planning
Board and such referral was made on 06-11-2024, 01-28-2025 and then again on 10-21-2025; and
Whereas, the Applicant subsequently submitted the application to the Planning Board for the
purpose of obtaining their recommendations with respect to the application in accordance with
Village Code § 79-6A; and
Whereas, the Planning Board reviewed the application at their 10-21-2025 meeting and submitted
to the Village Board of Trustees a Resolution recommending approval with conditions presented
below; and
Whereas, pursuant to the New York State Environmental Quality Review Act (SEQRA), the Board of
Trustees received a Short Environmental Assessment Form (EAF) on 12-11-2023 and revised 01-24-
2025, declared itself to be Lead Agency and identified the proposed action as an unlisted action; and
Whereas, the Village Board of Trustees (1) considered the action as defined in 6 NYCRR §§617.2(b)
and 617.3(g); (2) reviewed the EAF, the criteria for determining significance set forth in 6 NYCRR
§617.7(c) and other supporting information to identify the relevant areas of environmental concern;
(3) thoroughly analyzed the identified relevant areas of environmental concern to determine if the
action may have a significant adverse impact on the environment; and (4) set forth its determination
of significance in this resolution; and
Whereas, the Village Board of Trustees considered the standards for Site Plan and Subdivision
review established by Village Code § 98-136.1.

as recited above, and the recommendation from the Planning Board the Village Board of Trustees of
the Village of Pelham finds and determines as follows:

D. In addition to the drawings identified in C. above, the application of Pelham Funeral Home c/o
Clive J. Anderson Realty is approved subject to the following conditions:
1. The Applicant shall, as a condition of Site Plan Approval and prior to the issuance of a Building
Permit submit to the Building Inspector a comprehensive stormwater drainage plan covering the
lots located at 64 Lincoln Avenue (SBL.163.28-1-5) and 216 Third Avenue (SBL. 163.28-1-6) that
incorporates to the maximum extent possible stormwater solutions that treat runoff on-site.
2. Obtain from Westchester County Department of Public works and Transportation (Section 239
F of the General Municipal Law) the approvals and/or permits for any proposed disturbance or
improvements to Lincoln Avenue.
E. Prior to the issuance of a Building Permit a complete and final plan set shall be provided to
the Building Inspector consistent with all of the above conditions; and
F. This approval is binding upon the Applicant, the property owner and any subsequent owner of the
property and may not be changed without the approval of the Board of Trustees of the Village of
Pelham. If any term of this Site Plan approval is violated, the Building Inspector may stop work, revoke a
Building Permit or deny a Certificate of Occupancy.
Be it further resolved, that in accordance with Village Code § 79-7, this Site Plan approval shall be null
and void if the applicant fails to obtain a Building Permit by February 25, 2026; and
Be it further resolved, that in accordance with Village Code § 34-9, a Building Permit shall become
invalid unless the authorized work commences within six months following the date of issuance and shall
expire 12 months after the date of issuance, unless an application is made to the Building Inspector to
renew per § 34-9.

Be it resolved, that pursuant to the provisions of § 4-400 of the New York State Village Law, the
Mayor hereby recommends to the full Village Board of Trustees that the law firm of Duane Morris
LLP., as the Village Attorney beginning November 6, 2025, pursuant to the terms set forth in Duane
Morris LLP’s Retainer Agreement, dated October 28, 2025; and
Be it further resolved, that the Board of Trustees of the Village of Pelham hereby approves the
appointment of Duane Morris LLP., as Village Attorney and authorizes the Mayor and Village
Administrator to execute the Retainer Agreement, attached hereto.

Item # 11 – Resolution Authorizing an Inter-Municipal Agreement between the Village of
Pelham and the County of Westchester for Use of Westchester County's Firing Range
Facility
Whereas, the Village of Pelham Police Department protects and assures the safety and welfare of
the citizens of the Village of Pelham (“Village”); and
Whereas, in order to maintain the high level of service and professionalism of the department, the
ongoing training, certification and preparation of the officers is an integral facet of the public safety
program; and
Whereas, one of the training requirements is certification and recertification of firearms training;
and
Whereas, for many years, this has been accomplished through the use of the Westchester County’s
Firing Range facility in Valhalla, NY; and
Whereas, the current agreement expired as of July 31, 2025, and the County of Westchester has
proffered an updated agreement and sent it to the Village of Pelham for its consideration for a term
of five-years commencing on execution through July 31, 2030; and
Whereas, use of the County’s facility provides a service to the Village that could not easily reproduce
on its own and the Police Chief and Village Administrator recommend that this Inter-Municipal
Agreement be authorized.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein
authorizes the Village Administrator to execute the attached Inter-Municipal Agreement between the
Village of Pelham and the County of Westchester for use of the County’s Firing Range Facility for a
period of five (5) years on October 28, 2025 and ending July 31, 2030; and
Be it further resolved, that the Village Administrator is authorized to undertake any administrative
acts required under the terms of the Agreement.

Item # 12 – Resolution Authorizing an Inter-Municipal Agreement between the Village of
Pelham and the County of Westchester for the Purpose of Mutual Aid and Rapid
Response Plan for the Police Departments of Westchester County
Whereas, pursuant to New York State General Municipal Law § 209-M, municipal police departments
may answer calls for service outside of their municipal boundaries when requested; and
Whereas, to ensure a synchronized response, the Westchester County Department of Public Safety
has instituted a Mutual Aid Plan to organize, supervise and coordinate both cooperative and
reciprocal assistance in which personnel, equipment and physical facilities of all participating
departments; and
Whereas, the Village of Pelham has been party to an existing Mutual Aid Agreement with the County
of Westchester for many years; and
Whereas, the current agreement expired as of July 30, 2025, and the County of Westchester has
proffered an updated agreement and sent it to the Village of Pelham for its consideration for a term

Item # 8 – Resolution Approving Site Plan Application for Jessie Development Co., LLC.
at 46 Second Avenue
Whereas, the proposed action is a request to grant Site Plan approval to construct a single-family
residence at 46 Second Avenue. The 5,018 square foot property is located in the Residential B-2
Zoning District; and
Whereas, the Village Board of Trustees has reviewed and considered the Site Plan Application and
Declaration of Intent to Develop, received on September 3, 2025; and
Whereas, pursuant to Village Code § 34-23, the Applicant has submitted the requisite documents
and fees; and
Whereas, Village Code § 79-5 authorizes the Village Board of Trustees to grant Site Plan approval
for proposed developments that comply with Village Code; and
Whereas, Jessie Development Co., LLC., (“46 Second Avenue” or the “Applicant”) has applied to
develop the property known as 46 Second Avenue in accordance with those requirements and
standards; and
Whereas, Jessie Development Co., LLC., has represented to the Village Board of Trustees that it is
the lawful owner or contract vendee of the 46 Second Avenue Property; and
Whereas, in furtherance of its application, Jessie Development Co., LLC., has submitted to the
Building Inspector a Site Plan Application and Declaration of Intent to Develop accompanied by the
requisite documents, information and fees; and
Whereas, Jessie Development Co., LLC., has further submitted a formal and complete proposed Site
Plan prepared by Mastrogiacomo Engineering, P.C., dated 9-10-2025, satisfying the requirements of
Village Code Chapter 79, showing a proposed development and use of the 46 Second Avenue; and
Whereas, Jessie Development Co., LLC., proposes to create a single-family residential dwelling with
two (2) off-street parking spaces; and
Whereas, Jessie Development Co., LLC., consists of one tax parcel, Parcel 163.35-1-52-1, which is
located in the Residence B-2 Zoning District; and
Whereas, the proposed application was referred to the Planning Board and the Architectural Review
Board; and
Whereas, at the September 17, 2025, meeting of the Architectural Review Board (“ARB”), the ARB
reviewed the plans dated September 10, 2025, that responded to previous ARB comments; and
Whereas, at the September 17, 2025, meeting the ARB recommended to the Village Board of
Trustees that the Site Plan be approved; and
Whereas, at the October 21, 2025, meeting of the Planning Board, the Planning Board
recommended the subdivision be approved; and
Whereas, the Village Board of Trustees affirms that:
(a) the proposed action is subject to the requirements of SEQRA;
(b) the proposed action is an Unlisted Action;

(c) the action is not located in an agricultural district;
(d) the Westchester County Board of Health is an involved agency, and
Whereas, Jessie Development Co, LLC., provided notice of its application to all property owners
contiguous to the applicant’s property as required; and
Whereas, notice was duly provided to the County of Westchester; and
Whereas, pursuant to the New York State Environmental Quality Review Act (SEQRA), on the Village
Board of Trustees received a Short Environmental Assessment Form (EAF), declared itself to be lead
agency and identified the proposed action as an Unlisted Action; and
Whereas, the Village Board of Trustees (1) considered the action as defined in 6 NYCRR §§617.2(b)
and 617.3(g); (2) reviewed the EAF, the criteria for determining significance set forth in 6 NYCRR
§617.7(c) and any other supporting information to identify the relevant areas of environmental
concern; (3) thoroughly analyzed the identified relevant areas of environmental concern to determine
if the action may have a significant adverse impact on the environment; and (4) set forth its
determination of significance in this Resolution; and
Whereas, the Village Board of Trustees considered the standards for Site Plan review established by
Village Code § 79-5.
Now, therefore, be it resolved, that after considering the documents submitted by the Applicant,
as recited above, the recommendation from the Architectural Review Board and the Planning Board,
the Board of Trustees of the Village of Pelham finds and determines as follows:
A. The proposed action will not have a significant effect on the environment and a Draft
Environmental Impact Statement will not be required; and
B. The property satisfies the requirements for consideration under Village Code § 79-5; and
C. The final Site Plan Approval is based on the following drawings prepared by Mastrogiacomo
Engineering P.C., dated 9-10-2025 that have been submitted by the Applicant (collectively, the
“Drawings”):

D. Site Plan approval is granted subject to the following conditions:
1. The Applicant shall, as a condition of Site Plan approval and prior to the issuance of a Building
Permit submit to the Building Inspector a complete and final set of plans and documents,
consistent with the conditions articulated above and as required by Chapter 34 of the Village

Code. Substantive deviations from the plans approved by the Board of Trustees will require a
resubmission to the Village Board of Trustees for a modification to an approved Site Plan.
This Site Plan approval is binding upon the applicant, the property owner and any subsequent owner of
the property and may not be changed without the approval of the Board of Trustees of the Village of
Pelham. If any term of this site plan approval is violated, the Building Inspector may stop work, revoke a
building permit or deny a certificate of occupancy.
Be it further resolved, that in accordance with Village Code § 79-7, this subdivision and site plan
approval shall be null and void if the applicant fails to obtain a building permit within 120 days of this
resolution unless the Board of Trustees extends, by resolution, the time within which to do so; and
Be it further resolved, that this subdivision and site pan approval will be null and void if the
applicant does not commence construction within six months of the date of the issuance of a building
permit, unless the Village Board of Trustees extends, by resolution, the time within which to do so.

Item # 11 – Resolution Authorizing an Inter-Municipal Agreement between the Village of
Pelham and the County of Westchester for Use of Westchester County's Firing Range
Facility
Whereas, the Village of Pelham Police Department protects and assures the safety and welfare of
the citizens of the Village of Pelham (“Village”); and
Whereas, in order to maintain the high level of service and professionalism of the department, the
ongoing training, certification and preparation of the officers is an integral facet of the public safety
program; and
Whereas, one of the training requirements is certification and recertification of firearms training;
and
Whereas, for many years, this has been accomplished through the use of the Westchester County’s
Firing Range facility in Valhalla, NY; and
Whereas, the current agreement expired as of July 31, 2025, and the County of Westchester has
proffered an updated agreement and sent it to the Village of Pelham for its consideration for a term
of five-years commencing on execution through July 31, 2030; and
Whereas, use of the County’s facility provides a service to the Village that could not easily reproduce
on its own and the Police Chief and Village Administrator recommend that this Inter-Municipal
Agreement be authorized.
Now, therefore, be it resolved, that the Board of Trustees of the Village of Pelham herein
authorizes the Village Administrator to execute the attached Inter-Municipal Agreement between the
Village of Pelham and the County of Westchester for use of the County’s Firing Range Facility for a
period of five (5) years on October 28, 2025 and ending July 31, 2030; and
Be it further resolved, that the Village Administrator is authorized to undertake any administrative
acts required under the terms of the Agreement.

may answer calls for service outside of their municipal boundaries when requested; and
Whereas, to ensure a synchronized response, the Westchester County Department of Public Safety
has instituted a Mutual Aid Plan to organize, supervise and coordinate both cooperative and
reciprocal assistance in which personnel, equipment and physical facilities of all participating
departments; and
Whereas, the Village of Pelham has been party to an existing Mutual Aid Agreement with the County
of Westchester for many years; and
Whereas, the current agreement expired as of July 30, 2025, and the County of Westchester has
proffered an updated agreement and sent it to the Village of Pelham for its consideration for a term
of five-years commencing retroactively to July 31, 2025 through July 30, 2030.
