MINUTES OF THE PEORIA CITY COUNCIL CITY OF PEORIA, ARIZONA CITY COUNCIL CHAMBER November 7, 2017 A Special Meeting of the City Council of the City of Peoria, Arizona was convened at 8401 West Monroe Street in open and public session at 5:00 p.m. Members Present: Mayor Cathy Carlat; Vice Mayor Jon Edwards; Councilmembers Bridget Binsbacher, Michael Finn, Vicki Hunt, Carlo Leone and Bill Patena. Council Youth Liaisons: Maylee Acosta. Members Absent: None. Other Municipal Officials Present: Jeff Tyne, City Manager; Julie Arendall, Deputy City Manager; and Rhonda Geriminsky, City Clerk. Authorization to Hold an Executive Session Motion was made by Councilmember Hunt, seconded by Vice Mayor Edwards, to authorize the holding of an Executive Session for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding: (a) Labor Negotiations Update with the Peoria Police Officers Association pursuant to A.R.S. § 38-431.03.A.5. Proclamation Proclaiming Peoria as a Purple Heart City Mayor Carlat read aloud a Proclamation declaring support for members of the Armed Forces who have been wounded or died by an instrument of war in the hands of our Nation's enemies by becoming a Purple Heart City. Jerry Crosby Sr, Department Commander for the Military Order of the Purple Heart, accepted the Proclamation and in turn presented Mayor Carlat with a plaque declaring the City of Peoria a Purple Heart City. CONSENT AGENDA: All items listed with a “C” are considered to be routine or have been previously reviewed by the City Council, and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event the item will be removed from the General Order of Business, and considered in its normal sequence on the Agenda. Mayor Carlat announced that the Consent Agenda included a Public Hearing on a liquor license application for Gift Marketing Alliance located at 8550 North 91st Avenue #F67. There were no requests from those present to address this agenda item. Mayor Carlat asked if any Councilmember wished to have an item removed from the Consent Agenda. Having no requests from Council, motion was made by Vice Mayor Edwards, seconded by Councilmember Finn, to approve the Consent Agenda. Upon vote, the motion carried unanimously 7 to 0. 4C. Disposition of Absence Approved the absence of Council Youth Liaison Gatrost from the Regular City Council Meeting held on October 17, 2017. 5C. Board and Commission Appointments Approved the recommendations from the Council Boards and Commissions Subcommittee pertaining to the following appointments/reappointment, and adopted the Resolutions as presented:  Adopted RES. 2017-116 reappointing Michael Watt as a regular member of the Building Board of Appeals for a term to expire in December 2021;  Adopted RES. 2017-117 appointing Matthew Cunningham as a regular member of the Industrial Development Authority for a partial term to expire June 2021;  Adopted RES. 2017-118 appointing Matthew Cunningham as a regular member of the Municipal Development Authority for a partial term to expire in November 2019;  Adopted RES. 2017-119 appointing Joanna Conde as a regular member and John Albright as an alternate member of the Planning and Zoning Commission for partial terms to expire in December 2019;  Adopted RES. 2017-120 appointing Linda Grice as a regular member of the Planning and Zoning Commission for a partial term to expire December 2018;  Adopted RES. 2017-121 appointing Tad Snidecor as a regular member of the Veterans Memorial Board for a term to expire in December 2021; and  Adopted RES. 2017-122 appointing Leah Gilbertson as an alternate member of the Youth Advisory Board for a partial term to expire in June 2019. 7C. Grants, State of Arizona Department of Homeland Security, Various Fire Department Programs (a) Authorized the Fire-Medical Department to accept two grant awards in the total amount of $80,711 from the Arizona Department of Homeland Security to be used to strengthen chemical, biological, radiological, nuclear or explosive detection, response and decontamination capabilities; and sustain and enhance the Terrorism Liaison Officer program; and (b) Approved a budget amendment in the amount of $80,711 from the Proposed Grants Contingency account to various Homeland Security Grant Fund accounts. 8C. Maintenance Improvement District No. 1214, Townley Park, 89th Avenue and Olive Avenue Approved the Petition for Formation and adopted RES. 2017-114 intention and ordering the formation of proposed Maintenance Improvement District No. 1214, Townley Park, located at 89th Avenue and Olive Avenue; and adopted RES. 2017-115 ordering the improvements within the proposed Maintenance Improvement District and declaring an emergency. 10C. Deeds and Easements, Various Locations Adopted RES. 2017-123 accepting Deeds and Easements for various Real Property interests acquired by the City. 11C. Designate Roadways, Establish Rights-of-Way, Various Locations Adopted RES. 2017-125 designating various Real Properties to be used as City roadways and authorized the establishment of Public Rights of Way to be opened and maintained by the City as a Public Street. 12C. Replat, CCV/Terrazza Center – Lot 10, 67th Avenue and Happy Valley Road Approved the Replat of CCV/Terrazza Center – Lot 10 located at 67th Avenue and Happy Valley Road, subject to stipulations. 13C. PUBLIC HEARING – Grant, United States Department of Justice, Edward Byrne Memorial Justice Assistance Grant (a) Accepted a grant from the United States Department of Justice in the amount of $21,297 to be used by the Peoria Police Department to fund crisis intervention and mental health training to all department personnel; and (b) Approved a budget adjustment in the amount of $21,297 from the Proposed Grants Contingency account to the Justice Assistance Grant Award account. 14C. PUBLIC HEARING - Liquor License, Gift Marketing Alliance, 8550 North 91st Avenue #F67 Recommended approval to the State Liquor Board for a New Wine and Beer (Series 10) Liquor License for Gift Marketing Alliance, located at 8550 North 91st Avenue #F67, Alex Quintana, Applicant, LL#20018469. City Council Meeting Minutes November 7, 2017 Page 6 of 9 REGULAR AGENDA New Business 15R. PUBLIC HEARING - Code Amendment, Zoning Ordinance, Section 21-813 Wireless Communication Facilities Staff Report: Chris Jacques, Planning and Community Development Director, and Cody Gleason, Senior Planner, provided an overview of the amendment to the Zoning Ordinance. Information included: • Compliance with new Federal Communications Commission regulations • Addition of minor updates to the current standards of the Code • Update to improve overall format, clarity and usability of the Code Public Hearing: Mayor Carlat opened the Public Hearing and asked if any Councilmember or citizen wished to comment on the proposed code amendment. Discussion ensued regarding standards on church steeples and effective dates. Having no requests from those present to address this item, Mayor Carlat declared the Public Hearing closed. Council Action: Motion was made by Councilmember Binsbacher, seconded by Councilmember Hunt, to adopt ORD. 2017-44 amending Chapter 21 of the Peoria City Code (1977 Edition), Sections 21-202 ("Definitions") and 21-813 ("Wireless Communication Facilities"). Upon vote, the motion carried unanimously 7 to 0. 16R. PUBLIC HEARING - Harvest Church Annexation, 8340 West Northern Avenue Staff Report: Chris Jacques, Planning and Community Development Director, provided an overview of the proposed annexation of approximately 10.49 acres of privately owned property located west of the northwest corner of 83rd Avenue and Northern Avenue, including the process for annexing property. City Council Meeting Minutes November 7, 2017 Page 7 of 9 Public Hearing: Mayor Carlat opened the Public Hearing and asked if any Councilmember or citizen wished to comment on the proposed annexation. Having no requests from those present to address this item, Mayor Carlat declared the Public Hearing Closed. Council Action: No Council action required. 17R. Contract Approval and Budget Transfer, Beardsley Road Channel Improvements Adina Lund, Development and Engineering Director, presented regarding the contract with Blucor Contracting to construct the Beardsley Road Channel Improvements. Information included the project overview, contractor selection and project funding. Motion was made by Vice Mayor Edwards, seconded by Councilmember Binsbacher, to: (a) approve the contract with Blucor Contracting; and (b) approve a budget transfer in the amount of $540,937 from the Union Hills Channel project to the Beardsley Road Channel Improvements project. Upon vote, the motion carried unanimously 7 to 0. Clerk’s Note: Agenda Items 18C, and 19C were voted on separately by the Vistancia West Community Facilities District Board. Councilmember Patena reported on his attendance at the Parkridge Homeowners Association annual meeting on October 20, 2017. Councilmember Patena reported on his attendance at the Peoria Support Collaborative Impact Workshop on Behavioral Health on November 2, 2017. Councilmember Patena reported on his attendance at the ParkFest! at Windrose Park on November 4, 2017. Councilmember Patena reported on his attendance at the Veteran’s Day Employee Recognition Event on November 6, 2017. Councilmember Patena reported on his attendance at the Grand Opening of the Pinnacle Peak Public Safety Facility on November 7, 2017. Councilmember Patena announced the upcoming rededication of the Veterans Memorial Wall scheduled for November 11, 2017 at Rio Vista Park located at 8866 West Thunderbird Road. Councilmember Binsbacher reported on her attendance at the Grand Opening of the Pinnacle Peak Public Safety Facility on November 7, 2017 and extended her congratulations to the Police Department on the success of the project. Councilmember Binsbacher acknowledged the various Veteran’s Day events throughout the city. Vice Mayor Edwards announced the new Bus Route 83, which runs from Camelback Road to Bell Road along 83rd Avenue. Vice Mayor Edwards reported on his attendance at the Grand Opening of the Pinnacle Peak Public Safety Facility on November 7, 2017 and praised city staff and Hayden Construction for the success of the project. Councilmember Finn reported on his attendance at the Neighborhood Pride event on October 28, 2017 and offered his gratitude to the Latter-Day Saints community for their participation in the event. Councilmember Finn reported on his attendance at the ParkFest! at Windrose Park on November 4, 2017 and offered his gratitude to the Police Department for the donated bikes and helmets. Councilmember Hunt reported on her attendance at the Grand Opening of the Pinnacle Peak Public Safety Facility on November 7, 2017. Councilmember Hunt announced an upcoming shred event scheduled for November 18, 2017 at Ira Murphy Elementary School located at 7231 West North Lane. Councilmember Hunt expressed her appreciation to Council Youth Liaison Acosta and Council Youth Liaison Gatrost for their participation at City events. Councilmember Leone reported on his attendance at the Department of Arizona Marine Corps League’s Fall Conference on October 21, 2017.
