MINUTES OF THE PEORIA CITY COUNCIL CITY OF PEORIA, ARIZONA CITY COUNCIL CHAMBER November 28, 2017 A Special Meeting of the City Council of the City of Peoria, Arizona was convened at 8401 West Monroe Street in open and public session at 5:30 p.m. Members Present: Mayor Cathy Carlat; Vice Mayor Jon Edwards; Councilmembers Bridget Binsbacher, Michael Finn, Vicki Hunt, Carlo Leone and Bill Patena. Council Youth Liaison: Cassidy Gatrost. Members Absent: None. Other Municipal Officials Present: Jeff Tyne, City Manager; Julie Arendall, Deputy City Manager; Andy Granger, Deputy City Manager; David Benton, Assistant City Attorney; Rhonda Geriminsky, City Clerk; and Dawn Prince, Assistant to the City Manager. Audience: Approximately three members of the public were present. Note: The order in which items appear in the minutes is not necessarily the order in which they were discussed in the meeting. CONSENT AGENDA CONSENT AGENDA: All items listed with a “C” are considered to be routine or have been previously reviewed by the City Council, and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event the item will be removed from the General Order of Business, and considered in its normal sequence on the Agenda. 1 C. Authorization to Hold an Executive Session Motion was made by Councilmember Hunt, seconded by Vice Mayor Edwards, to authorize the holding of an Executive Session for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding: (a) Legal issues pertaining to a notice of claim filed by Peoria Historical Society, Inc., pursuant to A.R.S. §§ 38-431.03.A.3 and 38-431.03.A.4. Upon vote, the motion carried unanimously 7 to 0. An Executive Session was convened immediately following the 5:30 p.m. Special Meeting holding of an Executive Session for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding: (a) Legal issues pertaining to a notice of claim filed by Peoria Historical Society, Inc., pursuant to A.R.S. §§ 38-431.03.A.3 and 38-431.03.A.4. Members Present: Mayor Cathy Carlat; Vice Mayor Jon Edwards; Councilmembers Bridget Binsbacher, Michael Finn, Vicki Hunt, Carlo Leone and Bill Patena. Council Youth Liaisons: Maylee Acosta and Cassidy Gatrost. Members Absent: None. Mayor Carlat and Councilmember Finn presented Certificates of Appointment to the following Board and Commission members who were appointed by Resolution at the November 7, 2017 City Council Meeting:  Matthew Cunningham, Industrial Development Authority  Matthew Cunningham, Municipal Development Authority  Joanna Conde, Planning and Zoning Commission  Linda Grice, Planning and Zoning Commission  John Albright, Planning and Zoning Commission  Tad Snidecor, Veterans Memorial Board  Leah Gilbertson, Youth Advisory Board CONSENT AGENDA: All items listed with a “C” are considered to be routine or have been previously reviewed by the City Council, and will be enacted by one motion. Mayor Carlat announced that the Consent Agenda included a Public Hearing on a liquor license application for Gus's New York Pizza Lounge, located at 10738 North 75th Avenue Suite B-7. There were no requests from those present to address this agenda item. Mayor Carlat asked if any Councilmember wished to have an item removed from the Consent Agenda. Having no requests from Council, motion was made by Councilmember Hunt, seconded by Vice Mayor Edwards, to approve the Consent Agenda. Upon vote, the motion carried unanimously 7 to 0. 4C. Appointment of Administrative Hearing Officers Adopted RES. 2017-126 appointing Administrative Hearing Officers for personnel, tax, licensing, and land use matters for a two-year term. Annexation, 71st Avenue and Thunderbird Road Adopted ORD. 2017-45 approving the annexation of approximately 11.82 acres of privately-owned property located at the northwest corner of 71st Avenue and Thunderbird Road (ANX17-03). 7C. Annexation, Harvest Church, 83rd Avenue and Northern Avenue Adopted ORD. 2017-46 approving the annexation of approximately 10.49 acres located west of the northwest corner of 83rd Avenue and Northern Avenue (ANX17-04). 8C. Intergovernmental Agreement, Regional Metropolitan Fire Service, Automatic Aid System Approved an Intergovernmental Agreement with the Regional Metropolitan Phoenix Fire Service Automatic Aid System for emergency response coordination with cities, towns, fire districts and governmental jurisdictions. 9C. Expenditure Authority, Sports Complex Surcharge Funds, Sports Complex Improvements (a) Authorized expenditures from the Sports Complex Facility Surcharge Fund and Sports Complex Non-General Admission Surcharge for the improvement of complex facilities and; (b) Authorized a budget transfer in the amount of $150,000 from the Sports Complex Improvement Reserve Contingency account to the Sports Complex GA Surcharge Building account and the Sports Complex Improvement Reserve Building account to complete improvements projects. 10C. Maintenance Improvement District No. 1207, Ironwood Estates, 104th Avenue and Pinnacle Peak Road Approved the Petition for Formation and adopted RES. 2017-44 intention and ordering the formation of proposed Maintenance Improvement District No. 1207, Ironwood Estates, located at 104th Avenue and Pinnacle Peak Road; and adopted RES. 2017-45 ordering the improvements within the proposed Maintenance Improvement District and declaring an emergency. 11C. Deeds and Easements, Various Locations Adopted RES. 2017-127 accepting Deeds and Easements for various Real Property interests acquired by the City. Ingress/Egress Easement, Central Arizona Water Conservation District, Vistancia Boulevard and Westland Road Adopted RES. 2017-124 authorizing the City Manager to execute the Ingress/Egress Easement to Central Arizona Water Conservation District, northwest of Vistancia Boulevard and Westland Road. 13C. Roadway Dedication and Public Utility Easement, 102nd Avenue adjacent to Pinnacle Peak Public Safety Facility Campus Adopted RES. 2017-128 authorizing the City Manager to execute the Dedication of Public Roadway and Public Utility Easement for the west half of 102nd Avenue. 14C. Easement, Arizona Public Service, Pinnacle Peak Public Safety Facility Campus Adopted RES. 2017-129 authorizing the City Manager to execute an Arizona Public Service Utility Easement. 15C. Final Plat, Four Seasons at Ventana Lakes, 107th Avenue and Beardsley Road Approved the Final Plat, Four Seasons at Ventana Lakes, located at 107th Avenue and Beardsley Road, subject to stipulations. 16C. Final Plat, Peoria Animal Hospital, 89th Avenue and Peoria Avenue Approved the Final Plat of Peoria Animal Hospital, located at 89th Avenue and Peoria Avenue, subject to stipulations. 17C. Final Plat, Pinnacle Peak Public Safety Campus, 102nd Avenue and Lake Pleasant Parkway Approved the Final Plat of Pinnacle Peak Public Safety Campus, located at 102nd Avenue and Lake Pleasant Parkway, subject to stipulations. 18C. Final Plat, Saguaro Motors, 92nd Drive and Grand Avenue Approved the Final Plat of Saguaro Motors, located at 92nd Drive and Grand Avenue, subject to stipulations. 19C. PUBLIC HEARING - Liquor License, Gus's New York Pizza Lounge, 10738 North 75th Avenue Suite B-7 Recommended approval to the State Liquor Board for a New Restaurant Liquor License (Series 12) for Gus's New York Pizza Lounge, located at 10738 N. 75th Avenue Suite B-7, Lauren K. Merrett, Applicant, LL#20018484. REGULAR AGENDA New Business: 22R. Memorandum of Understanding, Peoria Police Officer's Association, July 2018 through June 2021 Laura Ingegneri, Human Resources Director, provided an overview of the request to approve a Memorandum of Understanding (MOU) with the Peoria Police Officers Association (PPOA). Information included:  Negotiations process  PPOA and City negotiators  Summary of the negotiations  Key provisions contained in the MOU Motion was made by Councilmember Binsbacher, seconded by Councilmember Finn, to approve a Memorandum of Understanding with the Peoria Police Officers Association in total for the period July 2018 through June 2021. Upon vote, the motion carried unanimously, 7 to 0. Clerk’s Note: Agenda Items 23C and 24C were voted on separately by the Vistancia Community Facilities District Board. The legal actions for these items will be reflected separately in the November 28, 2017 Vistancia Community Facilities District Board minutes. Call To The Public (Non-Agenda Items) None. City Council Meeting Minutes November 28, 2017 Page 7 of 8 Reports from City Manager: 25. Council Calendar 26. Reports A. Jeff Tyne, City Manager, informed Council that their packets contained the 2018 City Council Meeting Calendar. Reports from City Council: Council Youth Liaison Acosta reported on her participation in an event sponsored by Centennial High School. The event provided an opportunity for eighth graders who will be students at the high school in the future, to visit the campus and explore the curriculum and learning options that will be available. Councilmember Patena congratulated the newly appointed Board and Commission members. Councilmember Patena reported on his attendance at the grand opening of the Veteran Success Center at Luke Air Force Base held on November 9, 2017. Councilmember Patena reported on the various City of Peoria activities he attended, including the Veterans Memorial Ceremony held at Rio Vista Community Park, a shred event held at Westbrook Village and a Morning with the Mayor event held at Rio Vista Recreation Center. Councilmember Binsbacher reported on her attendance at numerous events honoring veterans. Vice Mayor Edwards recognized the members of the Veterans Memorial Board and City staff for the Veterans Memorial Wall expansion and reflection area at Rio Vista Community Park. Councilmember Finn reported on his experience during a ride-along opportunity with the crew from Fire Station 193. Councilmember Finn expressed his appreciation for the successful negotiations with the Peoria Police Officer’s Association. Councilmember Hunt recognized City staff for the success of the Veterans Memorial Day event held at Rio Vista Community Park. Councilmember Hunt expressed her gratitude for the successful negotiations with the Peoria Police Officer’s Association. Councilmember Hunt invited the public to attend the upcoming Old Town Holiday Festival to be held on December 1, 2017. Councilmember Hunt recognized the artists with the What’s Happening Art Movement for the decorative planters that were installed along 83rd Avenue in Old Town. Councilmember Leone reported on his attendance at the Veterans Memorial Ceremony held at Rio Vista Community Park. Councilmember Leone reported on the Arizona Night Market event held November 17-19, 2017 at the Peoria Sports Complex. City Council Meeting Minutes November 28, 2017 Page 8 of 8 Council Youth Liaison Gatrost reported on her participation at a turkey-bowling event held at the Community Center on November 18, 2017. Ms. Gatrost thanked City staff and Arizona State University (ASU) West students for hosting a forensics lab for Peoria teens on November 21, 2017 and providing a tour of the ASU campus. Reports from the Mayor: Mayor Carlat reminded the public that they can recognize individuals who served in the United States Military by reserving a space for their name and service details on the Veterans Honor Wall.
