MINUTES OF THE PEORIA CITY COUNCIL CITY OF PEORIA, ARIZONA CITY COUNCIL CHAMBER December 12, 2017 A Special Meeting of the City Council of the City of Peoria, Arizona was convened at 8401 West Monroe Street in open and public session at 4:02 p.m. Members Present: Mayor Cathy Carlat; Vice Mayor Jon Edwards; Councilmembers Bridget Binsbacher, Michael Finn, Vicki Hunt, Carlo Leone and Bill Patena. Other Municipal Officials Present: Steve Burg, City Attorney; Linda Blas, Deputy City Clerk; Laura Ingegneri, Human Resources Director; Stuart Kent, Public Works/Utilities Director and George Anagnost, Presiding Municipal Judge. Audience: There were no members of the public present. Note: The order in which items appear in the minutes is not necessarily the order in which they were discussed in the meeting. CONSENT AGENDA CONSENT AGENDA: All items listed with a “C” are considered to be routine or have been previously reviewed by the City Council, and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event the item will be removed from the General Order of Business, and considered in its normal sequence on the Agenda. 1 C. Authorization to Hold an Executive Session Motion was made by Councilmember Hunt, seconded by Councilmember Binsbacher, to authorize the holding of an Executive Session for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding: (a) Employment, assignment, appointment, promotion, or salaries of a public officer or appointee pertaining to the evaluation process and performance reviews of the Municipal Judge and City Attorney pursuant to A.R.S. § 38- 431.03.A.1. Upon vote, the motion passed unanimously 7 to 0. Clerk’s Note: In accordance with A.R.S. § 38-431.03(B), minutes of executive sessions must be kept confidential except as outlined in statute. City Council attended the 2017 Peoria Youth Artists Reception held from approximately 6:00 p.m. to 6:45 p.m. in the Lobby of City Hall, located at 8401 W. Monroe Street, Peoria, Arizona. No City business was conducted during the reception. City Council Meeting Minutes December 12, 2017 Page 3 of 11 Presentation: 3. Mayor and Council's Young Artists Program Mayor Carlat provided information on the Young Artists Program which was instituted to engage Peoria students interested in the arts and showcase their artwork at Peoria City Hall. Council Youth Liaison Acosta and Council Youth Liaison Gatrost presented certificates to the youth whose art was selected and displayed at City Hall from November 1, 2017 through December 12, 2017. 4. Introduction of New Deputy City Manager City Manager, Jeff Tyne, introduced Erik Strunk, the City’s new Deputy City Manager, who begins his employment in January 2018. CONSENT AGENDA: All items listed with a “C” are considered to be routine or have been previously reviewed by the City Council, and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event the item will be removed from the General Order of Business, and considered in its normal sequence on the Agenda. Mayor Carlat announced that the Consent Agenda included a Public Hearing on a liquor license application for Even Stevens Sandwiches, located at 16955 North 75th Avenue, Suite 105. There were no requests from those present to address this agenda item. Mayor Carlat asked if any Councilmember wished to have an item removed from the Consent Agenda. Vice Mayor Edwards requested that Agenda Item 8C be removed for separate discussion. Motion was made by Councilmember Finn, seconded by Vice Mayor Edwards, to approve the Consent Agenda with the exception of Agenda Item 8C. Upon vote, the motion carried unanimously 7 to 0. 5C. Grant-in-Aid Fiscal Agent Agreement, Tohono O’odham Nation, Peoria Unified School District Approved the Grant-In-Aid Fiscal Agent Agreement with the Tohono O’odham Nation on behalf of Peoria Unified School District. Grant-in-Aid, Arizona State Library, Archives, and Public Records, Sunrise Mountain Library, Non-Fiction Material (a) Approved a Grant-in-Aid administered by the State Library, Archives and Public Records to update and expand the non-fiction collection at Sunrise Mountain Library; and (b) Approved a budget transfer in the amount of $8,026 from the Proposed Grant Contingency account to the Books Periodicals and Subscription account. 7C. Grant, Arizona State Library, Archives, and Public Records, Library Services and Technology Act, Library Hot Spots (a) Accepted the Library Services and Technology Act Hotspot Subgrant administered by the State Library, Archives and Public Records for hot spots; and (b) Approved a budget transfer in the amount of $1,533.45 from the Proposed Grant Contingency account to the Computer Hardware account. 8C. Intergovernmental Agreement, Maricopa County Department of Transportation, Traffic Signals Clerk’s Note: Agenda Item 8C was presented at the end of the Consent Agenda. Dan Nissen, Development and Engineering Deputy Director, provided an overview of the scope, purpose and terms of the Intergovernmental Agreement with the Maricopa County Department of Transportation for the installation of two traffic signals. Motion was made by Vice Mayor Edwards, seconded by Councilmember Binsbacher, to approve an Intergovernmental Agreement with Maricopa County for cost sharing on two new traffic signals at the intersection of Happy Valley Road and Vistancia Boulevard and at the intersection of 87th Avenue and Deer Valley Road. Upon vote, the motion passed unanimously 7 to 0. 9C. Contract, Felix Construction Company, Butler Well Rehabilitation Approved an individual job order utilizing an existing Job Order Contract with Felix Construction Company for a guaranteed maximum price of $1,295,432 to construct the Butler Well Rehabilitation project. Exemption Request, Requirement to Post Security for Self Insured Workers' Compensation Claims Authorized the execution of documents necessary to certify the City of Peoria exemption from the Industrial Commission of Arizona requirements to post security for self-insured Workers' Compensation claims. 11C. Budget Transfer, Sunrise Mountain Acquisition Payment Authorized a budget adjustment from the CIP Projects Fund Contingency to the Land Acquisition account for the Sonoran Preservation Program in the CIP Projects Fund in the amount of $108,030. 12C. Fiscal Year 2017 Comprehensive Annual Financial Report, Single Audit Report and Auditor Communications Received and filed the Comprehensive Annual Financial Report, Singe Audit Report, Management Letter, and Auditor Communication to Governance Letter for the fiscal year ended June 30, 2017. 13C. Maintenance Improvement District No. 1212, Blackstone at Vistancia, Parcel B13, El Mirage Road and Blackstone Drive Approved the Petition for Formation and adopted RES. 2017-130 intention and ordering the formation of proposed Maintenance Improvement District No. 1212, Blackstone at Vistancia, Parcel B13, located at El Mirage Road and Blackstone Drive; and adopted RES. 2017-131 ordering the improvements within the proposed Maintenance Improvement District and declaring an emergency. 14C. Final Plat, Riverwalk, 77th Avenue and Pinnacle Peak Road Approved the Final Plat, Riverwalk, located at 77th Avenue and Pinnacle Peak Road, subject to stipulations. 15C. PUBLIC HEARING - Liquor License, Even Stevens Sandwiches, 16955 North 75th Avenue, Suite 105 Recommended approval to the State Liquor Board for a New Restaurant Liquor License (Series 12) for Even Stevens Sandwiches, located at 16955 N. 75th Avenue, Suite 105, Marc Goldsen, Applicant, LL#20018613. City Council Meeting Minutes December 12, 2017 Page 6 of 11 REGULAR AGENDA New Business: 16R. VOID 17R. PUBLIC HEARING - Rezoning, Metzger Residence, 7423 West Rowel Road Staff Report: Chris Jacques, Planning and Community Development Director, provided an overview of the request to rezone approximately 1 acre of land located at 7423 West Rowel Road from Suburban Ranch 43 (SR-43) to Single Family (R1-35). The information included: • Site and area context • Development Standards • Public Outreach o Notice of application and notice of hearing o Opposition and support letters o Neighborhood meetings • Planning and Zoning Commission public hearing • Recommendation Public Hearing: Mayor Carlat opened the Public Hearing and asked if any Councilmember or citizen wished to comment on the rezoning request. Having no requests from those present to address this item, Mayor Carlat declared the Public Hearing closed. COUNCIL ACTION: Motion was made by Councilmember Binsbacher, seconded by Councilmember Finn, to concur with the Planning and Zoning Commission's unanimous recommendation and adopt ORD. 2017-48 approving the rezoning of approximately 1 acre of property, located at the southeast corner of 75th Avenue and Jomax Road from Suburban Ranch 43 (SR-43) to Single-Family Residential (R1-35). Upon vote, the motion passed unanimously 7 to 0. City Council Meeting Minutes December 12, 2017 Page 7 of 11 18R. Memorandum of Understanding, American Federation of State, County and Municipal Employees Local 3282, July 2018 through June 2022 Laura Ingegneri, Human Resources Director, provided a summary of the negotiations with the American Federation of State, County and Municipal Employees Local 3282 (AFSCME). Ms. Ingegneri reported that the meet and confer process began on September 19, 2017 after the conclusion of a market wage and benefit study. Ms. Ingegneri noted that the City was notified by AFSCME on December 7, 2017 that their membership had ratified the proposed contract. Ms. Ingegneri highlighted the key provisions contained in the Memorandum of Understanding (MOU). Motion was made by Councilmember Binsbacher, seconded by Vice Mayor Edwards, to approve the Memorandum of Understanding with the American Federation of State, County and Municipal Employees Local 3282 in total, for the period of July 2018 through June 2022. Upon vote, the motion carried unanimously 7 to 0. 19R. Public Art, Happy Valley Road and Lake Pleasant Parkway John Sefton, Community Services Director, and Marylou Stephens, Arts and Theater Manager, provided an overview of the proposed placement and contract for Peoria’s next public art installment. Information included: • Site selection process • Application and art selection process • Public art review panel • Arts Commission involvement • Public engagement • Finalist recommendation Jeff Zischke, local Arizona artist and recommended finalist, provided an interpretation of his art sculpture entitled “Blooming Spire.” In response to questions from Council, Mr. Sefton and Mr. Zischke indicated that accessibility to the public art site has been incorporated into the project plan and that the construction and installation process would take approximately six months upon completion of the final contracts and preparations. Motion was made by Councilmember Binsbacher, seconded by Vice Mayor Edwards, to: (a) Approve the recommended artwork for Happy Valley Road and Lake Pleasant Parkway, Jeff Zischke’s “Blooming Spire”; and City Council Meeting Minutes December 12, 2017 Page 8 of 11 (b) Authorize a contract to Jeff Zischke in the amount of $180,000 to construct and install public art at Happy Valley Road and Lake Pleasant Parkway. Reports from City Manager: 24. Council Calendar Jeff Tyne, City Manager, provided the following information to Council: • Peoria received a clean opinion resulting from the audit of the Fiscal Year 2017 Comprehensive Annual Financial Report (CAFR), as well as its 32nd consecutive year receiving the Certificate for Excellence award from the Government Finance Officers Association. • Peoria Fire Department deployed firefighters to assist with wildland fire efforts in San Diego and Ventura Counties in California. • Condolences were extended to the City of El Mirage, Arizona for the loss of an officer in the line of duty. Over the next few days, the Peoria Police Department will provide assistance to and coverage for the El Mirage Police Department. • Video presentation highlighting the upcoming Winter Water Safety Day and Polar Plunge event to be held on January 6, 2018 at the Sunrise Pool, located at 21321 N. 86th Drive, Peoria, Arizona. City Council Meeting Minutes December 12, 2017 Page 9 of 11 Reports from City Council: Council Youth Liaison Acosta congratulated Jeff Zischke for his winning art sculpture entry, the participants of the Young Artists Program and the new Deputy City Manager, Erik Strunk. Council Youth Liaison Acosta reported on a Play 360 event, hosted by the Arizona Cardinals, which promoted youth health and fitness. Council Youth Liaison Acosta attended the Police Department’s Community Partnership Awards event held on December 7, 2017 and recognized the outstanding partnerships throughout the City. Council Youth Liaison Acosta reported on the Lunch with a Councilmember event held at Centennial High School on December 7, 2017. Councilmember Patena reported on the success of the Old Town Holiday Festival held on December 1, 2017. Councilmember Patena attended a meeting with the consultants at the Sunrise Mountain Library to discuss the Library strategic plan. Councilmember Patena reported on the Police Department’s Community Partnership Awards event held on December 7, 2017. Councilmember Patena welcomed Erik Strunk, new Deputy City Manager, to the City of Peoria. Councilmember Binsbacher welcomed Erik Strunk, new Deputy City Manager, to the City of Peoria and congratulated the Young Artist Program participants. Councilmember Binsbacher expressed her gratitude to the firefighters assisting with the wildland fires in California. Councilmember Binsbacher expressed her condolences to the City of El Mirage on the loss of its officer and thanked the Peoria Police Department for providing assistance to the El Mirage Police Department. Councilmember Binsbacher reported on a meet and greet meeting held at Lake Pleasant on December 6, 2017 to promote economic development and business partnerships for the area. Councilmember Binsbacher reported on the Police Department’s Community Partnership Awards event held on December 7, 2017 and the Shop with a Cop event held on December 9, 2017. Vice Mayor Edwards welcomed Erik Strunk, new Deputy City Manager, to the City of Peoria. Vice Mayor Edwards reported on the Lunch with a Councilmember event held at Centennial High School on December 7, 2017 and the Teacher Appreciation Breakfast held on December 8, 2017. Vice Mayor Edwards encouraged participation in the Angel Tree Program. Councilmember Finn welcomed Erik Strunk, new Deputy City Manager, to the City of Peoria and expressed his appreciation to staff for their work throughout the year. Councilmember Finn reported on the Shop with a Cop event held on December 9, 2017 and the upcoming Coffee with a Cop event scheduled from 9:00 a.m. to 11:00 a.m. on December 16, 2017 at the Union Coffee Company located at 6750 West Thunderbird Road, Suite 109, Peoria, Arizona. Councilmember Finn expressed his appreciation to all public safety personnel. City Council Meeting Minutes December 12, 2017 Page 10 of 11 Councilmember Hunt welcomed the Campos family, who recently received a home courtesy of Habitat for Humanity, to the City of Peoria. Councilmember Hunt invited citizens to attend the Holiday Squad – Day of Giving event scheduled from 9:00 a.m. to 4:00 p.m. on December 16, 2017 in Old Town Peoria and hosted by the American Federation of State, County and Municipal Employees Local 3282 (AFSCME). Councilmember Hunt reported on the Police Department’s Community Partnership Awards event held on December 7, 2017 and congratulated Council Youth Liaison Acosta on her award. Councilmember Hunt welcomed Erik Strunk, new Deputy City Manager, to the City of Peoria. Councilmember Hunt attended a meeting with the consultants at the Main Library to discuss the Library strategic plan. Councilmember Hunt attended the Breakfast with Santa event held at the Community Center on December 6, 2017. Councilmember Hunt thanked City staff for completion of recent Acacia District projects including; cleanup of alleys, installation of the median on Monroe Street between 83rd and 85th Avenues and the decorative planters installed along 83rd Avenue in Old Town Peoria. Councilmember Hunt expressed her sentiments on the importance of arts in the City of Peoria. Councilmember Leone reported on the Police Department’s Community Partnership Awards event held on December 7, 2017. Councilmember Leone expressed his appreciation to Peoria’s first responders for assisting California’s battle against the wildland fires. Councilmember Leone expressed the importance of hiring new City staff from a pool of existing employees. Council Youth Liaison Gatrost congratulated the Young Artist Program participants and the new Deputy City Manager, Erik Strunk. Council Youth Liaison Gatrost reported on the Police Department’s Community Partnership Awards event held on December 7, 2017 and congratulated Council Youth Liaison Acosta for her award. Council Youth Liaison Gatrost attended the Old Town Holiday Festival held on December 1, 2017, the Peoria Unified School District event held at Pioneer Park on December 5, 2017 and the Elf on the Shelf event at the Main Peoria Library on December 9, 2017. Council Youth Liaison Gatrost reported on the Youth Advisory Board’s volunteer service at Lowe’s Home Improvement store on December 2, 2017. Council Youth Liaison Gatrost expressed condolences to the residents of California and the City of El Mirage. Reports from the Mayor: Mayor Carlat welcomed Erik Strunk to his new position as Deputy City Manager. Mayor Carlat expressed her appreciation to City staff for all of their efforts during the past year.
