MINUTES OF THE PEORIA CITY COUNCIL CITY OF PEORIA, ARIZONA CITY COUNCIL CHAMBER October 6, 2020 A Special Meeting of the City Council of the City of Peoria, Arizona was convened at 8401 West Monroe Street in open and public session at 4:00 p.m. Members Present: Mayor Cathy Carlat; Vice Mayor Michael Finn; Councilmembers Bridget Binsbacher, Denette Dunn, Jon Edwards, Vicki Hunt and Bill Patena. Members Absent: None. Other Municipal Officials Present: David Benton, Chief Assistant City Attorney; Lori Dyckman, Deputy City Clerk; Judge Anagnost, Municipal Judge and Christine Nickel, Human Resources Director. Audience: No members of the public were present. Note: The order in which items appear in the minutes is not necessarily the order in which they were discussed in the meeting. CONSENT AGENDA CONSENT AGENDA: All items listed with a “C” are considered to be routine or have been previously reviewed by the City Council, and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event the item will be removed from the General Order of Business, and considered in its normal sequence on the Agenda. Motion was made by Councilmember Hunt, seconded by Councilmember Edwards, to approve the Consent Agenda. Upon vote, the motion carried unanimously 7 to 0. 1C. Authorization to Hold an Executive Session Authorized the holding of an Executive Session for the purpose of discussions or consultations with designated representatives of the public body and/or legal counsel in order to consider its position and instruct its representatives regarding: (a) Employment, assignment, appointment, promotion, or salaries of a public officer or appointee pertaining to the evaluation process and performance review of the Municipal Judge pursuant to A.R.S. § 38-431.03.A.1. City Council Meeting Minutes October 6, 2020 Page 2 of 8 ADJOURNMENT: Being no further business to come before the Council, the meeting was duly adjourned at 4:01 p.m. EXECUTIVE SESSION AGENDA 2. Proclamation Recognizing October as Domestic Violence Awareness Month Mayor Carlat read aloud a Proclamation recognizing October as Domestic Violence Awareness month. Art Miller, Police Chief, accepted the proclamation and introduced Elizabeth Hartley, Victim Assistance Coordinator, who presented statistics regarding the number of domestic violence incidents. Mayor Carlat announced that the Consent Agenda included a Public Hearing on the Edward Byrne Memorial Justice Assistance Grant from The United States Department of Justice and liquor license applications for Coop’s Bar and Grill located at 8455 W Peoria Avenue and #1 Brothers Pizza located at 9815 West Happy Valley Road. There were no requests from those present to address these agenda items. Mayor Carlat asked if any Councilmember wished to have an item removed from the Consent Agenda. Having no requests from Council, motion was made by Councilmember Edwards, seconded by Councilmember Hunt to approve the Consent Agenda. Upon vote, the motion carried unanimously 7 to 0 4 C. Board and Commission Appointments and Reappointments Approved the recommendations from the Council Boards and Commissions Subcommittee and adopted RES. 2020-72 appointing and reappointing members to various boards and commissions. 5 C. Grants, Arizona Department of Homeland Security, Statewide Disaster Response Program (a) Authorized the acceptance of three grants from the Arizona State Department of Homeland Security in the amount of $100,311; and (b) Approved a budget amendment in the amount of $100,311 from the Proposed Grants Contingency Fund to the Arizona State Department of Homeland Security Grants Fund. City Council Meeting Minutes October 6, 2020 Page 4 of 8 6 C. Grants, Governor's Office of Highway Safety, Highway Safety Projects (a) Authorized the City Manager to accept five grants in the amount of $189,696 from the Governor's Office of Highway Safety for various enforcement and education efforts; and (b) Approved a budget amendment in the amount of $189,696 from the Proposed Grants Contingency Fund to various Governor's Office of Highway Safety Fund accounts. 7 C. Intergovernmental Agreement, Maricopa County, Use of Maricopa County Sheriff’s Office Sworn Basic Training Academy Approved an Intergovernmental Agreement with Maricopa County to utilize the Maricopa County Sheriff’s Office Sworn Basic Training Academy for Peoria Police Department recruit training. 8 C. Contract Amendment, Kimley-Horn and Associates, Inc., Jomax Road, Loop 303 Future Traffic Interchange to Vistancia Boulevard Approved Contract Amendment No. 4 in an amount not to exceed $30,892 with Kimley-Horn and Associates, Inc. for the design and post-design services for Jomax Road from the Loop 303 future traffic interchange to Vistancia Boulevard. 9 C. Surplus Land Disposal, West of Southwest Corner of 107th Avenue and Beardsley Road (a) Adopted RES. 2020-73 authorizing the City Manager to execute a Quit Claim Deed to Ventana Lakes Property Owners Association; and (b) Adopted RES. 2020-74 authorizing the acceptance of land rights from Ventana Lakes Property Owners Association to complete the disposal of surplus property. 10 C. Replat of the Master Final Plat, Camino A Lago South II, Deer Valley Road and 104th Avenue Approved a Replat of the Master Final Plat, Camino A Lago South II, located on Deer Valley Road and 104th Avenue, subject to stipulations. City Council Meeting Minutes October 6, 2020 Page 5 of 8 11 C. Replat, Village H at Vistancia Parcels H-7/8/9 and H-10 Master Final Plat, White Peak Drive and Vistancia Boulevard Approved the Replat for Village H at Vistancia Parcels H-7/8/9 and H-10 Master Final Plat located on White Peak Drive and Vistancia Boulevard, subject to stipulations. 12 C. PUBLIC HEARING – Grant, United States Department of Justice, Edward Byrne Memorial Justice Assistance Grant (a) Authorized acceptance of a United States Department of Justice, Edward Byrne Memorial Justice Assistance Grant in the amount of $26,155; and (b) Approved a budget amendment in the amount of $26,155 from the Proposed Grants Contingency Fund to the Justice Assistance Grant Fund. 13 C. PUBLIC HEARING - Liquor Licenses, Various Locations Recommended approval to the State Liquor Board for: (a) A Person Transfer for an On-Sale All Liquor License (Series 06) for Coop’s Bar and Grill, located at 8455 West Peoria Avenue, Timothy Marquez, Applicant,LL#20000553 and (b) A New Restaurant (Series 12) Liquor License for #1 Brothers Pizza, located at 9815 West Happy Valley Road, Timothy I. Martin, Applicant, LL#20-000535. REGULAR AGENDA New Business: Clerk’s Note: Agenda Items 14R and 15R were presented together. 14 R. Contract Amendment, ForeSite Design & Construction Inc., Country Meadows Neighborhood Park Construction, 111th Avenue and Butler Drive Adina Lund, Development and Engineering Director, presented on contract amendments for Country Meadows and Sonoran Mountain Ranch parks. Information included: • Country Meadows Park project description o Twenty-five year old park o Public involvement activities occurred in Spring 2019 o Proposed Improvements City Council Meeting Minutes October 6, 2020 Page 6 of 8 • Sonoran Mountain Ranch Park project description o Fifteen year old park o Public involvement activities occurred in Spring 2019 o Proposed Improvements • Construction Timing o Delayed due to COVID-19 o Project rebids scheduled for Summer 2020 • Project Schedule o Procurement scheduled for October through December 2020 o Construction to begin in January 2021 o Country Meadows Park completion scheduled for May 2021 o Sonoran Mountain Ranch Park completion scheduled for March 2021 Discussion ensued regarding: • Whether landscaping will be included in the improvements • Adaptive equipment • Possibilities for compressing the schedule • Combining the two grass areas at the Sonoran Mountain Ranch Park to be more contiguous • Whether restrooms will be addressed in the improvements Motion was made by Councilmember Dunn, seconded by Councilmember Hunt to: (a) approved a contract amendment with ForeSite Design & Construction Inc. for a Guaranteed Maximum Price in the amount of $1,661,578 for construction of the Country Meadows Neighborhood Park improvements located in the vicinity of 111th Avenue and Butler Drive; and (b) authorize a budget amendment in the amount of $188,411 from the General Fund Contingency account to the General Obligation Bond Fund Park Improvements account. Upon vote, the motion carried unanimously 7 to 0. 15 R. Contract Amendment, ForeSite Design & Construction Inc., Sonoran Mountain Ranch Neighborhood Park Construction, Miner Trail and Chalfin Boulevard Motion was made by Councilmember Binsbacher, seconded by Councilmember Hunt to: (a) approve a contract amendment with ForeSite Design & Construction Inc. for a Guaranteed Maximum Price in the amount of $455,370 for construction of the Sonoran Mountain Ranch Neighborhood Park improvements located in the vicinity of Miner Trail and Chalfin Boulevard; and (b) authorize a budget amendment in the amount of $133,182 from the General Fund Contingency account to the General Obligation Bond Fund Park Improvements account. City Council Meeting Minutes October 6, 2020 Page 7 of 8 Call To The Public (Non-Agenda Items) None. Reports from City Manager: 42. Reports A. Assistance and Recovery Programs Update Katie Gregory, Deputy City Manager, presented on the Peoria Small Business Grants Program. Erik Strunk, Deputy City Manager, presented on various Peoria assistance and recovery programs. Information included: • Grab-n-Go events • Library contributions • Partnership with Peoria Unified School District • Rent/Mortgage and Utility Assistance program Jeff Tyne, City Manager, summarized that the City is making a meaningful impact for Peoria businesses and residents. Reports from City Council: Dominique Van Winkle, Council Youth Liaison, reported on the Youth Advisory Board Retreat and his involvement on the Social Media Committee. Saanvi Tiwary, Council Youth Liaison, reported on her participation with the Youth Government Day Committee and conveyed their goal to educate youth on all aspects of local government in hopes of raising awareness for municipal government.
