Minutes from the Petersburg City Council meeting held on: July 1, 2014 -1– ______________________________________________________________________________ The regular meeting of the Petersburg City Council was held on Tuesday, July 1, 2014, at the Union Train Station. Mayor Moore called the closed session meeting to order at 6:30p.m. 1. CLOSED SESSION – 6:30 P.M. 2. ROLL CALL: Present: Council Member David R. Coleman Council Member W. CLOSED SESSION (a): City Attorney Brian Telfair, stated that it was City Council’s desire to enter into a closed session under Section 2.2-3711.A (1) of the Code of Virginia, and specifically under Subsection 3 to discuss matters pertaining to real estate, where the discussion in open meeting would adversely affect the City’s bargaining and or negotiation of the City; and under Subsection 7 to consult with legal counsel, where discussion in an open meeting would adversely affect the position of the City. Council Member Coleman moved that the City Council go into closed session for the purposes noted by the City Attorney. The motion was seconded by Council Member Myers. There was no discussion on the motion, which was approved on roll call vote. On roll call vote, voting yes: Coleman, Myers, Pritchett, Wilson-Smith, Webb and Moore; Absent: Ross City Council entered closed session at 6:30 p.m. CERTIFICATION: Council Member Coleman made a motion to return City Council into open session and certify the purposes of the closed session. Renada Lewis gave the presentation on behalf of Dr. Alice Freeman regarding the Biggest Healthy Loser. She stated that the first place runner up as Amanda Rodriquez and the second place runner up as Margaret Dotson. She announced the winner as Nanette Tice for losing for 10.7 pounds. b. Presentation by Fire Chief T. C. Hairston on an update on Fire EMS Strategy. Fire Chief T.C. Hairston gave a brief update on the Fire EMS Strategy. There was discussion among City Council Members. 5. CONSENT AGENDA: a. A request to schedule a public hearing on a proposed ordinance granting to Columbia Gas of Virginia, Inc. an exclusive easement, variable width right of ingress and egress and variable right-of-way on and through a tract of land along South Adams Street and Apollo Street. b. A request to schedule a public hearing on the consideration of an ordinance amending certain Sections of Article II of Chapter 66 of the Code of City of Petersburg to reflect the previous elimination of the Commission on Community Relations and its supporting staff.  Minutes from the Petersburg City Council meeting held on: July 1, 2014 -3– ______________________________________________________________________________ c. A request to schedule a public hearing on an ordinance declaring 1150-52 Farmer Street a blighted property and a public nuisance to the community and authorizing the abatement of such nuisance. d. A request to schedule a public hearing on an ordinance declaring 554 Halifax Street a blighted property and a public nuisance to the community and authorizing the abatement of such nuisance. f. A request to schedule a public hearing on an ordinance declaring 834 South Jones Street a blighted property and a public nuisance to the community and authorizing the abatement of such nuisance. g. Council Member Myers made a motion to adopt the consent agenda and to hold the public hearings on July 22, 2014. The motion was seconded by Council Member Ross. The motion was approved on roll call. On roll call vote, voting yes: Coleman, Myers, Pritchett, Ross, Wilson-Smith, Webb, and Moore 6. OFFICIAL PUBLIC HEARINGS: (In accordance with the Rules of Council, public comment will be heard before discussion by Council. Once discussion has started, no further input from the public will be accepted. Each speaker will be limited to three (3) minutes.) a. A public hearing on a proposed ordinance amending Chapter 54 of the Code of the City of Petersburg regarding open burning. BACKGROUND: This ordinance is being proposed in order to protect the public’s health, safety, and welfare by regulating open burning within the City of Petersburg. RECOMMENDATION: Recommend Council approve and adopt the proposed ordinance amending the City Code by adding §§ 54-4, 54-5, 54-6, and 54-7 to Chapter 54. Jeff Fleming, Fire Marshall, gave an overview of the proposed ordinance. Vice Mayor Webb made a motion to approve and adopt the proposed ordinance amending the City Code by adding § 54-4, 54-5, 54-6, and 54-7 to Chapter 54. The motion was seconded by Council Member Wilson-Smith. The motion was approved on roll call. On roll call vote, voting yes: Coleman, Myers, Pritchett, Ross, Wilson-Smith, Webb, Moore 14-ORD-66 AN ORDINANCE TO ADD SECTION 54-4 TO ARTICLE I, OF CHAPTER 56, PROHIBITING OPEN BURNING AND EXCEPTIONS; TO ADD SECTION 54-5, REQUIRING OPEN BURNING PERMITS; TO ADD SECTION 54-6, FIREWORKS PROHIBITIONS AND EXCEPTIONS, AND TO ADD SECTION 54-7, DEFINITIONS; OF THE 2000 CODE OF THE CITY OF PETERSBURG, AS AMENDED. b. A public hearing on a proposed Stormwater Management Ordinance for Local Implementation of the Virginia Management Program (VSMP). BACKGROUND: In accordance with the current Virginia Stormwater Management Regulations, the City of Petersburg has been required by the Virginia Department of Environmental Quality (DEQ) to adopt and locally administer the VSMP permitting process starting on July 1, 2014. Due to Virginia Stormwater Management Act revisions passed in the 2014 General Assembly and its effect on DEQ’s timeframe for providing comments to localities, a revised implementation schedule was issued by DEQ consisting of the following major milestones: 1) Localities shall submit a final VSMP Application Package (including ordinances, policies and procedures to be submitted to the local elected body for approval) to DEQ by June 15, 2014 for Final or Provisional approval. (This milestone has been achieved – DEQ is currently reviewing this final submission). 2) Localities shall continue to work to amend and adopt ordinances to address the Virginia Stormwater Management Act revisions through June 30, 2014. To fulfill the second milestone, a public hearing needs to be held to meet Code of Virginia requirements prior to City Council adoption of the required ordinance. RECOMMENDATION: Recommend Council adopt the proposed stormwater management ordinance for local VSMP implementation. Darryl Walker, Stormwater Manager, gave a brief overview of the proposed Stormwater Management Ordinance for Local Implementation of the Virginia Management Program (VSMP). Mayor Moore opened the floor for public comment. Seeing no hands, Mayor Moore closed the public hearing. Vice Mayor Webb made a motion to adopt the proposed Stormwater Management Ordinance for Local Implementation of the Virginia Management Program (VSMP). The motion was seconded by Council Member Wilson-Smith. The motion was approved on roll call. On roll call vote, voting yes: Coleman, Myers, Pritchett, Ross, Wilson-Smith, Webb, Moore 14-ORD-67 AN ORDINANCE ADOPTING THE PROPOSED STORMWATER MANAGEMENT ORDINANCE FOR LOCAL IMPLEMENTATION OF THE VIRGINIA MANAGEMENT PROGRAM (VSMP).  Minutes from the Petersburg City Council meeting held on: July 1, 2014 -5– ______________________________________________________________________________ 7. PUBLIC INFORMATION PERIOD: The Public Information Period is established by the Rules of Council to hear input from City residents or owners of businesses in the City. It will last for a maximum of 30 minutes. Speakers will be called in the order that they have signed up to speak. If there are ten or fewer speakers, each shall speak for a maximum of 3 minutes. If there are more than six (6) people desiring to speak, the time allotted to each person may be adjusted or the number of speakers limited to meet the time limitation. A speaker may speak on items except those that are listed on tonight’s Council agenda. Any matter brought before the attention of the City Council during the public information period will not be acted upon by the City Council at this meeting. John Rooney, 1993 Ridgewood Drive, stated that he would like to speak briefly on an issue regarding Devon Thomas. He stated that he has noticed that some of the police have greater respect for some of the liberties than Colonial Heights and Prince George. He stated that however with Devon Thomas situation where the young man was attacked by a couple of officers and with the video evidence this made him wonder what was going on. He stated that he went over to the apartment complex and asked some of the witnesses that were present what happened. He stated that they did confirm to him and that he had been assaulted and that he had a concussion and that he had to go to the hospital. He stated that he talked to Devon a week later at a protest and that he was still rattled by this. He stated that the prosecutor is charging Devon with two charges. He asked why the police officers are not being charged with assault. He stated that equal justice is something that is important to America. He stated that this is something from our heritage that we must not lose. He stated that in the process of passing out flyers last week he started to hear a lot of stories. He stated that the stories were a little surprising. He stated that from these stories he began to think that there are double standards. He stated that if you live in a lower class and middle class you are treated differently. He stated that if you live in the poor black areas they are treated like they have no rights. He stated that he knows that crime is deeper there and that he can go on and on about what causes this. He stated that the people in these areas are actually terrified of these police officers. He stated that some of the children run away because they are scared that they are going to be beat on. Larry Akin Smith, 816 Cameron Street, stated that he is present to declare his continued support for progressive development in Petersburg. He stated that although some would argue that there is no progressive development in the City and that the schools are failing and the streets are filled with potholes and houses are dilapidated and that the spirit of the City is eroding. He stated that some say that Fort Lee personnel are told to stay away. He stated that some say that there is nowhere for the youth to play in the City. He stated that some say that the citizens wring their hands in dismay. He stated that he stands to say that he is in support of the positive things going on in the City. He stated that he is calling on forward thinking open minded citizens to join in support of the City leaders to continue the great effort that they can see today. He stated that he has seen hard working teachers and administrators. He stated that he has seen and driven on new paved roadways. He stated that he witnessed the quick response to the water main break on South Crater Road. He stated that he knows of and participates in several initiatives that help decrease gun fire and drug use and crime in the community. He stated that there are meaningful relationships with Fort Lee. He stated that the children will be just fine as long as the adults seize the moment to provide healthy alternatives for them. He stated that he called for a review for continued support of the neighborhoods. He stated that some citizens say that the City’s infrastructure and charter is antiquated and somewhat dissimilated to the position of meeting the City’s needs. He stated that there are changes that need to be made and that they need to make them. He stated that where policy should be then they should implement them. Willie Noise, 1508 Circle Drive, stated that he has about six things to speak on his list. He stated he would like a cover over the Farmer Street Pool. He stated that the children are out swimming in the heat. He stated that he thinks that they have advanced enough to have some type of cover over the pool. He stated that he thinks that they are receiving out of state trash at the City’s trash dump. He stated that anymore properties that are being demolished on Halifax Street should be authorized by the Halifax Association. He stated that he does not know how many more properties are on the docket for demolition but that the thinks the City should stop and take a strong look on Halifax Street. He stated that some of the houses there should be rehabilitated. He stated that burials, funerals, and memorial death sites should be monitored. He stated that he has talked to them before about boot camp. He stated that nobody is listening except Council Member Pritchett. He stated that boot camp needs to be started in the tri- city areas. He stated that some children that have no father figures in their life need to be sent to a boot camp and knock some sense into them. He stated that he thinks about the President all the time. He stated that the City should send him something thanking him for the service that he has done for the country. Vernel Gannaway, 652 Old Wagner Road, stated that he comes to challenge them on something that one of the Council Members mentioned. He stated that the City does need intervention. He stated that he continues to look at the Council Members and the Senate. He stated that there should be some sort of prayer or moment of silence. He stated that he wants them to take this serious because all of the decisions that are being made are not their own. He stated that some of the decisions are for the cares of the City. He stated that there are a lot of good things that are going on in the City and that there could be a lot more. He stated that there are a lot of things that are going on because of where the leaders stand. He stated that there are people that are present that are concerned about the things in the City. He stated that they do not want people to run away from the City. He stated that there are a lot of new administrators that are coming to the City. He stated that he would like to know what these people are earning with all the debt that is taking place in the City. He stated that he questions himself on whether the new administration will be bad or not. He stated that he cannot say anything about the medical facility not cutting their grass in his area when the City is not cutting their grass as well. He stated that they need to know that the City is going in the right direction. He stated that he will continue to bow his head because he knows where his help come from. Linwood Christian, 410 Mistletoe Street, stated that there are two issues that he is going to bring up. He stated this is dealing with the trash and Juneteenth celebration. He stated that he will wait until he brings the issues up to the person who is in charge. He stated when the City has someone present in the City you do not go to Richmond to get a minister when there are plenty within the City of Petersburg to pray. He stated that if it rains or hails tonight then everyone would know why. He stated that he is the last person that will defend somebody when they are wrong but at the same time he will uphold them when they are right. He stated that he heard something that was kind of disturbing. He stated that he will say that he is not going to write a letter to the editor but he will put it out in the air. He stated that the City should not let if what happened by a few bad cops overshadow the good cops that are within the City. He stated that it is not fair that they take this incident and run. He stated that they do not know the real story behind this. He stated that others did an investigation and he did an investigation as well. He stated that this is one time that he will stand behind the police department especially one of the officers that was named. He stated that he stands behind the City of Petersburg Police Department. He asked why the school system is having problems paying their bills. He asked why the money that is supposed to come from the City to the school system been released. He stated that the school system in Petersburg does not have the technology that surrounding area school systems have. 8. BUSINESS OR REPORTS FOR/FROM THE MAYOR OR OTHER MEMBERS OF CITY COUNCIL: a. Consideration of changing the location of the council meeting scheduled for July 22, 2014, to Vernon Johns Junior High School, located 3101 Homestead Drive. BACKGROUND: City Council usually holds its meetings in the Union Train Station, located at 103 River Street. A council meeting is scheduled for July 22, 2014. A production company will be using the train station on July 22nd and it is necessary to change the location of council’s meeting. Staff recommends holding the meeting at Vernon Johns Junior High School. RECOMMENDATION: Recommend the location of the council meeting be changed to Vernon Johns Junior High School, which is located at 3101 Homestead Drive. Ms. Jackson stated that due to an update regarding facility availability this item will be removed from the agenda.  Minutes from the Petersburg City Council meeting held on: July 1, 2014 -7– ______________________________________________________________________________ b. Consideration of authorizing the City Manager to negotiate the terms of a $5,000,000 Revenue Anticipation Note (RAN). BACKGROUND: The Revenue Anticipation Note is an influx of cash on a temporary basis to assist in addressing the day to day operations until tax revenue is received. RECOMMENDATION: Recommend council authorize the City Manager to negotiate the terms of a $5,000,000 Revenue Anticipation Note. William Johnson, City Manager, gave a brief update on the $5,000,000 Revenue Anticipation Note. Vice Mayor Webb made a motion to authorize the City Manager to negotiate the terms of a $5,000,000 Revenue Anticipation Note (RAN). The motion was seconded by Council Member Myers. The motion was approved on roll call. On roll call vote, voting yes: Coleman, Myers, Pritchett, Ross, Wilson-Smith, Webb, and Moore 14-ORD-68 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO NEGOTIATE THE TERMS OF A $5,000,000 REVENUE ANTICIPATION NOTE. c. Consideration of a request to amend the City’s Fiscal Year 2014-2015 budget. BACKGROUND: Councilwoman Wilson-Smith has requested that the City’s FY14-15 budget be amended by transferring funds in the amount of $15,000 from the contingency fund to the non-department budget in order to provide funding to TRIAD, 4-H, and PAL in the amount of $5,000 each. RECOMMENDATION: Recommend Council consider an amendment to the City’s FY14-15 budget. There was discussion among City Council Members. Council Member Coleman made a motion to amend the City’s FY14-15 by transferring funds in the amount of $15,000 from the contingency fund to the non-department budget in order to provide funding to TRIAD, 4-H, and PAL in the amount of $5,000 each. On roll call vote, voting yes: Coleman, Pritchett, Ross, and Wilson- Smith; Voting No: Myers, Webb, and Moore 14-ORD-69 AN ORDINANCE AMENDING THE CITY’S FY14-15 BY TRANSFERRING FUNDS IN THE AMOUNT OF $15,000 FROM THE CONTINGENCY FUND TO THE NON-DEPARTMENT BUDGET IN ORDER TO PROVIDE FUNDING TO TRAID, 4-H, AND PAL IN THE AMOUNT OF $5,000 EACH. Council Member Coleman stated that he would like to thank the City Manager for attending his ward meeting and expressing to the citizens where the City is going and what the City is doing. He stated that he would like to thank the Interim Public Information Officer, Ms. Hyatt, and the police officers and citizens that came out. He stated that he would like to talk briefly regarding the flashing lights in Petersburg. He stated that someone is going to get seriously injured or killed. He stated that yesterday afternoon he came through the intersection of West and Wythe Street and that soon as he cleared the intersection he heard a bang. He stated that he looked in rearview mirror and that there was a car upside down on the sidewalk and that it was hit by a police officer. He stated that the main thoroughfare should not have blinking lights. He stated that the intersection of Wythe and South Street has a blind spot that cannot be seen around the curb. He stated that the lights are blinking. He stated that someone is going to get seriously injured in the City. He stated that the City does not need someone to get injured for them to change the lights back to where it should be. Council Member Coleman made a motion to suspend the test immediately and put the lights back into operation mode immediately. The motion was seconded by Council Member Wilson-Smith. Mr. Johnson stated that after receiving the voicemail on yesterday from Council Member Coleman and the conversation from Mr. Hicks and Petersburg Police Department immediately following the incident the lights were put back in working fashion. Council Member Coleman asked were all lights put back in order or just that intersection. Mr. Johnson stated that it was just that intersection. Council Member Coleman stated that he is asking that all lights be put back in order. Mr. Johnson stated that Mr. Hicks will come present with an update. Steven Hicks, Director of Public Works, stated that this would be the Washington Street, Wythe Street, and South Street. He stated that will this consist of Route 36 as well. Council Member Coleman stated yes he would like all the lights to be put back in place. He stated that he would like West and Farmer Street as well. Mr. Hicks stated that the lights that are flashing did not meet any of VDOT warnings. He stated that just like last time they are doing an operational assessment just like last time. He stated that this would include speed and all other data. He stated that once this occurs a determination will be made to either keep them or not. He stated that the ones that did already have incidents they have already declared concern. He stated that the main ones are still being assessed. He stated that it should end in the next seven days. He stated that it is important that they complete this study and try to finalize the record of decision. He stated that he can understand the concerns in that incident. He stated that he knows that there is a motion on the table but that he just wanted to share the process. He stated that in the next few days all the flashing will be completed. Mayor Moore asked Mr. Hicks that to clarify after the next seven days the test will be over. Mr. Hicks stated yes. Mayor Moore asked Mr. Hicks will he come back to City Council to further approve if there is a desire from maybe Council Member Coleman for data to be brought back to City Council. Mr. Hicks stated to Mayor Moore that if he gives the City Manager the guidance then he would provide Mr. Johnson with a report. Mayor Moore asked Council Member Coleman whether he would concur with this information. Council Member Coleman asked whether the study would be finish in seven days. Mr. Hicks stated yes. Council Member Coleman stated that he is wary of what may happen between now and seven days. He stated that something could happen tomorrow. He stated that if this is the wishes of his colleagues then he will concur.  Minutes from the Petersburg City Council meeting held on: July 1, 2014 -9– ______________________________________________________________________________ Council Member Wilson-Smith stated that her concern is the light at Slagle Avenue and Washington Street. She stated that because this entrance is difficult coming out of and making a left turn on Washington Street the traffic will be heavy. She stated that her other concern is the children and the school buses. She stated that she understands what they are trying to do but that this is not a good idea for this particular stop. She stated that there are too many dangers and possibilities. Mr. Hicks stated that this is what the study will capture. She stated that ones on Washington Street where the incident happened at have mass columns. She stated that the ones at Slagle Avenue will have to be upgraded. He stated that they are battling with the upgrades of the lights because they do not meet the warning. Council Member Wilson-Smith asked Mr. Hicks whether if they take the light away there will be no need for upgrading. Mr. Hicks stated yes. Council Member Wilson-Smith stated that she would appreciate very much if they leave that light at Slagle and Washington Street. She stated that she knows that a study can only do what a study is designed to do but most studies don’t study people or lives. She stated that she would prefer that they think about the people and their lives. Mr. Hicks stated that they are going to have a third party review to help in making the recommendations. Council Member Coleman stated that he withdraws his motion and will wait until after the study is done. Council Member Myers stated that with respect to the presentation made by Alexander Graham on behalf of the Petersburg Community Development Corporation as it relates to the feasibility study of Virginia Avenue Elementary School and whereas the cost for such renovation in the proposed study will not impact the City’s budget and subject to provide an abundance of services designed to serve the community at large. Council Member Myers made a motion that City Council accepts the feasibility study as presented and to authorize the City Manager to move forward in his duties to start the process of the transference of Virginia Avenue School to the appropriate party. The motion was seconded by Vice Mayor Webb. The motion was approved on roll call. On roll call vote, voting yes: Coleman, Myers, Ross, Webb and Moore; Voting No: Pritchett and Wilson-Smith Council Member Coleman stated that he is told that this property is school board property and not the City. He stated that he would like to know of this is correct. Mr. Telfair stated that this is not correct. He stated that it is not the school’s property it is actually the City’s property. He stated that they are in the middle of the process that soon as the City goes forward with the motion then this would help the City go forward. He stated that the City is actually the owner of the property. Council Member Pritchett stated that he thinks that they are putting the cart before the horse again. He stated that he thinks that they need more decision on this. He stated that he thinks that this is something that could possibly be on the agenda for the advance. He stated that this is a big decision for the City or citizens. He stated that he thinks that they need a lot more discussion than what is needed so far. Council Member Pritchett stated that he would like to go back two years ago to the designation of the meals tax regarding the extra 2% that they added. He stated that he thinks that they discussed at that time the monies be used for beatification and clean-up purposes for the entire City. He stated that he happened to be coming from Puddledock and stopped at the light and watched cars coming from Slagle Avenue. He stated that he saw four or five cars back up on street. He stated that it looked like the third or fourth one was getting frustrated for waiting on their time to come out. He stated that regarding this light he would concur with Council Member Wilson-Smith to have it working all day and put it on flashing lights at nights. He stated that he thinks that they are pretty successful with putting the lights on flash in the downtown area at night. He stated that the speedway on Washington Street needs lights to control the speed in those areas. He stated that he happened to be showing a house on West Washington Street. He stated that he felt like he needed a black and white flag to flag the person on. He stated that the cars must have been going about 60 miles per hour. Mayor Moore stated that he will be having a town hall meeting on July 16th at Old Towne Catering/ The Black Swan beginning at 6:30pm. He stated that the keynote speaker will be Lieutenant Governor Ralph Northam. He stated that he invites everyone to come out and attend. 9. CITY MANAGER’S AGENDA: a. City Manager’s Report The report will be given by City Manager William Johnson. Questions/Answers: 1. What is the police department policy regarding citizens video tapping officers? a. He stated that as long as all laws are being upheld citizens can videotape the officers. 2. Will there be a progress report of accomplishments of the goals identified during the police meeting being held on Saturday, May 31st? a. He stated yes.
