3. SCHEDULED BUSINESS
A. Discussion, consideration and possible action to recess to Executive Session for
confidential communications with city attorneys to discuss pending litigation,
Boevers Homes LLC v City of Piedmont, District Court Canadian County, State of
Oklahoma, Case No. CJ-2021-447, WINDING CREEK
LIMITED PARTNERSHIP. v City of Piedmont, District Court Canadian County,
State of Oklahoma, Case No. CJ-2022-384, and MARK & PHIL LLC, v City of
Piedmont, District Court Canadian County, State of Oklahoma, Case No. CJ-2022-
385 as provided for by 25 O.S. sec. 307 (B) (4).
a. MOTION TO MOVE TO EXECUTIVE SESSION
Mayor ProTem Melissa Ashford motioned to move to executive session. Councilman Jonathan
Hisey seconded this motion.
VOTE WAS:
AYE: Councilman Ryan Aller, Councilman Ron Cardwell, Councilman Jonathan Hisey,
Mayor ProTem Melissa Ashford
NAY: None
b. MOTION TO RECONVINE BACK TO SPECIAL MEETING
Mayor ProTem Melissa Ashford motioned to move to executive session. Councilman Jonathan
Hisey seconded this motion.
VOTE WAS:
AYE: Councilman Ryan Aller, Councilman Ron Cardwell, Councilman Jonathan Hisey,
Mayor ProTem Melissa Ashford
NAY: None
B. Discussion, consideration and possible action to engage the services of outside legal
counsel to defend the City in, WINDING CREEK LIMITED
PARTNERSHIP, v City of Piedmont, District Court Canadian County, State of
Oklahoma, Case No. CJ-2022-384
Mayor Kurt Mayabb made a motion to give City Manager permission to hire Mr. Shen if needed
to help OMAG and gave Mr. Jones authorization to contact McAfee & Taft if needed.
Mayor ProTem Melissa Ashford seconded this motion.

C. Discussion, consideration and possible action to engage the services of outside legal
counsel to defend the City in, MARK & PHIL LLC, v City of Piedmont, District
Court Canadian County, State of Oklahoma, Case No. CJ-2022-385
Mayor Kurt Mayabb made a motion to give City Manager permission to hire Mr. Shen if needed
