MINUTES OF THE PUBLIC HEARING AND REGULAR MEETING OF THE PLANNING AND ZONING COMMISSION OF THE TOWN OF PINETOP-LAKESIDE, ARIZONA, HELD THURSDAY, NOVEMBER 10, 2016, IN THE TOWN COUNCIL CHAMBERS. Vice Chairman Snitzer called the Meeting to order at 6:10 p.m. Roll call was as follows: ROLL CALL: Present Absent Present Absent John Jarchow X Timothy Williams X James Snitzer X Errol Heslop X Rob Ingels X Adam Staley X Richard Smith X STAFF PRESENT: Cody Blake, Interim Zoning Administrator and Jill Akins, Assistant to the Town Clerk. ITEM NO. 3, CALL TO THE PUBLIC: There were no requests to address the Commission at this time. ITEM NO. 4, RECOGNITION OF VICE CHAIRMAN JIM SNITZER FOR HIS YEARS OF SERVICE ON THE PLANNING AND ZONING COMMISSION: Cody Blake thanked and presented a plaque to Vice Chairman Snitzer for his years of service on the Planning and Zoning Commission. He said he had been an asset to the Town and to the Commission. Commissioner Ingels thanked the Vice Chairman, and said he appreciates the positive changes the Vice Chairman has brought to the community over the previous years. ITEM NO. 5, APPROVAL OF THE REGULAR MEETING MINUTES OCTOBER 27, 2016: COMMISSIONER INGELS MOVED TO APPROVE THE REGULAR MEETING MINUTES FROM OCTOBER 27, 2016. COMMISSIONER SMITH SECONDED THE MOTION AND IT CARRIED UNANIMOUSLY. ITEM NO. 6, INFORMATION/DISCUSSION/LEGAL ACTION REGARDING CONDITIONAL USE PERMIT NO. 121; LOCATED AT 2100 S. RICHARDSON LANE, APN 212-42-004B; ALLOWING UP TO TWO (2) HORSES TO BE LOCATED ON THE PROPERTY: COMMISSIONER INGELS MOVED TO ADJOURN THE REGULAR MEETING AT 6:16 P.M. AND GO INTO THE PUBLIC HEARING MEETING. COMMISSIONER WILLIAMS SECONDED THE MOTION AND IT CARRIED UNANIMOUSLY. Mr. Blake said the property is three acres and the Town Code allows up to six horses, but he said the owners are requesting to keep two horses on the property. Mr. Blake said the property is flat, with a very small slope, and he said the owners have sufficient corral space with twelve hundred square feet per horse. He said there will also be a barn on the property. Mr. Blake said the owners meet the requirements per Code, and said he recommends the Commission to approve Conditional Use Permit No. 121. Owners Gary and Laurie James 1 were present at the meeting to answer questions from the Commissioners. Mr. James said an acre would be fenced off for the horses. Drainage and property slope were discussed and determined to meet all requirements. Commissioner Ingels said he reviewed the equine requirements, and he asked the applicants if they were concerned with a condition of the permit allowing only two horses. Vice Chairman Snitzer said the motion could be for up to six horses allowed on the property. Mr. Blake said he had not received any comments from neighbors. COMMISSIONER WILLIAMS MOVED TO ADJOURN THE PUBLIC HEARING AT 6:25 P.M. COMMISSIONER INGELS SECONDED THE MOTION AND IT CARRIED UNANIMOUSLY COMMISSIONER INGELS MOVED TO APPROVE CONDITIONAL USE PERMIT NO. 121 WITH THE FOLLOWING CONDITIONS: THE APPLICANT MUST COMPLY WITH ALL REQUIREMENTS OF THE EQUINE REGULATIONS INCLUDING MINIMUM CORRAL SIZE AND FENCE HEIGHT; THE APPLICANT MUST COMPLETE REGULAR MAINTENANCE OF THE CORRAL ENCLOSURE TO ENSURE THERE ARE NO NEGATIVE IMPACTS TO ADJACENT PROPERTIES; THE APPLICANT WILL BE SUBJECT TO AN ANNUAL INSPECTION BY STAFF TO ENSURE COMPLIANCE WITH ALL APPLICABLE REGULATIONS; APPLICANT IS LIMITED TO A MAXIMUM OF THREE HORSES. COMMISSIONER WILLIAMS SECONDED THE MOTION AND IT CARRIED UNANIMOUSLY ITEM NO. 7, STAFF REPORTS: Cody Blake said there is a possible zone change for the property the old Munich House is on. He said this change may come before the Commission early next year. He said at the meeting in December there will be a Conditional Use Permit for a home-based occupation. He said Mark Sterling, owner of High 5 Design, lives behind the Blue Ridge Vet Clinic, and said Mr. Sterling would like to close his storefront business and move the business to his home and semi-retire. Mr. Blake said there would be minimal business usage at the property. He said he and the Chairman and Vice Chairman met and they all agreed this should be brought before the Commission as a Conditional Use Permit. He said he encouraged Mr. Sterling to talk to his neighbors, and said he would be mailing out letters to properties within three hundred feet of Mr. Sterling’s home and the property would be posted. ITEM NO. 8, INFORMATION/DISCUSSION/LEGAL ACTION REGARDING RECOMMENDATION TO TOWN COUNCIL CHANGING THE MAKEUP OF THE PLANNING AND ZONING COMMISSION TO RAISE THE NUMBER OF COMMISSIONERS LIVING OUTSIDE THE TOWN LIMITS FROM TWO TO THREE IN ORDER TO ATTRACT A BROADER POOL OF APPLICANTS: Vice Chairman Snitzer said it was decided by he and the Chairman to send this forward to the Town Council hoping they would be able to receive more applicants for the vacancies on the Commission. Commissioner Ingels said he is comfortable with this change in order to fill the vacancies. COMMISSIONER INGELS MOVED TO RECOMMEND TO THE TOWN COUNCIL CHANGING THE MAKEUP OF THE PLANNING AND ZONING COMMISSION TO RAISE THE MAXIMUM NUMBER OF COMMISSIONERS LIVING OUTSIDE THE TOWN LIMITS FROM TWO TO THREE. COMMISSIONER SMITH SECONDED THE MOTION AND IT CARRIED UNANIMOUSLY. 2 ITEM NO. 9, INFORMATION/DISCUSSION/LEGAL ACTION REGARDING REVIEW OF TOWN CODE TITLE 17 ZONING: Vice Chairman Snitzer said he proposes reviewing the organization of Title 17 Zoning Chapters Index. Mr. Blake suggested 17.112 Nonconforming Uses to be put before 17.80 Conditional Use Permits. Vice Chairman Snitzer suggested breaking out in more detail 17.104 Supplemental Provisions. Mr. Blake said he would agree. General discussion ensued regarding the Title 17 Zoning Chapters and Index. ITEM NO. 10, FUTURE AGENDA ITEMS: Vice Chairman Snitzer said a Chairman and Vice Chairman will be decided at the December meeting. He said there will be only one meeting in November and only one meeting in December. Dated this 9th day of December 2016. Pursuant to Arizona Revised Statutes Section 38-431.02, notice is hereby given to the members of the Pinetop-Lakeside Planning & Zoning Commission and to the general public that the Planning & Zoning Commission will hold a regular meeting and public hearing on Thursday, November 10, 2016 beginning at 6:00 p.m., in the Town Council Chambers located at 1360 N. Niels Hansen Lane, Pinetop-Lakeside, Arizona. AGENDA 6:00 p.m. REGULAR MEETING: 1. Call to Order and Ascertain Quorum. 2. Pledge of Allegiance. 3. Call to the Public. This is a business meeting of the Planning and Zoning Commission. The Town values and welcomes public input. Please address the Commission as a whole and not individual Commission Members. Do not address staff or members of the audience. Commission action on items brought up in Call to the Public is limited by the Open Meeting Law. The Commission may direct staff to study the matter and reschedule for further consideration at a later date. Items on the agenda will not be heard or discussed in Call to the Public. Individuals are limited to three (3) minutes. 4. Recognition of Vice Chairman Jim Snitzer for his years of service on the Planning and Zoning Commission. 5. Consent Agenda a. Approval of the regular meeting minutes for October 27, 2016. 6. Information/Discussion/Legal Action re: Conditional Use Permit No. 121; located at 2100 S. Richardson Lane, APN 212-42-004B; allowing up to two (2) horses to be located on the property. 7. Staff Reports: No action will be taken. 8. Information/Discussion/Legal Action re: Recommendation to Town Council changing the makeup of the Planning and Zoning Commission to raise the number of Commissioners living outside the Town limits from two to three in order to attract a broader pool of applicants. 9. Information/Discussion/Legal Action Re: Review of Town Code Title 17 Zoning. 10. Future Agenda Items: Discussion regarding any future agenda items. No action will be taken.
