Page 2 Mayor Irwin led the Pledge of Allegiance to the Flag. Pastor Diane White offered the Invocation. 8. Call to the public Mayor Irwin called for public comments. No comments were offered. C. Consent Agenda Mayor Irwin announced consideration of the Consent Agenda and explained that all items listed would be acted upon by a single vote of the Council, unless a member of the Council asked that specific items be removed from the Consent Agenda, discussed, and voted upon separately. Vice Mayor Smith moved for passage of the Consent Agenda. Council Member Beus seconded the motion and by show of hands the following vote was recorded: AYES NAYS ABSTAIN Mayor Irwin X Vice Mayor Jeny Smith X Council Member Krigbaum X Council Member Snitzer X Council Member Watson X Council Member Beus X Council Member Heisler X Mayor Irwin then declared that all Consent Agenda items in these minutes were approved, passed, and adopted with a 7-0 vote. C.1 Consider approval of the Minutes of the Town council Meeting held on July 21, 2022. By a unanimous vote under the Consent Agenda, Town Council approved the minutes of the Town Council Meeting held on July 21, 2022. Page 3 By a unanimous vote under the Consent Agenda, Town Council approved the Town Check register for the period of June 1 through 30, 2022. D. Business Before the council Mayor Irwin announced that Public Comment will be taken at the beginning of each agenda item, after the subject has been announced by the Mayor and explained by Staff. Any citizen, who wishes, may speak one time for five minutes on each agenda item before or after Council discussion. Questions from Council Members, however, may be directed to staff or a member of the public through the Mayor at any time. D.1 Presentation of the EPA Brown fields Grant awarded to the Navajo and Apache County Communities. Dave Laney of Stantec Consulting presented on the Northeast Arizona Property and Business Revitalization Program. Mr. Laney stated that this program will identify, plan for and provide findings and technical assistance to property owners. Mr. Laney added that the goal is to reuse, revitalize and redevelop property with an emphasis on vacant, abandoned, blighted, underutilized, and contaminated property. Mr. Laney stated that brownfields are former auto repair shops, old warehouses, vacant commercial buildings, former gas stations, former dry cleaners, junk yards and dump sites, former supermarkets, abandoned railyards, old schools, old churches, health clinics and hospitals. Mr. Laney stated that economic transition, infrastructure improvements, illegal dumping and natural disasters are some of the reasons brownfields are created adding that common contaminants are petroleum, solvents, asbestos, metals, PCBs. Mr. Laney shared economic, social and environmental impacts of brownfields, a few being lost tax revenue, decreased property values, diminished job opportunities, public safety concerns, public health risks, water quality, greenhouse gas emissions and wildlife habitat populations. Mr. Laney then shared some benefits of brownfleld redevelopment, increased tax revenues, increased property values, job creation, attracts private investment, decreased crime, community pride, preserves open space, reduces greenhouse gas emissions, and much more. Mr. Laney shared success stories of completed projects. Mr. Laney stated that there are 30 potential brownfields in Pinetop-Lakeside and 145 within Navajo and Apache Counties. Mr. Laney shared some goals and objectives for Community Outreach and Engagement stating that there will be a website and public meetings as well as a Brownfield Advisory Committee (BAC). Mr. Laney shared that there is a site nomination fomi for assessment. Minutes Of the Town Council Regular Meeting -August 4, 2022. Page 4 Council Member Krigbaum asked if the current property owners shown in the presentation for the Pinetop-Lakeside area had already been contacted about this grant. Mr. Laney stated that the property owners will be informed that the grant is available and explained that this is step one and more public meetings will be held, and those property owners will be invited to attend. Mayor Irwin stated that the potential money available with this grant is $600,000 and could be very helpful for Pinetop-Lakesides downtown areas. Vice Mayor Smith asked if a tenant could qualify if they have a long-term lease. Mr. Laney was unsure of the answer as he is unsure if a tenant has ever applied and added that a tenant could fill out the form and see if it gets approved adding that it does not cost anything to apply. Council Member Watson asked if there is a maximum dollar amount that can be applied for in phase one and phase two. Dave Laney stated that EPA will not allow more than $200,00 for one site. Council Member Watson stated that it looks like Stantec is a firm of planners, engineers, and scientist and asked if they are contracted with APA for funding. Dave Laney responded that they are contracted with Apache County which is the grantee of record adding that every community that is part of this coalition had to sign a memorandum of agreement with Apache County. Mayor Irwin thanked Mr. Laney for the presentation and information. D.2 Public Hearing for FY2022-2023 Budget and consider Resolution No. 22-1629 adoption of the Final Budget for the Town of Pinetop-Lakeside for the Fiscal Year ending June 30, 2023. Finance Director Rodolph stated on July 14, 2022, Council did approve and adopt the tentative budget. Director Rodolph shared that there are no changes to the Final Budget. Director Rodolph gave a brief summary of the Final Budget. Mayor Irwin opened the Public Hearing.  Minutes Of the Town Council Regular Meeting -August 4, 2022. Page 5 Lany Mccormick asked if there had been any changes since the Preliminary Budget was approved. Director Rodolph stated that there have been no changes. Council Member Krigbaum moved to adopt Resolution No. 22-1629 approving the FY2022-2023 Final Budget for the Town of Pinetop-Lakeside for the Fiscal Year ending June 30, 2023. Council Member Watson seconded the motion and by show of hands the following vote was recorded: AYES NAYS ABSTAIN Mayor Irwin X Vice Mayor Smith X Council Member Krigbaum X Council Member Snitzer X Council Member Watson X Council Member Beus X Council Member Heisler X Mayor Irwin declared the motion passed with a 7-0 vote. D.3 Pursuant to A.R.S. 38-431.03(A)(1) the council may vote to enter into Executive Session: A. Upon a public majority vote of the members constituting a quorum, a public body may hold an executive session for the following purposes: 1.Discussion or consideration of employment, assignment, appointment, promotion, demotion, dismissal, salaries, disciplining or resignation of a public officer, appointee or employee may demand that the discussion or consideration occur at a public meeting. The public body shall provide the officer, appointee, or employee with written notice of the executive session as is appropriate but not less than twenty-four hours for the officer, appointee, or employee to determine whether the discussion or consideration should occur at a public hearing. • Performance Evaluation of Town Manger Council Member Snitzer moved to enter into Executive Session pursuant to A.R.S. 38-431.03(A)(1) Vice Mayor Smith seconded the motion and by show of hands the following vote was recorded: Minutes of the Town Council Regular Meeting -August 4, 2022. Council entered into Executive Session at 6:40 p.in. Regular Meeting reconvened at 7: 15 p.in. D.4 Consider Resolution No. 22-1630 approving the renewal of Town Manager's Employment Agreement for a four (4) year period. Mayor Irwin asked if Council had any questions regarding the Employment Agreement for Town Manager, Keith Johnson. No comments or questions. Council Member Watson moved to adopt Resolution No. 22-1630 approving the renewal of the Town Manager's Employment Agreement for a four (4) year term with a change of a 6-month severance.
