Calltothepublic Mayor Irwin called for public comments. No comments were offered. C. ConsentAgenda Mayor Irwin announced consideration of the Consent Agenda and explained that all items listed would be acted upon by a single vote of the Council, unless a member of the Council asked that specific items be removed from the Consent Agenda, discussed, and voted upon separately. Vice Mayor Beus moved for passage of the Consent Agenda as presented. Council Member Heisler seconded the motion and by show of hands the following vote was recorded: AYES NAYS ABSTAIN Mayor Irwin X Vice Mayor Beus X Council Member Snitzer X Council Member Krigbaum X Council Member Heisler X Council member Brimhall X Mayor Irwin then declared that all Consent Agenda items in these minutes were approved, passed, and adopted with a 6-0 vote. C.1 Consider approval of the Minutes of the Town council Regular Meeting held on February 16, 2023. By a vote of 6-0 under the Consent Agenda, Town Council approved the minutes of the Town Council Regular Meeting held on February 16, 2023. C.2 Consider approval of the Town check Register for the period of January 1 through 31, 2023. By a 6-0 vote under the Consent Agenda, Town Council approved the Town Check Register for the period of January 1 through 31, 2023. Minutes of the Town Council Regular Meeting -March 2, 2023 Page 3 D. Business Before the council , Mayor Irwin announced that Public Comment will be taken at the beginning of each agenda item, after the subject has been announced by the Mayor and explained by Staff. Any citizen, who wishes, may speak one time for five minutes on each agenda item before or after Council discussion. Questions from Council Members, however, may be directed to staff or a member of the public through the Mayor at any time. D.1 Town ofpinetop-Lakeside proclamation "Women's History Month" Mayor Irwin Proclaimed March 2023 as "Women's History Month" in the Town of Pinetop-Lakeside. D.2 Presentation from the Arizona Rangers to the pinetop-Lakeside Police Department and the Town of Pinetop-Lakeside. Captain Craig Boston and Lieutenant Bob Coleman of The Arizona Rangers Show Low Company presented a plaque of appreciation to the Pinetop-Lakeside Police Department. D.3 ADEQ Update Mannie Bowler Community Liaison for ADEQ presented roles of ADEQ Community Liaisons, Area Support, Grant Support, Project Assistance, and a Brownfield Update. D.4 Presentation Addressing Navajo county's opioid Epidemic. Town Manager and Amy Stradling with Navajo County presented. D.5 Consider Resolution No. 23-1661 Approving and Authorizing the Mayor to execute Opioid Settlement Fund Agreements with Teva, Allergan, CVS, Walgreens, and Walmart and an Intergovernmental Agreement with Navajo County for the use of Opioid Settlement Proceeds Pursuant to One Arizona Plan. Town Manager Johnson introduced Deputy County Attorney, Jason Moore. Jason Moore, Deputy County Attorney shared the following comments, "A4)/ 73czme is Jason Moore. I am the Deputy County Attorney fior the Navajo County Attorney's Office. I exclusively do civil work f;or the County. A few years ago we decided as a County to seek outside representation to represent the County in opioid lawsuits that Minutes of the Town council Regular Meeting -March 2, 2023 Page 4 had started being filed nationally to seek remedies f;or damages that counties and smaller municipalities have incurred because Of the opioid crisis that we all face today. We had one round of settlements earlier that I would just rofer to generally as the distributor settlements. The County has started to receive monies from that Settlement and at this point we are looking at how to spend that. That is what the prior presentation was about. What I am here to talk to you about tonight is the settlement with Allergan, Teva, CVS, Walmart, and Walgreens. This is the second major settlement in what will be a series of settlements that will be presented to you from time to time. The biggest players have not settled yet. But that ultimately will be coming tonight. We are asking your approval and the approval Of all municipalities throughout Navajo County to approve a settlement with the firve entities I identified earlier. What this settlement means fior Navajo County is that we would receive, as a county, approximately three million two hundred thirty four thousand f;our hundred and Seventeen dollars and eighty f;our cents. The way these settlements are structured between the five settling entities are that they will pay out over six to fifteen years. Some Of the settlements include provisions that they will provide Narcan f;or free which is something that can reverse opioid overdoses. So, we would get some Of that f;or free, but that is the dollar amount that you are looking at and I did provide Mr. Johnson and I cam sure you have in your packets how that's divided between the cities and the county. If it were broken down approximately 70 percent Of the settlement money would go to Navajo County and smaller percentages to each Of the municipalities. the town Of Pinetop Lakeside would receive 4.75 percent. Those at the municipal level do not have health departments to administer this and as part Of the settlement requirements it has to be overseen by County Health Departments throughout the country. This was stated in the One Arizona Plan and it is structured into the settlement proposals which basically is to ensure that the money is utilized in appropriately which is also outlined in the One Arizona Plan that you approved a couple years ago. So, what this basically does is it allows the county and the municipalities to work together collectively to solve what is a problem that plagues all Of our coryanunities collectively and do so in a comprehensive way. This would be diJ:ficult f;or smaller cities and towns to administer such small amounts offunds and to use them on their own. Collectively, we can have a much bigger impact and that is what this settlement is all about. Tonight I am asking you to approve the proposed settlement. We are going to each of the cities and towns and asking them the same thing throughout Navajo County and every city and town throughout the state is going to have the same thing on their agenda. In order to maximize our settlement, to get that full amount, I was discussing we have to get sign-ons from every county, every city or town throughout the State of Arizona. That is key to making this one Arizona plan work which underpins all Of this so if there is any questions, I'd be happy to answer them. " Council Member Krigbaum asked if distributions are based on the population of the City or Town. Minutes Of the Town Council Regular Meeting -March 2, 2023 Page 5 Jason Moore responded, yes. Town Manager Johnson stated that Pinetop-Lakeside was awarded more than other towns in Navajo County that were the same size or smaller. Jason Moore stated that there were measurements that were made in terms of the impact that opioids had on each community adding that this along with population was how the amounts were established. Vice Mayor Beus moved to adopt Resolution No. 23-1661 Approving and Authorizing the Mayor to execute Opioid Settlement Fund Agreements with Teva, Allergan, CVS, Walgreens, and Walmart and an Intergovemmental Agreement with Navajo County for the use of Opioid Settlement Proceeds Pursuant to One Arizona Plan. D.6 Public Hearing, Discussion and consider Resolution No 23-1660 and Ordinance No. 23-460, proposed changes to the Pinetop-Lakeside Town Code Chapter 12.16 Town Cemetery. Town Clerk Salskov stated the last time Town Code to Chapter 12.16 Town Cemetery was last revised in 2016. Town Clerk Salskov explained that a review of Chapter 12.16 Town Cemetery was done with Public Works Director Patterson, Engineering Technician, Kathrin Nunn and it was found that there were a few updates to be made. Town Clerk Salskov shared the following proposed changes; The definition of a "Plot Owner", meaning, that a person purchasing a plot is not purchasing real property, rather just a purchase of a license for use of a plot for burial. The next proposed change was adding the maximum allowed width and height for headstones and specifying the difference between a single plot, companion plot, and a family plot. Lastly, a third cleaning day annually was added to the Cemetery and allowing two (2) weeks per cleaning occasion. Minutes Of the Town Counci,I Regular Meeting -March 2, 2023 Page 6 Mayor Irwin opened the Public Hearing. No Comments were offered. Mayor Irwin closed the Public Hearing. Council Member Heisler moved to adopt Resolution No. 23-1660 and Ordinance No. 23-460 Amending Town Code Chapter 12.16 TOWN CEMETERY as Proposed.
