Council Minutes February 21, 2013 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, February 21, 2013. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Cochran Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts made a motion to waive the reading of the February 7, 2013, minutes. Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written of the February 7, 2013, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect that both motions passed unanimously." Mayor Sanders suspended rules. Barry Wilson, PHCC President, stated that he had planned to present a check in the amount of $300.00 to Rudd Middle School Drama Department for the Dinner Theater proceeds. Mr. Wilson added that PHCC and Tammy Parker, Rudd Middle School Drama Teacher, are exploring the idea of starting a Community Theater. Mr. Wilson asked anyone interested in this should contact a PHCC Board member. Mayor Sanders reinstated rules. Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $40,232.58; a copy of the bills schedule is attached. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner mentioned that $20,000.00 of the total amount is to fund the TCNP Management position that we pay once a year. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Mayor Sanders gave a 7 month report on the General Fund, which includes business license and franchise fees through January 2013. Mayor Sanders stated regarding business license and franchise fees we have met and exceeded our revenue expectation. Mayor Sanders added that regarding the franchise fees as of today we have received $321,000. and the budget was $300,000. Mayor Sanders stated that he is projecting to be approximately $40,000.00 over expectation by the end of the fiscal year assuming that everything maintains. Mayor’s Report: Mayor Sanders announced the Planning and Zoning Commission meeting will be held on February 25, 2013, at 6:00 p.m. Mayor Sanders added that there is an opening on the Planning and Zoning Commission, those interested should contact him. Old Business: Councilor Cochran offered a resolution authorizing and directing the Mayor to execute an amended contract to purchase certain property. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 13-08. Councilor Churchwell offered a resolution expressing intent to consider purchase and authorizing the Mayor to negotiate and explore finance options in preparation for consideration by Council, regarding Pinson Rock School and Triangle Park. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 13-09. New Business: Councilor McCain offered resolution authorizing the Mayor to enter into a license contract with Solid Rock Church, regarding CityFest and Movies in the Park. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 13-10. Councilor McCain offered a resolution authorizing the Mayor to enter into a contract for the purchase of property, regarding property on Glen Brook Road. Councilor Cochran duly seconded the motion. Mayor Sanders stated that this property is located behind State Farm on Glen Brook Road and the seller has agreed to sell the property for $3,000.00. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 13-11. Councilor McCain offered a motion authorizing city funding of the rides for CityFest at a cost of approximately $2,600.00. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect that the motion passed unanimously.” Councilor Roberts stated that due to the popularity of the recycle trailer he contacted Waste Pro. Councilor Roberts added that Waste Pro will provide an 8 yard dumpster and empty it once a week for $65.00 a month. Councilor Roberts stated that he will have more information for council at the next meeting. Mayor Sanders recognized Ronnie Dixon, Executive Director of the Clay Pinson Chamber of Commerce. Mr. Dixon reported on the 2012 Alabama Butterbean Festival stating that the festival received $20,500 in sponsorship as in years past. Mr. Dixon added that although there were fewer vendors those vendors made more money than previous years. Mr. Dixon stated that the largest expense this year was $5,000. for fireworks which was paid for out of $20,000. from sponsorships. Mr. Dixon added that no one person gave $5,000 for the fireworks, it was a combination of the grant we received from the Tourism Department and Pinson Discount Drugs. Mr. Dixon reported that all the bills have been paid and we don’t owe any money. Mr. Dixon added that in April 2012 we had $6,412. in the checking account once we finished paying all the bills from the 2011 Butterbean Festival. The checking account balance from the 2012 Butterbean Festival through December 31, 2012 is $10, 233. Mr. Dixon added that the festival made more than it made last year and we donated more than we have ever donated. We should finish up with about $9,000 in the bank after all bills are paid. Councilor Tanner offered a resolution concerning the Clay Pinson Chamber of Commerce, regarding a contract in the amount of $5,000.00. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-abstain; Councilor McCain-yes. Mayor Sanders, resolution passes as, Resolution 13-12. Councilor Roberts offered a resolution authorizing the Mayor to enter into a contract for advertising and promotion with the Clay-Pinson Chamber of Commerce for the 2013 Alabama Butterbean Festival, in the total amount of $30,000.00. Councilor Tanner duly seconded the motion. Mayor Sanders mentioned some of the terms of the contract which states that the City will pay the Clay Pinson Chamber of Commerce $10,000.00 to promote and advertise the City of Pinson while it is promoting the Alabama Butterbean Festival. The City shall provide Sheriff’s deputies beginning at Noon on October 4th and ending at 5p.m. on October 5th the day of the festival. The City shall also provide Emergency Fire and Medical personnel during the open hours of the festival, 5-10pm Friday and 8am-4pm Saturday. The previously mentioned staff will work at the direction of the City of Pinson. Mayor Sanders added that these in-kind services will be paid by the City at an approximate cost of $20,000.00. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-abstain; Councilor McCain-yes. Mayor Sanders, resolution passes as, Resolution 13-13. Mayor Sanders welcomed Mayor Webster of the City of Clay. Councilor Churchwell stated that he abstained from voting on the Chamber of Commerce contract and the 2013 Alabama Butterbean Festival contract because he is a Chamber member, adding that he is not against either contract. Public Comment: None. Councilor Cochran moved to adjourn. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say “no”, all in favor say “aye”. Motion carried.
