Council Minutes April 18, 2013 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, April 18, 2013. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor Churchwell Councilor McCain Absent: Councilor Cochran Minutes: Councilor Roberts made a motion to waive the reading of the April 4, 2013, minutes. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Roberts made a motion to accept the minutes as written of the April 4, 2013, meeting. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect that both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $50,020.87; a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner mentioned that $20,000. of this amount is for our final installment payment of the Civitan Building/Community Center. Mayor Sanders reported that we have received our Capital Trust Fund money in the amount of $163,433., which includes a corrective payment from the Alabama Trust Fund. Mayor Sanders added that we use these funds to pay our mortgage and for other fixed capital improvements or payments. Mayor Sanders stated that our final installment payment for the Civitan Building/Community Center will be paid out of these funds. Mayor Sanders called for any further discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama. Owners, The Mayor of the City of Pinson and Vickers-Wise Pinson, LLC, located at 4685 and 4689 Center Point Road and 6691 Highway 75. Councilor Tanner duly seconded the motion. Mayor Sanders asked for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance number 2013-07. Mayor’s Report: Mayor Sanders suspended rules to open the Public Hearing regarding re- zoning of 6975 and 6995 Narrows Road, from Jefferson County zoning A-1 to City of Pinson zoning RR. Mayor Sanders stated there was no comment offered for or against the re-zoning. Mayor Sanders reinstated rules. Councilor McCain offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, regarding 6975 and 6995 Narrows Road, Pinson, Alabama. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2013-08. Mayor Sanders reported that a large number of trees were downed by the recent storm but have now been collected by our contractor. Mayor Sanders mentioned that the zoning office is in need of a Plotter and we have 3 potential machines we are looking at purchasing. Councilor Churchwell stated that his concern was the cost for one year of service seemed high. Mayor Sanders stated that this would not be a high volume plotter and we would maybe purchase without maintenance. Old Business: Mayor Sanders offered a first reading of a resolution establishing a regular work schedule, holiday, paid vacation, and paid sick leave policy for the City of Pinson employees. Councilor Tanner offered a motion to approve the purchase of audio equipment for Rudd Middle School in the amount of $2,144.92. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner stated that the equipment is portable and can be used in the lunchroom or outside at a baseball game. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders call for all opposed to say “no”, all in favor say “aye”. Mayor Sanders, “Let the record reflect the motion passed unanimously.” New Business: None. Public Comment: Jack Chandler; Proud that the city has made the last installment on the Civitan Building and feels that it is a good investment. Councilor Churchwell offered a motion to enter executive session for the purpose of discussing real estate and trade and commerce. Councilor McCain duly seconded the motion. Mayor Sanders, I provide certification in regard to trade and commerce it would be detrimental if items were discussed in open forum. Mayor Sanders called for all opposed say “no”, all in favor say “aye. Mayor Sanders, “Let the record reflect the motion passed unanimously”. Mayor Sanders stated we will not reconvene other than to adjourn. Mayor Sanders called council out of executive session. Councilor Tanner moved to adjourn. Councilor McCain duly seconded the motion.
