Council Minutes October 17, 2013 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, October 17, 2013. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Cochran Councilor Roberts Councilor Churchwell Councilor McCain Minutes: Councilor Roberts made a motion to waive the reading of the September 26, 2013, minutes. Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written of the September 26, 2013, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Councilor Roberts made a motion to waive the reading of the October 3, 2013, minutes. Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written of the October 3, 2013, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. Pre-Meeting Comments: State Representative Allen Treadaway. Rep. Treadaway stated the Legislative Session begins in January and asked if the Mayor or Council needed anything they should contact him. Rep. Treadaway mentioned he has $12,000 to split between the 3 school systems in his District. Mayor Sanders reinstated rules. Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $117,027.29; a copy of the bills schedule is attached. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner mentioned that a portion of the total is for the Roof at City Hall $39,000; Sheriff’s Contract $28,000; and $10,000 for Fire/Medical services at the Alabama Butterbean Festival. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect that the motion passed unanimously.” Mayor Sanders mentioned that he has secured Borland Benefield for our yearly audit which is now well underway and we should have a report from them the end of November or first of December. Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners Danny & Jennifer Deavers and Wade & Brenda Martin, located at 5211 and 5221 Willow Ridge Lane. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners Tommy & Angela Reed and Brenda Oliver, located at 3301 and 3303 Osage Lane. Councilor Cochran duly seconded the motion. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owner Carl Callahan, President for Calco Builders and Callahan Construction, located on Ashberry Drive. Councilor Roberts duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2013-33. Education: Mayor Sanders announced the Education meeting will be held on November 4, 2013, at 6:00 p.m., at City Hall, with Special Guest Dr. Nowlin. Councilor Roberts offered a motion to approve the release of the school allocations in the amount of $12,500.00 per school, with the exception of Pinson Elementary which will be receiving their allocation in paving repairs. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders mentioned that Council has been invited to participate in Kermit Johnson Elementary Open House on October 28 and 29. Enhancements: Councilor McCain mentioned the Veteran’s Day Breakfast will be held on November 11, 2013, at 8:00 a.m. at PHCC. Councilor McCain added the Guest Speaker will be Phillip Wills, Guard of the Tomb of the Unknown Soldier. Mayor Sanders stated Ronnie Dixon and the Chamber Board will be here in January to recap the Alabama Butterbean Festival. Mayor’s Report: Mayor Sanders mentioned there is a vacancy on the Planning Commission, anyone interested should contact him. Mayor Sanders mentioned the Rock School closing took place on Tuesday. Old Business: Councilor Cochran stated there will be a hearing at the November 7, 2013, council meeting to discuss waste disposal and recycling, RFP, at the same or less rate the citizens are paying today. Councilor Cochran asked if council had any comments. Councilor McCain asked if we could schedule picking up small limbs once a month. Mayor Sanders added that this would be paid by the residents and not be mandatory to participate, but the city will not fund. Councilor Churchwell asked if the company would provide a 95 gallon container. Councilor Cochran answered yes. Councilor Tanner offered a motion to approve $5,000.00, of discretionary funds, for PVHS Softball to aid in the replacement of old dug outs. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. Councilor Tanner stated that the Softball Field is a nice field but it is not on the PVHS Campus and Rudd Middle School uses the field as well as PVHS. Councilor Cochran stated that the field is also used for practice in the summer by three teams, Rudd, JV, and Varsity. Mayor Sanders called for any further discussion. New Business: Mayor Sanders offered a first reading on a resolution authorizing the Mayor to enter into an amendment to the contract for enhanced law enforcement services between the City of Pinson and the Sheriff of Jefferson County. Mayor Sanders offered a first reading on a resolution authorizing the Mayor to execute a contract for the purchase of real estate located on Spring Street, at a cost of $10,000.00, from Hometown Bank. Councilor Cochran offered a motion to nominate Councilor Churchwell as Voting Delegate, Councilor Tanner as Alternate Voting Delegate and Councilor Roberts as Alternate Voting Delegate for the NLC Convention. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect the motion passed unanimously." Public Comment: Barry Wilson, PHCC President. Announced “Insanitarium” will run through November 1, 2013. Mr. Wilson added that there has been a very good crowd this year. Mr. Wilson added that PHCC will host Christmas Around the World and a Craft Show on November 23, 2013. Mayor Sanders mentioned that the Farmers Market will continue two more Thursdays. Mayor Sanders added they have fried pies and all types of vegetables. Councilor Tanner asked when the Farmers Market would start again. Mayor Sanders stated in the Spring. Councilor Cochran moved to adjourn. Councilor McCain duly seconded the motion.
