Council Minutes January 2, 2014 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, January 2, 2014. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor Churchwell Councilor McCain Absent: Councilor Cochran Minutes: Councilor Roberts made a motion to waive the reading of the December 19, 2013, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the December 19, 2013, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect that both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $46,565.54; a copy of the bills schedule is attached. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect that the motion passed unanimously.” Councilor Tanner offered a motion to accept the 2013 Audit. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders said "Let the record reflect that the motion passed unanimously.” Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners Thomas Wayne and Elizabeth Hicks, located at 5502 Southfield Road North. Councilor Roberts duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2014-01. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owner The City of Pinson, located at 4304 Center Point Road. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2014-02. Enhancements: Councilor McCain mentioned CityFest will be held April 5, 2014. Mayors Report: Mayor Sanders mentioned that the Spring Street Property closing was complete. Mayor Sanders added that the building was set up for a professional office such as an attorney or accounting office, etc., if anyone is interested in renting. Mayor Sanders stated we would be potentially interested in renting the Rock School if we had a suitable tenant like a church. Mayor Sanders stated that our Farmers Market had a good beginning. Mayor Sanders mentioned that some of our sister cities use a Farmers Market coordinator which is paid by volume. Mayor Sanders added that we may possibly do that here. Mayor Sanders asked council to be thinking about this and he would continue checking on this as well. Old Business: Mayor Sanders stated that he and Councilor Roberts visited Springville to look at their Splash Pad, adding that there are some items that seem to be in our best interest to remove. Councilor Roberts offered a motion to drop 4 showers from the plans leaving 2 handicapped showers and a family shower and relocate the diaper stations into these units; Also add 3 concrete pads-2 at the Splash Pad and 1 at the Playground. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. Councilor Roberts stated he felt we should also go ahead and add conduit under the sidewalk for future needs, and he offered this as a friendly amendment to his motion. Councilor Tanner accepted the friendly amendment. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders called for a roll call vote on the motion with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders stated the motion carries. New Business: Mayor Sanders stated the Christmas Float winner will be recognized at the January 16, 2014, meeting and we will have Attorney Black and Mr. Dixon with us as well. Mayor Sanders offered a first reading of a resolution changing the name of a street, regarding Center Point Road and Center Point Parkway. Councilor Tanner offered an ordinance of the City of Pinson, Alabama, to exempt certain “covered items” from the municipal sales and use tax during the first full weekend of August, 2014, as authorized by § 40-23-213 of the Code of Alabama, generally referred to as the State Sales Tax Holiday legislation and certain Emergency Preparedness items under Act Number 2- 12-256. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes.
