Council Minutes April 17, 2014 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, April 17, 2014. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor Churchwell Councilor McCain Absent: Councilor Cochran Mayor Sanders suspended rules. Pre-meeting comments: Katie Herron, spoke about her research project regarding her study at Turkey Creek Nature Preserve and the Vermillion Darter. Jim Murphree, State Senate District 17 Candidate, introduced himself and explained his plans for the position and asked those present for their support in the upcoming elections. Mayor Sanders reinstated rules. Minutes: Councilor Roberts made a motion to waive the reading of the April 3, 2014, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the April 3, 2014, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect that both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $46,706.14; a copy of the bills schedule is attached. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owner Katherine D. Horsley, located at 8046 Marsh Mountain Road. Councilor McCain duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2014-15. Enhancements: Councilor McCain stated CityFest was well attended and the free rides for the children were enjoyed. Councilor McCain announced Beat the Heat at Turkey Creek will be held on July 19, 2014. Education: Councilor Roberts announced the Education Committee Meeting will be held on Monday April 28, 2014 at 6 p.m. at Pinson Valley High School. Councilor Roberts offered a motion to approve $1,000.00 to assist with cost of the PVHS & Rudd Drama Department’s production of the musical Hairspray. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. Councilor Roberts stated the Drama Departments of PVHS and Rudd have submitted a request for assistance in the amount of $3,800.00 and $1,000.00 is 25% of that cost. Mayor Sanders stated this will benefit both PVHS and Rudd. Mayor Sanders called for any further discussion. Councilor Roberts offered a first reading of a request for PVHS Band Uniforms in the amount of $15,000.00, adding the total cost is $40,000.00 of which $25,000.00 has already been raised. Councilor Tanner offered a first reading of a request for football field repair at PVHS at a cost of approximately $15,000.00. Councilor Tanner added this field is used by several organizations including, PVHS Varsity and Jr. Varsity; Rudd 7th and 8th graders; and a Semi Pro Football team to mention a few. Councilor Tanner stated the repairs will need to be done mid May in order for the field to be ready for the season. Councilor Tanner added the organization has been asking for help for 3-4 years now. Mayor’s Report: Mayor Sanders mentioned the paving at PHCC and the Rock School are now complete. Mayor Sanders stated “Let the record reflect Chris Esquire has been appointed to the Planning Commission to fill the unexpired seat of Jan Lemaster, which will expire the end of 2016.” Mayor Sanders stated this year is our cities year to host the Center Point Fire District Breast Cancer Awareness event and we are continuing to plan for this event which will be held in our parking lot in the fall. Planning And Zoning: Mayor Sanders stated at the last meeting zoning case Z-2014-04, 7068 Highway 75, was tabled. Mayor Sanders ask for any discussion on this case. Councilor Roberts stated he had researched this case and he posed several questions to Bob Jones, Zoning Administrator. Mr. Jones displayed maps to explain the zoning issues of the area. Councilor Tanner stated that she had spoken with citizens that said they wanted what was best for the city and they were concerned for their property values. Councilor Tanner added if the property is zoned commercial it is worth more. Councilor Churchwell asked Mr. Jones if the proposed Light Industrial zoning was consistent with our Master Plan. Mr. Jones stated the Master Plan calls for Highway Commercial and the next step up is Light Industrial, adding it is a minor change and the Master Plan is just a guideline. Mr. Jones asked the applicant, Jason Stidham his opinion of the covenants for this property. Mr. Stidham stated the only change he would request is that they be allowed to work half of a day a couple of Saturdays a month. Mayor Sanders called for any further discussion. Councilor Tanner offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, located at 7068 Highway 75. Councilor Roberts duly seconded the motion. Mayor Sanders called for any further discussion. Mayor Sanders, “Let the record reflect Councilor Cochran joined the meeting at 7:45.” Councilor McCain offered an ordinance adopting changes to the zoning ordinance of the City of Pinson, Alabama, regarding Not for profit outdoor organizations; Upper story dwellings & Manufactured Homes special exception uses. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. Old Business: Councilor Cochran offered a motion regarding Delegates for AMIC and the League of Municipalities Convention to be held on May 3-6, 2014, Voting Delegate-John Churchwell; 1st Alternate Delegate-Joy McCain; 2nd Alternate Delegate-Dawn Tanner. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Councilor Churchwell offered a motion to completely remove the Boardwalk as an alternate in the Park Plans. Mayor Sanders, "Let the record reflect that the motion passed unanimously.” New Business: None Public Comment: Sherry Patton, Heatherpointe Community. Ms. Patton stated she feels that Heatherpointe is being excluded from the Christmas decoration, adding she has lived here since 2004 and pays taxes here with no benefits from the city. Mayor Sanders, stated the city spent $100,000.00, 3 years ago finishing the paving in the Heatherpointe Community, adding that the city adds to our Christmas decorations each year and as of now center the decorations we have in the Business District. Mayor Sanders stated we will look at this in the fall but we can’t decorate every street. Mayor Sanders stated he will look at adding streetlights to help with lighting in the area. Charles Yeager, TCNP Resident Manager. Mr. Yeager thanked Katie Herron for the amazing job she did on her research and her family for being with her tonight. Mr. Yeager stated TCNP will offer Summer Camp for 3rd-5th graders the 1st 3 weeks in June, 15 students in each session. Mr. Yeager also announced the Beat the Heat at Turkey Creek will be July 19th with an even bigger and better event planned for this year. Kim Vaughn, Loren Lane, PVHS Band Booster President. Ms. Vaughn stated the band can order the uniforms with the $25,000.00 they have raised but the balance will be due in August, adding these uniforms are used for 10-12 years and there are 100 Children in the program. Councilor Cochran offered a motion to enter executive session for the purpose of discussing real estate. Councilor McCain duly seconded the motion. Mayor Sanders called council out of executive session. Councilor Roberts offered a resolution authorizing the Mayor to execute a contract for the purchase of real estate, regarding 1.65 acres located at 5129 Old Pinson Road at a cost of $18,300.00. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no further discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Councilor Roberts duly seconded the motion.
