Council Minutes April 4, 2014 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, April 4, 2014. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Mayor Sanders appointed Anje May, Acting City Clerk. Roll Call: Anje May, Acting City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Cochran Councilor Roberts Councilor Churchwell Absent: Councilor McCain Mayor Sanders suspended rules. Pre-meeting comments: Jim Roberts, State Senate District 17 Candidate, introduced himself and explained his plans for the position and asked those present for their support in the upcoming elections. Mayor Sanders reinstated rules. Minutes: Councilor Roberts made a motion to waive the reading of the March 20, 2014, minutes. Councilor Tanner duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written, with one change on page 2,of the March 20, 2014, meeting. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect that both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $67,080.70; a copy of the bills schedule is attached. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners Mary Paulette Carico and Don and Carolyn Hartley, located at 8170 North Valley Road. Councilor Tanner duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2014-11. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners Michael Noles and Sheneeka Watkins, located at 5981 and 5980 Willow Ridge Road. Councilor Cochran duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2014-12. Enhancements: Mayor Sanders announced CityFest will be April 5, 2014. Mayor Sanders announced Beat the Heat at Turkey Creek will be held on July 19, 2014. Mayor’s Report: Mayor Sanders mentioned the paving at PHCC has begun and is almost complete. Mayor Sanders added Pinson Elementary School will be next, then Emerald Forest. Planning And Zoning: Mayor Sanders suspended rules for a Public Hearing for the following zoning classification cases. Case Z-2014-04 Parcel ID# 09-20-3-0-9.000 (7068 Highway 75) from City of Pinson RR to City of Pinson LI. Chase Harrison, representing applicant, explained where the building would be located, how big the building is projected to be, the number of employees, and how many trucks would be coming and going from the property. Lynn Hogan, 6252 Skyview Trail, expressed her concerns about traffic being dangerous. Gwen Brady, 360 Pine Mountain Lane, stated that she was concerned about the runoff water and didn’t think this would be good for the area. Al Ridgeway, 5746 Henry Black Drive, stated he was concerned about rats and the value of his property. Councilor Churchwell stated that he was concerned that businesses might get an impression that they would not be welcome in the City. Councilor Roberts stated that he went out to the property and where they are wanting to put the building is on the far side of the property away from Henry Black Drive. Councilor Churchwell stated that he would like more time to consider all the information that was given tonight before a decision was made. Case Z-2014-05 Parcel ID# 9-29-1-0-2.003 & 2.004 (6798 Ashberry Drive & 6758 Brittany Place) from Jefferson County R2 to City of Pinson District RM. Mayor Sanders stated “Let the record reflect there was no opposition present”. Case Z-2014-06 Parcel 9-15-2-0-3.000 (5502 Southfield Road North) from Jefferson County A1 to City of Pinson RR; Parcel 9-15-2-0-22.000 (5549 Southfield Road North) from Jefferson County A1 to City of Pinson AG; Parcel 9-31-3-2-54.000 (4304 Center Point Road) from Jefferson County C1 to City of Pinson CI. Ms. Hogan asked if there was going to be another hearing for the zoning case by Henry Black Drive. Mayor Sanders stated there will not be another hearing. Gwen Brady, 360 Pine Mountain Lane. Ms. Brady wanted to again let the council know she didn’t want the warehouse to be built. Neeci Phillips, 6843 Ashberry Drive. Ms. Phillips wanted to know if the zoning case would affect her property. Mayor Sanders explained that the City was taking over the zoning for the two cases. Michael Allison, 5130 Dewey Heights Road. Mr. Allison expressed his concern about the traffic on Dewey Heights and asked if we had a dog and noise ordinance. Mayor Sanders directed Mr. Allison to speak with the City Zoning Administrator, Bob Jones. Councilor Cochran offered a motion to enter executive session for the purpose of discussing real estate and trade and commerce and litigation. Councilor Churchwell duly seconded the motion. Attorney Black, I provide certification in regard to litigation it would be detrimental if items were discussed in open forum. Councilor Cochran offered a resolution authorizing the Mayor to enter into an agreement with Salisbury Development Company; Grayson Land Company and James Grayson Jr. related to the unimproved conditions of the roads in the Aspen Ridge Subdivision. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no further discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes. Mayor Sanders, resolution passes unanimously as Resolution 14-11. Councilor Cochran moved to adjourn. Councilor Tanner duly seconded the motion.
