Council Minutes May 29, 2014 – 7:00 p.m. Special Called Meeting The Pinson City Council met in Council Chambers at 4410 Main Street on Thursday, May 29, 2014. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Cochran Councilor Roberts Councilor Churchwell Councilor McCain Mayor Sanders opened the Public Hearing for the reconsideration of Zoning Case Z-2014-4, 7068 Highway 75. Gwen Brady, 360 Pine Mountain Lane, Remlap. Ms. Brady stated that she was told when this case did not pass it could not be heard again for one year. Mayor Sanders responded stating that Council has the right to reconsider any action. Ms. Brady stated the County set the guidelines and the city has to follow those guidelines. Mayor Sanders responded no this has nothing to do with the County’s guidelines. Mayor Sanders asked Attorney Black to explain the reconsideration procedure. Attorney Black explained that the council is acting within the rules to reconsider the rezoning and the motion to reconsider was made properly. Attorney Black added local body’s set their own rules of procedure and have the ability to reconsider any action taken. Attorney Black stated the council acted appropriately and they could have taken the reconsideration up immediately, but the Mayor felt it was important to re-notify those involved. Ms. Brady asked council to consider voting no for the rezoning. Jane Bradford, 7012 Highway 75 Pinson. Ms. Bradford stated the surrounding area does not want this and doesn’t think we need to have this in our area where we live. Ms. Bradford is also worried about her property value going down. Anita Ragsdale, 7832 Williams Street, Pinson. Ms. Ragsdale stated that she is not against business but just doesn’t think it should go there. Ms. Ragsdale added her main concern was for the kids and doesn’t think it is an appropriate place for the business. Mayor Sanders closed the Public Hearing. Councilor Tanner offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, at 7068 Highway 75, from RR to City of Pinson LI. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. Councilor Churchwell stated he felt item #4 listed in the Covenants should be removed, adding that he felt there doesn’t need to be a buffer along the main highway. Mayor Sanders asked Mr. Jones, Zoning Administrator, if the buffers are required. Mr. Jones stated no front buffer is required that was put in place because it seemed to be the place that everyone was agreeable. Councilor Churchwell offered an amendment to the motion to remove Item #4. Councilor Tanner stated the change was acceptable to her. Councilor Cochran stated the change was not acceptable to him. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion regarding the amendment to the ordinance only. Councilor Cochran stated that he likes having the buffer. Councilor Churchwell stated he felt we shouldn’t hide the building we should be proud of it. After some additional discussion, Mayor Sanders asked for a roll call vote with the following results: Mayor Sanders-no; Councilor Tanner-yes; Councilor Cochran-no; Councilor Roberts-no; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, “Motion to amend fails”. Mayor Sanders called for any further discussion on the main motion regarding changing the zoning classification of real estate located in the City of Pinson, Alabama, at 7068 Highway 75, from RR to City of Pinson LI. After some brief discussion, Mayor Sanders asked for a roll call vote on the main motion with the following results: Mayor Sanders-no; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes as, Ordinance 2014-20. Councilor Cochran offered a motion to approve security for Turkey creek Nature Preserve for the summer. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Mayor Sanders stated he has received quotes for the Library Air Conditioning replacement from APEX $6,902.80 and Darden Green $8,660.00 and offered this as a first reading. Councilor Cochran offered a motion to replace 3 HVAC units at the Spring Street building, at a cost of $6,000.00. Councilor Churchwell duly seconded the motion. After some discussion the motion was tabled until the next meeting. Mayor Sanders stated the ordinance regarding the lease of the Spring Street Property is being offered as a 2nd reading. Council only discussed the terms of the lease and will consider the ordinance at the next meeting. Mayor Sanders mentioned he met at the High School 10 days ago with Ms. Parsons & the Board Staff to discuss ways to proceed with the football field replacement, there was also an architect there to look at the field. Councilor Cochran stated the ball is in their court now and we are awaiting word from them. Mayor Sanders stated it was a very productive meeting. Councilor Cochran Stated we are waiting on the Board to bring us something for us to move on. Councilor Roberts offered a motion to enter executive session for the purpose of discussing real estate and trade and commerce. Councilor Cochran duly seconded the motion. Mayor Sanders, I provide certification in regard to trade and commerce it would be detrimental if items were discussed in open forum. Mayor Sanders called for all opposed say “no”, all in favor say “aye”. Mayor Sanders, “Let the record reflect the motion passed unanimously”. Mayor Sanders called council out of executive session. Councilor Cochran moved to adjourn. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed to say “no”, all in favor say “aye”. Motion carried.
