Council Minutes November 6, 2014 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, November 6, 2014. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Mayor Sanders appointed Anje May, Acting City Clerk. Roll Call: Anje May, Acting City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Cochran Councilor Roberts Councilor Churchwell Councilor McCain Mayor Sanders suspended rules. Pre-meeting comments: Shelly Dawkins, Rudd’s Athletic Director, stated that she comes before the Mayor and Council to ask for $3,800.00 to fix the floor in the gym. Mayor Sanders reinstated rules. Minutes: Councilor Roberts made a motion to waive the reading of the October 16, 2014, minutes. Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written of the October 16, 2014, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect that both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $120,920.59; a copy of the bills schedule is attached. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owner Sandra Park, located at 5424 Sandi Circle. Councilor Tanner duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as Ordinance 2014-40. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owners Philip and Amanda Sharpe, Wendy South, John and Patricia Bookmiller and Earl and Ellen Fallin, Ruth Smith and Natasha Johnson, and Jose and Maria Ojeda, located at 5563 Foti Lane, 5744 and 5880 Red Hollow Road, and lots 73 and 76 Pinson Heights. Councilor McCain duly seconded the motion. Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, owner Camo Rebecco LLC, located at 6612 Old Bradford Road. Councilor Roberts duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Education: Mayor Sanders stated “Let the record reflect the appointment of the Education Committee,” a copy of the Education Committee is attached. Mayor Sanders stated that the first Education Committee will be at City Hall, November 17 at 6 p.m. Mayor Sanders stated that Dr. Pouncey will be the guest speaker. Councilor Roberts made a motion to release the 2014-2015 funds to Johnson, Rudd Middle and Pinson Valley High School in the amount of $12,500.00. Councilor Cochran duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed say "no", all in favor say "aye." Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Enhancements: Mayor Sanders stated that the shredding day was a great success. Mayor Sanders stated that Cintas donated their service and two men which really helped the flow of traffic. Councilor McCain stated that the Enhancements Committee will be setting up for Veterans Day Luncheon, Monday at 4 p.m. at Palmerdale Homestead Community Center. Councilor McCain stated that the Veterans Day Luncheon will be Tuesday, November 11 at 11:30 at PHCC and we will be serving Italian food and Kurt Kilpatrick will be the speaker. Councilor McCain submitted a bicentennial report to the council; report attached. Mayor’s Report: Mayor Sanders mentioned the grading work at the park has begun. Mayor Sanders suggested the Sunday after Thanksgiving for the ground breaking. Mayor Sanders mentioned that the boy scouts will host a jamboree at the Rock School Center field the week of June 8-12. Planning And Zoning: Mayor Sanders opened a Public Hearing regarding changes to the zoning ordinance. Also, Post Annexation rezoning of properties located at 7952 and 8006 Highway 75, 4671 and 4681 Elfreth Johnson Road, 5809 Red Hollow Road, 4167, 4159 and 4183 Center Point Road, 3332 and 3336 Sweeney Hollow Road and 3335 Flynt Lane. Councilor McCain offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 7952 & 8006 Highway 75, 4740, 4671 and 4681 Elfreth Johnson Road and 5809 Red Hollow road, from Jefferson County, A-1, R2, R-4 and R-5B to city of Pinson RR. Councilor Cochran duly seconded the motion. Old Business: None New Business: Councilor Cochran makes a motion to amend contract with the Chamber of Commerce to include promotional items in amount of $750.00 for the Pinson Valley High School football playoffs. Mayor Sanders, "Let the record reflect that the motion passed unanimously.” Councilor Tanner made a motion to give the Assistant to the Mayor a $ 0.50 raise, the zoning administrator a $ 1.00 raise and the City Clerk a $ 2.00 an hour raise. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. Councilor Roberts stated that Councilor Tanner will be the first women Mayor Pro Tempore of the City of Pinson. Mayor Sanders called for further discussion. Mayor Sanders, resolution passes unanimously as Resolution 14-46. Public Comment: Gene Coleman, Center Point Fire Department, wanted to thank the city council for the money they gave the fire department. Mr. Coleman stated that they purchased 5 inch hoses. Councilor Cochran offered a motion to enter executive session for the purpose of discussing real estate, trade and commerce and litigation. Councilor McCain duly seconded the motion.
