Council Minutes April 7, 2016 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, April 7, 2016. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Mayor Sanders appointed Anje May, Acting City Clerk. Roll Call: Anje May, Acting City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Cochran Councilor Churchwell Councilor McCain Absent: Councilor Roberts Minutes: Councilor McCain made a motion to waive the reading of the March 17, 2016, minutes. Councilor Cochran duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Cochran made a motion to accept the minutes as written of the March 17, 2016, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect both motions passed unanimously." Committee Chair Comments: Finance: Councilor Tanner made a motion to approve payment of the bills in the amount of $83,780.25; a copy of the bills schedule is attached. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Annexations: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, located at 5581 Melissa Drive. Councilor Cochran duly seconded the motion. Mayor Sanders called for unanimous consent to consider: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2016-12. Mayor’s Report: Councilor McCain made a motion for Steel City Slammers to be the entertainment for the Veterans Day Luncheon to be no more than $800.00. Councilor Tanner duly seconded the motion. Mayor Sanders "Let the record reflect both motions passed unanimously." Mayor Sanders stated there was sad news coming from the City of Clay with the Sheriff’s department on scene of a murder. Mayor Sanders stated some news sources were reporting it was in the limits of Pinson. Councilor Cochran made a motion to approve three recommendations from the Mayor; A citizen’s request to plant a tree at the park in honor of their son, to order the mowing crew leader a credit card limit not to exceed $2000 and to order and mail post cards for the park opening in the amount of $1200-1500. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. After some discussion, Mayor Sanders called for any further discussion. Planning And Zoning: Mayor Sanders opened a Public Hearing regarding changes to the zoning ordinance. Also, Post Annexation rezoning of properties located at 4049 Hickory Trail, 401, 369, 365, 361 and 357 St. John Road, 4020 Leigh Road, 3805 Venus Avenue and 3801 Mars Avenue. Joe Brynes, 5234 Midwood Road, spoke if favor of the changes to the zoning ordinance. Mayor Sanders, “Let the record reflect no one else was present to comment for or against”. Mayor Sanders closed the Public Hearing. Councilor McCain offered an ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama, 4049 Hickory Trail, 401, 369, 365, 361 and 357 St. John Road, 4020 Leigh Road, 3805 Venus Avenue and 3801 Mars Avenue, from Jefferson County, A1 & R- 1 to City of Pinson RM. Councilor Tanner duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Churchwell-yes; Councilor McCain-yes. Councilor McCain offered an ordinance adopting changes to the zoning ordinance of the City of Pinson, Alabama, regarding requirements for keeping of winged animals or livestock (chickens). Councilor Tanner duly seconded the motion. Mayor Sanders called for unanimous consent to consider with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for any discussion. Old Business: Councilor Cochran offered a motion to accept a license agreement between the City of Pinson and Jim Dooley and to adopt Pinson Farmers Market Rules and Guidelines with the amendment of where it states Pinson Farmers Market Advisory Committee to be changed to state Mayor and/or his designee. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell offered a resolution directing the Mayor to execute a contract with the Jefferson County Commission regarding elections. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for a roll call vote on the main resolution with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Cochran-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes as Resolution 16-23. New Business: Councilor McCain made a motion recommending delegates for Alabama League of Municipalities annual convention in May as follows: voting delegate, Councilor Churchwell, 1st alternate, Councilor Tanner and 2nd alternate Councilor McCain. Mayor Sanders announced Eric Henderson with Hendon Huckestein Architects will be at the next council meeting to discuss renovations and plans for the Rock School Center. Public Comment: Pete Chandler, 4450 Silver Lake Road, stated there needed to be some repairs done to the parking lot at Rock School Center before the Farmer Market starts. Adam York, 4271 Clayton Street, asked if he could receive a copy of the new Farmer Market rules and regulations. Councilor Cochran offered a motion to enter executive session to discuss security and safety measures involving municipal facilities and real estate. Councilor McCain duly seconded the motion. Mayor Sanders called for all opposed say “no”, all in favor say “aye”. Mayor Sanders, “Let the record reflect the motion passed unanimously. Mayor Sanders stated we will not reconvene other than to adjourn. Mayor Sanders called council out of executive session. Councilor Cochran moved to adjourn. Councilor McCain duly seconded the motion.
