Council Minutes March 5, 2020 – 7:00 p.m. Regular Meeting The Pinson City Council met in regular session in Council Chambers at 4410 Main Street on Thursday, March 5, 2020. Mayor Sanders led the invocation. Councilor Tanner led the Pledge of Allegiance to the Flag of the United States of America. Roll Call: Marie Turner, City Clerk, called roll of Pinson City Council with the following council members present: Mayor Sanders Councilor Tanner Councilor Roberts Councilor Churchwell Councilor McCain Absent: Councilor Galamore Minutes: Councilor Roberts offered a motion to waive the reading of the February 20, 2020, minutes. Councilor Churchwell duly seconded the motion. Mayor Sanders called for all opposed to say "no", all in favor say "aye." Councilor Churchwell made a motion to accept the minutes as written of the February 20, 2020, meeting. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders" Let the record reflect both motions passed unanimously". Committee Chair Comments: Councilor Tanner offered a motion to pay the bills in the amount of $28,602.25, a copy of the bills schedule is attached. Councilor Roberts duly seconded the motion. Annexation: Councilor Churchwell offered an ordinance annexing certain territory into the corporate limits of the City of Pinson, Alabama, located at 6059 and 6055 Lakeside Drive. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for unanimous consent to consider. Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders called for a roll call vote on the main ordinance with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2020-6. Mayors Report: Mayor Sanders opened a public hearing regarding zoning at 3104 and 3108 Sweeney Hollow Road. Kathy Jensen, 6424 Bogue Road, asked what would be done with this property? Mayor Sanders stated it is perpetual green space, as it is in the flood plain. Mayor Sanders closed the public hearing. Councilor Roberts offered am ordinance changing the zoning classification of real estate located in the City of Pinson, Alabama. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for unanimous consent to consider. Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell; Councilor McCain-yes. Mayor Sanders, unanimous consent passes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2020-8. Mayor Sanders stated, we are following the Coronavirus progression and location and receiving updates from EMA. Councilor Roberts added, preparation is important and we will handle as best as we can. Old Business: Attorney Black explained the purpose of the ordinance establishing a Department of Public Safety. Councilor McCain offered an ordinance to establish a Public Safety Department in the City of Pinson, Alabama. Councilor Churchwell duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders asked for a roll call vote with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, ordinance passes unanimously as, Ordinance 2020-7. Councilor Roberts offered a resolution concerning an agreement with the Jefferson County Sheriff. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders asked for a roll call vote with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-11. New Business: Councilor McCain offered a resolution authorizing the city’s purchase of certain real estate located at 6100 Oak Lane, in the amount of $2,500.00. Councilor Tanner duly seconded the motion. Mayor Sanders called for any discussion. Councilor Roberts stated the city is purchasing the property for green space. Mayor Sanders called for any further discussion. As there was no further discussion, Mayor Sanders asked for a roll call vote with the following results: Mayor Sanders-yes; Councilor Tanner-yes; Councilor Roberts-yes; Councilor Churchwell-yes; Councilor McCain-yes. Mayor Sanders, resolution passes unanimously as, Resolution 20-12. Councilor Tanner offered a motion nominating Mayor Sanders to serve as Voting Delegate at the upcoming Alabama League of Municipalities Convention; Councilor Churchwell to serve as 1st Alternate; and Councilor Roberts to serve as 2nd Alternate. Councilor McCain duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Mayor Sanders suspended rules and introduced Nick Greenwood, Hand Arendall. Mr. Greenwood explained the refunding of the 2014 & 2018 Warrants. After some discussion, Mayor Sanders asked Mr. Greenwood to gather additional information and attend the March 19, 2020, council meeting, along with a representative from Joe Jolly. Allison Scanlan, Library Director, asked council about purchasing shirts for the upcoming Census. Councilor Tanner offered a motion authorizing the purchase of 200 T-shirts for the upcoming Census. Councilor Roberts duly seconded the motion. Mayor Sanders called for any discussion. As there was no discussion, Mayor Sanders called for all opposed to say "no", all in favor say "aye." Mayor Sanders "Let the record reflect the motion passed unanimously." Ms. Scanlan also gave the Library report. Eric Winfrey, Public Works Director gave the Public Works report. Matt Nixon, Parks and Recreation Director gave the Parks and Recreation report. Chief Gene Coleman, Center Point Fire District gave the Fire District report. Public Comment: Charles Oliver, 5479 Lazy Acre Trail, asked if there was a zoning map that could be placed online. Councilor McCain offered a motion to enter executive session to discuss litigation, and security of critical infrastructure. Councilor Roberts duly seconded the motion. Attorney Black, I provide certification in regard to litigation it would be detrimental if items were discussed in open forum. Mayor Sanders called for all opposed say “no”, all in favor say “aye”.
