MINUTES TOWN OF PITTSBORO BOARD OF COMMISSIONERS REGULAR MEETING MONDAY, NOVEMBER 26, 2018 7:00 PM Mayor Cindy S. Perry called the meeting to order and asked for a moment of silence. PLEDGE OF ALLEGIANCE Pledge of Allegiance was led by Commissioner Farrell. ATTENDANCE Members present: Mayor Cindy S. Perry, Mayor Pro Tern Pamela Baldwin, Commissioner Jay Farrell, Michael Fiocco and Bett Wilson Foley. Commissioner John Bonitz excused absence. Staff present: Manager Bryan Gruesbeck, Clerk Alice F. Lloyd, Attorney Paul S. Messick, Jr., Police Chief Percy Crutchfield, Planning Director Jeff Jones, Planner II Victoria Bailiff and Engineer Elizabeth Goodson. Mayor Perry introduced Chloe a reporter with Our Chatham Group. I Motion made by Commissioner Baldwin seconded by Commissioner Foley to approve the regular agenda as submitted. Vote Aye-4 Nay-0 CONSENT AGENDA Commissioner Fiocco stated on page 5 of the November 13, 2018 minutes the date of the UDO worksession should be changed to December 6, 2018. Motion made by Commissioner Foley seconded by Commissioner Farrell to approve the consent agenda with the change to the November 13, 2018 minutes listed above. The Consent Agenda contains the following items: 1. Approve Minutes of the November 13, 2018 meeting. (with change on Page 5 - change UDO meeting date to December 6, 2018) 2. Accept FY 2018-2019 Financial Reporting as of October 31, 2018. Vote Aye-4 Nay-0 REGULAR MEETING AGENDA CITIZENS' MATTERS Carolyn Townsend - 36 Lockville Street - addressed the board about flooding issues. She said she know the town had an Engineer look at the flooding at the Pittsboro School Road bridge but November 26, 2018 Minutes Page 1 she is not sure what is being proposed will take care of the problem. She said she walk Robeson Creek East today and there are trees/timbers, etc. all in the Creek bed (which causes backup). Ms. Townsend said their property doesn't flood because they are too high up, but their neighbors does and it has caused them thousands of dollars in repairs. Al Capehart - 36 Lockville Street - said in the last three years the folks across the street have been flooded out twice. Wayne Britt-151 Prince Creek-stated he lives in the middle of the Chatham Park Development. He feels we should commend Chatham Park and their sub-contractors for the environmental impacts that have in place. Mr. Britt stated everything they have done meets or exceeds the State as well as Chatham County requirements. Mr. Britt said he has been reading on Facebook the last couple of weeks that Chatham Park should be required to have 2,000 ft. setback from Haw River. He said if that same requirement was used before there would not be a "Bynum" or "Chatham County Courthouse". He said that Lake Norman sits right on the Lake but they have environmental impacts in place. COMMISSIONER/MANAGER UPDATES Mayor Updates - Mayor Perry reported that: • She judged the STEM Project at Perry Harrison (along with Mayor Pro Tern Baldwin, Manager Gruesbeck and Chief Crutchfield). • Spoke with FBLA club at Margaret Pollard. • WUNC filmed a documentary on the Role of Women in Construction/Planning and Zoning. • Attended Tree Lighting. • Met with member of Waste Industries. • Wrapped gifts during the Shop Local Event Downtown. • EDC - Commissioner Fiocco said there has been no meeting since last town board meeting. • RPO • Fairground Association • PBA/Downtown • Triangle J Council of Governments - Commissioner Baldwin said Triangle J meeting is Wednesday. • Main Street - Commissioner Fiocco said he has been working with the group putting the handrails in. • Climate Change • Human Relations Committee • Chatham County Arts Council Manager Bryan Gruesbeck submitted updates with the agenda packet and they can be found at: https://pittsboronc.gov/index.asp?Type=B BASIC&SEC={4DD4D0A9-D93B-4E92-8B2B- 1BAC76976EB0}&DE={6C6766F9-CEDD-4ElD-BF25-94C80A6Bl 864} (Updates 11.26.18) November 26, 2018 Minutes Page 2  NEW BUSINESS - None Scheduled OLD BUSINESS Commissioner Bonitz was absent tonight and asked that his comments be considered. They can be found at: https://pittsboronc.gov/index.asp?Type=B BASIC&SEC={4DD4D0A9-D93B- 4E92-8B2B-1BAC76976EB0}&DE={6C6766F9-CEDD-4E1D-BF25-94C80A6Bl864} (November 26 2018 memo from Bonitz) REQUEST FOR TOWN SUPPORT FOR LOCAL CONTRIBUTION TO CHATHAM PARKWAY ROAD PROJECT WITH CHATHAM PARK INVESTORS AND NCDOT Manager Gruesbeck stated the North Carolina Department of Transportation (NCDOT) and Chatham Park is requesting that the Town consider offering a letter of support for the Chatham Parkway Road project. You may recall that this road will connect 15-501 north of Pittsboro and eventually extend to 15-501 south of Pittsboro. No "out of pocket" Town contribution is expected for this project. Chatham Park is providing $9,000,000 for the first phase of the project- the northern portion of Chatham Parkway which will extend from 15-501 to US 64. Following completion of the project, NCDOT would allocate $4,500,000 back to Town for other highway projects. Chatham Park Investors is requesting that the Town reallocate the $4,500,000 to other projects in Chatham Park. Manager Gruesbeck said if the Town supports this project, he recommends that the Town craft a letter that provides general support for the project subject to final agreement between Chatham Park Investors and the Town of Pittsboro regarding how the future allocation of the $4,500,000 will be spent. Planning Director Jeff Jones said it was the Town's idea all along to support the project. About two weeks ago Chatham Park requested that the $4,500,000 be used on eligible projects within Chatham Park. Matthew Day, Triangle J Council of Governments, said the letter of support does not have to make mention of how the $4,500,000 will be spent. There was much discussion about how the $4,500,000 would be used, but they all agreed to send a letter of support. After discussion a motion was made by Commissioner Fiocco seconded by Commissioner Baldwin to authorize a letter of support be sent for the project and to get clarification later on how the $4.5 million will be spent. " Page 29 - redlined version - bottom of page - change certificate of occupancy to "platted units" Page 29 - redlined version - bottom of page - add a sentence that reads "financial security for completion of greenways to be provided the same way as with streets". Page 30 - redlined version - Payment-in-Lieu delete "or all" from first paragraph. Changes to the Public Facilities Element Public Works Site submitted tonight: First sentence - insert "shall" after "and". Last sentence on first page - 1st line to read "The proposed Public Works Site shall not be located in a public park site" Mayor Perry went over Commissioner Bonitz's list of concerns. After much discussion a motion was made by Commissioner Fiocco seconded by Commissioner Farrell to approve the Public Facilities Additional Elements with the amendments made tonight and adding Section 7 of the Public Facilities Element (Attorney Messick and Attorney Eagle are to get the updated Element Prepared) Vote Aye-4 Nay-0 ADDITIONAL UPDATES AND REPORTS COMMISSIONER CONCERNS Commissioner Farrell said the handrails are getting a lot of use on Main Street. Commissioner Fiocco said one of the trees has the light cord cut. FYI- 1.
