r MINUTES I TOWN OF PITTSBORO BOARD OF COMMISSIONERS WEDNESDAY, MARCH 18, 2020 SPECIAL MEETING 6:00 PM Mayor Jim Nass called the Special Meeting to order. PLEDGE OF ALLEGIANCE Pledge of Allegiance was led by Commissioner Farrell. ATTENDANCE Members present: Mayor James Nass, Commissioner Jay Farrell, Commissioner Kyle Shipp, Commissioner Michael Fiacco, Mayor Pro Tern Pamela Baldwin. (Via phone) Commissioner John Bonitz. Staff present: Interim Town Manager Bob Morgan, Attorney Paul Messick, Finance Director Heather Meacham, Interim Town Clerk Cassandra Bullock, Chief Percy Crutchfield. f NEW BUISNESS 1. Approval of Developmental Associates to be the firm to search for new Town Manager. Discussion: Commissioner Baldwin had a question about the fee for the background check, she feels it's very costly. Interim Town Manager Bob mentioned that we don't have to go with that option, or we could choose to select different levels of background checks we would like to use. Commissioner Shipp advised they don't do the background checks themselves they contract it out. Bob says they usually use the Police Chief. Commissioner Baldwin also questioned the Psychological portion, she said it appears [ that no one has a degree. Bob advised that they have personal that is trained and highly certified in those areas. Commissioner Fiacco made a motion and seconded by Commissioner Shipp to Approve Developmental Associates for the search for Town Manager. Vote Aye-5 Nay-0 2. Approve Ordinance to Amend FY 2019-2020 Operating Budget for Consulting services Contract. Commissioner Baldwin made a motion and seconded by Commissioner Fiacco to approve the ordinance to amend operating budget for the Consulting Contract. Vote Aye-5 Nay-0 3. Adopt Ordinance Amending the Disconnection Policy included in FY 19-20 Budget. Discussion Commissioner Fiacco wanted to confirm with Finance Director Heather Meacham who was currently disconnected from water service. Heather advised we currently have 3 disconnected, 2 are unoccupied and 1 occupied who has a high balance prior to the pandemic. Commissioner Shipp confirmed only 1 is occupied. Commissioner Fiacco asked if any commercial accounts were disconnected? Heather advised we only charge the commercial accounts the disconnect fee but never disconnect them per our policy . Commissioner Shipp asked would we take this up again later to establish late fees and when reconnect fees would be applied again. Heather explained yes, at whatever date the Governor says we can resume late fees and we will work with our customers on payment plans. Commissioner Fiacco made a motion and seconded by Commissioner Shipp to adopt the ordinance amending the budget. Vote Aye-5 Nay-0 Mayor Updates: Mayor Nass discussed the Press Releases from Bob and discussed if the Town should go ahead and declare a State of Emergency . 2  Commissioner Fiocco wanted to know what the Pros and Cons for Declaring a State of Emergency and what does that include. Commissioner Farrell wanted to know if a curfew would be included. Bob stated that it could put restrictions on grounds, public buildings and businesses and we could possibly get federal funds. Commissioner Fiocco asked does the Board have to take action to put a curfew or no gathering events or would the Town Manager and Mayor make that call? Mayor Nass says the Town Manager or Mayor could issue a curfew or no gathering events. Commissioner Fiocco wanted to know was there a time frame that we would be in the State of Emergency or does it just expire? Attorney Messick advised the Mayor can withdraw it at any time because he made it. Commissioner Jay asked are we going to do the State of Emergency without a curfew? Mayor Nass said yes. Attorney Messick asked has the County already declared a State of Emergency? f Bob advised they have. Attorney Messick stated we can either consent with the County's or do our own or both. Mayor Nass stated that Attorney Messick has prepared a document for him to sign and consent to be apart of the County's State of Emergency. Commissioner Baldwin said we can do our own and consent on with the County's. Attorney Messick stated regardless we have control over our buildings, parks and property. We can leave the restaurants up to the Governor. Mayor Nass advised he will sign the consent and we will also do our own. Commissioner Shipp questioned what is the idea for the March 23 meeting? Bob advised we have one Public Hearing and the meeting should go pretty quick and April 13 we could have a Public Hearing on that one as well. Commissioner Fiocco wanted to know if having a Public Hearing would be wise when we are being told not to have a gathering of l Oor more. [ Attorney Messick advised that Board hasn't told anyone to stay home or not to gather. Commissioner Baldwin believes we should push the Public Hearings off for now. 3 Bob will check to see if the Public Hearings are time sensitive. Attorney Messick believes no one is going to show up for the Public Hearing also the NC Governor said 50 people and the President says 10 people. Commissioner Shipp stated that if we advise on the website site that our citizens can drop off comments at Town Hall through the drive thru window or email the Clerk, we will have them read into the minutes.
